Hawkins and his sons, particularly James Jr., were military/war veterans who knew far more about the use of weaponry and Guerilla warfare and were willing and able to meet these cats on THEIR terms. And the POINT obviously flies right PAST you: 1, only 10 percent or less of ANY gang are true riders to begin with, but they are supposed to have the entire gang BEHIND them, so why wouldn't the whole gang be against the Hawkins after James Jr. gunned down one of their YGs? 2, the Hawkins tooled up and waged WAR against these fools; THAT is indisputable no matter what some old thug wants to claim now. They stood and fought and lost not ONE of their own. I know th excuse was "well, the police were helping them"; the police weren't staking out their house until the THIRD night of that feud. And since it was 4 people against a fucking GANG, why the hell shouldn't the police have gotten involved? These niggaz ran up against a real gangster, criminal, thug muthafucka and killer named James Hawkins Jr, who they were afraid of and couldn't FUCK with. If that man had been a Bounty Hunter Blood, he would be hailed by them today as their greatest soldier. But he was AGAINST them, and they made the mistake of fucking with his family. All y'all, everyone, PLEASE cut the bullshit. When you enter into a plea agreement, ANY plea agreement, the D.A., U.S. Attorney or whatever you are dealing with are going to INSIST that you undergo ALLOCUTION. In short, you must give a truthful statement, whether written, audio/videotaped or in open COURT, and under penalty of perjury in any case, as to YOUR part in the crimes which you are pleading guilty to in exchange for the plea deal, as well as any accomplices. If you do not agree to this, you will not GET a plea deal, or if they find out later that you lied, they will VOID your deal. The point is that you don't GET a plea deal unless you give these folks what they want, PERIOD. Anyone telling you that they agreed to a plea deal but didn't have to snitch or give information on ANYONE is full of shit. Why would the state or the feds give someone a deal unless they were getting something FROM them? What it is, these cats will never cop to having snitched, so they try to change the definition of snitching. "Well, I didn't testify in open court, so I'm not a snitch". No, you cooperated by giving them the same information in an oral or written deposition. It is just as binding as testifying in open court. "Well, a snitch is someone who informs for the police". Sure, but what is someone who offers incriminating testimony, or corroborates incriminating testimony in a criminal case to reduce his or her time? On what planet is that not snitching?

You signed a statement, right? Did that statement feature, in DETAIL, the crime/crimes you were pleading guilty to? THAT is allocution. You don't HAVE to write the statement yourself; in fact, the statement which you sign to enter into your plea agreement will NEVER be written by the person pleading guilty. It will be written by the D.A., State or U.S. Attorney, and you sign it to make it BINDING. The point is, you don't GET a plea deal unless you allocute to the facts, whether that means testifying in court or signing a confession.

I can run with most of what he said here, although I do have some reservations. If he said that no one made ANY such statements... and the DA came in with prepared statements written by the state? That's plausible but really there's nothing you can argue here without the paperwork saying he made those statements and signed them. First... a state appointed attorney and a public defender are one in the same... to argue that point you're just splitting hairs and trying to muddy up the water. That being said, your state appointed lawyer dropped the ball in your case, because it was his DUTY to object to any and ALL statements made... (especially statements you DID NOT MAKE). He should have filed every motion in the book to get those statements thrown out. The optics that leaves behind makes it look like you in fact made those statements. That's neither here nor there... the separatees issue is blurry, because although they will seperate co-defendants who are states witnesses, you can make a statement and not necessarily be a witness for the state. You can make a statement, then refuse to take the stand repeating the statement... or you can try to retract your statement... in either case, the statement is admissible. In this instance, your statement is state's evidence, but the person making the statement isn't necessarily cooperating. So there's no need to file for separatees . So you could have told (by making the statement) but decided against it after the fact... which LOOKS LIKE what happened here. Since there's no paperwork to contest what happened it's he said - she said... and you TECHNICALLY can't be called a rat without that paperwork.... But the argument that you HAVE TO get on the stand to be a snitch, is a weak argument... and you shouldn't be trying to make it.

Facts facts facts and you can make a statement and not be snitching as well. You can have an entire conversation with the police and not say anything incriminating, but it’s smarter to stay quiet because you can say something more times than not that’ll lead to you incriminating someone or yourself or at the very least your statement will be used in an attempt to incriminate someone or yourself. Plea deals w codefendants are tricky because the court looks at it as an admission of guilt. So it’s seemingly high risk to take it to trial when your codefendant has pleaded out. However snitching is giving any information that leads to a conviction. It’s not that hard the lines aren’t blurry. You get caught you keep quiet and allow your lawyer or state appointed attorney to do the talking. But as you’ve stated there’s no paperwork to verify his statements so people can’t say if he snitched or not
