Lmao in all seriousness thanks for the shout out, it's mind boggling to read all the stipulations that show how every defence for defamation almost entirely cover your bases. I've said I understand that youtube is a "private company" and it's not officially a legal dispute, but it's to highlight there is zero legal standing to make this claim in the first place. So it suggests to me they have no intention to fully persue this avenue, just a completely butthurt attempt at throwing whatever they can to take down videos that revealed the problem and hurt egos. Not to mention their first wave of fradulent DMCA claims failing, rather than come out of the gate with defamation, only further compounds how it's just sad attempts of flailing at this channel.

If I had to guess as to why they are pushing so fervently to suppress any backlash about the game, its likely due to SEGA trying to maybe do it...? Or possibly someone connected to SEGA unofficially (Or simply just CA refusing to back down) that could be doing this because they think that while selling Hyena's, this could damage the possibility of getting at least something back upon it being sold... Alternatively it could just be due to someone with far more money and time than they realistically should coming around to cause trouble out of boredom, hurt ego (as you say) or just simply because they want to be annoying due to having been threatened with being fired or something along those lines. Who knows though, things still aren't settled and people in CA still obviously don't know what they want to do,. how to defend themselves, or even where to go anymore. Feels like the whole company just fell into a complete depression after this shakeup and lost all hope for their futures, rather than making an effort to make sure it doesn't happen again in an even worse way.

ive got 3 years of defamation documented and then i have an ex-CA tell me how CA staff had close connections to the /r/totalwar moderators who were capriciously enforcing (or not enforcing) rules the entire time. even recently, ive had people collate screenshots for me of non-stop defamation of me. theres even deamation going on right now on /r/totalwar. every time i make a video i get libelled extensively. and CA are fine with it. they love libel and defamation.

In France we call those "procédure-bâillons" ( "gag-procedures" ). Nonsense, but simply there to shut up at least temporarily a critic, make him waste money - the ones to abuse that, individuals or companies, are usually pretty wealthy. Normally, such a procedure would simply not be recieved by a tribunal on its blatant lack of tangible elements, but with an overloaded system, and on a relatively new domain -amateur video publication/investigative journalism, a number make it. Since there's no fine for abusing the system, it may simply be considered cheaper to start such procedures than suffer news' adverse effects on one/one's company's own actions, and the effects can be at worse neutral, at best beneficial. For anyone without qualms, and companies executives ranks are more full of sociopaths and psychopaths than nearly any other demographic, that's a no brainer. Happily, there's one consequence they often forget: the Streisand effect. Healthy societies tend to filter out such individuals. And healthy justice systems to reject abusive procedures.

*The ironic thing about all of this stuff is that CA has done more than enough to significantly damage their own reputation. Nobody would even need to bother defaming them! Their own business practices and attempts to weaponize the legal system to censor journalism are doing more than enough damage. Who needs to lie when the truth is already so damning?* (other than CA) I'm no lawyer, but I have taken a classes on constitutional law at an Ivy League university, which spent a significant amount of time covering press protections in the USA. And at least as far as the US law is concerned, not only do they have basically zero leg to stand on when it comes to claiming defamation under US Law, but in general, defamation is one of the hardest things to prove in the USA. Since not only does the statement have to be demonstrably false but the fact it is false has to have been known by the person at the time of them making the statement. On top of that, it is also a matter of intention, so you actually have to prove that the statement/s were also made with genuine malice/intent to do damage. Based on the fact that the video isn't blocked in the USA, but is in the UK, I'd guess that the laws for that place regarding defamation are much easier to weaponize. This entire thing also makes it pretty clear that someone at Creative Assembly literally consulted with their legal department on how they could attempt to silence you since their spurious DMCA takedown failed completely. The fact that they first attempted to use a spurious DMCA takedown and are now claiming defamation already makes their defamation claim seem illegitimate and just like yet another method of them trying to weaponize the legal system to censor journalism. This whole saga of trying to take down your videos just goes to show how completely out of touch they are and how little they understand PR.

Volund just a quick tip, Sega is a Japanese company, and they erroneously tend to think Japanese laws work outside of japan. In Japan, even if what you are saying is the truth, you can still be sued for defamation if you negatively affected the person you reported about.
