They let him stay in the country at least a year longer than that because of the fact he was not a danger to anyone. There are levels of documentation: tourist visa, worker temp visa, special project visa, and all of which require going to court every,3 , 4, 6 months to reapply. It costs a price of an attorney and time. The other issue is their country of origin have,none of the required paperwork.

Actually, if he had gone through the process, his application would probably have been denied--unless he could prove that he was being persecuted in his home country and/or his life was in danger. We don't normally give Green Cards to people like him (meaning poor people). The people who typically get Green Cards are the high-income earners (doctors, engineers, computer programmers, etc.) who will be paying us a LOT of $ in the form of federal and state income taxes.

The blame should not be pout on the USA, but his parents, or themselves. If they were in the country for 10 years, working hard, etc, why didn't they apply for asylum or citizenship? There is always another side of the story...his dad entered illegally first, then his mom. They had plenty of time to apply for citizenship. Too many people enter illegally and because of past administrations lack of enforcing the laws of our country, immigrants, illegal and legal, get complacent or believe they will not be deported for breaking the law.
