So glad to hear this information. I’m 58 and engaged but was married previously to my ex spouse for 34 yrs. His earning was 3 times more than mine. So important to know.

@@Dolphinfinancialgroupfl Omg! I'm so thankful I came across this. My question is: My ex-husband passed away four years ago. I did not know he had passed away. We were married for over ten years, I got married again at the age of 65, I’m still married. Will I still be entitled for survivors social security benefits and Will I get the retroactive back pay for the four years I didn’t apply for years after he been gone for four years. I hope I’m making sense… I live in the state of California.

@@foreveryours7464 it sounds like you have a claim for Survivor Benefits. Remarriage after age 60 doesn't change that. Some situations allow for a retroactive decisions up to 6 months. You'll need to inquire with SSA.

My late husband's first wife divorced him after she got caught cheating on him to marry the man she cheated on him with. She remarried in her mid twenties. When my husband passed she thought she would get widows benefits under him and I would get nothing. She was wrong I get all the widows benefits.

Multiple people can claim and receive a Survivor Benefit from the same person, if they qualify.

If you get re- married it would have a big impact on your potential spouse if they were on SSI because they would count your spousal benefits ( with X of 10 yrs) agents them, also the couples rule would apply to them. It's a broken and sad system for sure. Love is sacrificed for red tape.

You may want to double check the 10 consecutive years rule. You can divorce and remarry within the same calendar year and the total years will still be considered.

So many of the comments secrion questions are incomplete or seem to make the assumption that everyone knows exactly what they’re talking about. You cannot even make heads or tails out of many of these questions. Also, I think it really helps when talking about Social Security, for the people presenting videos to be very direct and concise when they ask a question and then give the answer. A lot of the discussion in between kind of muddies the answer. But really, really good content otherwise.

I am divorced, now 75 yro female & received SS at 62. He recd SS at 62 but died a few yrs later. I got some of his SS added to mine ($200). Should I meet a new man & we both want to marry do I lose all my Social Security or just my exes part?

Thank you for so much information. So, just to confirm what I understood, if a person has been married 6 times, he/she can choose which ex-spouse's benefit he/she wants to claim [let's say the first spouse] as long as that marriage lasted for 10 consecutive years, he/she is not married at the time of the claim, and is over the age of 62, am I correct?

Yes, you can pick from among eligible ex-spouses. However, for Survivor Benefits, you can be remarried after age 60.

I know someone that’s hanging on 10 years because her other 4 marriages didn’t last and they are all ex husbands are still living in a marriage then divorcing the guy then she only has to wait a year to marry

This video describes me to a Tee. On my second marriage currently. Just recently found out I can draw on for survivorship on dead first wife which would be quite nice... I checked with SSA. Problem is I married before 60 as didn't know these intricacies of SS. Now, can I divorce and remarry 2nd wife now that I'm over 60 as she is a keeper, but I'd possibly like to retire early and draw off 1st wife's account. Let my own build till 70. What are the restrictions here? Another site said I'd have to wait a few years to be eligible in SS's eyes. What say you?

If you divorced, you'd be eligible for Survivor Benefits from your first wife and then could switch to your own benefits at 70, if that makes sense financially. However, you have to consider your current wife's benefits and how your decision will impact her. It's best to contact us to run through this complicated situation.

You could begin the Survivor Benefit claim quickly and provide the details to SSA as soon as possible. The waiting period or timing considerations would be for your current spouse. For instance, if you passed away quickly after remarriage there may be an issue for her as you generally must be married for one year before you can get spouse's benefits...assuming you haven't already been married for 10 years.

Is there an easy way to reset the divorce/marriage trigger? I'm thinking this is a viable option and current wife is OK with this. Appears to be the easy way to early retirement? lol

Easy divorce!? We are going to stick to the financials on this one and suggest you get a lawyer's opinion. The financials make sense. Don't forget your current spouse may lose benefits as a result of divorce and/or be subject to waiting period. So I didn’t realize that you can get survivor benefits at age sixty if divorced. My question is, is the amount reduced if you take it before your full retirement age? Or do you get the full amount available. Thanks!

If you claim SS benefits before your Full Retirement Age (FRA), there will be a reduction based on age. This applies to your own benefit or Survivor Benefits.

If on SSI you'll be forced to take it immediately and be reduced to approximately 75% and that's permanent. not fair but out of your control. If you're X spouse of at least 10 yrs dies, your benefits will then go up.

I hope that i can get and answer to this question. I was married to may exhusband for 13 years. We got a divorce to be able to save our business and properties from a lawsuit, but we never separated. We did it strictly for business matters. We both retired at 62. Now he us 82 and im 69. My husband wants us to get married again for many reasons. Im having a hard time making decisions on his health care, because on papers he is my ex, even though we have been together fo 38 years My question is: If we remarry , would i loose the SS benefits that i actually would have if he passed before me? What happens if we remarry, and he passed way before me? What benefits will i get? If i passed before him, nothing will change because my benefit is a little less that him. Thank you for this video.

I was forced to take spousal support. I did not want to because i was on ssi. I got penalized because at 62 disabled. They said it gave me 200.00 a month. I lost a lot of money. Taking it early. .

So if I remarried at 45, and then my ex passed away 2012, we divorced 1998, I remarried 2002. I can't get any survivor benefits? He never remarried. He was even in the service when we was married.. We was married 18yrs.

If you remarry your ex husband you can get survivor benefit even if he died 9 months after remarried to his ex wife.

He is wrong. You can remarry the same person and it adds up. It does not have to be continuous. Check it out with better lawyers

Consider this: a woman is married to a man for 45 years and he divorces her to marry a 25 year old. The first wife remains unmarried until retirement age and then draws on his Social Security. Seems fair to me. Does not impact the amount that he will get at all.

My (female) friend was married for 8.5 years BUT they lived together over 11 years. They had an 11 year old daughter together and 2 younger kids (3 total together). She married another man around age 45 but was only married to him for less than 5 years. Can she claim on her first husband (the father of her 3 children)?

The rule is 10 years. It seems your friend is 1.5 years short to qualify against her ex-spouse.

An important consideration is common-law marriage. Some states recognize common law marriages and the SSA may also. You'll have to check the local laws about your situation.

It boils down to the date the divorce was declared by a divorce decree. I thought my ex and I were married for 19 years. Come to find out after getting divorce decree for these purposes that I was married for 20

I would never get married again. As I am not ever willing to share my SS or all other investments n savings etc. as my husband that I do so still love him dearly. We worked very hard for these savings n investments.. so why would I share any of this. Even though I may love another man dearly. So I would or could have a very air tight pre-nup..... but there is always someone in a marriage may want to try to talk me into sharing, especially if I might have a wee bit of dementia. I would have my son n daughter as my soul beneficiaries. After I may pass or become incapacitated.. I would also NEVER have a person ( a man ) move in or stay overnight as 1 night may lead to week etc.. Depending on what state one lives in... This person would say I am now your tenant. I know there will be those naysayers that I could miss out on a very special relationship. But whatever !!

You would be entitled to a Survivor Benefit if your spouse predeceases you. But your current SS income would not change as a result of a divorce.

If ex-spouse is alive, you could get Spousal benefits (up to 50% of ex-spouse's PIA). If ex-spouse dies, you could claim Survivor benefits. How much you get will depend on your age when you file.

Ive been getting my soc sec since age 62 (reduced of course), If my Ex dies, (he just started getting his Soc security at AGE 70. Will I get the same Soc Security amount at his age 70 benefit? (I know i would get the reduction). I never remarried. P.S. I AM 74 years old.

It depends on your age: Widow or widower, full retirement age or older gets 100% of the deceased worker's benefit amount. Regarding your ex-spouse's delayed retirement credits (waiting past full retirement age to file), here is what SSA Code says: "All delayed retirement credits, including any earned during the year of death, can be used in computing the benefit amount for your surviving spouse or surviving divorced spouse beginning with the month of your death. I have a sister she has been divorced for a long time from her husband..her husband got married again then he passed away just recently..he didn't work or claim taxes so him and my sister had to pay irs back...but now he passed away and she wants ss from him and he remarried and passed..he hasn't worked in years and my sister thinks that she can get his ss..I don't know if his new wife worked I think that she did. My sister thinks she is getting 70%..but if they didn't pay taxes on their business and my sister is now working under the table..not paying in either lol it's complicated..she also said that she is getting back pay from ss...when my husband passed away I did not get back pay as only started my check to me...as said that they didn't pay back pay because I called them...if you can understand any of this can you help please lol oh my goodness lol

So Im divorced (was married10+ yrs. I want to start SS at 65 I have no record due to being a homemaker. If my x spouse passes before 70, should I wait to file for survivor benefits? Because it will be larger to wait till Im 70?(I don't want a haircut per say.) We are born same yr however he is six months younger. I am 62 as of right now. No I haven't re married. Delaying survivor benefits past your full retirement age doesn't make sense as it does grow with delayed retirement credits. In most cases, if you are married to the deceased for at least nine months (unless the death is an accident), you can qualify for survivor benefits (if married when they die).

If you divorce a after 10 years of marriage, then remarry someone else, b, before age 60, can you divorce b before age 60 then remarry b after age 60 in order to get ss benefits from a's records? My husband is a british citizen but lived in the US for close to 30 years, working the whole time and paying into social security. He got deported and cannot return unless he overturns his case. What if your first husband dies at 52. You are 50 and you remarry before 60. Then your second husband dies. Can you collect on your first husband’s record if it’s larger? I understand the divorce rules but can’t seem to find the rules for being twice widowed. Anyone know the answer?

I know this is not about social security money from ex spouse. But I’d like to know about all the utube videos about seniors getting food cards. For over $2000 or less is it real. @@Dolphinfinancialgroupfl sure if you have been married twice for over 20 years to each one, do I have a choice as yo which social security I would draw from. 1st husband died at 54 with no children so his ss has never been drawn on my 2nd started drawing when he was 62.

Yes, you could choose between each if you are currently unmarried. Keep in mind, that one would be considered a Survivor Benefit while the other would not since he is still alive. These are two different calculations. This also depends on your age. There are too many variables and you should run optimization software.

I am confused!I am FRA now but remarried at 59-my current spouse and I are talking divorce which will allow me to draw on my first ex spouse-IF I remarry anyone again do I lose ex spousal benefits from my first marriage??

@@Dolphinfinancialgroupfl I got that question answered today from Social Security but the question they couldn’t answer is the one that was addressed in this video. My current husband and I are considering divorce so I can draw X spouse benefits off my first husband -we married when I was 59 sadly.My current husband and I have been married 8 yrs in Sept September .If my current husband and I remarry after divorce to complete the 10 yr rule after collecting ex spouse benefits for a year and locking in survivor benefits from from my ex to my understanding we have to remarry within the next calendar year or is it from the date of divorce to the date of remarriage that needs to be under one year? Or is it just anytime during 2025 if we divorce this Spring?? I found the information on the SSA website as well, but it doesn’t break it down exactly.

He took ss at 62 so i would get less. He took it 4 years early to cut my amount. Pretty crappy. He lives with mom now. She pays all the bills. Wow

Unless you qualify for higher benefits from your new spouse, your existing Survivor benefits won't be impacted.

Im so confused. My situation is this. I was married 12 yrs divorced, I then re- married at 51 and divorced 2 1/2 yrs later. My first husband died in 2017. I believe he may of been on disability prior to his death (his obituary stated he died after a long illness) and also that his earnings were most likely more than mine are. Can I draw off of his instead of mine?
