To some degree, it has to be like that. When an invader employs war crimes against defender, the defender feel required to fight on the most even ground they can. If invader employs war crimes in their strategy, the defender is at an unfair advantage if they continue to follow the rules.

That's where Constitution that needs to be followed both by government and people steps in. Depending on what's used in Constitution. It serves both as a means to preserve safety of civilians and/or government.

Not quite. There are certain limitations. "Grave Breaches." See Article 147 of the Geneva Convention relative to civilians. Mandates have consequences.

The “rules of war” mostly exist on paper. On a battlefield where people are doing everything they can to kill each other, it becomes more like suggestions for most and it really boils down to an individual soldier’s sense of morality.

Brilliance- abhorrent actions are generally not recognised as an action of organisation. Abhorrent practices amount to war crimes by virtue of administration. There are all kinds of 'rules' that delineate 'civility' in industrialized society. It's like if we're playing tag and you get pegged in the genitals by a player trying to escape. If it happens once, it's something the other players might tell you not to do again, they might even laugh about it. If everyone's realising it works then it's "out of the realm of playing tag" in terms of realistic expectations. Humans are usually indoctrinated and act like that indoctrination is advancement of or upon a feral state.

⁠@@jessicalacasse6205There is a police to enforce it… just as soon as they get to you. Also everyone bombed Civil targets in WW2 mostly to destroy enemy factories and military installations. Also they thought that bombing Civilians would make them less inclined to keep fighting, but that’s not how that works.

I’ll be honest one my three deployments first two as a medic, I found that enemies will freely fire on medical personnel. They did in El Salvador when was a peace keeper, and in Desert Storm. My M-113A3 ambulance got shot at multiple times. Then in the next Iraq war they bomb the crap out of our CRESH. They also blasted our ambulances and medevacs.

There is a hollow point 5.56 round. For those who are not aware the hollow point ammunitions do not pierce level 3 body plates or steel sheets used for indoor ranges. They are used in indoor ranges.

I feel like the Rules of War are totally pointless since adversaries typically sink to each others level as soon as one starts using illegal tactics. The victor usually gets to shrug off the consequences and complain about their enemies conduct anyways.

They're not pointless. It makes breaking the rules a taboo each side breaks sparingly. The rules mean prisoners are taken alive and treated well 98% of the time rather than 2% of the time. They mean that medics are usually not targeted. That cluster ammo and mines are used only when desperate and necessary and not as the default.

@@jessicalacasse6205 it's like speed limits. Most people don't follow them, police catch very few speeders. But the existence of speed limits do slow drivers down. If the limit is 30 you don't get many drivers going above 40, but if there wasn't limits you'd have drivers driving 40+ I'm sure

Fun fact: The United States is not a party to The Hague Conventions, which is why the International Criminal Court cannot prosecute war criminals based in the U.S.A.; the United States legislature even passed legislation that would result in a U.S. declaration of war on The Netherlands were any such charges brought forth.

Doesn't Hamas go out of their way to hide their bases within protected civilian structures? Such as schools, hospitals, and Civilian Homes? Also, hasn't Hamas murdered civilians on multiple occasions? And hasn't Hamas taken multiple Civilians as hostages? And havent they indiscriminately targeted civilians with missile strikes? And haven't they, on multiple occasions, they stated that their goal is the Genocide of the Jewish people and the destruction of the Jewish state? Tell that to the German civilians burned alive at Dresden, German women and girls raped by Soviets in Berlin in 1945, the South Vietnamese civilians murdered by NVA forces ("But muh American war crimes muh Agent Orange reee!"), and the towns/cities burned by Union forces during the American Civil War.

I would also like to point out that after these rules were established, they have been abused and used as methods of shielding by our enemies. Such as not wearing uniforms to appear as a civilain... or using civilian structures and densely populated areas as strongholds. Rarely are these codes of conduct extended to us by our enemies.

@@emberfist8347 yeah basically the rules are writen in a way to basically cover the fact that there are those who will try and use the rules of war against one side or another for propaganda reasons. in such case of this happening then it's fair game for the other side to prosecute any of those enemies taken alive for those crimes.

I know and I would wager that those who wrote the rules did cover that angle of non state actors trying to weaponize the rules of war against people to allow crimes to happen and bate people in to a propaganda trap. the signers of such must have to take that in to account and should have fail safes in place to punish those who play that tactic.

The problem with the laws of war is how easy it is to circumvent them. I remember footage of a journalist and his camera man as well as some people that tried to stop and help him because the gunner claimed the camera was a rocketlauncher.

I remember seeing that footage. That was the infamous “collateral murder” video that was leaked by Wikileaks. Apparently the gunner had no idea those guys were journalists and civilians and were basically on their side. He opened fire on all of them. Crazy stuff.

Normally Medics and Corpsmen carried M1 Carbines or 1911s as back up guns. This was due to the fact in the Pacific theatre Japanese soldiers often disregarded the rules of engagement in combat

They still do. If you look at royalty around the world, they typically have or are serving in the armed forces. When WW2 broke out, the (UK) King at the time wanted to go to the front lines along with then-Prime-Minister Churchill. They say they had to restrain them from grabbing a weapon and running right into the action.

There is a photograph somewhere of an exchange of fire between a plane and someone in a parachute. The plane started firing at enemy pilots who bailed out after losing a dogfight. One of these pilots hanging from a parachute pulled out his pistol and killed the threat

As far as I know, there's only one recorded case fitting that description. I don't recall all the details, but I believe the paratrooper was a British airman in one of the World Wars (WWI, I think).

Certainly one of the more Informative and Educational videos you have done. I have always wondered about the "Rules of War". Most people know all about the FIRST category, but the rest i bet almost no one knows less you have been in the military. Most of this stuff sounds like it would be considered "inhuman" or "unthinkable" by most people. So thanks for informing us.

Just for anyone who is curious of the parachuting person, do not confuse the protections granted to aircrews/pilots to be the same for paratroopers. If a pilot or airplane crew are shot down over enemy lines and they are parachuting down, they would technically be protected since their aircraft serves in place of what would be a soldiers "Rifle" Once the aircraft is shot down, the pilots lost their ability to threaten enemy fortifications or incoming enemy planes. (Unless of course they use their service weapons to shoot at ground targets as mentioned in the video, then they would ultimately revoke their protections.) However, paratroopers do not qualify for this protection since they are being dropped down with full kit and gear with the intent of being on a mission to cause damage to the enemy.

During a war and in the heat of the moment, the rules of war does not apply to the ones on the battlefield. It really comes down to the morality of each soldier. War isn’t a game of kickball, you are literally trying to kill another human being and they are trying to do the same. Most often to survive the war or to protect their comrades.

Well I have seen guys including myself that have absolutely known we we’re looking at Taliban men that were going to attack us. They hid their weapons in a tree line and kept walking out and looking at us waiting to attack us when we left a compound we were in. We could have killed all of them before they could attack us but since we couldn’t see any weapons we waited. Sure enough when we all exited the compound and were out in the open they opened up on us, then we were in a gunfight for the next 4 1/2 hours. So there are people who do adhere to the rules

These rules primarily serve two purposes: For winning nations to further punish and thus neuter those they defeat For strong nations to eliminate the only real recourse lesser nations have, so that they either have to fight with hand tied behind their back or provide excuse for escalation of force.

@@wyattpeterson6286 Quite a few things in the World Wars, but most of them came from the First War. One main thing the Canadian Army was known for was their exceptional low number of POWs captured. Canada was essentially the British Empire's shock troops when it came to trench warfare and especially at raiding trenches. They were known to take very few if any prisoners during the raids and quite a few instances of mutilating the bodies of the dead Germans. There were also several instances of them executing German soldiers after the soldiers surrendered to them. Another instance was around Christmas the Canadians threw cans of tin meat to the German trenches for a few days and after the Germans got use to it and didn't duck for cover they threw grenades at them instead. While around the same time in some other German/Canadian trenches the Germans tried to get another Christmas Truce between the two sides. After exchanging Christmas songs the Germans stood up out of the trenches and the Canadians shot them all down. There's a lot more different instances of Canadian war crimes but the main ones are of their treatment of captured, or lack of captured, German POWs.

One thing to note when it cluster weapons, this applies in the same way as landmines. If the submunition is designed to be 'intelligent', and seek out targets on its own, it's legal for use (This being the case for weapons like the CBU-97 and CBU-105).

@@emberfist8347 that's not an issue with the CBU-97 and 105... They're designed to detonate regardless of if they find a target or not. Though it is possible for duds to exist, as with any weapon system, it's far less likely with those two than previous generations of cluster weapon.

The last survivor always tells the truth. What I mean by this is that is there is no evidence then it does not matter what you've done. History and actions are easily hidden and it's safe to assume every country has committed war crimes in the past few decades and gotten away with it

Remember that old adage "History is written by the victor." It is uncommon for the Victors, to acknowledge their own war crimes and prosecute those who committed such acts. So oftentimes its only a war crime if you lose.

I find it curious that something non-lethal and with no lasting effects like tear gas is banned. The only reason I can see is to prevent the party it is being used against jumping to the conclusion it is a lethal gas attack and responding with an illegal act (such as actual poison gas or nerve agent).

Actually tear/CS gas is classified as a incapacitating agent, thus the use of the chemical could be used to incapacitate combatants so they are easier to terminate.

Forces should never be used for so called policing. The enemy and terrorists follow no rules at all, but service personnel are expected to. Then when the civilians rules cause deaths and things get messy, the terrorists get given amnesty and the forces personnel get put in the dock and pilloried for doing their duty.
