Sir k hashim v St. Of TN Court said ki word used in section 133 is may but vo to shall hai Or agar court usually approver ki statement corroborate karte hai almost always in practice, to sec 133 to useless ho gya? Please explain
@harpreetsinghkahlon28274 жыл бұрын
Shall is for accused ,and not for court, court along with section 133 always keep sec 114(b) in mind
@shubhamchaudhary2323 жыл бұрын
Sir please add Rameshwar Kalyan Singh v State of Rajasthan (1952) and Sideshwar Ganguly v State of West Bengal ( 1958) where the testimony of prosecutrix has to be corroborated to make sure that the accused has not been falsely implicated. It is necessary where, there is a suspicion on the naturalness of the story. Therefore, It is unsafe to convict on the solitary statement of the prosecutrix as she cannot be blindly trusted. (Corroboration used as caution)
@harpreetsinghkahlon28273 жыл бұрын
There r number of case law in favour of both side but yet if prosecutrix stands on her statement, court could convict accused

You are making it more complex, where court bounds it by that such confession should be corroborated? Where courts bound it? If bounds it anywhere then what about 133?
@harpreetsinghkahlon28274 жыл бұрын
Corroboration is required if there are more accused then one, as confession by one affect others, so in that situation court is bound to corroborate with other evidence
