Let him - only makes the case easier ------ 9 To be clear, nothing in our analysis should be interpreted to suggest the unconstitutionality of the 43 States’ “shall-issue” licensing regimes, under which “a general desire for self-defense is sufficient to obtain a [permit].” Drake v. Filko, 724 F. 3d 426, 442 (CA3 2013) (Hardiman, J., dissenting). Because these licensing regimes do not require applicants to show an atypical need for armed self-defense, they do not necessarily prevent “law-abiding, responsible citizens” from exercising their Second Amendment right to public carry. District of Columbia v. Heller, 554 U. S. 570, 635 (2008). Rather, it appears that these shall-issue regimes, which often require applicants to undergo a background check or pass a firearms safety course, are designed to ensure only that those bearing arms in the jurisdiction are, in fact, “law-abiding, responsible citizens.” Ibid. And they likewise appear to contain only “narrow, objective, and definite standards” guiding licensing officials, Shuttlesworth v. Birming- ham, 394 U. S. 147, 151 (1969), rather than requiring the “appraisal of facts, the exercise of judgment, and the formation of an opinion,” Cant- well v. Connecticut, 310 U. S. 296, 305 (1940)-features that typify proper-cause standards like New York’s. That said, because any permit- ting scheme can be put toward abusive ends, we do not rule out constitu- tional challenges to shall-issue regimes where, for example, lengthy wait times in processing license applications or exorbitant fees deny ordinary citizens their right to public carry.

7:58 what? When I used to go all you brought was your gun, bullets and ear protection. What's all this other stuff?
@p2o8wer8 ай бұрын
Let me sum this up a little bit better for these people that are thinking about getting into firearms. You don't have to do everything at once. You can apply for your FID and maybe one purchase permit. That permit will last 30 days and then after that it extends for 90 days. So you have plenty of time to look for a pistol, save up a few dollars and purchase one. You can buy a thousand rounds of ammunition online shipped to your door under $300. Now you have home protection for you and your family now. If you want to protect yourself when going out in public then you take the course. The qualifications are good for one year so you don't have to pay the $200 application fee after the $200 to $300 qualification fee. So therefore you have time to recoup some money if you're on a budget.

I have a question for a client of mine: One of my patients is on prescription pain medication taken on a “as needed” basis. Does the State of NJ deem that person ineligible for being under the use of narcotics or intoxicating substances? When I read the FID application it appears as if the question of intoxicating substances is more geared towards illicit substances, but I understand a DEA Schedule II substance like OxyContin may also fit that description. Any advice on that question or is there a better place to search for that specific answer?
@martelltraininggroup5 ай бұрын
In the State of NJ, you are ineligible to receive a Firearms Purchaser ID Card if you have a “substance use disorder involving drugs as defined in section 2 of P.L. 1970, c.226(C.24:21-2)," which defines “substance use disorder” as "…taking or using a drug or controlled dangerous substance, as defined in this chapter, in association with a state of psychic or physical dependence, or both, arising from the use of that drug or controlled dangerous substance on a continuous basis. Here is a link to the statute: casetext.com/statute/new-jersey-statutes/title-24-food-and-drugs/chapter-246n/chapter-2421/section-2421-2-definitions Of course, there are other disqualifiers such as alcoholism, mental disorder, etc… On the application they do ask; “Are you dependent upon the use of any narcotic or other controlled dangerous substance?” Federally, on the ATF 4473 Form (You complete this when you buy a gun.), they also ask about unlawful use and if you are addicted to a “…narcotic drug or any other controlled substance?” For NJ Permit to Carry a Handgun, under NJS 2C:58-4.4 Safe requirements, handgun carry, they specify you cannot use or be under the influence of alcohol, cannabis, or a controlled substance while carrying a handgun. So, my interpretation is that it’s more about whether you’re dependent or addicted to a narcotic or controlled dangerous substance, not so much about being prescribed a narcotic or controlled dangerous substance. Of course, if you are prescribed a controlled substance and you have a carry permit, you cannot carry while taking the drug. And yes, the statutes are mostly geared toward unlawful use and addition/dependency, including marijuana as that is still illegal under federal law. As you know, many states have legalized marijuana and have initiated medical marijuana programs which are disqualifiers for firearms. Hope this helps.

Residents can buy handguns and rifles with out a PRL or FID card also long as they pass a state background check for handguns and Federal for rifles. This basically takes 2-5 minutes and the dealer does it on line. If the system is down the dealer can still you the old method of calling it in. Thanks for the rundown. Not looking forward to the added cost for my re-qualification. Don't underestimate the value of dry fire. It will give you experience with safe gun handling, reloads, and drawing from a holster. If you take it seriously it can greatly reduce the amount of rounds you need to practice with live fire.

Never included holster. Good video otherwise. It's not a cheap right or hobby but I'm still going to do it. I try to help friends, family members, even acquaintances the best I can still. With knowledge, gear or just practice. Only about 15% follow through with it 🤷♂️

Good catch! I forgot the holster! Pretty important when we are talking about concealed carry. Thank you!

@martelltraininggroup maybe make a video emphasizing quality and style of holsters vs gimmicky/illegal as a longer full length video? Emphasis on how to use like a sticky holster too and not trying to reholster while it's in your pocket/waistband. Just an idea

The kicker! Concealed carry is only legal with a NJ PCH. PCH are issued to residents and non-residents. A firearms training course is required for new applicants, who must be at least 21 years old. In terms of reciprocity, New Jersey does not honor permits from any other states.🤬

Montclair made me get finger prints for my carry permit even though they were on file from my FID card.

We need national reciprocity.

Wow! Unbelievable. If you ever have the opportunity to move to a southern state, do so. It's much cheaper. Good luck, carry safely and carry all the time when the law allows. 2A all the way!

How are these prices not racist, but requiring an ID to vote (which is already required to work, have a bank account, or receive government assistance) is somehow racist because some people can't afford to have an ID, which is way cheaper? FPM

NJ people you only have to look at the majority of States where you don't need a gun permit,license, any type of gun registration to legally carry a gun.. Then ask yourselves why.

You forgot the fee for food when you're in the course, gas to get to the various places you need to go, and the cost of a car. Sorry to be sarcastic, but some of costs you listed don't really have anything to do with NJ's gun laws or the cost of a NJ permit.

So I get that he adds certain costs that you will need for future use or if you want to do extra. But that $2,500 is extremely inflated and misleading. I get it, NJ is trying to make you not want to go through with getting a CCW or a gun in general. But this video is disingenuous with prices and what you really need. You do not need a cap, first aid kit, range bag(though it will make life easier) or a bleeding control kit. Ammo I have seen in shops is as low as $15-17 for 9mm. You don't need a membership. Most ranges that do conceal carry courses will have you do CCARE after doing a safety training course/self-defense course, a pistol course, and maybe a pistol cleaning course. But there are some instructors and ranges that have all that built into 1 3-4 hour class at a low rate of $200-300. You might have to pay extra for ammo and range fee for the shooting portion of the course, but most courses have the price built in. Also, the safe you don't need if you keep the case the gun came in with. They all normally come with a cable and lock. You only need a small bag to put the ammo in or buy the ammo at range when you go to shoot. You can buy targets and rent ear and eye protection at the range. I know a few ranges have the ears and eyes built into the price. If you wear glasses, you don't need eye protection. Insurance is not required in NJ but I do recommend it. US Law Shield and Attorneys on Retainers are the only "insurances", more so defense attorneys, allowed in NJ.
