If u hire a room in a hotel then u pay only rent but if u file a case that the said rent include the boarding expenses also, then u have to prove the agreement in that sense, this is what that illustration says

Question :- two parties to the contract A and B. But the suit between A and C. Can A produce oral evidence in respect of varying or contradicting the terms of the said contract as the suit is not between the parties to the contract under sec. 92 of Evidence Act reand with sec. 91. Sir what is the difference btw the language of s92 and proviso 4 of the same. The first one is excluding oral evidences of any agreement or statement btw parties for the purpose of contracting, varying, adding subtracting the terms...whereas the proviso 4 says that oral evience may be given for subsequent oral agreements altering, modifying or rescinding the contract. Then why these words (terms of contract, grant or disposition of property agreed by the parties) have been used in s91 and s92 if their oral evidences can be given under proviso4. Why s91 and s92 doesn't only say the matters required by law to be reduced to document form only.
