Indeed - it wasn't his business or owned vehicle, in reality he would likely have accepted the cash and let it go at that - the police car arriving on scene so quickly was a bit iffy. Great series though.

So many stuff wrong here. The whole scene is about a traffic material accident between two drivers in France. This is pretty standard stuff, you don't even need to call the cops on such cases, unless it becomes litigious. Accident insurance report froms (constat amiable) where literally invented to deal with such incident in a quick and efficient manner. The driver getting upset is pretty normal. Fixing a car in such context isn't just about paying upfront, it's about accountability and insurance claims. As an employee, he need an official trace of the incident, so he doesn't have trouble with his boss and the insurance company. This is why he refuse the bribe of the Jackal. From his point of view, he's facing a bloody rich twat that think he can just solve everything by throwing money at it. This is a terrible mistake from the Jackal. He's supposed to be an experience world traveling assassin. I don't know if he actually rented his car in Munich, but if he has ever operated in Europe, he should have known about that form (it's literally the same all over Europe). All he had to do was to take it out, fill it up (even with bullshit if needed) and he would have moved on easily. Bad luck a cop arrive and the pissed off truck driver calls him. As said, this isn't really the sort of stuff where you need cops. But, if it become litigious, they can call the police to sort it out. However, this is not the right sort of police for this job. The cops that shows up is a municipal police agent. It's already rather out of character for a municipal police patrol to happen outside of the urban area, but what is worse is that this agent should have just called the national police or the gendarmerie. Municipal police, in France, are not full fledged police officer. They have the status of deputy judicial police agent, which mean all they can do is to issue tickets for minor infraction. Car accident do fall in their jurisdiction, but thoses situation can end up so quickly outside of it they generaly just secure the area and call in the gendarmerie or the national police. Beyond securing the scene, controling the papers and possibly explaining to the Jackal that he need to fill up the form, his role on such scene is severly limited. What is even worse is that the agent actively the inside of the vehicle. That's a legal search inside a private property and he cannot do that. Firstly, a legal search inside a private property can only be performed in case of a criminal investigation (or under a requisition of the public prosecutor). So you need an actual criminal offense. The problem is that none have been committed and the cops has no reason to suspect this is is the case. Secondly, even if there was a criminal investigation, the cops still cannot do it. He's a DJPA, like all municipal police agent. Search can only be performed (legally speaking) by a judicial police agent or a judicial police officer, which are ranked above (and even there it's complicated). If the municipal cop had some reason to suspect the Jackal of crime, or to be a wanted fugitive, or anything that would require a search of the vehicle, he should have immedialty called in the gendarmerie or the national police before doing anything else. Searching alone, by himself, the trunk of a car that is involved in a minor accident is not standard practice and it make no sense whatsoever.

Par ailleurs, contrairement à l'agent de police judiciaire, l'APJA n'a pas le droit de rédiger de procès verbal, chose qui sera nécessaire pour matérialiser en procédure la perquisition, ce qui limite le rôle de l'APJA à l'apport d'une assistance matérielle à la réalisation de la fouille. Par ailleurs, dans le cas présent, on parle d'une perquisition sans assentiment express. Cela n'est réalisable que sur autorisation d'un magistrat, ou à l'initiative d'un OPJ en flagrance, qui doit être présent. Or l'APJA est seul et ne notifie nullement les services de la police ou de la gendarmerie nationale pour dépêcher un OPJ. Par ailleurs, la flagrance implique un crime ou un délit punit d'une peine d'emprisonnement. Or l'agent de police municipal, ici, intervient sur un accident matériel de la route. La seule infraction qu'il puisse relever au Chacal est un défaut de maîtrise, soit une contravention de classe 4. Et même si on avait affaire à un OPJ, même si on était bien sur une infraction ouvrant droit à une enquête de flagrance, au regard de la situation, quel est l'intérêt de fouiller le coffre? On ne procède pas à une perquisition juste pour le lol. Il faut avoir des raisons suffisante de penser que se trouve dans le coffre des éléments, traces ou indices liés à la commission de l'infraction. Or là, qu'est-ce qui relie le fait que Monsieur le Chacal rentre dans le fion du camion avec le contenu de son sac dans son coffre? Rien. On ne peut même pas parler du fait que le nom ou le véhicule ressortent comme étant recherchés puisque le policier municipal n'a pas accès aux fichiers correspondant et doit passer la gendarmerie ou la nationale. Et si il avait été informé avant que ce véhicule était recherché il aurait appelé des renforts bien avant de ne serait-ce que penser à une fouille du coffre. La scène en franchement stupide. Le Chacal pouvait simplement remplir le constat amiable avec de la merde, le conducteur du camion aurait été content et l'histoire en serait resté là.

Surprisingly, RE the legality of searching his vehicle like this, per France's Code de Procédure Pénale, a French officer needs a judge's search warrant with probable cause (a good solid reason like he thinks a specific crime took place). But the cop didn't conduct a search he asked the Jackal to open his boot...and to open the briefcase had the jackal refused to comply then the police officer would have had to contact the guard national to conduct a stop and sieze search much like how being asked to turn out your pockets isn't considered a search persay, had the Jackal refused then the officer would have had due reason to detain him and the guard national would have been called anyway so the jackal complied buying just a few seconds time while he formulated a plan to get out of the situation without drawing more attention from the police.
