Hello....Amarjeet...agar property ki transfer deed 2004 ki hai to unko SDM se property ke regarding koi relief nahi milega....aap SDM court main transfer deed jarror lagwaye, aur yahi stand rakhey ki transfer 2004 main hui isliye ye act applicable nahi hai...doosra agar wo 450000 per month pension le rahe hain to aapko unka pension record lagana hoga case main...yadi aapke pass nahi hai to aap SDM ko request kijiye ki father se unki income aur assests ka affidavit lijiye...i m sure father false affidavit nahi denge court main...denge to criminal case ho sakta hai un par...aur agar wo affidavit bhi nahi dete to RTI main pension record information manga lo that will be sufficient proof...senior citizen act is there to help parents senior citizens who actually cannot maintain themselves...agar wo maintain kar sakte hain apne aapko to koi relief nahi milega iss act main....Thanks..hope you got my point.

Hello...Surasree..till now there is no direct provision which could fix liability or responsibility of son in law or daughter in law in maintaining parents...however if after the death of father the property of father will go to son in law or if father has transferred his property to son in law then it is the responsibility of son in law to keep and maintain the father in law...Govt of India is soon going to amend this Act and include son in law and daughter in law in the definition. Also the limit of 10,000/- will be removed. thanks..

He can claim maintenance from daughter in law and grand daughter in law only if they will be ultimate beneficiary of his properties or he has transferred his properties to them or their husband. Hello Pradeep...yadi wo jo aarop laga rahe hain unko prove kar dete hain tabhi unko relief milega...agar wo prove nahi kar paate to unka case dismiss ho jayega...dekhiye court main jhoothi gawahi dene par saja ho sakti hai but aapko wo prove karni padegi ki wo jhoothi gawai di court main...aur aapko documentry evidence ke dwara prove karni padegi...yadi aisa kuch hai to aap unke khilaaf joothi gawahi ka case daal sakte hain...but agar aap bhi orally sab kuch keh rahe hain to phir koi action nahi banta...eg...yadi wo affidavit dete hain ki main kuch nahi kamata ya koi income nahi hai aur aap prove kar dete hain ki unki income hai with documentary proof then aap un par false affidavit dene ka case kar sakte hain...Thanks..

Hello Kamal...yes the act gives them power to take back their property but if they are making false allegations and you have sufficient proof that you were taking care of them then its not that ki tribunal will pass one sided order...they will pass order on merits of the case...however even if its against you then you can always have recourse to file appeal in high court...so its a long process...just gather all ur evidences and fight the case with cool mind...Thanks..
