I'm going through that right now. Social Security claims that they overpaid me by over $5000 and is demanding repayment. I wondered how on earth they arrived at such a ridiculously high amount of overpayment. I took the SS letters to a caseworker and she was shocked. She also wondered how this had happened. She read one of the letters and saw that the most recent period in which SS claimed I was overpaid was from January 2022 to June 2022. The caseworker put the letter down on her desk. She looked up and told me to look to where she was pointing on the paper. I looked and then the caseworker said here it says that the amount of your SSI in January 2022 was this much, right? I replied yes, and she asked was it the same amount for each month from January 2022 to June 2022. I said yes. The caseworker said that it looked like SS had taken the amount of SSI in January 2022 and multiplied it by six(the number of months) and that adds up to a little over $5000. That sounds fishy, I said. The caseworker agreed, but it was an awful challenge.

When I went to the DMV to deal with my stolen plates (after a police report) they kept making mistake after mistake while issuing me a new registration and plates. Only to then not do anything about the stolen plate which the Dept of Finance, also black people, is now hounding me for violations despite clear proof of me not being the operator and that it was stolen.

The first one got a check suddenly clawed back months later the 2nd one needs their taxes done for years but IRL SS wont present those forms yo do that or update address who knows where or who to they're sending anything or if they're going to be clawed back too. And SS is calculated and taxable. Lots of kids had SS because of parent death, shouldn't that be standard process too? Seems like the IRS could demand that any death related SS stuff be completed by them within tax a year

We had this happen but made many calls until they fixed it. They did take our SS away for a few months so we lost our car and had to borrow money for our rent. It took us a few months to get it sorted out. The thing with us is they had my hubby making 10,000.00 in one month which would be impossible so it was their mess up, not ours.

Most people don’t report their correct wages or lie about being married so SSA don’t take their spouse income into account for their SSI benefits. Then when the SSA finds out years later that she was married this whole time. They’ll backdate her husbands wages to her account and poof she owes 28k of money she wasn’t entitled to

Most of the calculations done by SSA is done by computers with data the customers provide. So you can’t fault SSA if they weren’t give the correct info to begin with. By the time IRS earnings are posted it is already almost two years down the line and now SSA realize that they didn’t qualify. The biggest thing is people not reporting their Robin Hood accounts. They don’t realize that even tho they lie when they apply for benefits. IRS always find them at the end

Don't believe you owe any amount the SSA tells you to pay. The SSA offices that spew out those letters do not know the SSA rules & regulations or simple arithmetic. The SSA actually overpaid me, but by far less than they demanded I repay. In my 10-year ordeal I got multiple SSA demand letters (5++) telling me I owed amounts as high as $61,000. Every subsequent letter demanded some lesser amount to correct calculations. After the THIRD hearing the administrative law judge ruled I'd been overpaid only $38,211. She advised the SSA Payment Debt Center (who spews out these demand letters) that the $38,211 did not include any credits for the US Treasury seized from my benefits for 25 months. Nevertheless, after the judge's $38,211 ruling, the SSA sent me another demand to repay $99,000, not the $38,211 less benefits withheld. Ultimately, the SSA owed me by their seizure of more benefits than I owed. Untrained staff with zero common sense. Bottom Line - The SSA in all likelihood overstated what you owe by thou$and$.

State of Indiana errored and 3 years after I retired they inform me they had over paid me $5500 in retirement benefits. They said either i pay it back in a lump sum or they would start taking a set amount out each month until it was paid back. NOT my fault but they win. They will be several month getting their money back...LOL. Thank God I have a nice retire income otherwise.

This happened to me about year or so again. I got a 2nd check. I thought it was weird because I didnt get any info from them that they were sending me another check. So I called and question them about it. They told me its ok. Its not a mistake. So I gave it to my homeless sister so she could live another month in a motel. About 3 or so weeks they sent me a bill for the amount of the check. They wanted it back. So I told them i have to make payments. They wanted $100 month. I said no. $50. Then about a year after, they sent me some info where during the past year there were times they over paid me and times they under paid me. WHAT? This is SS. How did this happen. Over. Under. But the great news is the payment they were taking out of disability check was stopped because of there mix up ,made up for what I owed. I still dont understand how this happened. Some months were over payment and some under paid. How does this happen. And it happened in a whole year.

Well, the bottom line is that how would they know if what they get from SS is incorrect? Unless there is a sudden jump in payment maybe a good indicator. But if you have been getting the same since day 1, there is no way to calculate / confirm your actual benefits.

Any recipient of an SSA demand for payment letter has 60 days to file a Form SSA-561 Request for Reconsideration (RfR), so ignore the letter's statement "You should refund this overpayment of $X,xxx within 30 days". That is standard misleading language in this SSA form letter. The same SSA debt payment center that issued the demand for payment will review the RfR, which is an obvious conflict of interest. Your RfR will be routinely denied. That would force the SSA Debt Payment Center to admit they made an error. After that RfR denial, file a SSA Form HA-501 | Request For Hearing By Administrative Law Judge. I've requested three hearings since 2013. It takes well over a year after requesting the hearing before the hearing occurred, and that happened three times. Fight these demand letters the SSA spews out without providing any documentation of their calculations. Don't just give in an pay. File the RfR and file the Request for Hearing.

My daughter is 19 years old and lives with me. I am on social security and disabled.She received a small benefit each month on a direct express card until she finished high school. Her dad died a year ago and social security gave her a death benefit. Shortly after that social security sent a letter in the mail asking for almost all the money back saying they overpaid her. They wanted her to explain why she couldn’t payback the money and why this wasn’t her fault. I think this is terrible! I am sick with my heart and really bad arthritis and her dad passed away. What a kick in the face.

Just a caution….it’s a team sport. Users need help. Letters have to go as Certified mail, they'll say they didn’t get the request in the allotted 60 days. Certificate of Mailing is $1.95, but needs a post office visit. With the certified tag and proper postage…$4.35 plus the .66 cents for envelope,can be given to letter carrier or put in letter box. Personal knowledge with a relative….they tried to lose her with whining about being understaffed.

I had the opposite experience. I've been UNDERpaid since Republicans took the majority in Congress and cut disability and even reduced ADA protections. I had to give up my place to live, too, since $600 a month doesn't pay rent. I've tried working, but employers keep saying my disability is beyond what they can accommodate, and the law doesn't require accommodation like it used to, due to the Republicans who limited the ADA. Last year I finally won the case to get my missing money. They have NOT paid it back to me yet. They said they have so many underpaid people that the Social Security office employees are having to work Saturdays to catch up and get everyone their accurate amount back. But it's been nearly a year and I still don't have mine back. They won't catch up with their own backlog, yet they want a woman to pay them $130,000 in 30 days. The Republicans just want us disabled people to die as soon as they can get us out of the way.

SSA cannot possibly demonstrate their calculations are accurate. SSA refused at least 5 times to provide me the data showing how they determined my overpayment. The SSA clearly does not accurately calculate overpayments based on SSA or simple arithmetic laws. SSA sent me many demand letters, each saying I owed a different amount ($61,000; $55,100; $51,500; an amount in the $40,000). 19 days after an administrative Law Judge ruled I had been overpaid $38,211, the same SSA Kansas City Debt Payment Center sent me another letter demanding that I pay $99,490. After pointing out egregious errors obvious to a third-grader, the SSA paid me $13,300 for amounts they over-withheld. SSA cannot possibly back their claims of accurate calculations when the spew out guesstimates like mine that wildly vary.

@@datbio7302 SSA can spew out a letter saying you owe $56,701, provide no details, ignore all FOIA requests for documents, and refuse to show how they arrived at that number. The appeals process is a classic bureaucratic circle jerk: (1) person told to pay up must send Request for Reconsideration (RfR) form to the same office demanding payment, where the same people who say you owe that much simply rubber stamp their original payment deman letter, saying it's valid. Form allows you to request face-to-face meeting, but SSA ignores that. They've never met or attempted to meet with me in person on any of 4+ RfR. (2) Next, request hearing before an administrative law judge {ALJ} (3) wait 1-3 years for the hearing (4) ALJ either rubber stamps what SSA claims your owe and advises sender of the original letter to collect that amount. Even if ALJ says you only owe $27,000 [giving no reason], original office is free to send you another letter ignoring the ALJ's decision, and demand you pay any undocumented guesstimate of what you owe. If you don't pay, SSA can just withhold SSA benefits and tax refunds.

WEP or GPO, Federal government workers, including postal workers, who were hired before 1983 didn't pay social security taxes. Instead, these workers paid into the Civil Service Retirement System (CSRS), a different benefits program. Workers who decided to stay in CSRS after 1983 are not eligible to collect Social Security benefits.

This is happening to me now. Have two children on SSI. I report my wages monthly and ensure I do everything correctly. I received a letter stating I was over paid for my children. 6k for each child over the course of a year. The form they sent shows the amounts they supposedly deposited. It’s not the correct amount. One example is, for May they say my kids each received 844, but they really only received 152 and I have the bank statement to show it. Then the months where the benefits are reflected accurately, they said my kids were supposed to get 0.00. This is false as well. I am on salary and my kids payments do not change. I am currently getting my documents ready (bank statements, stubs) and I hope they admit their mistake because I am panicking.

Overpayment real or false has become fashion, style, and culture of SSA. I experience a false claim of overpayment by SSA and proved them wrong. Employees of SSA probably gets promotion if they create problem of overpayment.

This could be avoided in both Canada and the USA (I get SS and SI from both countries) if that fund was ONLY used for those who worked for their retirement check (cheque in Canada) and disability and other programs came out of general revenue. That way if you're overpaid you know damn well you're getting too much in your account. This is an account EARNED for revenue, not welfare.

SSI is taken from the general fund but our paychecks from work have a separate Social Security tax that goes into that account. SSDI, Survivors and Retirement are insurance.

This happened to my mom. She verified MULTIPLE times that the amount had been correct, and they garnished over a year. It almost happened to me but I revealed the “overpayment” that wasn’t actually one was due to a bank error that put my mom’s assets as my own.

All these SSA overpayment stories I'm seeing on KZbin are hitting in the last couple of months. There seems to be a sharp rise in interest in this problem on the media's side. This egregious bookkeeping seem to be unrelated to the other SSA issues we're dealing with, it's just badly run and not actually properly tracking the incomes of people collecting.

It's mostly the agency's fault. According to SSA, _“The beneficiary or third-party provided the information we requested, but we failed to use the data/information to validate accuracy prior to making a payment,”_ the agency reported.

If you are under age 67 and make over $22,500 a year you have to reimburse S.S. $1 for every $2 you go over. That is if you make $32,500 a year you will owe S.S.$10,000 / 2. However, you could make payment arrangements up to 36 months ahead. However, by the time the request gets into their dated / slow computer systems, you will have already paid the overpayment back.

Congress is so busy with their assets, they come to work to tend to their portfolio…they don’t know this is going on. It’s up to us to give them the truth of what is going on. It costs nothing to email them, your two senators and one Congressmember. You should have their webpage on your desktop. You can letter mail any of the 535, but online contact is only your three…..oh, how many adults in your household? We should be highly suspicious of this. You are either Full Retirement Age or not. You are employed or not, you have spousal or not. If I answered truthfully, in writing, if there’s a mistake….it’s on you. Be suspicious….too backlogged…oh, but let’s try this.

I was not able to collect my Railroad Benefits at all (money that I paid into it) I also seen where some recipient's were criminally charged .So the ones that had their money clawed back better be thankful they are not going to jail on top of losing their money. NOTE: I have also seen reports that the Railroad Retirement Board spent a quarter of a million dollars on ammunition ? Why does a Retirement Board need ammo ?
