Recorded back in 2010, Professor Cucolo has long been a voice to the ineffectiveness of sex offender laws. Brad Sussman interviews with Prof Heather Cucolo on what we think and need to know about this problem of society. Anger, fear and justice all have to be considered. This is the full un-edited version of the broadcast version.
Professor Heather Cucolo is an Adjunct Professor at the Emory University School of Law. She is a proponent of Therapeutic jurisprudence which is an interdisciplinary method of legal scholarship that aims to reform the law in order to positively impact the psychological well-being of the accused person.

Sex offender laws are legalized continuous punishment. They are not about public safety, but rather public shaming of individuals while providing a false sense of safety to the community.

I'm on the offender registry without ever being charged any where in the country. My name is the same as over 10000 people on the registry. I've never been in prison never served time have no victims nothing yet I am and have been listed for 16 years, my allegations on the registry have been changed more than 7 times because of the number of individuals with my name. I've been on this registry for 16 years as a tier 3 for crimes I've have no charges for. The state of Michigan has taken my children because of the list and not one attorney in the entire state wants to be a lawyer who releases a "monster/predator". Once, I tried to be removed and now I have no other chance to be removed ever again because of the tiering level I have attributed to my name. I am currently facing ten years of prison for Michigan suspending the registry duties during the COVID pandemic by judge cleland from Port Huron Michigan. No not every offender is guilty as over the 16 years I've been on this list Ive seen children, all boys, as young as ten years old put on this list for things like having to pee and going in public areas and someone calling cops on them for such a thing. You need to learn more about the truth of the registry and how it has destroyed the lives of innocent men. Many teens are put on the list between the ages of 12-17 are on the list because in many cases the older woman they were with claimed rape on them so they themselves would not get into trouble for statutory rape. This is wrong on so many levels that too ma y are suffering from. Do I think the real monsters be listed. No they should be kept behind bars for the horrors they inflict on people. please go learn the truth and try not to be ignorant or speak ignorantly about this subject until you learn more. Sadly not enough people argue the case by case and only go after the laws being unconstitutional which is the wrong arguement or only part of the arguement.

Im sorry but that is hard to believe. If you actually have no charges against you and you are mistakenly on the Sex Offender Registry because of a common name then that will be readily apparent by cross-checking police files. It would be a fairly simply matter to clear up and there is no way that you could be told you can never appeal it again. You are either leaving out something, like an actual offense, or you need to find yourself an attorney with a handful of functioning brain cells. A case like yours would be some lawyers dreams.

@@enderthexenocide760 for what it's worth I don't know why I was put on it. All I know is cops came to my house while I was practicing softball with my kid. Several car in force with guns drawn demanding I go register this was in Saint Clair shores Michigan. Yet I was never charged no victim no jail time nothing. I explain this to the cops and no matter what I said, I could sign the paperwork or be a dead rapist my choice. I chose to go home to my kids instead of the gun pointed to my skull. I've been fighting ever since. and now for the first time in 16+ years I'm finally free.

@@JoseTorres-dl3kh no one can force you to sign something. They must have had some kind of accusation because even if they thought you were already on the registry because of a common name mistake they wouldn't show up with guns drawn over a failure to register and all you would need to do is request an attorney and demand to see the charges against you. It is possible you were railroaded and pressured into signing a false confession, that does happen, but usually after many hours of interrogation and generally the accused is low on the IQ spectrum. What do you mean by you are free after 16 years? Were you in prison over this? Your account of what happened is confusing.

Professor Cucolo should join up with an organization who wants these hyper-punitive sex offender registry laws struck down - NARSOL - the National Association for the Reform of Sex Offender Laws.

In my two bits, this is not the way to chastise sexual criminals or transgressors. Sure, sex offender registry laws are currently there to track these people before they even re-offend--until they are off the registry. But there are very serious land mines with these laws. The land mines are--for these registrants..... 1. Massive cancel culture. Even by blood relatives, close friends, and other family members. This includes family friends. They will disown these registrants generally immediately. 2. High risk of homelessness. 3. Continued harassment, belittling, disparagement, and intimidation. 4. High risk of being targeted for gang-beatings, extortion, major malware attacks (if they are allowed to use the Internet), and even assassination/murder! 5. Risk of garbage attacks - that is - vigilantes throwing feces, waste, urine, or other garbage at the offenders by way of walk-ins or drive-bys in vehicles. 6. Blacklisted from future employment, usually permanently. 7. High risk of being demoted or fired if they are already employed. 8. Blacklisted from renting nearly any property. 9. Perpetual shaming, especially at the societal level. 10. Constant threats of arrests/fines/jail for such offenses as trespassing, illegal encampment, and squatting.

Even worse, if these registrants publicly urinate or defecate as homeless people and they are caught, and police see that they were already charged with these offenses and already ended up on the registry for these minor slip-ups, their rap sheets/arrest records will worsen, and their statuses/reputations will tank to a much worse abyss.

Why is it nobody ever talks about the large percentage of registered persons who never went to prison and never left society. Many were only given probation but must follow all the registry rules

people do talk about that. Many people are angry that some offenders get off with probation because the judge gave them lenient sentences or let them plead down to lesser charges. That is something that needs to stop. Rape, sexual battery/assault, and any crimes against children should all be met with mandatory minimum sentences (life in my opinion but it's open for debate) but by no means should they ever just be getting probation or even given the chance to plead down and take away from the severity of their actions.

no we don't have to get rid of it but if we do lets set a warning that if anyone molests or rapes a child they will be put up for life and if they rape and murder a child they get the death penalty.

It absolutely depends on their case and what they did or what happened because some people are becoming sex offenders for girls lying about their age picking them up in a bar and they still get in trouble or just pissing outside a barn you become a sex offender it's a joke anymore

This is what happened to my 19 year old son in Illinois. The girl lied about her age. Illinois needs to adopt Romeo and Juliet laws for these teenage romances that are consensual.

Time recollection:1980s to 1999>The registries have been fed by a history exagerrated hysteria a media fed fearmongering:feeding the ego to shame individual in no way gives people security! I remember one man who was so much sex Offenders, going around talking loud about about how bad sex offenders were, until it was found out that he had in his past sexual offended but kept quiet. I know someone who is a sex offender and has been put in jail even though he has not actively gone out and committed a crime. He didn't steal anything, harm anyone, or rob anyone or anything. The registry is just continued punishment even though he has done his time in Canada. He's not a dangerous person. In Canada they let murderers walk free after only 7 years.

I would like to tell my story briefly, I am one of the first group of children to be placed on Megan’s law in 1994 For lifting up a girlfriend skirt at school I just turned 14 years old . I am now 43 years old which means I been on there for 30 years . I was forced to drop out of school in the 8th grade because of this and I choose to work instead. I choose to learn about Glass which is called a Glazier and I am one of the best Glaziers in the country. Why have I been on there so long is the million dollar question ? At the age of 18 I had consensual sex with a 14 year old who told me she was 17 , she got pregnant and that’s how my name came up. I was arrested and was told her real age. I did 2 years in prison and was released in 2003 I then found out I would have to be on Megan’s law for 15 years with a parole officer and was given dozens of Unhuman rules , requirements and restrictions I was completely shocked. I Did about 7 years and they found out I was one of the top 10 charcoal artists in the country and just opened my own Glass company LLC . I was starting to make the papers from my art so they took me off the registry but kept me on supervised psl. I ended up doing 15 years on parole or Psl as they call it and the most I got was a small motor vehicle ticket in all that time. I was easily removed from the psl after 15 years which was 2018 , my lawyer was fighting for me to be removed from Megan’s law all together but the court said hey remember when u were 14 and lifted a girl skirt up ? Well we are not removing u off . That made me stronger to be even more successful, so I started more businesses and always stayed as a Glazier to the point where I became so good no matter what glass company I worked for I was the highest paid employee. I was never fired from a job because of this , I never was turned down from a job , I was never denied a apartment or house. I have horror stories from life on psl and I mean horror stories. I would like to tell those stories along with how I beat them and didn’t fail in life and right now I am extremely successful. I earn a 6 figure salary, I had No problems since I been removed from Psl until Now . I had a opportunity in Arizona where I can double my success and the NJ detective found out and violated me for leaving NJ and not telling Arizona police that I was there to work within 10 days smh . I am pissed that Law does Not want anyone on Megan’s law to be successful. I have a story where a police officer tried to set me up in NJ for crimes he knew I didn’t commit and if I didn’t have the money or resources I would have went back to jail and everything I done would have been wasted. But I out smarted him and hired a private investigator and he got the truth and all charges was dropped with a apology from the judge I have that report right now in my icould that I want to make public a long with all the illegal stuff I seen in these past 30 years . We adapt to our environment. Can you imagine how desensitized one must become to face the ostracization on a day to day basis? May as well wear blinders and ear plugs, and turn a blind eye to anyone in distress due to fear of risking one's own welfare, or just to return the favor of disregard.

This lady claims that incest rape is the big issue when in reality what is not accounted for in her arguement is the women who are caught cheating on their spouses or the division of the family life where the men are forced out of the home under these false allegations so the female can be with another man. So they are accised of raping their children so these women can have the freedom to cheat or be with someone else. This is the number one cause of how so many men can be on the registry without ever being guilty and because of the threats of life in prison and threats of never seeing their children again plead to lesser cases. In the hopes of being in their childrens lives. For those who are actually guilty they are the ones who have mulitple crimes mulitple attacks in which they should be imprisoned for life rather than released. Many first time offenders are only listed because they were forced to cop to plea deals when facing life in prison even though they may have not offender or because of those victimized as children not understanding that what happened to them shouldnt be done to another. Their minds are broken and dont know better and with the lack of help for victim of child abuse or children of sex slavery never getting help to show and teach them its not right and after being forced to see their own actions should be given a chance to live their lives. As for the churches and the list of other child programs that children are apart of boy scouts , colleges, or the like are what many need to see is a major issue. Unless you are personally familiar with the registry you will continue to think like so many who say they are all child predators and deserve xyz punishments. I have never been convicted any where in america and ive been listed for 16 years for having the same name as over 10000 people on the list.

Put orisoners, exfelons back to work, community labor programs, and partial military training for able bodied ex offenders, get rid of the Federal public registry!

Fully agree. They need to stop making the nearly million people and growing on the registry into outcast. Get rid of the registry, have work programs in place to help them all get better than minimum wage/construction/truck driving jobs especially while on probation, and let them reintegrate back into society like all other felons. Have an actual line in the sand so to speak that says once you get to that point your free to live your life without restrictions. They can have a family, leave the country, not have any label on any forms of id, and get better employment if they haven't already gotten a good one they are happy with thru the work program. Get more true "second chance" companies that aren't gonna play the whole "oh we are feliny friendly but we are family oriented so we won't hire anyone with a sex offense"

Community labor programs? Is that all ex felons are worth? How about scientists discovering new planets, high-honors professors for prestigious universities, adult celebrities for American Idol/Dancing on the Stars/America's Got Talent/The Voice? What about *_these_* jobs?

Yeah Indiana D.O.C. handles the registry in that state, they made the decision to increase his registration from 10 years to life, he should fight that. Take them to court, have the judge make D.O.C. change him back to 10 years so he can be done with this nonsense. In no way, shape, or form do I agree with registration in any capacity. It's what the Nazi's did to the Jews isn't it? It strips human rights, its takes away liberty, and that's not ok.

I would say both because the dangerous offenders might want to take revenge on the victim if they know where they live. The offenders that don’t have victims will be assaulted by vigilantes.

There can be discussion about reform to better approach cases such as " ending up on the registry because I peed on a school property when school was not in and it was 10 pm" or the "I was dating a 16 year old when I turned 18, but we had been a couple for 3 years"-Those cases or similar iffy ones yeah cool lets figure that out HOWEVER: Child Rapists/groomers, and violent predatory rapists? Nah man, nope. They make the conscious decision to prey on the most vulnerable and defenseless targets possible. There is no remedy or rehabilitation capable of fixing that kind of vampire. The death penalty should be expanded to include repeat offender child rapists and repeat violent sexual battery cases. Saying that you feel bad because they feel depressed? Seriously? If you choose to be inhuman then you don't deserve human emotions. And this argument of it being a family member offender targeting prey within the family so its not as big of a deal-who the hell thinks that way? A large portion of what this woman is saying is absolutely repulsive.

However this woman is advocating ideas such as if a family member commits sexual assault on another family member its "not as big of a deal" than if it were a stranger.- what kind of world does that make sense? That , along with more of the views she advocates for are completely ridiculous and horrifying.

"Violent predatory rapists" are not on the sex offender registry. They are in prison for life. The sex offender registry does not protect anyone from danger or harm because we already have a prison system that does that.

I'm on the offender registry without ever being charged any where in the country. My name is the same as over 10000 people on the registry. I've never been in prison never served time have no victims nothing yet I am and have been listed for 16 years, my allegations on the registry have been changed more than 7 times because of the number of individuals with my name. I've been on this registry for 16 years as a tier 3 for crimes I've have no charges for. The state of Michigan has taken my children because of the list and not one attorney in the entire state wants to be a lawyer who releases a "monster/predator". Once, I tried to be removed and now I have no other chance to be removed ever again because of the tiering level I have attributed to my name. I am currently facing ten years of prison for Michigan suspending the registry duties during the COVID pandemic by judge cleland from Port Huron Michigan. No not every offender is guilty as over the 16 years I've been on this list Ive seen children, all boys, as young as ten years old put on this list for things like having to pee and going in public areas and someone calling cops on them for such a thing. You need to learn more about the truth of the registry and how it has destroyed the lives of innocent men. Many teens are put on the list between the ages of 12-17 are on the list because in many cases the older woman they were with claimed rape on them so they themselves would not get into trouble for statutory rape. This is wrong on so many levels that too ma y are suffering from. Do I think the real monsters be listed. No they should be kept behind bars for the horrors they inflict on people. please go learn the truth and try not to be ignorant or speak ignorantly about this subject until you learn more. Sadly not enough people argue the case by case and only go after the laws being unconstitutional which is the wrong arguement or only part of the arguement.

@@mrgoblueguy I'll answer this. Most if not all sex offenders were victims who survived their own trauma and by a world that will not help them they succumb to their demons. As do all who never receive help for the traumas inflicted on them. Those who are the worst are those with power who by their own power destroy others. I've personally seen the worst of humanity and have personally experienced this pain until I turned 18, from the age of 1 years old. Men Shoving my face into a toilet full of human excrement so none could here me scream. To those who had the most gentle touch and still took from me for there own pleasure. These men were police, lawyers, judges, pastors, teachers, foster parents, and yes loved ones. I had no hero to save me, no one person who showed me anything but my pain. Then those same people put me on this list making me the monster they created. For people like you to hate through ignorance, building off of your fear while they stand idoly by watching you destroy people like me. I've studied into this subject more than any human has given it ear to hear. Those who have their guilt are the broken who were never fixed. God repaired my brokenness as I had none who could. Love showed me the kindness of man of which I've never seen. And in this world filled with hate my heavenly father is who healed my wounds. His grace made me the man I am today. And to those who have been listed with out just cause you condemn not knowing the truth of their lives only listening to those who point fingers. One thing I've learned is those who point their fucking fingers are usually those with the greatest guilt. Not all are guilty and not all are monsters. But if I've learned one thing they are victims as well. Even the worst. Stop throwing your stones lest God shatter your glass house.

93 percent of the time, if a child is sexually abused, it will be someone the child already knows, and won't be on the registry. Your kind of talk proves the brain washing the media and government officials have fed you of the "stranger danger" narrative. It puts money in their pockets and votes. They use your fear. That does nothing to protect your family. Go look up any story involving sexual abuse, and you'll see a consistent pattern, that it was someone close to the child. They create these false sense of securities, and you all fall for it every time. Honestly, you'll only understand if you end up the registry, then you see how messed up it is, and FYI, not everyone on the registry has actually hurt someone.

As a survivor of some really nasty stuff when I was a kid...the guy who did it, wasn't thinking of a "positive impact" to my psychological well-being at all. He preyed on me, he stalked me, after he had served his 8 months in jail...he taunted me. Why should I care, or the rest of society care about his psychological well-being? I understand, offenders return to society at some point. But don't ask me to be okay with my tax dollars or my public servants being utilized to enhance their well-being. No one enhanced mine, my parents had to pay for therapy, I suffered years of issues. I. HAVE. NO. EMPATHY. for these monsters. I hate that this video made me so angry I had to leave a long-winded comment. I literally wanted to reach through the screen and shake these people? does she understand her "wokeness" is just insane? I'm literally vibrating. And I never discuss my past....I have never heard such a shovel full of horseshit in my life. What a literal wank-stain of a human being this woman is.

@Xon Xon at no point did I imply what punishment should be or to continually make someone pay forever. Nor did I try to weigh victims of crime against each other. I'm saying it's disgusting that this woman puts so much effort into enhancing the psychological well-being of the perpetrator. They can do that on their own in court-ordered therapy. I'm saying, the victims crimes againts innocent children who cannot protect themselves, need to have this level of attention, first. And I don't think people see child victims as "disgusting people" as you say.

My comment was because I was angry that people who commit these types of crimes against innocent children who cannot defend themselves or even understand what has happened to them, are getting a sympathetic ear. I'm all for rehabilitation and re-entry and believe our current penal system is broken all the way around. What I'm not for, is a measure of sympathy for the perpetrator in relation to "what they may have been suffering emotionally, that drove them to commit this crime". I simply don't care about their feelings, when they're hurting children willfully.

@@lars_of_the_north I just feel the path she's taking to get to that point, is very disregarding to the victims of these criminals. I get it, without understanding and support, these criminals are likely to reoffend and it's important to focus on that. I just feel there's an imbalance in her views, when it comes to the victims of the crimes. These are life-sentences for the victims...they didn't choose their position, they hurt greatly in many areas of their life from the acts that were forced upon them. I think the larger balance of empathy needs to be with supporting the victim.

I’m sorry but that is a good bit of the problem with the registries. Sex offender means an actively sexual deviant that is looking for a victim. A registered citizen that has completed their sentence is a citizen and not active. Besides most sex offenses committed today are in the home or and 95% are not committed by registered citizens. Think. Don’t add to the problem. Educate yourself and your community. That’s wrong approach of what you say. That’s creating the revolving door 🚪

A child rapist...OK, that person needs to be monitored for life. A 16 y/o with an 18 y/o b/f and parents that hate him? These laws are pretty broad. "Sex offender" is a heavy label that will ruin a person's chances for employment and housing. For the record no, I'm not a sex offender. I just think we need to think our laws through better.

You’re uneducated. Most sex offenders are not pedophiles. Pedophilia is predominant sexual interest in prepubescent children under the age of 13. There’s dozens of different charges that can make someone a registered sex offender. Besides, prison is supposed to be about rehabilitation.
