Well articulated by Jimi. I think the hosts did not get his point of view in regards to execution of court orders. The police maintain law and order and together with the ODPP can present anyone in court for criminal offences. When an arrest warrant is issued by the court it is the police who are tasked with the work of apprehending and presenting the person in court. If the arrest warrant is for the high ranking police officers considering they work in a command structure then you see why the do not arrest their own. The court can only issue orders but the police can decide to execute. The courts cannot arrest anyone so summons will only be on paper if police do not execute. The KRA issue is different from police. The enforcers of taxation are the accounting departments of companies or parastatals. The collection of tax is at the discretion of the companies and that is why some fraudulent companies deduct from employees and fail to remit. The method of execution is KRA seeking court orders to freeze accounts or send agents to the companies to ensure execution. So KRA needs the law and the courts to enforce collection of tax. So if the 16% VAT on petroleum products is reduced to 8% then KRA will not have any authority to freeze accounts those companies that will only remit 8%. For those collecting 16% when a case is brought before court for collection of illegal tax then they will pay for the illegal collection which KRA will not refund them so they will have to take that hit. The execution of arrest warrants is dependent on Police enforcing. While the execution of taxation is dependent on law and the courts.

In my opinion, Jimmy Wanjigi is someone who deserves protection at all costs. He is imparting a lot of valuable knowledge, and I, for one, am listening intently. For those who doubt him, just wait for the court's ruling. If it confirms that the tax is 8%, it only takes one person to go to the pump, see a different rate, take a photo of the receipt, and post it online. This way, the entire country will know who is stealing from them, and it will be clear which stations to avoid next time you fuel up. I believe this would put an end to their fraudulent practices.

The other thing that you have to ask is, if Total Kenya reduced its retail fuel costs by 8%, because by law the VAT on fuel should be 8% not 16%, what recourse would KRA have since they can't raid and force Total to pay an unlawful tax. And once that happens, Total's fuel sales would go through the roof. At that point, what option would other retailers have other than to reduce their fuel prices?
