Pro tip: Don't let them put you in cuffs/detain you unless you are under arrest; they can stop you momentarily to ask some questions, but someone who knows their rights will ask "Am I being arrested" (which they have to answer- this cop didn't follow police procedure, and that could f*ck up his case), and if they are not being arrested they will ask "Am I free to go?". Unless you are under arrest, you do not have to help them f*ck you over. If they say stuff like "We need you to come in to the station", "We need come in", or "We need to search your car", that is them pretending that their request is actually obligatory. You have no obligation. So many cops get off on the authority, and act like anything that they say is the law- know your rights. There is such a thing as "disobeying a lawful command", but that is stuff like dispersing a crowd, or if you are under arrest, telling you to put your hands behind you or above your head. So many pigs try to twist that concept into "I am the law; if I say jump, you say 'how high' and that it is ridiculous." If you ask if you are under arrest, they must tell you- she has a case that he was abusing his authority by NOT telling her. If she wasn't under arrest, she was free to leave; if she was, he is obligated to read her Miranda rights to her. They have no right to search your house/apartment or car without a warrant, or without probable cause; they can stop you to question you with only reasonable suspicion, but you do not have to answer them (although it might be better to give brief, bullsh*tty answers; otherwise it might raise more suspicion). The difference is that reasonable suspicion is more like a hunch based on experience/training, and only allows them to go so far, whereas probable cause requires evidence, and is what is needed to arrest or search. This was a domestic call, so she lost a bit of leverage there, because they have a reason to come in and make sure no one was hurt or being held captive, but unless her husband was pressing charges or they saw the attack, they would have had to leave after a preliminary check. She f*cked herself by just going along with what they said willingly, and not asserting her rights (again, unless the husband said/did something that gave them reason to assert their authority). P.S. Like I said, some cops are pigs, and get off on authority, so in those cases, especially if you are black, it might be better to not force it if they get aggressive about you knowing your rights and standing up for them. In those cases, it might be better to acquiesce, and pursue it legally later, when the danger has passed- especially if the pig is wearing a bodycam, where you have evidence (like she does) that they did not follow proper police procedure. If you are white, however, and especially if you are rich, feel free to push the issue, and demand that they honor your rights- do not comply with requests, even if they make them seem like "lawful commands". It will make it easier for the rest of us when we do the same (you set the precedent).

Exactly; if they are that type, you are already f*cked, and nothing you do can get you out of it. You either demonstrate that you know your rights, and perhaps that makes them wary of paperwork or discipline for ignoring your rights, or you bow down and let them do whatever, and you end up in jail for your cooperation. Me, I risk the one-time beating (which if I survive, I sue, and if not, my family does) rather than help them put me in jail, where I would face that kind of brutish authoritarianism on a daily basis with no recourse- at least if I assert my rights and they are ignored (even if I get a beating), then my lawyer has something to work with, and can get any evidence thrown out because of that violation of rights, as opposed to bowing down and obeying, in which case your lawyer can do nothing for you, because you consented and willingly obeyed everything they requested that you do. Also, I am not saying get an attitude, insult them, or give them any provocation; like I said, if they consider you asserting your rights to be a provocation, then you are already f*cked- if they want you right then, they can have you, and all you can do is make it so that getting legal redress afterward is easy and overwhelming. But saying, "I'm sorry, Sir/Ma'am, but am I under arrest?" isn't enough to provoke most cops; again, if you say "you can't arrest me, pig, I ain't done nothing!" then yeah, that is different, and you should expect a beat down (not that it is justified, but rather expected). Also, I fully admit that being white or female in these cases is a HUGE boon, and makes it more likely that the cops won't persist in violating your rights (inversely, being male or black increases the chances that they will persist). That said, though, respect and lack of a hostile attitude goes a long way. You want them thinking that you are well-educated and respectful of authority, but knowledgeable about the rules of that authority, so that they worry that you might be connected, or that hassling you is more paperwork and headache than it is worth. There is a reason that the a**hole cops tend to target the poor and powerless, and steer clear of the rich and powerful, and you can use that to your advantage, if you can make them believe that you are similarly not worth it to f*ck with.

But you comment was based on not knowing the charge. She was charge with domestic abuse. She drew blood from her husband. She would have been arrested regardless of her color. Just how police matters are these days. Hubby dropped the charges and as I read most recently, they are seperate. She is still pretty regardless. Maybe she'll give me a shot.

I'm not a fan of Stacey Dash at all, but I do feel that law enforcement needs to be consistent with their operations and treatment of people. Far too often handcuffs are placed on people of color who are non-violent, and are being detained.

I’m not pretending to be an expert but my friend is a lawyer and a LOT of times when a woman is assaulted in her home and she calls the police on a domestic battery incident, the male (or female) perp will inflict wounds on themselves to make it look as if *they* were assaulted as well. By the time police arrive, whoever has the scars gets the bars. Listen to Stacy Dash’s 911 call. She said her husband had her in a chokehold and told the operator he then was taking pictures of scratches on his body she didn’t inflict on him. So I’m assuming by the time they got there, her reddening had diminished and he had the scratches. It’s a sick game. I’m not saying by any means that she did or didn’t do it or he did or didn’t do it, but Stacy’s husband is now sticking by her saying they want to move past this. This is why police body cam videos shouldn’t be released. It’s insensitive, invasive, not to mention often times so misconstrued. Body cam footage should only be released if an officer is accused of misconduct. Not just because a person was on television. Omg I am so sorry to get off the subject with my ranting to your original post! You did pose a great question about the bra. And yes I should have said a female officer *SHOULD* always be present when another female being arrested for body searches! But the bra thing I know is a fact because I lived in Chicago and that happened. The woman was sitting in the back of a cop car and undid her bra, took the wiring out and started scratching her wrists and arms and legs. I’m guessing she wasn’t properly handcuffed or knew how to release loose cuffs. My friend represented her in 2015 Sorry if I bored you to death Steel Castle 🤭
