@@liamgio795strange how words change from their roots from 800 years ago and are actually used by their current definitions. I also like how you chose only part 2 of a 2 part definition specifically the objection to the generally accepted root. The bit you chose to skip is important, the most commonly accepted root of the word is: “Cernere” to distinguish, like perhaps distinguish truth from lie. This is linked specifically through a route of words linguistically from old French to Latin that can be historically traced. Klein and Tucker may have an alternative view but with little linguistic backing or historical evidence to back up their theory. A crime is a crime. If you don’t like the law deal with the legislature don’t try to pretend it doesn’t apply to you. Alternatively go live on an uninhabited island with no society where you won’t have to worry about laws and crime at all. Everywhere else if you’re in a place and you commit a crime you’re in their jurisdiction and you deal with their laws.

The defendant sees the judicial system as a "verbal game" which he believes he is playing well. That is however like seeing baseball as a bat swinging game... and missing the fact a ball is also involved. Watching him go out to bat having turned up by himself, swinging wildly as he goes; and seeing the umpire and the other team trying to work out how this results in him losing the match is fascinating.

In Western-Roman law, your name --- from Latin _nomen_ to mean an 'inscription of a Roman slave' --- in all capital letters (e.g., JOHN Q. DOE) denotes the *greatest* loss of rights in the [system] aka _capitus diminutio maxima;_ eventually, in time, this came to represent a descriptor of trusts, estates, funds and corporations in law. The *least* number of rights lost 'd be your name in all lowercase letters aka _capitus diminutio minima,_ effectively the flesh of the man or woman standing as surety to _persons;_ with _person_ being a form of Roman corporation unless otherwise qualified as a *higher* form of person with greater rights. That's what they're referring to and that's where the confusion lay, both in "sovereign-citizen" circles and [Roman courts].

I am not a lawyer, so take this with several grains of salt: _Technically_ the burden of proof rests with the prosecution to prove jurisdiction. However, this burden is trivial -- the fact that the judge agreed to schedule a hearing on this case means that the court is satisfied that it has jurisdiction. Thus, as a practical matter, the defendant needs to put forward an argument as to why the court lacks jurisdiction. Generally speaking, sovereign citizens *do* put forward (bogus) arguments why the court lacks jurisdiction, although this tends to be incidental to a demand for the court / prosecutor to prove jurisdiction. The fatal flaw with sovereign citizen thinking on this subject (and several others) is that the only person who needs to be convinced is the *judge*, not the sovcit. If the judge is convinced that the court has jurisdiction then it _does not matter_ that the defendant believes otherwise. If the defendant believes that the trial judge has erred then the correct avenue to address this is via appeal _after_ the trial.
