I recently had my hearing for ssdi and I am awaiting a decision. In the meantime, I am going on my second appeal at Sedgwick /AT&T. I was receiving Ltd and then they denied it stating no disabled. I have been off for 2 years. Will I have to pay offset if I get SSDI in the appeal process with Sedgwick if reversed?

You will still be responsible under the AT&T policy to repay any overpayment resulting from receipt of SSDI benefits that overlap with a time that AT&T paid disability benefits, regardless if you win your appeal or not. If your SSDI is awarded that will serve as strong additional evidence in support of disability to use in an appeal with Sedgwick.

@@DisabilityAttorneys I just received a letter from Sedgwick and they approved me for 2 months of short term disability. I have been out of work going on two years. They stated their decision is final and I don't know what this means. What do I do about this situation? Does this mean a lawsuit needs to be filed? In the letter it stated, The Unit and the independent physician advisors reviewed all of information contained in your disability claim file and determined the medical information contained sufficient clinical findings to substantiate a disabling condition. As such, disability benefits are approved for 62 days. I am so dumb founded. Please help. I already filed for SSDI.

@@sittingpretty64 I am sorry to hear of your struggles with Sedgwick. We will gladly review the denial letters and your claim for potential representation. From what you describe above, the next step may be either to file an appeal to challenge the decision, or if an appeal has already been filed, then the next step is to file a lawsuit. We look forward to speaking with you.
