If one nation state launches an attack against another nation state, it could be held that logically, a the aggressor state had entered a state of war, irrespective of whether or not the nation state attacked retaliates. As such, any American participating in a specific conspiracy to launch that attack could be charged with Treason. In addition to that, there are still a lot of unanswered questions about Flynn's conspiracy with the Turks to commit aggravated kidnapping against a US resident in exchange for $15M. Those activities began prior to the campaign, continued into the campaign, and Trump recently was "looking into finding a way around US law" to use his official capacity to effect the same result, delivering a enemy of the Turks into their hands, in contravention of US policy, for extra judicial incarceration or execution. Some dots would still have to be connected, but not many. It's very unlikely, but not impossible that Donald could swing. It's almost a lock that he will get a Manafort-style death sentence.
