Last two weeks at 16 year old male was shot for knocking on wrong door, 20 year old woman was shot for driving in wrong driveway, Texas cheerleader shot for accidentally going to wrong car and a 6 year old girl (and her parents) shot at when she retrieved her ball that rolled on to neighbor’s property. Too many people feel threatened and pull out their guns in situations that are not threatening just simple mistakes. Law terminology should be changed from “stand your own ground” to “shoot first and ask questions later.”

The man who shot the cheerleader is NOT a self-defense case nor did he even claim self-defense either. Reports state that when the cheerleader got into the backseat of the wrong car, he was in the front passenger seat, and she quickly got out when she realized she was in the wrong car. She then got into another car, the right car, with two other cheerleaders, and that's when the man exited his vehicle, walked up to the cheerleaders in their vehicle, some words were exchanged and that's when he pulled a gun out and opened fire on them. He then fled the scene but was later arrested. This case is still pending. But it's clear that this is NOT a self-defense case, this man is an obvious criminal, and will be charged and held accountable accordingly. And the 6 year old being shot while trying to retrieve her ball from a neighbor's lawn is NOT a stand your ground case either. The man who shot at her was already a convicted felon in possession of an illegal firearm, with a rap sheet of domestic violence too. This was clearly an open and shut case of a violent criminal shooting innocent victims. NOT a stand your ground case. The other two cases are extremely rare cases involving the accidental or negligent discharge of a firearm and then attempting to claim self-defense or stand your ground afterwards. I highly doubt that the courts will allow self-defense or stand your ground to be used in either of these cases as a credible defense in court. Just like that guy arguing over dogs or like that Salama Ra lady. This is the 1%'er club. One slip, and you're out.

The court CAN rule in their favour. Because this is a ridiculous law that has nothing but grey areas. The reason why the shooter of that cheerleader will go to jail isn't because it's not a SYG case. In all likelihood he won't even invoke that defence. But even if he did, he'll go to jail because his name is Pedro Tello Rodriguez Jr. In addition to that, his victim _lived_ - meaning she can testify. Her friend was also a witness. What if the victim was shot dead, and there were NO witnesses? There even _were_ witnesses when Nick Julian shot Garcia, contradicting his claim of self defence, but since that was word against word... the KILLER was believed. There is NOTHING good about Stand Your Ground laws, and a lot of things _demonstrably wrong._

Also, what you failed to notice and mention, like John Oliver does, is that Julian had a witness that saw Garcia rush towards him in a threatening manner. Julian tried getting back into his house but couldn't get the screen door open in time. By then Garcia was already on Julian. In order to stop Garcia from physically harming him or worse, Julian turned and fired. If you think every case is stand your ground just because someone claims it aftwards, then you'll end up in prison like that guy arguing over dogs or like that Salama Ra lady. Self defense cases are taken very seriously and anyone who abuses it will be punished according to the law. This is the 1%'er club. One slip and you're out.

Second, Stand Your Ground and Castle Doctrine laws fall perfectly in line with the Non-Aggression Principle. Third, evidence clearly shows that an armed population does in fact keep violent crimes at low levels and John Oliver even reinforced this statistic by showing that 70% of Stand Your Ground cases are justified.

For example if your a woman and you have the moral right not to be raped, then of course you are perfectly legit in using force in order not to be raped. If you have the moral right not to be assaulted, then you have the moral right to use force to prevent yourself from being assaulted. If you have the moral right not to be murdered, to not be stolen from, you have the moral right to use force to prevent that. So whatever we define as the _moral_ is what we give permission to use violence in the pursuit of or the defense of that principle. Morality _is_ violence. It's not to say that the two are completely synonymous because you can have just self defense; which is the use of violence to defend your moral rights and that's perfectly fine. However! When people talk about morality, they're talking about _justified violence._ *Justified violence.* So what is the morality that reduces the amount of violence in the world? Clearly it has to be reactionary morality. And it has to be _case limited_ morality. The Non-Aggression Principle is _reactive._ It's not proactive. Thou shall not initiate force against others. But if force is initiated against you then you have the right to initiate force to defend your persons and/or property and that includes ex parte and third party too. It's a universal principle. So once we understand the morality, that which is used to justify violence, we have to be very sparing, tiny, case controlled and tight in our justifications for morality. Because whenever we justify morality, whatever we apply morality to, there is where we also justify violence. And if we want to keep violence down in the world we have to keep morality reactive, case specific and very very tightly defined. So if we say morality is the Non-Aggression Principle that bans rape, theft, assault and murder, we have a very powerful and very _limited_ justification for violence and it's reactive. If you don't want force involved then it's not morality. It's then aesthetics or politeness or social convention or something els; it's not morality. Morality is that which takes the safety off the gun and let's you point it at somebody. That's the foundation of morality. It's flicking the small domino (this is immoral) and the last big domino is the safety coming off the gun. Hence why we have these laws and this is what they are based on. Morally defending your person and/or property or someone else's person and/or property with equal if not greater force from theft, assault, rape or murder. Anything less would be considered aesthetic morality and laws based on aesthetic morality are obviously subject to change. But not laws based on true morality. Get it?

Lethal force was never used or even threatened 2. The killer was not in any sort of danger. NEITHER WAS his neighbour, who wasn't even at home. So third party extension, my foot. 3. A principle being universal doesn't mean it extends to third parties, unless you WANT to for your own nefarious reasons. And when the third party in question isn't even THERE, it's already passed beyond ridiculous and is now firmly entrenched in Bizarro-land. If this was a case where the non-aggression principle could be used as a defence, then E V E R Y single case of murder could be defended the same way. All murders can be "justified". This entire episode reminded me of when I worked at Walmart. Start of the pandemic, I had the lovely "easy job" of telling people they had to put on a mask. I got to see an altercation so stupid, I became a proponent for stricter gun laws. This lady swung into the lot going too fast and nearly hit a guy. He walked up after they parked and shouted "What the fuck!? You almost hit me!" And she immediately pulled a gun and said "I feel threatened!" Thankfully he ran, and the cops were called soon after. Nothing happened to her of course, and she then walked into the store like nothing happened. EDIT: Since people seem to be missing the point I will clarify. I don't think a man being rightfully angry, and shouting at someone, should be grounds to instantly draw a deadly weapon. Had he banged on the window, or acted violent, I would understand, but he stood a good distance from the door, and waved a hand to get her attention. He was upset, but not being an active threat. And if that is all it would take for you to draw a gun as well? Then you are sad, and shouldn't own a gun. Guns are a far bigger escalation than an angry shout.

My mom and stepdad were victims of the “Stand Your Ground” law: they were driving in our neighborhood, when these two neighbors blocked the road and nearly attacked my mother, and when my stepdad retaliated in order to protect her from harm, *he* got arrested, because he attacked the guy a few feet away from the attacker’s driveway. It also didn’t help that the arresting officer was the neighbors cousin, and the prosecutor of the case was their family friend. So now, 15 years after the fact, my mom has a record, my stepdad has a felony over his head, and we can never leave the country as a family for any vacation. Btw, this was all happening while my stepdad was in the first stages of going through chemotherapy and radiotherapy treatment (Stage 4 brain cancer). Don’t worry, he’s still alive and still in remission.

I reality, both parties involved were at fault. The guy who killed Scott Beary and claimed self-defense was charged and sentenced guilty to involuntary manslaughter in the first degree. He was sentenced to prison for 5 years, where he currently resides, and he will never be allowed to legally own a firearm ever again. Remember that John Oliver is a comedian hosting a comedy show, *generalizing* information read from a teleprompter, in order for it to fit into his comedic act. As a gun owner, and member of USCCA, I like this segment, because it reaffirmed and clarified my existing concerns. I believe that there are parts of these laws that have a real usage, specifically in instances that don't allow for a reasonable retreat, but at the end of the day they are too broad. PS. I already know someone is going to say that there isn't a use because those situations are already covered by other self defense laws. Sadly, that isn't the case, because without these laws, there isn't anything stopping a prosecutor from claiming that someone didn't try hard enough to retreat. They need to be heavily modified, but not repealed.

When in fact, both parties involved were at fault. The guy who killed Scott Beary and claimed self-defensee was charged and sentenced guilty to involuntary manslaughter in the first degree. He was sentenced to prison for 5 years, where he currently resides, and he will never be allowed to legally own a firearm ever again. Here in the US we take firearms very seriously. The law and the courts have made it crystal clear that if you foolishly use your gun in asinine situations like this one, you _will_ be held accountable. Period. This is what I'm talking about. The 99.9% of people who listen to John's rhetoric, his generalization of information in order to fit it into his comedic act, take it at face value and actually believe it to be true just because he's funny. Fourth, it is incredibly well-documented that immigrants, "legal" or otherwise, commit fewer crimes than native-born citizens, so the fact that some immigrants commit crime is hardly an argument against immigration when non-immigrants commit more. As I stated before, illegal immigration is not even a criminal offense, much less a capital offense. Furthermore, the problem with immigration is not the "security" of our border, but our broken immigration system. Integration is a two-way street, and it's not only the responsibility of immigrants to integrate into our society, but our society's responsibility to facilitate their integration. But here in reality, the guy who killed Scott Beary and claimed self-defense was charged and sentenced guilty to involuntary manslaughter in the first degree. He was sentenced to prison for 5 years, where he currently resides, and he will never be allowed to legally own a firearm ever again. I own and carry a firearm, and have taken self defense style classes my whole life (shooting, boxing, MMA) and the number one rule is avoiding conflict. Do everything in your power to avoid direct conflict with anybody else, only defend yourself when you are absolutely forced to. When that time comes to actually draw you are damn right I won't hesitate to kill. You can't be of the mindset that you are trying to injure someone or simply stop a threat, that's what pepper spray is for, if you are at the point of pulling a *gun* you need to be willing to use it and have mentally prepared for what may unfold. It isn't pretty, life isn't a movie, you aren't a badass. Live your life and avoid hurting others unless they intend on hurting you

By his attitude and his tone? Since you are always 100% accurate in your assessment of what people are thinking and how they are acting, you should sit in on police interrogations. Because of your special talent you could immediately tell if a suspect is lying or not, saving time and money in our court systems. Please consider this. The way I look at it is...He had his neighbors back. No one has the right to steal your property. When does it end? Let's say you needed to lose a few pounds, so you bought a bicycle. It was stolen and you called the cops. They wrote down the information because they arrived too late to stop the theft. What are the chances of you getting that bike back? So you buy another bike and it was stolen right out of your garage. When does it end? People will argue "A bike is just an object that can be replaced, it is not worth a human life". Well, how many times do I need to replace that bike? How much money do you think I have? Why is there so much sympathy for a thief that doesn't give a damn about you or your property? That thief doesn't care about me, my property or my family, he doesn't care how long I had to save to buy that bicycle, or if I'll ever be able to replace it. So why should I care about him? I'm not saying go hunt the man down, I'm saying that if a man comes onto your property to steal your belongings, you have a right to stop him from doing so. In the case of the man who shot his neighbors thieves, the same logic applies. He knew his neighbor, he knew the men who were next door didn't belong there. He protected the man's property.

Do you or don't you have the right to defend yourself and your property? As long as thieves are not armed and wish you no harm, should they be allowed to steal your property? Where does it end? Here's a fun story for you which, for the record, I can personally confirm is true. A friend of mine was sitting in the passenger seat of his brother's car and a third man walked up to the passenger side window and pointed a gun at my friend's brother. My friend, obviously fearing for his life, fired one round through the door and hit him. The man who had been shot survived, and managed to get back to his car and drive away. My friend and his brother called the police and filed a report, including the license plate of the man's car. When the police found the man, he had gotten rid of his gun, so the police didn't charge him. Instead, my friend is serving eight years for felonious assault and improper handling of a firearm, because as far as the police are concerned, he shot an unarmed man without provocation. The craziest thing? If the man had died, his gun would have been lying next to his body, and my friend would have been found not guilty for reasons of self defense. Yeah. You read that right. My friend is in prison because he *didn't* kill a man. Hooray for America's gun laws.

That's exactly what it was, and it was unconscionable. And it had absolutely nothing to do with stand your ground, as that law would not have protected him. A different Texas law applied, one that is much more widely criticized, allowing the use of deadly force to stop criminal mischief in the nighttime. While questionably lawful, it was morally an obvious premeditated murder.

What I'm wondering about, is that sometimes people have to deal with PTSD after shooting someone. Like, even police have to do theraphy in some cases, after they killed a perpetrator. How can people, like that old fart, be like "Yea, I killed someone, and I'm proud of it". Possibly he already was in a war and learned to kill, but do you actually feel save, knowing that they're people living in your society who seem to have no moral quarrel or mental aftereffects from taking a life?

That guy really did want to shoot someone. I just don't understand how he wasn't prosecuted for it. First off, it wasn't his property so he had no legal right to defend it. Secondly, he put himself in the situation, and while he may no longer have a duty to retreat, he certainly doesn't have to right to start a conflict. Lastly, even if that reporter said "they came towards you", the investigation found that he shot them in the back, which belies the "i felt threatened" response. What is lacking, and desperately needed, it a standard by which to judge. "I felt threatened" is far too vague of a concept. There should be no excuse, ever, to shoot an unarmed person. Imagine a world where you can just shoot anyone because you are afraid of a fist fight.
