1.We need a neutral judge. 2. We need a judge who does not want to proof so hard that he is a learned judge. Especially by undermining the defense. 3. A judge who does not want to proof that he is a goverment. 4. We need a judge who talks when necessary. 5. We need a judge not a coach. 6. We request a judge to slow down and relax not to panic because he is giving us the impression that he wants the state to win. This is not about who wins. It is about justice for Senzo. It is not about who is the best between the state and defense. It is about getting the truth from the witness without favor. So please help us to get the real criminal for this case.

There is a serious problem with the judge. Surely, if the witness says he made a Hand-written Statement that was commissioned then the State (especially Police) must have it; is that not common coz. I really don't see why the judge is having problem with Advocate Mnisi's request. I wonder if Police/State are at liberty keep original statements of witnesses to themselves and hide them from courts? I'm a layman but I don't see logic in that kind of such secrecy - if it is permissible at law.

I have my reservations about tge conduct of the judge...he is like entering the arena now...why he does not play tge record as requested by the defence lawyers..it appears the witness did say on record that he made a written statement.

The state does not have the written statement but the typed statement. The witness however inferred that he did write the notes to inform the typed statement. Therefore Mnisi is not putting it correctly. If the notes are destroyed then the state never had the written notes. Argument is between the notes and statement. Why are lawyers missing semantics.

This witness has misled this court. When Ramasepele questioned him on Friday regarding this WRITTEN statement, he gave the court a whole story about the WRITTEN statement, now he is stating that he made notes. Why then was he speaking about having initialled each page of his WRITTEN statement if it does not exist? This judge is biased in favour of the prosecution.

Zungu back paddled this morning saying that he never wrote any statement yet he keeps saying now that in “his statement, the names were gadla and nkani, but this lady typed wrong, this lady must come and tell us why she wrote the wrong thing instead of typing verbatim. We will only believe this swap if she will be called to corroborate that indeed she made her own judgement on what to change and what not to change. Fact rematch at this typed statement is not the original since it depicts things that the witness did not say so why must we take anything from it? Is it not like tampered evidence?

Why is this judge putting words into Adv Mnisi’s mouth. Again how does an investigation officer Commission an affidavit, especially one that is now in contention? Isn’t that the conflict of interest that Adv Mnisi is referring to. For a very long time I’ve observed that the judge has already found the suspects guilty. He is just filling spaces for reasons thereof. When something serious contradicts his preconceived idea he attacks Advocates. I noticed how disappointed he was when WO Mosia’s testimony was being tested apart by Adv Mshololo. I pity these suspects and unfortunately on certain forensic issues, they don’t have funds to have their own experts.
