@@MrBollocks10 only if it’s a grey area. Such as on the battle field. False imprisonment by someone who is definitely not a member of the police or military is just that. The right thing to have done would have been to take pictures of the man’s face and truck and license plate and let him do his job and leave then let the police sort out the legalities. Trapping someone who is not causing risk to life is illegal by anyone other than police. Why do you think security allows shoplifters to leave if they fight being detained? They can ask them to stay but they can’t force them to because it’s illegal.

@@emsamish I’m not so sure he was risking arrest, the repo guy did not have court order. Even though he had the right to repossess based on a civil contract. The police officers successfully verified the paperwork, and informed the ‘concerned citizen’ that they are aloud to grab the shed. If the employee escalated it ANY further after the police verified he had a right to remove the shed he’d go to jail. But up to that point a reasonable person could assume he was just ensuring the rando with a roll off trailer wasn’t stealing a shed. It is definitely gray area though!

The employee already pretty much admitted to knowing it was up for repossession saying his boss wanted him to schedule picking it up so he could get his stuff out. The employee was borderline going to jail had he closed that gate.

@@30anvz28 no prosecutor would seek a kidnapping charge, he was free to leave at any time (just without his truck) and that was made clear. Not saying no laws were broken, MAYBE could have been arrested and charged for conversion, but no jury would convict him, as within 10 mins of the cops being there the matter was resolved without escalation. The employee was just doing what he was told by his employer - until the cops said you can’t do that. All parties did a decent job here, and even if laws were broken, vicarious liability should be applicable here meaning the employer (not the employee) would have been the one considered liable here.

It’s because apparently the storage yard wasn’t the renter - and they too were charging for the storage of the shed (so they were claiming until that was paid the shed couldn’t leave). Imagine a tow yard has your car and wants you to pay to remove it, the gate opens to let a truck in and you run in too while the gate is open (while yelling ‘I’m so lucky that gate was open just then’), the tow yard employees would also probably close the gate and refuse to let you leave without paying the storage fees they want. In that context - once you know the storage place charging the storage fee wasn’t the renter - it starts to make more sense why they demanded the storage fee be paid before it could leave.

First, it’s “allowed” not “aloud” and kidnapping is when you move someone from a place they are to a place they don’t want to be. The employee along him to leave on foot but blocking in the vehicle is illegal. Not sure what state this is but just look up the false imprisonment law for that state. I know these things because I’m a Private Eye and have had a couple people get froggy and try and box me in. They fucking move quick when you call 911 and tell them you’re being held against your will. The shed driver had the employee tell him on video that “he can’t leave with the truck”. That’s illegal as fuck. You can’t detain someone unless you have their consent or the legal authority to do so. This isn’t “mischief”. And he doesn’t need to be held in an actual cell to be falsely imprisoned. Maybe look up the definition of some laws.

According to Google false imprisonment “occurs when a person intentionally restricts another person's movement within any area without legal authority, justification, or the restrained person's permission” I’m not so sure that applies here. You are right it is not mischief either. It seems like conversion is the most applicable law here, definition “Conversion is an intentional tort which occurs when a party takes the chattel property of another with the intent to deprive them of it.” Also - being a “private eye” doesn’t mean anything with regard to knowing the law. It’s like saying a police officer knows the law. Yes there is an expectation that you should know more about the law than an average Joe - if you didn’t go to law school those words alone mean nothing.

I live in a 5th wheel. My wife and I travel the country in it. Even if we stayed stationary. The 5th wheel is paid off. Lot rent is $400 a month. Water, internet and trash is normally included. All you pay is electricity. So $400 + electricity is a heck of a deal. We make over 140k a year. So think of all the disposable income you would have.

Actually no, you can in fact hold someone if they attempt to steal items off your property, and those items would be whatever is in the shed. You are quite deluded if you think otherwise. You would not have been a hostage because you were still free to leave without the contents of the shed. That tiny little detail makes the difference and makes the lot employee in the right, and the repo guy a potential thief. If he had done this a different way, had gotten a court order with a repossession date that was served to the owner, then he could have taken the contents because the owner was given notice when to have it unloaded by that date. If the repo agent had been in contact with the owner and the owner refused to remove contents, again he was given a chance, but in this case, that chance was not given. This can vary by state of course, but few states would consider it kidnapping to prevent a truck from hauling off your possessions in that shed without the owner having a chance to remove them, being given notice of when that had to be done.

@@stinkycheese804 you do not have to give owners a chance to retrieve items at the time of repo, you have to allow them to schedule a time to regain their possessions in a reasonable timeframe after the repossessed item is secured at the lot. They want contents removed before repo because then theres less liability for their insurance company if something is damaged in transport or stolen. No he was not held hostage, but he was imprisoned. Now theres no use in any lawsuit for 20 minutes of wasted time... But legally he has a case against fatboy if he wants to take it to civil court and claim his rights were violated. I doubt the state would pursue criminal charges for this situation, not worth taxpayer money. You have a legal right to detain someone committing a crime, but you better be damn sure that there is a crime and he is the one doing it because you do not have qualified immunity against false imprisonment like cops do. Youll find your butt in civil court with lawsuit for civil rights violation and you dont have a police dpt to pay for that settlement. Like i already said he wasnt preventing a theft, the repo does not have to remove personal belongings at time of repossession in ANY state

If People Insist on getting one of these things, PAY CASH and PAY IT OFF at time of Purchase and DO NOT Rent Them Or Make Monthly Payments!... A 15,000 Shed by the time you Pay it off, will Cost just Under 30,000 .... Or have one built of same size for Almost Half the 15,000....

No not at all. For example I just looked at 3 websites..all the same deal..building is about 7500..payments are 336x36 months equaling about 5k for financing it. So closer to about 20k for a 15k shed not double. If you're working class or low income with 2 checks coming in and no credit or bad credit I'd say 5k for financing something isn't bad. No different than people paying 600 to 1k a month plus full coverage to have a new car...if you need it and you can afford the monthly but not afford to eat your entire savings it makes far more sense to finance it. Most companies have no early payment penalties so just better advice is pay everything extra you can on top of monthly to reduce that 5k as much as possible.

Like for example hotel cleaner steals pills from a guest's room, and when caught says 'boss told me to take em' to shift blame. Sure, you can practically claim anything, but without proof it ultimately won't stick. Whatever the case, it won't really save em anyways. At the end of the day, it's the cleaner who committed the crime, not the boss. If there is proof the cleaner did it on orders the boss can also be charged ofc, but that still wouldn't absolve the employee...

They legally then have the power to search text messages, recover phone conversations from the provider, any form of communication you used is subject to search for the investigation. If you were the boss, and said to do such a thing, and the employee obeyed, that can be admitted into evidence and used against you proving you were involved.

"Just" doing what your boss tells you, is not an excuse to willfully commit a crime. If you kidnap someone because your boss tells you to, you could be convicted of kidnapping. The boss might be convicted as an accessory, accomplice, or co-conspirator. People, be careful "just doing" your job!

@@benjurqunov Incorrect. He was held against his will. By detaining someone's property, you are detaining the individual. Telling him he could leave, but not with the property he had legally loaded up onto his truck was detaining him against his will. That meets the elements of kidnapping/false improsonment of the Model Penal Code. Moving the person is not a required element of the crime. Unlawfully preventing them from moving where they are entitled to go is enough.

@@daveduncan2748 Incorrect, he was not being held against his will. His will is to leave with nothing more than he came with, and he was free to do that. You have no idea of the law if you think that if you don't prevent thieves from coming onto your property, that you are then obligated to let them leave with whatever they can haul off. That's madness. Again, you are not preventing him from leaving. He was told this in the first place and had the opportunity to leave just as he came, without the contents of the shed. He did have a right to take the shed with him but not the contents inside without allowing the owner the opportunity to remove those contents first.

@@stinkycheese804 You are under the misunderstanding that repossessors are thieves. It is quite the opposite. The person who promised to pay for the item, via contract, and failed to do so, yet wants to retain the item, is the thief. The repossessor is the legal agent of the rightful owner and is legally securing the rightful owner's property. The person blocking the gate was neither the owner of the land nor the property being repossessed. It the end, he did what he was always legally required to do--let the repossessor take the shed. That's why he had to do just that when the police came. Before letting him leave with the property, he was illegally detaining the property entrusted to the owner's agent (repossessor), thus detaining the owner's agent himself. That's false imprisonment. He was very fortunate that neither the repossessor nor the cop was interested in pressing charges. It could have been very ugly for him.

I admire your infinite patience with your "kidnapper". And you were so understanding - getting that he was in the middle of something that really wasn't his problem and basically being forced to be loyal to his employer. Well handled! And it showed that yelling and screaming only prolongs the process AND creates potentially dangerous situations. One of the best repo videos I've seen!

I used to repo moblehome . Back in the 70s and 80s. It was a riot. Had guns pulled dogs told to attack. We always got the trailer we were sent to get it was a hard fun interesting job. Lots of police called but we had the papers. We won those conflicts.

(it was a public building, not a private residence) Closing a gate to prevent someone from leaving is legally considered kidnapping. Had a boss ask me to do the same thing for a company work vehicle years ago. He showed up ask me where’s the truck was ranting and raving. I told him they took it. He starts yelling at me about why didn’t you stop him! I tell him you don’t pay me enough to go to jail! Maybe, just maybe you should pay your bills.
