We did subpoenas when we sued the school district in the special education courts. Nobody showed up but it made our case look stronger as we had checked off all these boxes on what we tried to do. We actually did have some people show up on the subpoenas. The judge originally thought that they were there because the school district had them show up but no it was us. The judge was very surprised and with the other information told the district to go out and settle with us because it wasn't going to go well for them. And that's how we sued and forced two school districts to settle with us over the educational needs of our children.

I used to work in an ER. We would get subpoenas for patients that police brought in for blood work because they were arrested for drunk driving. The subpoenas would just be posted on a board. None of us ever checked the board because we didn’t want to go to court when we were normally sleeping.

I'm in Australia, the best your going to get from ANY court that issues a subpeona is for you to give testimony via video link because travelling in person to that particular court is overly burdensome.

It depends over here, if you're the defendant and you get subpoenaed, you have to show up or at least send a lawyer so you don't lose the case exparte. However, if a court closer to you is available then the people suing you will have to accommodate you and travel to that court. As a witness, it's entirely up to you whether you show up or not. There are a few exceptions where they can force you to show up, but in that case the police will come and pick you up. I've inconvenienced the lawyer of a municipality some 200km from here by requesting the hearing to take place in my home town. Sadly for said lawyer the court scheduled the hearing for 9 o'clock so he had to drive for 3+ hours through morning rush hour. The municipality lost the case, and appealed. Which I again had moved to the closest court near me. Which was about an hour drive north for me. The poor lawyer had to be there at 9 in the morning again and spent almost 3.5 hours in traffic just to get there. In the end I won the appeal on the same grounds that I won the initial trial. It being that the enforcement officer who had ticketed me, technically didn't have a mandate because the way they had set that up was unconstitutional. The appeals court then took it a step further and required the municipality to retroactively reimburse all parking tickets issued since they had changed the way mandate was given. It cost them hundreds of thousands of euros.

It is hard to enforce subpoenas locally, too. Generally, if I am trying a case, I am not going to have the bandwidth and manpower for an entertaining side quest to enforce a subpoena through contempt proceedings and few clients want to pay for such a side quest.

When i worked security, my boss told me that I singlehandedly acceued more subpoenas in a year than the entire rest of the company in the last five years put together. Twenty-plus trespassing, eight vehicular colisions, five B&E, two assaults, and one DUI. I was prepared to go to court for every single one of them, only actually went to court for a handful of them. That DUI case was annoying though. The defense filed six continuances. I was paid for my time by my company, but still annoying AF.

This is the kind of information that really should be explained in school. In fact, it used to be explained in (US) schools up until the 1950's or 1960's, in the courses on civics and government., where children were taught what government does, how it works, what the government does for you the people, and what you the people are expected to do in return (jury duty, answering subpoenas, etc.). Those courses also helped people practice their discussion and debating technique, learn critical thinking skills, and learn how to function as a member of a diverse community. Sounds like we could do with re-introducing those courses.

I was a witness to a very bad car wreck with multiple severe injuries and I ended up working it as a volunteer fire fighter. I was also immediately behind the vehicle at fault for the wreck. I gave a verbal and written description to the deputy that was in charge of the investigation. This was in Colorado a couple months after 9/11. I moved to Arizona a couple months later because of the economy. About 6 months after that, I get a call from an attorney that represented the plaintiff (not at fault driver). They recorded my statement over the phone which pretty much matched the written statement I had given on the day of the accident. The attorney offered to fly me up and get a rental for me to drive the 5 hours from Denver. I opted to drive up since I was only a 9 hour drive. By the time I flew from Phoenix and drove down to Pagosa Springs, I could drive it. So my wife and I drove up. It was September and beautiful. I only wish I had time to do some archery hunting at the time. Anyway I testified and got to spend a long weekend with my mom and her long time partner. I also was able to get my dog that I had left behind when I first moved to Arizona. I even was able to get fresh roasted hatch chilies. I was so glad I drove up instead of flew.

Genuinely it is, until you find out certain courts use Microsoft teams, other courts use zoom, others Google duo etc...., well for the state/local courts it would probably be like that. you might be able to get the federal courts to agree to one standard. But I would be in favor of anything that makes it easier for witnesses to testify, give depositions etc..

Not in my country, no matter where you are once a subpoena is served on you, you have to show up. But of course discussions must have gone ahead between the party being subpoenaed and the party asking the court to issue said subpoena. The court doesn't issue subpoenas suo moto! I believe its cause we have an adjudicatory system and not an inquisitorial system. The court would be seen as descending into the arena if it issues a subpoena suo moto.

This is the case in most countries, however US is a federal republic, where all non-federal cases are judged by local state courts, which technically have no power outside their jurisdiction. There are still federal laws and agreements between states, that bridge the gap between states (by requiring you to pay a fine you got in a state you no longer in, for example), but on the base level some court from California can’t command what a New York resident should do.

@@whitestripe484 oh I see. My country is a federal republic as well. However, the court is seen as one across all states. The hierarchy of the court is also the same across all states. So, if subject to the rules of court, you file a suit outside the jurisdiction of the Defendant(s) or even just one of the Defendants, the Defendant(s) has no choice than to make an appearance if not judgement would be entered against him on the evidence of only the Claimant/Plaintiff. Likewise, if a subpoena is served on you, even though you are outside the jurisdiction of the court and so far there is proof that you received said subpoena, if you fail to attend court on the date slated for hearing, contempt proceedings may be brought against you. However, as I pointed out earlier, the party praying the court to issue a subpoena against an individual must have first discussed with said person and made arrangements on how to get the person to court venue on the date slatted for hearing. It would be unwise to subpoen someone outside the court's jurisdiction because it would tell on the finances of the person calling said witness. Also, you wouldn't ask for a subpoena to be issued to call a witness whose evidence would be adverse to your case. I'm sure that goes without saying. I must say this though, I like the method of the US judicial system, because if it isn't convenient for me, then I don't want to or have to stress about it.

@@deborahi910 each court here only has jurisdiction over a certain part of the country except the US Supreme Court. Each federal district Court has jurisdiction over certain states or certain parts of states. Then above them there are appeals courts that have jurisdiction over set districts. Then after them is the Supreme Court. Then our states have their own laws, which are again enforced under certain judicial districts and then appeals districts and a state Supreme Court. The US is a big country. Most countries in the world are only as big as one US state.

In Montana, we give the server a check made out to the witness to cover witness fee and mileage to and from location. If the witness asks for payment and server doesn't have it, the subpoena can lawfully be refused. If they don't ask, the server returns our check and we shred it.

In Massachusetts, if it's a civil judgment, the sheriff can arrest them on a warrant for nonpayment if you pay them to. They can give an order to appear for say $40 but to arrest its $400. They must be in county of the warrant and you need to know when and where they will be at. At least this was my experience in both my divorce where my ex skipped state and never paid any of things set forth in my judgment and a ex friend who stole money and items from me that she owed me for according to my judgement. Sadly I couldn't press criminal charges on her because of a few reasons including no physical proof she took the money and items regardless of the fact she admitted it to others.

What legal authority does a state judge even have to compell a witness to show up from another state? If I live in Virginia, and a California state judge/lawyer says i have to be there, what is the enforcement mechanism? The whole concept feels broken as hell. By the same logic, a cop from another Virginia could arrest someone for lane splitting in California (where it's legal) when the cop and the person arrested were both in Florida. At that point, there is no truth to local government whatsoever. Not that judges line to be told there are limits on their power. Or that "your honor" is uncomfortably close to the kinds of titles that the Construction explicitly bans

A co-worker of mine got called to be a witness in some trail for a former sheriff whose accused of taking bribes (often forcefully) in Bartow County GA and he came in to work ranting about how he wasn't going to go cause the guy will re-elected anyway (rural northwest Georgia is super corrupt take it from someone who lives here) and he didn't want to get on the shit list of a corrupt sheriff. They never forced him to come but to be fair this guy would be the definition of a hostile witness.

So what do you do when you show up to court at the day and time stated on the subpoena only to find out the trial was rescheduled for the next day and nobody told you? About 18 years ago I called the police to report an abandoned vehicle in the middle of the road at about 11pm. Smack in the middle of the road. It was a neighborhood road behind the apartment I was in. I didn't see anyone in or around this van. A couple of months later I received a subpoena from the defense lawyer. Guy was passed out drunk somewhere in the van and claimed his friends drove him there and ditched him. He had been charged with DUI. They basically wanted me to testify at trial that I didn't see him driving the van. So when the trial came, I took the day off work and went to the courthouse. I couldn't find the case on the docket for the day. I called the lawyer and he told me that the judge had to reschedule the trial for the following day, or maybe the next week. I don't remember. They never called me to let me know. I was pissed. Took another day off to show up to testify. The guy was acquitted, largely based on my testimony. But yeah, I showed up on the day and at the time stated on the subpoena, only to find out it had been rescheduled and the lawyer didn't have the courtesy to let me know ahead of time.

Getting the subpoena was quite the experience too. It was about 9:00 pm (well after dark) and I got a call from an unknown number. They guy asked me my name and I confirmed. He then asked if I was home and I hesitantly confirmed. I asked who he was and he only said he would be there in a minute. I didn't have a clue what was happening, but sure enough there was a knock on my door a minute or two later. I grabbed my Glock before opening the door. The guy again asked my name, handed me an envelope, and said, "You've been subpoenaed." He then turned and walked away without another word. There was of course a phone number on the paperwork for the lawyer so I could call him and ask questions.

It's simply a witness who is testifying against the party that called them. The difference is that you can ask them leading questions like you would under cross-examination. As far as I understand you need permission from the court to treat the witness as hostile. If they work for the opposing party, for example, it might be easy, otherwise you'd have to demonstrate through an initial set of questions that the witness is antagonistic to your side. IANAL

I got a subpoena to provide all of my company's information related to a client we'd been doing business with since the 1950s. That's a lot of emails, receipts, letters and memos. Our lawyers told us to provide everything that was requested in boxes but make no effort to organize them. After tallying all the boxes, we rented two U-Haul trucks to drive 200 boxes of memos, letters and receipts to the lawyers who had subpoenaed this stuff. We even added files that weren't directly related, but had been filed under the same monthly folder. It was the perfect opportunity to bury a lawyer behind a nuisance suit with a truckload of papers while also clearing out our own records department.

You'd have to be providing significantly valuable information to justify the costs, and it wouldn't be the court footing the bill. They aren't going to pay all that for a testimony in a case worth 10 grand, or even 100. And they're going to explore every single alternative avenue before even considering paying such a thing.

However, you CAN subpoena a witness to a local courthouse and have them testify remotely. If the courthouse is local, yes, they have to go.

No, at least not under the federal rules you can’t. Otherwise, I would not be going to Detroit - I would just have the witnesses appear via zoom, but I can’t do that.
