they need to sue him for a lot more than just the rent. idk if in previous stories you saw where she was fined by the HOA several times cuz the grass got too dry and was dying off and so was the palm trees in the yard and some other things. the lady even went to the house and put on the sprinkler system and the previous owner went out and ripped all the lines up. all the utilities were on and in the new owners names. there was a ton of stuff. I hope they are able to get every penny they had to pay out!

Some states already changed the law to punish the squatter; but due to pandemics, all new laws are off because the fed commanded "Eviction Ease" which went above all the law regardless of the current owner's situation.

No, the problem is that her lawyer sucks. When the previous owners didn't hand the keys the lawyer should not have transfered funds. The money for the home should have been stuck into escrow and rent should have been deducted monthly from the escrow funds. This should be in the agreement from the beginning.

It probably cost them more in legal fees than What did get back. Plus winning in court does not automatically get you the money winning and collecting are two VERY different things. The court s don't care and don't give a shit about helping you collect on the judgment.

Some people watch the squatters and if they leave the property they change the locks and throw out belongings and have guards at the premises. The squatter has no legal standing.

That was indeed incredibly silly. A few random items that looked more like the reporter placed on that countertop herself before she started filming. The house itself looked to be in pristine condition with absolutely zero trash or damages. Stainless steel appliances looked brandnew without even a scratch. I was expecting the place to be completely thrashed with spraypaint and holes punched through the doors etc. but it was so clean you could eat off the floor. So yeah, it's more likely that they happened to find that one little gardening shovel in the backyard, the box in the garage, and those clothes hangers in a closet. Then decided to bring them all to the kitchen for that one shot. Still sucks that the new owners had to wait for a full year before they could move in but it could have been a LOT worse. I've seen squatter infested mansions before where they completely ruined the place before they left. So yeah, sucks to be the owners but at least they have a pristine home with some extra clothes hangars and a free gardening tool. 😜

I dont think they will give his info and not sure they should. He may have been dealing with a mental health crisis. I mean it's a really nice and expensive looking house that he sold and now he was reduced to being a squatter in his former home. It sucks for the new home owners but the former home owner probably had his own geniuin difficulties. With covid 19 in full bloom for the greater part of last year he was able to stay and the law protected that. People are still struggling and he should have left way before now. Even with not knowing the facts I feel sympathy for the guy. He looked old to me and I'd take a weapon to the front door too with an angry mob outside. I wish he had talked to the news people to share his side of the story and then people may have helped him move sooner. I guess his pride/shame got in the way....which makes sense seeing that being blasted on the news lit a fire under his but to get him to finally vacate. Sad. Terrible situation for all involved. He left the inside in good condition. The yard wasn't maintained...probably didnt have the money to do so or was too afraid to be outside unnecessarily and for long periods of time....cuz you know....angry new homeowners could get a call from the neighbors and decide to pop up at any time.

Most likely any income resulting from the sale was lost to previous litigation, gambling, substance abuse or some other issue. It will take many years and litigation for the new buyer to recover some losses, if ever. Best case, they will get a judgement and go after future earnings or the prior owner. The prior owner though may be able to show no assets and no earnings going forward.

I noticed how dirty the carpet was in a couple of the rooms, the issue being, how would you feel if you spent your life savings and bought a home, went to move in and the previous owner was still there?, then you still had to pay your mortgage, HOA fees and pay to rent another place while he squatted there? I don't think you would be happy at all, and I am sure they had to put out more money to make the place right again. The squatter is a low life no matter what.

Something similar happened to us when we bought some property but the owner wouldn't hand over the deed. It took a year in court, and paying the man's liens we didn't know about, before we finally got title to the property. During the interval the man stole a big greenhouse and 2 trucks from the property that were included in the sale. After it was all over we were so sickened that we decided to sell the land. Glad to see these people finally in the home they paid for. Some people think they can take your money and get away with it.

I don't think the squatter was necessarily a bad guy, I just think he couldn't afford the house anymore and put it up on auction or lost the house to the bank. unbeknownst to him, the house was probably sold rather quickly without him being able to find a new home to relocate to. You can tell he cared for the house as to how it's not as trashed and basically in livable conditions. I believe this squatter was down on his luck, elderly, and once covid hit, it made it extremely difficult to find a new home altogether and not being able to leave the house due to infection. Although he should have brought it up to the buyers instead of squatting the buyers wouldn't have listened and would have thrown the guy to the street. Either way the squatter was saved by the covid moratorium.

Fun way to solve this problem: Bring tools and materials and seal up the entirety of the bottom floor of the house from the outside, bar the windows, have the electricity and water turned off, and have all abandoned vehicles towed from the property. Wait a week and then go back and see if he's ready to leave.

That’s why on KZbin there aren’t any cases involving California trials or people in court for California unless their faces are blurred out almost constantly. It actually surprised me as heck the first time I saw footage from a real life criminal case and another state that actually show the defendantt full face, expressions and everything. This brings joy to my heart, as a real estate agent in New York, that situation was the worst of the worst. I’m glad they are finally in their home that they bought. People say real estate is easy.... if this isn’t an indication of how messed up it can truly be at times then I don’t know what is.

I had to google 'america squatter meaning' In my country you have to legally have a written tenancy agreement contract signed by both the home owner and tenant - otherwise the tenant has no right to be in the house and the owner will get a fine for not writing the contract.

Yup they better sue quick before the money they saved during Covid rent or mortgage and the proceeds from the sale of the house get locked into a new home. People don’t get evicted from a house they chose to sell.. it’s so strange they called it an eviction at all. The previous owners closed on their house. When you wanna sell you are expecting to give it up.

What is a restraining order is supposed or why a court would grant one? The prior owner left, is not stalking them or threatening them. "Put their information online" where exactly? Which site do you check before buying a house to be sure the current owner doesn't have a weird history. I'm not aware of a site specializing in such things.

@UCnR1aF-lr-TMVLXINLx4sWw I hope you are having a great day too, really. I am totally empathic for the buyers, it's a terrible situation. But one has to understand the law. If someone tries to force their way into a property through a locked door, even if they own property, the person inside can legally defend themselves in most places. Access to a property in this situation would have to involve law enforcement and a court order, period. The occupant was within his rights to take a swing at someone coming through a locked front door when someone is breaking in (unless law enforcement is coming with a search warrant). We may not agree with, but that's how it is. All complaints should be filed with the legislatures that write such ridiculous laws. In order to get a restraining order, specific legal criteria have to be met, and they haven't been, so it just isn't going to happen. Just because someone is crazy and is of terrible character (which we the case), doesn't mean people can easily get legal protection from them (via an order of protection or similar), it doesn't work that way. Fortunately the buyers didn't do anything stupid or they could have _easily_ been the defendants in court in a criminal case. Misunderstanding of the law gets a lot of people get in real trouble in situations like this. Did you find a site one can go to avoid people like this? I would really like to know about that one.

I dont understand how they were able to stay in the home after the sale was completed. It was no longer their home and the previous owner has zero rights to the home. This makes no sense. I am in the same shape right now I sold my family home that I had let a guy live in for 30 years for free never charged him a dime! I told him 3 years ago the property was up for sale that he needed to be looking for a place then I sold it March 4 2021 and I paid 6 month’s rent on a storage building for him rented a uhaul and hired 4 guys to move his stuff he called the police on me and said I was trying to throw him out of his home I was almost arrested and was told if I came back to my land I would be arrested for trespassing it’s in the courts now but I am paying the new owners $100 a day until he is gone I am out $10100.00 as if today and the bill keeps going up.

These people said they did, then the owner moved in a week before they did. There also have been instances where people moved in just 48 hrs before the owners made it there to move in and by law 48 hrs is long enough to establish residency in some states...

Thank GOD this family can finally get their home now! This literally happened to us, only not nearly as long.... we bought our home on 12/21/2020, and came to take possession, and the owner was still in, and all of her possessions were in the home. She was a hoarder as well. All of the items in the contract, she was supposed to have removed from the property, were still there. We had the sheriff out, but could do nothing. We’d sold our old home the week before, so we were left homeless, with two kids, a dog, three cats, a cockatiel and six chickens! We lived out of U=Hauls and hotels rooms, until a week later, when she left the property, but all of her stuff was still there, all on the front porch. We moved in and took possession, VERY fast, so that we were in. She kept coming back, trespassing, taking items, having other people show up and take things, saying she sent them, then she would accuse us of stealing her crap, left on the porch... it was a nightmare. The sheriff told us we could put all her junk by the road, and we did, but ultimately had to pay to have it hauled off. But, it could have clearly been far, far worse, like this poor lady. The laws protecting “tenants” are literally out of control. They let that word cover anyone, from squatters, to sellers who sell and don’t vacate. Why doesn’t the actual HOMEOWNER have any protections?

Not sure of the details in this case, but I am thinking this was more of a foreclosure situation, or near foreclosure (e.g. short sale), so the buyers were more or less getting into a situation where something like this could occur rather than a traditional sale between two individuals which involved both sides being represented by real estate agents.

I know it's California and the state loves to jump on the squatters' side LONG before COVID, but squatting involves rents and rental agreements, NOT staying in a home that is sold. My guess is that in this situation, this was not a traditional sale between two individuals being represented by real estate agents, but more along the lines of a foreclosure or possibly a short-sale. I am leaning towards a foreclosure situation because even a short-sale involves two individuals; the seller relieved to get out of their home with their credit intact, and the buyer getting a deal, for the most part. I do not really know the circumstances, so yes, if this WAS a traditional deal between buyer and seller, the DA should be bringing down charges against the seller for grand theft at the least. I mean, I couldn't imagine selling someone a car, and agreeing that they would be back the next day to pick it up, I then park it in my garage and do not let the buyers take it after all.

@@timezonewall Yes, there are "squatters right" laws but the owner of the home could have evicted the squatter through a court process, however, even if the court sides with the owner, the eviction moratorium prevents the legal eviction judgment by the court. These poor homeowners paid for a house they couldn't live in for nearly 1.5 years. You're telling me within 1.5 years, the owners couldn't get a eviction order?

@@kevinp8108 What I am saying is this: If there weren't "squatters rights", then an eviction would be needed in the first place. Call the Police, "there is someone in my house uninvited, here is my ID and the deed to the property I recently purchased, please remove them". If the person inside can't show a rental agreement, then they are escorted off the property as a trespasser. Done. The "eviction moratorium" doesn't come into play, because it's not an eviction, it's removing a trespasser. I do agree that any sort of "eviction moratorium" is problematic and not a good solution. The only time people should be allowed in a private home is IMHO: 1) they own the property; 2) they are invited, and that invitation can be revoked at any time; 3) they have a written lease; 4) through legal action such as a search warrant; 4) imminent danger exists that gives the police / fire / child protective services or other agency good cause to enter without permission.

Cannot worry so much about his not leaving the home in pristine condition. It actually looks way better then expected unlike most scenarios involving squatter's trashing homes with broken cabinets if not missing all together with holes in every wall and the list goes on. Good day for the homeowner, Glad that they finally were able to take possession of their home but again could have been allot worse. Cleaning/new carpet/fresh paint/change of all locks is all it needs based on what is shown. Such a shame that the guy/family was able to stay for as long as they did. The laws regarding situations like this and squatters need to change. I would hope that they eventually can recoup some of the money lost from this guy.

Had something like this happen to me. They broke into the wear house. Door was ripped off. Yet cops would not do anything. said I like them stay there. I had to evict. Yet, I had no idea who they were. So even though I won the case. I gave the sheriffs the court paper work to legally evict. They would not do it. Because there was no name of who to evict. I did not know who they where because they broke in. It not like I got paper work and IDs of these people. It was the lamest thing ever! I had to get them out by other means. Which it should of never had to come to that. The System is broken.

People will see this video and still not get how something like this can happen. A Certificate of Title is not an Allodial Title. A "Certificate" of Title only proves a Title exist. If you don't have possession of the Allodial Title you never really OWN the house/land. Possesing the Certificate of Title makes you a caretaker responsible for maintaining the value of the property during your stay.

Squatters don't give a damn! They will live somewhere for free as long as they possibly can! Total disrespect!!! It is a miracle that the home appears to left in decent condition. Many squatters get angry & destroy the place completely out of revenge. 😡😡😡😡😡😡

I know there are people out there like that, but I couldn't imagine the stress of squatting somewhere knowing that someone is out there behind my back trying to get me out of THEIR home that I have no business being in anymore.

So called "Squatters rights" are so that someone can move into a long abandoned dwelling if they have nothing. Situations like this, should be exempt.

What’s wrong with buying a house with an HOA on this case? This is not a squatter or HOA problems. This is problems with escrow instructions that buyer did not requested property have to be cleared and walkthrough property before closing the escrow date.

@@donaldmiller4386 I live same street with this home owners, and their problems was not involved with HOA. Their problems caused by insufficient escrow instructions in purchase contract agreement. Buyer shouldn’t signed the final closing paperwork and withhold funds in escrow when they last walkthrough property before escrow closing date. It seems like buyer and escrow officer did not requested property have to be cleared before closing date.

@@cruisedance979 Irrelavent to the fact. I didnt say the problems they have/had were "because" of HOA. I simply said that was the first mistake. Government controls us enough. No way am I buying with an HOA so there is someone who fine tunes or extends that control. If I pay for my house with my own money. Then pay the property taxes after I buy that house, its mine. Nobody is telling me what kind of fence I can have, or what color my house should be, or my trees are wrong. And so on. Its mine I will do with it what I want. Its only coincidence Their "first mistake" got them punished with this guy.
