Let me get this straight. In order to have squatter's rights it takes: New Jersey - 30 years Pennsylvania - 21 years Delaware, Main, Maryland, Massachusetts, New Hampshire - 20 years Connecticut & Vermont - 15 years Rhode Island - 10 years New York...30 days. Kinda dropped the ball on that one New York.

Yeah, it is some bullshit. During COVID, my boss's tenants stopped paying and didn't bother even after the rent regulations were lifted and wouldn't leave, changed the locks, wouldn't respond and he was just legally battling to get them out. I think he eventually died get them out but it took a while.

Florida legislature just passed a law basically eliminating squatters rights, making squatting a felony, and allowing sheriffs to immediately remove them. I hope other states will follow soon.

Insaw a video about a lady who found squatters in her house. They completely demolished her house and it would take her thousands just to fix the interior let alone the furniture, stolen items, and appliances.

My aunt dealt with this in South Carolina. She bought a new home and gave her old home to her grandson, but he was away at college. Finally, when he came down from school there were squatters in his home. It was the same situation and my aunt felt helpless. Thank goodness for her community. They handled that situation better than the law... He's been there for 2 years in his new home.

You need to prove that you're living there. In USA and a few other countries in the world, if someone has occupied your property, the only way you can get them out is by legal notice of eviction. Unfortunately, it might take 30 days to a year based on the court though.

Then the police show up, talk to the squatters, turn around and tell you it's a civil matter. It's the same outcome no matter what wording you use because the police are still going to talk to them next.

In some states if the landlord accepts any amount of money from the tenant it constitutes a month to month lease based on an oral agreement. The tenant could show a text, email, invoice, venmo transaction with a house icon, etc. between the two parties as proof of the agreement.

@@michelleobrien6996 i think the white guy at the end is the guy who has been squatting there for longer and he might of been getting other people to pay him rent to stay there, lying that he is the Head Tenant of some BS. So he doesn't even own the house squats there for free and is making money off of it. Just really Brazen, he knows the loopholes in the law and how long it takes and he is just taking advantage of it.

With the New York person the best option is to sign a legal lease with a good friend or family member, then the tenant can get the police to evict squatters with out all of the court BS. It has to be someone they trust. In the in New York rights area signed leaser is > than squatters > the landlord's rights.

Yeah... If she was charged for unlawful eviction, and the police arrested her without getting evidence for that or had evidence by the time that she was probably innocent, which in this case there was because the squatters could not show any documentation of a lease and could not name anyone who supposedly gave them a lease, then maybe she can sue the police department.

Only the LAW has the right to evict a person. Imagine if people went around privately evicting people claiming to be the owners of the house. In this case it's clear it's hers. But in the same way he can invade the house and say it's his one could come and say, 'It's mine', bring some bodyguards and change the lock. It's a case to be settled in court. That's called RULE OF LAW. I know it's hard for north Americans to understand that. Looks insane cause in THIS CASE we now it's HIM the one on the wrong. But could be her fault. she could have false documents, etc. That's a thing to be decided INCOURT, where both have EQUAL rights to present their case. A cop can't decide on that.

I did a lot of reserach because I am in similar situation with an empty house waiting for rent, if your in CA, search up trespass arrest authorization and LAMC 41.24, if you file that with police department and hang out a sign; it'll let police arrest trepresser for up to a year, you just have to keep renewing it every year.

Im too petty for this kinda stuff. That house would all of a sudden have bedbugs, rats, bees. Some damage is easy enough to fix that's its worth it for the end result. I think I'd just get a truck, show up and take off all the doors, and let them figure it out! Michigan winter will do the rest.

The sad part is these laws are put in place to protect RENTERS from scuzzy landlords that illegally evict actual tenants. These squatters have found a loophole in the law. They need to change the laws so squatters cannot take advantage of a law that wasn't even made for them. Crazy.

Yes this blew my mind also. I got locked up for this exact same issue in 2019. I found some dude living in the basement of my home after returning from a long stay in Malawi, I called the police and they said I had to take him to court. for a year-and-a-half this man terrorize me and my family he did whatever he wanted pissed on my door damage my new BMW to the point where the insurance company no longer wanted to pay out and canceled my insurance this guy was about 5foot 2 and I could do absolutely nothing to him without being placed in cuffs. I spent thousands of dollars on a attorney and he received free legal help courtesy of the city and my tax dollars.

My mother in law was saying in Vietnam if you buy a house and leave it vacant it won’t be long until someone moves in and they’ll pay the police so there’s not much you can really do 😪 Also Aba talking about going on holiday for 2 weeks and coming back to having squatters in your home reminded me of the woman that posted about having rented out her home/room on AirBnb and when she came back the woman refused to leave and she couldn’t get her out - that’s nuts

Same situation here in Germany, happened to my dad. Guy wouldn’t pay rent, didn’t return keys, just disappeared. Not before taking in another squatter. So he had to take legal action against BOTH of them, not just paying a lawyer but also paying for storage for their potentially existing stuff for at least half a year in advance, plus paying for government officials to get them out - all of that twice! Oh and they were using water and electricity, heating and running down the place to the point he had to redo everything, changing locks, new floors, wallpapers etc. I get the state wants to protect innocent, well behaving tenants from crazy landlords but this is straight out government backed daylight robbery.

Someone tried to do this to my home went i went on vacation but they were not able to actually get into the house. Instead they sat on my front porch and the backyard for 2 weeks. They slept there, did random non sense yard work? Moved decorations around all day and tried to get into the house in any and every way they could. I have cameras but being on vacation I did not check for anything and when i came home she was sitting on furniture she had moved from the backyard to the front. Then had the nerve to tell us she had been there for years and that this is her house.

There was a guy in the UK, who went away for work for a period of time (think maybe 3 months), came home, to find that his house was SOLD by someone else in that time...land registry etc all updated etc. Taken him so far 3 years and counting to get it resolved, because the people that bought went via a mortgage etc as well, so a whole host of shit going on with it. 😮‍💨 My family is going thru this right now in Louisiana. My granny passed away and we couldn’t bring ourselves to do anything with the home yet, generations grew up in that home, so it sat for a good 6 months. We finally made a family decision to start renovating. Showed up with a contractor to see what needed to be done and we heard dogs barking in the home. A woman comes rushing out, claiming we’re trying to break into “her home” that she has a lease for. Super loud and straight cursing out my mom. I’m pissed on the phone listening from Cali. The Cops were called, she’s immediately starts lying to them saying she’s been staying there for years, when literally my freaking granny died in there not even the full 6 months ago. Get this. This b!$&h was the daughter of the neighbor across the street. We've known these people for DECADES! They plotted daily to see if anyone would come by and since it had been 6 months, they just broke in and started living there. Her mother sat there across the street, on the front porch as this confrontation went down. The cops asked the girl for a copy of the lease, then boom, she froze. No paperwork or anything, because they didn't think that far ahead. Luckily, the cops don’t play that here and arrested her for breaking and entering, also destructive of property. The Locks have been changed and bars are now going on the windows and doors. She’s being charged for all the stuff they destroyed in court. Neighbors are no longer just that, they are VULTURES! This country has truly fallen. 🤦🏾‍♂️

What I don't understand literally at all is how did this become a loophole to begin with? You pay a deposit and rent PRIOR to moving in. No rent or deposit was paid, just because you break into someone's house and fall asleep doesn't mean you are renting or living there. This is such an easy loophole to close. States like NY make it so easy to clown the fuck out of them.

Sadly I hear this same type of story quite often. have a friend who was nice and let a friend/acquaintance who needed a place to stay for 2wkd or so. The 2 wks turned into over 2years of horror. Came home from work one day and dude had had furniture and hundred boxes delivered, dog, Cat, oh and eventually a girlfriend showed up to live to.. the guy messed with his property, boobies trapping things. Cutting electric cords to coffee maker, lights, fans, lawn equipment etc., painting all over walls. Turning faucets on to let water run and run bills up. Busted doors,windows. He had to live with this squatter. Was afraid to leave house but at same time afried to stay especially Closer to getting him out because was scared for his own safety & life with some of the things that has happened. He was not allowed to change lock, cut off water,power etc. He had to provide all of these things to this guy....SMH

my girl works in court & deals with homeowners who have squatter issues & deals with their genuine frustrations for she cant do anything about it & she is the one who signs documentation for sheriff to evict homeowners who are foreclosed on…can evict a homeowner who’s behind on their mortgage, but can’t evict a squatter…let that sink in

In Georgia, the squatter has to be on the property 20 years before claiming legal ownership. They just recently put a bill into play this month to make squatting a criminal offense.

I was terrorized by squatters in California in an apartment complex (that I still live in) during the pandemic. They were selling Fentanyl and meth and prostituting, stealing bikes and worse. The manager wouldn't make them leave. She had few options and had to follow protocol. They did a home invasion, broke a window, stole my car and the manager is still charging me for the crime committed against me. Legal Aid won't help, no one will.

For reference - in non-retard places squatters right are applicable after 10-15 years. as in this law exists for people who have taken occupancy in what is essentially abandoned property or very long-term disputes between people sharing accomodation. whoever made this law applicable after 30 days was INTENDING for malicious crap like this.

If within those 21 years the land and home owner never even bothered to go to the property then common sense would say they abandoned it. Within those 21 years, it's still considered Criminal Tresspassing. You abandon it, and others maintain it seems like a fair trade that the state make them the new owners. 🤷‍♂️

I had this happen to a friend of mine. They had a parent pass away in CA. House went unchecked for 6 months and when they did, a random couple was found living in it. Instead of going to the police, they had to go thru the court system where it took an additional 4 months to get them out the house. I’m telling you, the laws are made not to help us at all.

I don't think it would actually work in that specific scenario because there's a difference between you living in the house and you owning the house. This stuff mostly works in scenarios like this(which is when a house is temporarily unoccupied because the owner passed away or previous tenants moved out or something) because it's harder to 100% confirm that the squatter didn't have a lease. Basically, the law exists to stop landlords from tearing up the lease and throwing people out on a whim by claiming they are squatters. The problem is that these laws don't really factor in that actual squatters exist so it's really easy to exploit. I heard Florida recently passed a law that basically invalidates the "exploiting the system" plan that squatters use and lets police kick them out instantly. So that's a point for Florida I guess.

There is a series on Netflix called Worst Roommate Ever and there was a NY woman who dealt with a similar issue. NY laws are insane and what she went through was crazy since they guy wasn't paying anything towards the bills. The squatter ended up being kicked out eventually after thousands was spent to get them out. The squatter ended up doing the same to 2-3 other people progressively getting more and more violent. Ended up unaliving his brother after the brother bailed him out of jail.

So just to clarify, and reiterate, if you are a landlord, and you know, people are squatting on your property do not interact with them. Have a new tenant sign a current lease. Now take that lease to the sheriffs department and report trespassers on your property with the new tenant. Now the sheriff will go and evict the trespassers a.k.a. squatters from your property. You as a landlord will never interact with the squatters. PS I am not giving you legal advice, but this is a heads up.

Seems like is an issue more in larger cities than rural areas. Things like this are when it is beneficial to have a good relationship with at least one neighbor to possibly keep an eye on your home if you are gone. The worst part about squatters is that the property usually gets destroyed, so with all court fees and property damage you are set back so far.

I can't remember the name of it but there is/was a documentary about this exact topic on Netflix about how some squatters had essentially ruined the lives of the people who owned the properties. Some people had to change their life plans because of the squatters, I think one woman even lost her cats because of one squatter stealing them or getting rid of them if i remember correctly. It was so sad to see how little they could do other than wait for the law to deal with it, which in many cases took years. At least one of the squatters was extremely well versed in the laws and how to abuse them in his favour. It was wild, some people have no shame or conscience at all.

This just happened to me here in California. I have a 6 cottage complex, squatters moved in and were there for 2 months fully moved in. The other tenants thought they were new renters until s tenant contacted me. They would not get out, I didn't call the police, I called the crew. We moved every single item out the cottage and onto to the streets. 5 days later their j uh jnk was still in the streets. I called for bulky pick up to removed their junk. This happened and I have a 7 foot remote control gate for tenants. People are out here trying to steal your property and some local governments are helping them. Stop the bureacratic madness!

I’m an agent in NYC. It is just terrible the rules they have about landlord-tenant issues. Most landlords are small mom and pops who just have a few apartments/buildings that they bought in the 70s, 80s, and 90s when NYC was desirable as it is now. They don’t have money a lot of times when tenants don’t pay or they have a squatter. There are little to no advocacy groups for them and there are stories of landlords who are under so much stress they are taking the law into their own hands and deleting non paying occupies. It’s a sad situation on all fronts.

This is actually a pretty common scam. Notice how he immediately mentioned her paying him for the "home repairs" he just wants a pay out. People will squat and then demand money. Many homeowners will pay because it's faster then the courts.

@@siriusbizniss Depends on the state. Some states, like New York, are as low as 30 days. In others they are as high as 21 years. Usually its the blue states with the lowest wait time to claim squatters rights

There should be rental documents issued by the state. If you're renting a property you should be have a state issued form. This would get rid of the squatter issue.

12:00 These are adverse possession laws, a totally different thing. Almost every common law-based legal system has an adverse possession law, typically 10 years. That includes Quebec. Adverse possession laws govern ownership of land/property while squatter's statutes govern right to occupy.

The 30 days they are considered a "tenant" and need to go through the eviction process which can take up to a couple years.. during that time though the person who owns the house could end up losing the house or going through forclosure which can draw it out longer.. if they forclose then i think the bank has to then go through it again as a tenant removal, again can take a couple years. In CA if youve lived there 5 years consecutively you can have claim to the house, I think you have to just pay for deed titles and property taxes and then you can claim the house or in other words own it.. thats where its nutty. So basically if they can make a way to stay there rent free for 5 years and hope to draw out the process, you can end up owning a house! Nuts!

Squatters are thieves. Plain and simple. In my country we had some laws protecting squatters because there was a lot of real estate that stood empty due to speculative investment for many years, so they put into the law you could squat a property after like 2 years of verified non-use. This meant that a property could not be squatted unless it was absolutely abandoned. It also gave a reason for property owners to rent out properties for cheap which helped the housing market a lot. There is a way to do it right, there is a way to do it wrong. This is wrong in all ways.

Squatters rights is one of those laws left over from early America, like before the Civil War early. Once upon a time if a settler wanted to claim a peice of land off the Goverment, or just claim it before someone else got there, they would have to squat for a certain amount of time. It did actually serve a purpose of sticking it to the man in the context of oil tycoons or ranchers dominating an area that would otherwise provide good crops for people with no ability to pay the cost to rent it. Those laws have no place in our current society though, their function is pointless now, except to cause pain extreme inconvenience to homeowners.

Its baffling that in the state of New York you need proof of address for any form of government amenities and are forced to jump through hoops to clear any verification checkmarks; but if god forbid you're trying to remove someone from your property, they will take their word without any documentation or hesitation. Im perfectly fine with squatter protection but that protection needs to be reasonable. Ive rented from garbage people who have tried changing the locks on me, and squatters rights allowed me to get my belongings, but I also had bank statements with that listed address for months to confirm that i had been living there, I had phone bills and medical bills to support my statements. Not just hearsay and a vindictive agenda to cede control of someone elses property. As a New Yorker whos benefitted from these rights I firmly believe they need amendments to protect both parties involved

@patricesheehan511 I was renting, then I was unemployed because my jobs parent company accrued financial losses and had to downsize, and after a few days, the locks were changed and I was sat in the building hallway with nowhere else to go. The moment my rent stalled, I was viewed as a squatter by law, regardless of how recent my last payment was. Had the cops not allowed me back in, I'd have lost my social security, my diploma, my birth certificate, amongst other things that left in a scumbags hands could irrevocably alter the flow of my life. Squatters' rights saved me a hell of a lot of trouble till I could make the arrangements to leave of my own volition without weeks or months of setbacks

I live in Montreal. I had a tenant who decided to squat my apartment after ending the lease. I was lucky it took me 7 months to evict him. I had to play hardball to make him leave. The law is not helping at all. After the eviction I was in a 5 years judicial process because he decided to sue me. It changed my mind about how to be a landlord.

The people who pay rent every Month on time are the ones being taken advantage of by the landlords. Especially when they’re charging you more than room is worth just because they know you’ll have to pay or uproot your life.

@@Tagerrun it is easy to say that landlords take advantage of their tenants. The mistake that most people make is when they think that all landlords are the same and are loaded with money. For individuals like me, the rent does not even cover the mortgage payments. We have to pay out of pocket all the charges. I am not a big corporation making millions. There are good and bad people everywhere.

And this doesn't even account for the damages that will be done to the property by the time they're out. Squatters almost always take the appliances, strip anything they can sell, then trash the place, and the owner will never get a dime from them. I'm with Aba on this one.

I'm from Spain and the situation here is way worse. If the house is not your main residence you can't do anything. Even if you take it to court, they won't be kicked out a lot of times. It's insane.
