I also question if the wife has any feelings towards OP, but she's the type I'm married to this man so I stay by his side & do what he wants, I know it's a bit of a stench, but there are those type of people, that if the made a commitment they stick to it, even if it's not what they want in the end.

@@zerobolt9506 Yeah if the brother wanted a child he could claim as 'his', then they should've gone to a fertility clinic and used a donor. Any guy that got his wife pregnant would have a parental claim on the child whether he knew it or not, unless he actually signed his rights away. Their marriage has nothing to do with the biological father's rights. It sounds like they used OP to get a baby for themselves without even consulting OP. I wonder if SIL actually took the plan b pill or if they lied and told OP that so he wouldn't ask questions. It didn't help that they were all high at the time and being idiots. OP has to choose between his rights as a father and the rest of his family. And even if he gets visitation he will still have to coparent with his brother and SIL.

This whole situation just REEKS of manipulation of OP. The brother is just okay with his brother sleeping with his wife? On a night that all three of them got drunk/high/whatever? And then did not get mad at his brother for knocking up his wife? Sure, he was fine with his brother fucking his wife, but a baby is a different story. And then the brother is keeping the baby to him and his wife and turning the family against his brother? No no, this doesnt add up. I'm betting money the brother has issues and they wanted a baby, a biological baby, and the brother was the next best thing. I believe the brother used OP and now that he has what he wants, since a nephew is as close to a son as possible, that's why the brother is adamant about the boy and his father not having a relationship. He is clearly not embarrassed about having this child, since he "explained" the situation to his parents to turn against OP. The brother is the most suspicious of all of this and the wife saying "she has to be on the brother's side"? I dont think the wife was fully on board with this or is starting to have second thoughts on all of this. Calling it now.

@@robertx8020 Not nearly as much as if they find out later. Keep in mind that babies don't have a standard for normal yet, they form that from experience with life. If you raise a kid with the fact that their uncle is their bio dad as an openly acknowledged fact that doesn't get associated with negative emotions, they'll just assume it's a perfectly normal situation to be in. And by the time they're realizing other people think it's strange, they'll already have their own view that this is just a normal thing for their family, and they're less likely to be bothered by other people's opinions. But if they treat it as a shameful secret or lie about it, then they're teaching the kid that this is something to be ashamed of.

Story 1: Wait wait wait so they all got fucked up, brother gave him permission to sleep with his wife, and then turned around and essentially punished him for doing something they BOTH (he and his wife) agreed he could do by keeping his child from him, all while calling him a "horrible and selfish brother" and now _suddenly_ they want to hand the baby off to him to watch him after treating him like utter shit? I get they were all drunk and that consent and stuff is a grey area during that but they're acting as if Op committed a damn crime when as far as we're aware, they were _all_ willing partipants. It almost feels like they used Op to get a child and are now shunning him in order to keep him from having any custody cause I can see them using "Well he hasn't been around like my Husband has 😌" as an excuse to take away any right he has to his kid. They're trying to act as if nothing happened as if there's not living, breathing proof that something _did_ happen, and that kid is gonna find out eventually whether it's because someone told him, he has a dna test done, or if he needs medical history from his dad's side. They can't keep this a secret forever and might as well accept that things aren't going to be the same and move the hell on. Im 99% sure that OP was used. No woman ever took a Plan B and not followed up with pregnancy tests. Also, why on earth they didn’t suggest condoms? No no no, not a chance. In relationships everyone (unless religious) uses contraception- pill or condoms are the most common. No way the woman was not on anything and was ‘fine’ having sex with OP. As I said…I’m almost completely sure they tricked him.

@@nikkiwhray1598 I doubt that relationship will last. SIL doesn't seem to agree with OPs brother about trying to freeze OP out and the brother has some real insecuries he hasn't worked through. That has the potential to kill the relationship on its own (but could be worked through), but with OP going down the legal route they can't hid from the situation like the brother wants to. If that relationship ends it may be possible to get the birth certificate amended and OPs brother becomes just another ex and the kids uncle, although I doubt that would go smoothly.

There is a HUGE difference between asking someone for advice vs expecting them to "handle" things for you. Had the bride-to-be explained the situation and asked her BIL for suggestions, he would've felt honored, and maybe even felt inclined to help her on his own. Instead, she treated her BIL like he wasn't part of her family, and needed to work for his seat at her wedding. I'd be surprised if her sister and BIL even attend after how she treated them.

Yeah... Just asking, and assuming there isn't a history of begging free labor, isn't an asshole move. Sister and BIL could've been less apoplectic and suggested alternatives. Assuming there *is* a history, their reaction is more understandable and may shed some light onto why the future in-laws disapprove of OP. P.S. A pair of my great-grandparents eloped because Great-Grandma's parents didn't approve of "that Irishman" sniffing around their daughter. Her parents even wrote their wills in such a way that their grandkids didn't get a *penny* until "that Irishman" *died.*

While I agree in theory... the reality is some one has to be in the same state to pay the day to day bills and things, and while there are ways to do it, OP doesn't live anywhere near them so he would either have to do it all remotely, or hire some one to come in and take care of G'ma which could ALSO steal from the estate as well. I don't know if OP can just up and move back home to take over care for how ever many years G'ma has left. Doing all the bills remotely CAN be done it's just a very big hassle, it's not like the "Single mom" has the cash to front the groceries and then email a receipt, pay for Gas for taking G'ma to the doc or on errands, pay for meds, etc. then again email the receipt. In theory they COULD order groceries on-line tell OP, then have OP go in and pay for them... but again it may be more hassle than its worth. Creating an account, and then just transferring the expected money needed that week/ month is ALSO a possibility, but won't cover emergencies (water heater went out / blew up lol) when the "single mom" doesn't have the funds to front those costs. And it won't stop the nephew from pulling this shit again when Sis turns her back (if that's what happened to start with). OP needs to sit down and have a very HARD and blunt convo with Sis that either this shit gets fixed NOW, and money starts flowing back into the account by X date, that she sends an accounting of where any money going forward has been spent on OR they are putting mom in a home, and selling the house and putting ALLLLLLLL proceeds from the sale of the house, her goods, etc. into an account that OP uses to pay the Nursing Home's bills each month. 14K in a year? That kid has either a drug problem, or a spending problem or BOTH.

Story 1: "the whole night is a bit of a blur". One night; OP's hammered; Plan B supposedly taken; brother steps right in and kicks OP out of his own kid's life. I'm not sure how that could be anything but a planned event. And possibly sexual assault. They all agree it will never happen again and that's it? There's no trouble between OP's brother and the wife? They go straight from messed-up night to well of course the brother is going to assume all parental rights and OP can't even hold his son? That doesn't sound even remotely likely if the event was as unplanned on the brother and wife's part as it was on OP's. The way OP relates the story sounds like he's used to letting brother call the shots, and isn't really seeing how messed-up the situation was from the get-go.

Had a friend in a similar position to the first story. She was in an abusive relationship and one day her boyfriends older brother went over for support after his fiancé left him. Her boyfriend got him high and drunk and pressured her into sleeping with him. Everything was fine then she found out she was pregnant. She got kicked out and the brother ended up taking her in since the baby was either his son or nephew. The boyfriend and brothers parents refused to get involved despite it being their grandchild either way. The baby ended up being the boyfriend but he refused to be involved and had his paternal rights revoked and the brother wanted a relationship with his nephew. She and the baby stayed with the brother and he ended up adopting the baby. They got married just before COVID hit. Despite the age difference and fucked up start of their relationship they have the healthiest and strongest relationship I’ve ever seen outside of fiction.

My parents got married in a church, but that's as fancy as it got. No engagement ring. No engagement party. No *bachelor* party. No rehearsal dinner. No reception. Mom made adjustments to Grandma's wedding dress so she wasn't tripping over the hem and Dad wore his Sunday best. Family and friends showed up at the church in whatever nice clothes they had. They paid whatever was required for the marriage license and the priest and that was about it. I think they might have bought a small bouquet, too. After the wedding, they went straight to finding an apartment (and a job, in Dad's case, as he'd lost his previous one shortly before the wedding).

1. What a messed up situation!! This is one of the worst I feel. OP could sue for visitation, but might end up having to pay child support also if he does. I get why OP feels the way he does, but this entire thing is so so messed up! 2. As a mom, I get why OP's sister doesn't want law enforcement involved. No one wants their kid to look at a potential jail sentence. But that was a lot of money he stole and there must be consequences for what he did or he will do it again, and worse.

2: I suppose, though my parents always said they wouldn't bail us out if we got in trouble with the law. They'd still love us, but if we screwed up, we'd face the consequences. Sorry not sorry Story 3: it would be a completely different story if it's the first time and you were like "I am so sorry. I am very anxious of the situation. I can bake you your favourite snacks for a year because I am financially unable to pay for security. Don't even bother with a present. This will be enough for me. I would appreciate it so much." Story 3: YTA because I think there is a LOT of information missing and that info won't make OP look good. Why do I say this? Because of the reaction OP got. Even writing this showing herself as best or as neutral as possible, she added enough to let us know that this wasn't a one time thing. A single request wouldn't prompt anger and a comment like " stop expecting him to do whatever you want just because you're bold enough to ask." That comment says that OP has a history of attempting to use the BIL in ways that they are sick of. And then after being told no, she uninvited them? They aren't obligated to help her and uninviting him simply for refusing to work for no pay is a massive asshole move. I think OP is a "missing-missing reasons" person. She has nO iDeA why her inlaws hate and "fOr sOmE rEAsOn" the room went radio silent after she tries to manipulate her brother in law into.providing private security because she hAs nO mOnEY aNd hEr iN-lAwS aRe hoRrIBLe Edit: mark made a good point. Not all police forces allow officers to moonlight. That request could have been so far beyond the pale that doing so would lose him his job. And that's on top of the "what if something happened" question. Off duty cops still have to act a specific way in a lot of situations as part of their job. This is a mess.

If OP is right and the in-laws really are bat shit crazy though, I suspect there will be radio silence for entirely different reasons if they ever insert themselves into OP's family's lives. At that point they will be forced to suck it up to save face or apologize to OP for being dismissive and minimalizing the concerns OP was trying to get them to take seriously.

Another great video Story 1: OP had every right to not look after his kid. Cause they’re just using him, and that hurts emotionally for him. I’m glad he’s going to fight to be in his kids life legally. You know they willl just use him again. Also this will be good if brother and SIL ever breakup.

It’s more than possible for this to be open thanks to everyone behaving like adults and keeping any mess away from the kid. The only thing screwing up his life is the crappy wife and brother wanting to make it a huge fight instead of acting mature.

Story 1: It does sound like they used him to purposefully get pregnant. Since they didn't actually discuss that with him and mutually agree to it you could call this reproductive coersion. He may have a better chance in court than he thinks. Story 2: Stealing from his own grandma. Wow that's trashy. My opinion is, if a minor knows they need to hide a questionable activity or they'll get in trouble, they know it's wrong and knew they shouldn't be doing that. He should indeed have to sell back everything he bought and work to make up whatever difference is left. I can't help but wonder how mother didn't notice such a large sum of items turn up in her home. Are we sure she wasn't in on it?

S1: Yeah that's a no from me, dawg. Also, sue for partial custody. It is your kid and they don't have a right to keep him from you (but expect you to be an on-demand, free babysitter when they need it). That said, it gives me a very petty sense of pleasure how much they must have hated to ask you at all, because that would give you time with your son. "My brother told me to stop being petty about what happened." You mean like they are being towards you? I could see them using OP as a patsy surrogate for them. It's just too much of a coincidence that SIL happens to get pregnant at that time, and decided to keep the baby. If husband was not OK with OP being in the child's life, why would he be OK with wife keeping Op's baby? It sounds sus. S2: I found it bizarre BIL was so "offended" at being asked to be security, especially being he's a cop. If my family had wacky in-laws threatening to crash and cause drama, I'd be happy to play the heavy. That's what you do for the people you love.

Story 2: NTA. When I first got an iPod (for Christmas when I was 12) I went a little crazy on iTunes and spent around a £100 on my mother’s credit card. I felt so guilty after realising how much I spent and immediately came clean to my mother. Which leads to this. Put the name on the police report. Seriously 100%. My mother punishing me for overspending on iTunes worked for me because I already knew I had done something wrong and felt guilty for it. OP’s nephew clearly doesn’t (because he took money multiple times and lied about where it was coming from) and also took a lot more money so the punishment needs to scale up to fit the crime.

First Story - ESH This should have never happened. OP should have never agreed to sleep with the wife. There is only so much alcohol and drugs can excuse wanting to do something this messed up. And when OP finds out wife if pregnant-he needed to have fought for his rights then and there. The real loser is the poor child for having these three idiots as their parents.

That last story. It probably would have been fine if he’d explained to his BiL what problems and concerns they had and their lack of budget and asked him if he had any ideas or suggestions. It shows respect and gives the BiL the opportunity to either volunteer himself willingly or propose a different solution. Rather than straight up telling him I need you to do this and then doubling down and telling him he can’t come when he refuses to do it. It really illustrates the importance of considering how you verbally approach someone about doing something. But like also, do they not have any bride/groomsmen? There’s been stories where some of the wedding party offered to step in and make sure certain undesirable guests couldn’t make it in to cause problems and since there’s more of them they can coordinate it so it’s not a full time job keeping any one of them from participating in and/or attending and enjoying the wedding and reception.

My BIL acted as unofficial security at my mom's funeral and my brother's wedding because of a crazy family member. He chose to. Frankly, all of us were watching the crowd, but he was the biggest and a good person to deal with crazy. Fortunately, the crazy didn't show up to either event.

I saw something on french news recently that sounded a lot like story 2 and basically the adult that committed credit card theft (cus that's what this is, could also be considered fraud under some circumstances) had to pay the money back on top of a 2000€ fine and 2 years of probation. And ofc that ended up on his credit record and his juidicial record meaning finding a home, a job or getting a loan will be extra difficult going forward. idk how similar the legislation is in the US but if it's similar, nephew should be thankful that this is happening when he's a minor, meaning his criminal record is essentially whipped off when he turns 18

#2 - How bad a parent is OP's sister in that she had no clue how much her son was earning, how many hours he was 'working' (btw, where was he going and for how long?), how he was cashing his paychecks, etc? Seems like she dropped a really huge ball there and OP filing a police report should get them both on track here - she needs to verify what this kid is telling her he is doing 24/7 for at least the next six months, and make sure he gets a job and drive him to and from. No one is doing him any favors by just 'taking it out of what he would get'. Not one bit.

The SIL that asked her BIL to act as security at her wedding reminded me of an incident at a birthday party. Here in Hawaii we have a big problem with flies when we have cookouts. I was invited to the birthday party of my find’s toddler. Within a few minutes of me arriving, his wife came up to me and gave me a fly swatter, then asked that I stand at the food table and keep the flies away. I did it for about thirty minutes, then said I wasn’t feeling well and needed to leave. A few months later I was invited to a backyard Luau at a another couple of friends place. Shortly after I arrived the wife approached me with a large palm leaf, and asked me to stand at the buffet table and keep the flies away.

Story 2: Mark, to answer your question, yes there is a time-limit to which a crime can be pursued as a criminal act. In the US (and other places) it's call a Statue of Limitations. However, the time limit varies depending on the type of crime...for most crimes it's anywhere between 3-7yrs, though in the US the definitive amount of time can vary from state to state. For financial crimes like this (over $5,000) I believe it is generally 7 years before it can no longer be criminally pursued. (Civil prosecution is another beast unto itself. Laws about civil suits are beyond my knowledge set.) The only crime I'm aware of that does not have a time limitation to pursue it as a criminal act is homicide. OP's lawyer undoubtedly knows what the Statue of Limitations for this crime is and is advising them accordingly. It's my understanding that many other countries have similar laws about such time-limits, though I'm most familiar with the US laws. Story 1: The more of the story I heard, the more it seemed like a set up, as others have mentioned. Why else would they be so entirely against OP having ANY contact with the child instead of insisting he can only be an Uncle? If OP can establish any measure of relationship it would be much easier for him to gain any measure of custody. Additionally, he might want to discuss the possibility of reproductive coercion with his attorney. If they can find any records of infertility problems from his brother they may have greater strength to his case. Story 3: I'm starting to get the feeling that it's not the FPIL that are the actual problem...and maybe they have a point.

Story 3 she definitely went about this the wrong way. First off she should have taken on extra hours at work so she could at least pay $17 an hour for 6 hours (which would only be a little over a hundred bucks) that way she could actually hire a bouncer or an off-duty police officer or something and then throw in free food and alcohol and let them know they don't have to stand at the door the whole time that they can hang out and socialize they just got to keep an eye on the door. I think it's incredibly entitled when you want anyone to work for free. Basically hers is the equivalent of wanting free art from an artist. She should have just asked her brother-in-law if he knew anyone who would be willing to do it or how she would go about finding someone to do it. I do think it's entitled to expect him (or anyone) to play bouncer FOR FREE and then threaten to not invite him if he doesn't want to.

It wouldn't be on just one and, on the off chance there was an issue, it would be easier to contain. She should have considered that an option instead of trying to pressure one with idle threats.

Story 2: I also get the feeling she's feels entitlement toward the BIL. In that situation I could see talking to him beforehand and setting it up so that a couple of other people in on the issue could be on the lookout and ask if BIL would mind stepping in if necessary, but that depends entirely on the relationship between them. (Some families are more willing to pitch in for each other than others, don't come for me lol!) Sounds like theirs isn't solid enough to ask that kind of favor. There's more to this story with the in-laws too.

I had the day off work. No one told me. No one offered to pay. I bowed out saying we had a family emergency.

*Mark, You are right about Story 3, see below* 👇 *Story 1:* I wasn't totally on board with the whole conspiracy of the pregnancy until this gem of a portion: My family was on his side about it and told me to stop being selfish because on paper this is his child (since they’re married) and if I’m around it’s going to complicate their marriage even more. The whole time I tried to convince them my parents would say I’m a horrible younger brother. Why do people think kids are gonna fix their marriage problems? 🙄 I wonder if the older brother is genuinely even in on it? It seems like everyone else is but him and OP. But that would make SIL some diabolical mastermind, the brother willing to be cucked (he seems in genuine denial to me), and OP's parents willing to be in on it. I don't think anyone else knows. If they let him sue for custody, everyone is going to know. They should have agreed to a visitation schedule. 🙃 Now the courts are gonna get involved and everyone is gonna know. Jerry! Jerry! Jerry! ESH except OP, I think he got taken for a ride and I feel bad for him... *Story 2:* Statute of limitations varies by state. What Reddit is trying to suggest is essentially a pseudo probationary stipulations and while that would be cool if they could do that - that would mean reporting the crime and the nephew. If they don't report it and the nephew, basically saying "work, pay me the money you owe me or I report the bad thing you did" is... Extortion. 😅 Solve it outside or sue, or report the kid. Fun family. *Story 3:* In the US it is a security license called a D License and with an armed guard, a G License. I want to assume this lady is panicking and not thinking. In her shoes I would have asked Cop BIL his advice for security and to recommend a firm. If I was that concerned, ate the costs or asked someone for help regarding said costs... And a payment plan, written and agreed upon. I would have definitely asked BIL to be my "guardian angel" if things got bad - that's the phrasing, that's it. BIL and sister could interpret that as they please, and yes I am appealing to their ego, yes it is purposefully manipulative, but that's as far as I would go, and that's as far as I feels.

Story 2: To answer your question about the name on the report, it doesn't really matter. Giving the kid's name would expedite the process, but filing a report means they will have to investigate and will eventually find out anyway. That amount of money is typically considered a felony, so him being a minor may not factor in to the severity of the punishment, and OP may not get a choice about whether to press charges or not. There are statutes of limitations for a lot of crimes, meaning that if someone commits a crime, you only have so much time to press charges (typically a few years). If the statute runs out before you charge someone, even if you know for a fact they are guilty, there's nothing you can do. But this is purely from a US standpoint, and sometimes it can vary from state to state how long the limits are or which crimes even have limits (outside of murder, no limit on something that serious). So, long explanation short, giving the cops his name or not shouldn't make much difference.

Story 1: I have to agree with a lot of other people. It seems like it was planned. If it was planned that means they intended to get him drunk and stoned, and have sex with him. That means he was raped by his SIL and brother. As for getting paternal rights, he was probably out of luck there, too. In many jurisdictions the law automatically assumes that the person married to the mother is the father of any child born in wedlock. There are all kinds of stories out there about men trying to get parental rights over their children and not being able to despite DNA evidence.

Story 1: A lot of people think this is a setup. It could be, but Occam's Razor says it is not. Now imagine being the OP's brother. Since the OP decided to pursue the legal rights, the kid isn't OP's brother's kid by any standards anymore. He is basically in a situation where he has to leave his wife because the OP can't let things be. If the OP truly cared about the kid he would not interfere. However, he cares more about _his_ feelings than the kid or the rest of the family.

Story 2: not only is 16 old enough to know not to steal, but this was a systematic theft over months and months, not a one time "maybe I'll never get caught" sort of lapse of judgment. The fact that he stole so regularly and that it was over $14K!!! I mean, gimme a break. This kid has no conscience to do something like that. And the mom is worried a police report could hurt his college outlook and ruin his future? Letting him get away with something like this could lead him to think that this sort of behavior is acceptable, which would not only ruin other people's lives, but also his own if (WHEN) he was caught and punished for it.

My question is that for story 1… if the brother and SIL had just let him BE an uncle and spend time with the child and not blocked him at every possible chance… would they even be in this situation? I'm guessing the reason they left his name off the police report is so that he wasn't immediately thrown under the bus. They reported it to the police and they'll do the investigation and find him out eventually, I believe this is why.

I think that's exactly it. The brother had fertility issues, so they came up with this little plan. It's quite a lot like the Bible story of Lots daughters. As far as the second story goes that's b*******. My 13-year-old knows better and has known better for years. You either teach your kids right and wrong or you don't.
