Stealing from an estate is a crime. It's known as inheritance theft. One of the most important duties of an Administrator or an Executor of a probate estate is to Locate the Estate's property, determine the value of the Estate then file an "Inventory and Appraisal" form with the probate court.
Know that inheritance theft can occur before and after a loved one's death. An example before your loved one's death caregiver, child, friend, neighbor, a new spouse, who steals money and other valuables like jewelry and other personal property.

Absolutely , my sister lied about everything , she said my parents affairs were in order . She was the executor and she was not and she refused to tell us anything . She had a list of my dads assets but refused to show it to any of us , now she says she doesn’t know what we are talking about . Her husband kept saying he was like a son to my dad . My dad never said that ever . Of course they made off with safes , antique coins , antique gun collection , life insurance proceeds , his brand new truck , moved into his house and refused us access to the property . Close to a million in assets and we hardly got the 65000 distribution before it was all gone . So sad , that money my dad worked hard for destroyed our family and the lies and the greed of my older sister who I looked up to my whole life and her husband discust me . The pathetic need to have it all . I thought we would all go on a fun vacation and toast our dad , I was way way off . There was plenty to go around . We got crumbs . My advice is to take inventory and have your attorney keep the records so a family member cannot keep this a secret and steal the information during the complications of your final days .

Your sister can't just do that. Not without consequences. You have legal actions you can take which are specific to this kind of thing. Find a good lawyer..

Thank you for posting this. The thief in our case is the surviving spouse, her children from a prior marriage and their lawyer. We are still in court after 7 years and I reported the lawyer to the state bar, that is pending.

Women committed perjury because I got Epilepsy and they knew I had it never told me I was with my cousin they took all of my mothers properties. Let’s attack the handicapped girl it was not just Scotland. Their son took my house in the UK took my mothers business Canada all over the United States more overseas their daughter, making fun of me because she has all of my stocks bonds investments for my mother and Attorney would make a very large amount of money handling this case my neurologist wrote a letter already stating due to my disability not understanding what was going on nothing prior to 2007 was ever legal I just had back surgery. I’m finally not having seizures. They were 1 to 5 times a day.

this has recently happened to my entire family. my great aunt who worked her entire life was very educated left behind an estate, my mothers oldest sister the executor and one of my mothers brothers the coexecutor took off with every dime. they cut off all communication refused any calls or emails or texts and said talk to our lawyer they chose an “ impartial approach” got ahold of a scumbag rotten lawyer who completely supports their choice to steal, the family is in ruins and devastated over this but my aunts and uncles are too old to fight. i have seen firsthand how ugly greed is

Wow! I sorry to hear that you’re going through that. Your story is far too common. The tough part about these situations is you have to have the will and the money to fight it. it will probably be worth speaking with an experience probate litigation Attorney to see if there’s something you could do.

Thank you so much for your support. It is quite sad because my mother and all my other 9 uncles and aunts are elderly now and they’ve lost their will to fight. I will still do what I can but unfortunately the criminals at hand were so conniving before they did all this, they got everyone to sign the form trusting them in as executors. It’s a very sad situation. I am 31 so I’m not that young anymore but after seeing all this pain caused by greed, I think I am going to study law. Seeing people get robbed is one of the worst things to witness. I want to see if I’m able to turn this suffering into something beneficial for others out there. @@WinWinRealtorsTV

Sisters did this despite my request to follow law in ontario..ones ex RCMP ..THEY changed decisions as they prefer ..refused appraisal of art and collectibles and jewelry also included their kids which weren't benefactors..I don't have kids so always ripped off .took jewelry to private jewelry dealer but didn't share or document. .they picked a day over 2 yrs later to choose jewelry but u was laid up with back issues .they chose for me.but wouldn't send pics said no time for me to find a,ride then sat eating and drinking .I'm high level autistic ADHD but they bully ridicule and lie about me .I'm early retired after 2 crashes.

This is all so true in my case. Only found out after executor (sister) passed away and we got executor title. Lawsuit has been launched against her estate. House she inherited still in probate so all costs to sue back up into house. She pays from estate or house is sold and decided with heirs. Don't let them get away with it. FIGHT!!

That's what probate does . They accomplish this by turning a blind eye to a bad executor and by causing malicious delays and endless fees .

I personally encourage people who have valuable assets titled in their name to consider a living trust in order to avoid probate.

My dad recently died and his wife and her son have stolen thousands of dollars worth of my stuff and the stuff dad gave me. She lied to the court trying to get $60k in spousal allowance. I want her off my property and have her and her son up for larceny. I’m in NC

We had a greedy trustee trust forgery cost a million in the long run so we recommend the FinCEN Validated and NICER certified Crime free inheritance Plan arriving in a few months to fight Financial Elder Abuse.

I’m going through this now! I’m a victim of inheritance theft at the hands of the registrar of wills office probate clerk , audit supervisor and 2 orphan court judge ! My name is in my grandparents will more then 3xs eradicated with my social but yet the register of wills and orphans court made their own rules for their outcome they wanted. My next step is sending my formal complaint to the House of Representatives in DC.

Father died and was only notified after the fact. Found out that father’s siblings told the probate court that he had no children when they knew that there were 3. Siblings of the deceased received all proceeds in Texas court. Children are in other states.

Here in California the personal representatives have a legal duty identify heirs of a decedent. Find out what resource you have, it may be worth consulting an experienced probate ligation attorney.

What I’ve seen is the more complicated the problem is the more money is needed to fight it. i’m sorry to hear that you’re having those kinds of problems of course here in the United States when we have disputes, it ends up in the court system and our court system of course isn’t perfect. if I were you, I would make sure I maintain all evidence as it relates to any wrongdoings. frankly, I don’t have an answer to that question.

I need help. My brother is executed of the will and has destroyed our family to divert my attention to their theft. I'm in Australia. Everyone meant to benifitdied before they got their share. My dad, my uncle killed himself over my mother's abuse to make gran sell. She wouldn't tied it up and trusted my brother, who has taken everything for him and his mum, my own mother I want to divorce

So I was raised from day 1 by my grandparents. They both died of cancer - one smoked, one worked 42 years at Bethlehem Steel & got methothelioma& then cancer. I took care of both. Grandfather passed 1st. I got nothing- only the biological kids which my grandmother tried to fight bc she don't get along w/my mom. So when my grandmother got cancer, she wanted only me to take care of her & I was more than willing. He son would tell me how great of a job I was doing all the time.All my life she said when she dies , my brother & I get my moms third. My grandparents had 3 kids. She told me repeatedly when she dies I'll have more than enough money to get my teeth fixed. Our house we had was sold for around $500,000. Now my Uncle was the executor of the will . Apparently him & my aunt got left Trusts from the estate. My brother & I were supposed to get a third & got nothing. In the will nothing is even mentioned about the money from the house or the trusts for my uncle & aunt. My mom did not get anything like planned BUT WHERE IS OUR THIRD?!! How could he not split the money the right way? All my life I was told I'd be getting my moms third bc my mom & grandmother never got along. Now in the will she was left only $1,000 bc my gmom probably didn't want her to try & sue for being left out. Bc like I said, my mom got $ from my grandfather for wrongful death even though my grandmother tried getting lawyers to get it to go to my brother & I. So now bc my uncle totally changed once gmom died, used me to take care of her & not put her in a home or pay a hospice nurse, could he have split the estate in half with just his sister instead of thirds like what was said & planned all my grandmothers life ?! How do I get my $ ? & why don't wills include Trusts? Wills are public, Trusts are not so it makes it easier for him to just steal all that money ?!!

Let me start by saying that I am not an attorney. And based on the involvement of your story it sounds as an experience Probate Attorney would be the best source to answer those questions. What I can share with you is wills do not contain living trust. often living trust includes wills. Here in the state of California, yes wheels are public and you should be able to go to your Probate courts website and view the will. if there were no will the law of intestate secession would apply here in California. if there was a wheel your grandparents could have named you as one of the beneficiaries and by law you would have been entitled to your portion of the estate. If there were no Will and your mom was a living when your grandparents passed your mom would have been entitled to her portion of the estate. if I were you I would go to your county probate website and do the appropriate research and read all of the notes of the case. If there were an attorney involved in the case the attorneys name will be there in the public record. I would call that attorney and expressed the concerns you told me about. I’m sorry that you were having to go through this experience this is what happens when there is in adequate estate planning.

Yup. My dads girlfriend stole tons of personal belongings and family heirlooms from the estate after he passed away. Unfortunately he was living with her when he passed, so she had very easy access to everything. It took months for us to even get access to my dad's personal belongings because she was being difficult.

My husband's inherited his father's property. His sister is the executor. She sold all of the items from his property without notifying him. She also left off items on the inventory list.

Leaving items often inventory and appraisal list is definitely a problem. I would express those issues to the attorney in the administration and get his or her guidance.

@@WinWinRealtorsTV A so called family member stole my grandfather's car, coins and photo albums. I had to call the police and file a report. It's been a lot & I don't even trust my lawyer. I don't understand why the lawyer won't write me the deed... It's so stressful. In his will he gave my mother and I his house, car and personal items.

@@rae08 When there is a Will the instructions of it supposed to be followed, and if they are not heirs have to take the appropriate steps to correct it. If I were you I would speak with the executor about my concerns and questions. The executor is usually in contact with the attorney.

One of my stepfather‘s nieces that I’ve never met kidnap my mother and has her in Las Vegas. After my stepfather died she took off with my mom. My mother is senile and going blind. My brother sister and I can’t even begin the probate process.

My Sister moved in with my mom who had dementia got a lawyer to give her POA my sister then withdrew the entire 401k then took me out of the life insurance policy as beneficiary then transferred the 25% of my grandmothers house to her name 2 weeks before she died. I found out 2 days later she was then cremated

My father died on Jan. 31 2023. I was contacted on May 10 2023 and was told of my fathers passing. I found out my fathers bother the day after the funeral went into my fathers home and took everything. He also sold my fathers cars and most anything of value. The only reason I found out was my uncle was trying to sell the home without telling anyone and the title company found me. I only hope its not to late.

I’m not sure how he was able to sell your dad’s car because it normally requires the signature of the car’s owner. And as it relates to the home, it also requires a signature or authority from the court. i’m sorry to hear about the loss of your dad.

In 2012, i was 16 years old when my grandfather passed away, i was in juvenile detention center. I was not able to attend funeral or be involved in the reading of will or court in regards to my grandfather. I finally receieved a copy of the physical will in 2023. When i read it myself i was listed as an heir and there was soemthing about UTMA and the $figure it stated vs the check i received in 2013 there is $40,000 missing that i never received. No one seems to want to tell me anything my aunt aka the executer refuses to talk to me banned me from coming to family cookouts functions ect. I need help. Especially with what a utma is where is the money thats supoosed to be mine. And what i should do

The UTMA stands for Uniform Transfers to Minors Act, it refers to laws that allows minors to receive property and have it held by a custodian until that minor is older. I would speak with the attorney who handled the Probate Case.

My brother physically attacked me while our mom was alive I tried to leave her house and she told me not to stress her out she needed me there so I stayed. After being in foster care from him as a child for about 3 or 4 years he's always abusive either mentally or physically. Right after our mom passed away he wiped her bank account and he broke into the home robbed me of my personal items and stole a lot of our mother's items. He also had a ski mask on and said he was standing outside of our sister's bedroom window staring at the top of her and her fiance's head while they slept and said it took everything he had not to bust the window out and rip their heads off and he also said instead he grabbed a brick and busted out the windshield on their truck he has done numerous numerous things against us and still continues to we have not even had a service for our mother yet and she died October 8th because everyone's too fearful to even move and barely breathe because of my brother. We know what he's been capable of in the past and also know that he is very unpredictable at the moment it's a very scary situation I need help I'm in fear for my life everyday. I can't sleep. I have night terrors, it's hard.

I have a pending case now going on 2 yrs in Texas. My sister had poa and my mom died from .espthelioma.. I an not find an attorney who will fught for ne withkut wanting a ridiculous amount of oney up front. I have an attorney who said ee were past the statute of limitations to file in a probate court and he filed breach of fiduciary duty, which she did.monies had and received.. it camr to kight she had $90000. The other sister was c inspiring ... they tried to make us settle, but I did not agree to terms in the settlement agreement and my atty quit. The case is pending, but I did manage to file a general denial. I don't know what wl happen.. my case might bget disnissed? I want. An accounting of my Mom's Estate

You mentioned that you had an attorney an I assume that you have shared this story with him or her. Probate litigation lawyers are the people who go to court and litigate matters like this. My brother took my mom to the bank while she was diagnosed with Algiers disease. She put his name for Benicia th of her annually. While she was ill. He got 122.000 dollars. The will said we were o spilt everything half he won't give me a dime

1. Father wrote a will pointing to my parent's trust. 2. Father died, trust became irrevocable, mother is primary trustee, my 3 sisters and I are contingent beneficiaries. 3. Mother has not and will not provide a copy and an accounting of the trust, and has now sold 100 year old family property belonging to the trust. 4. My sister lives with my mother who is very old. My sister will burn the trust documents the day my mother dies, so there will be no record of the trust. What are my options?

As a beneficiary of the trust, I know you mentioned A contingent beneficiary I’m not exactly sure what that is, however as a beneficiary I believe I’m not sure you may be entitled to to see that trust. Please contact Probate Attorney in your state and get their opinion on that.

@@WinWinRealtorsTV Contingent = I get the money when mother dies (she's the primary) And, I have read over and over on search engines that ALL beneficiaries are entitled to a copy and accounting of the trust. When on earth would a parent like my father go through all of that effort to protect his children, only to die and let the courts say "yep, your mother owes you nothing."?

@@basicprogrammer6147 Check the records of your father's probate/will. Your father's will, and proof that the trust exists, most likely exists somewhere outside of the copy your sister has. ...Try the attorney (or the office) who wrote the trust. They should have a copy.

I am in Wisconsin. I am currently in probate for my mother’s estate and there is $4.5 million of my mother’s investments that before she passed someone removed ALL of her financial documents. We will call that person Jane Doe2 👌 she’s admitted to having 15 boxes of my mother’s financial records- she literally wrote that to the judge and the woman has also admitted to the judge that she pretty much has done what she’s wanted with the money on these various accounts even distributed the funds out. Also my PRIOR attorney stated to the judge “We know for a fact that Jane Doe was the beneficiary of the **** account and they are telling us that Jane Doe2 changed it” 🥺 My mother named me as the beneficiary and I had no idea. And and also this was the first of myself and the judge hearing this a year into this! Excuse my language but it has been a shit show from the beginning. Jane Doe2 kept it a secret that my mother was even in the hospital-my mother arrived at the hospital at the end of 2021 in a non responsive state because she had suffered approx 4 to 5 smaller strokes and then a major one (stated by the hospital that if she would of gotten medical treatment sooner they may have been able to help her from having the major stroke) that left her in a vegetative state😢 I didn’t find out until 2 weeks later. I feel like I’m living a story that would be on a Dateline show. The judge has appointed an attorney now and this attorney is a clone of our prior attorney. The judge specifically appointed him to “get to the bottom of what is going on” The faith I had in this attorney is gone because he is not interested in anything except figuring out what to liquidate as far as selling some of the real estate to pay bills, pay off her debt to close the estate. No questions about her investments. I cannot believe this. Investigation into my mother’s finances has to be done. There is way to much money unaccounted for and admitted to by Jane Doe 2 about this money. What do I do? This is the worst situation of my life to be in. This is MY Mother and I love my mom and I have to speak up for what’s not right. In honor of my mother. I know there have been many wrongs done by the ones that I should of been able to trust. There have been many laws broken and many regulations violated. And the level of disrespect to the rule of law by these attorneys is shameful. The disregard to the law and the lack of respect to the judge. What can I do? I feel so helpless because I have been beaten down by the manipulation done to me by my prior attorney I’m starting to feel like no one is listening and the judge needs to know what’s going on and as a heir I have rights but how can I get the judge’s attention to the situation and for background? I have to get some way for what’s really going on to the judge but How?

Experienced Litigation attorneys would be where would look for guidance in a case like yours. I hope that was helpful. I’m to hear you experiencing this situation.

albertsons is a law firm, they wrote no trustee can be charged with a crime for being bad. nobody knows what is going on with the weak laws here. I have tons showing I am supposed to expect inheritance but it isn't coming. On here when that happens in the comments I see that you say sorry get a lawyer. that is an endless loop.

I WATCHED A PERSON DRIVE OFF WITH AN 1934 FULLY RESTORED FORD ROADSTER FROM AN ESTATE. THE SELL OF A 199? NSX HONDA. THE beneficiary load up a U-Haul and drive off with valubles from the home after being sent a text from a relative that everything was fair game.

My sister convinced my mother to add her as joint onto her bank account. My mother didn't put my inheritance money into a trust account, so when she died, my sister was able to keep all of my inheritance money. The lawyer said the money wasn't in a "trust," and all of my mothers money is considered belonging to my sister now.

Same my aunt was the trustee in my grandparents Will in the even they died before I turned 21 so she knew of their Will. This lady cleaned my grandmother account without presenting a letter of administration. Failed to probate my grandmother Will after her death and waiting two years later to do so - but consented and refused to execute the Will and hid the administrative probate from me and I’m the only legatee written in my grandmothers Will ! Imagine a corrupt Register of Will office !! Imagine that ! Baltimore City !!

I think that’s what happening to me too. My brother is the executor and he had my mom put his name on a joint bank account and he’s just keeping the money along with her car, house, etc. She died almost a year ago and he hasn’t bothered with an inventory yet.

I can relate to what your sister did. My sister used undue influence to get my mother to give her financial power of attorney 3 months before she died while she was in the hospital. My mother was in the hospital and skilled nursing for 6 months before her death. 6 weeks before she died, she used her POA to add her name as a joint owner on her CD accounts. Probate Court was useless. Not only did I lose my mother, but I lost a sister due to her greed. The next time I see her will be in court.

Just asking if you heard it being done in probate judge, probate notes: Petnr seeks to reclaim three of decd's assets: a) approximately $0000 of foreign currency held by Decedent, individually, at a Swiss bank just prior to and after Decedent’s passing; b) R/P at Home 1 Street, Playa Del Rey,; and c) R/P at home 2 Playa Del Rey, - all of which were removed from Decedent’s estate by such persons using fraud.

Hello Mr. Williams, I REALLY enjoyed your video. Here's my situation... As stated in a family members Will, I was appointed Personal Representative of their Arizona Estate. The day after the family members death, one of their children transferred money to their bank account and stated they did so to use the funds to cover the burial expenses; though not the correct way to handle matters, it seemed harmless, as the family member discussed and was preparing their to pay for their burial via cash, but passed away before they were able to do so.. Well, when reviewing account balances to add them to the Property list, I noticed that additional funds were removed. The adult child agreed to return those funds, so I did not file a fraud/theft report with the bank....Five months later and they still have not returned the money and there are other beneficiaries in the Will who are entitled to part of those funds; any suggestions as to the best way to address this? I will reach out to the individual again, to allow them the opportunity to do the right thing; then will need to advise the court, bank, law enforcement or all of the above 😢

How was that child able to withdraw money if him or her were not on that account? if the banking institution allowed it, they are responsible for that money, that is my understanding. unfortunately matters like this our fault via Probate litigation. I would get an opinion of an experience, probate litigation attorney and see what guidance they would offer me. I hope this is helpful.

Im a personal representative and had and I got scammed from the wife of the owner of an antique shop who claimed she was a certified jeweler specialist. She underpaid and I believe the jewelry may have been worth a lot more and I think she was lying about her being certified. Now I dont know what to do cause im terrified. I want to tell my family but I know they may think that I stold the jewelry and scared to tell my probate attorney cause I dont know what to expect. I didn't even want to take this role to begin and got talked into doing by the beneficiaries who are family members. What can I do? Pls help. What can I expect?

I would explain the situation to the estate’s attorney. The worse thing that I’m aware that can happen; one can be removed as the PR an or held responsible for any lost to the estate. You are probably not the first PR to have faced this kind of challenge.

If 2 siblings live in the decedent's home and 1 claims the house as his without proof? And starts charging the other sibling and everyone in the residence rents is this considered theft? I am a beneficiary now in probate cade for my mother's estate. My older sibling claimed everything as his and attempted to keep my portion (20%) of inheritance and my mom's estate.

My sister passed away in November 2021. She left the home I live in and 5 acres of land it's on to me. Her other two properties and homes and everything else she had she left to her grandson who is also the executor of the will which is still in probate. My brother and I are very reasonably sure that the grandson has been stealing from the estate. From what I understand he cannot do anything with the home and property that has been willed to me. I guess my question is, since he is inheriting the rest of her estate anyway is it still considered stealing if he is selling things, not telling anyone and then pocketing the money for his own personal use?

It’s sad to hear challenges you are experiencing. if there is a will it has to be entered into the probate court in the state of California. If that will has been accepted by The probate court, the instructions of that will would need to be followed by the executor, an executor’s job is to carry out the instructions of the will. wills are public information. if there is a Probate Attorney in your particular case they have the answers to these questions. That sounds to me as the appointment hearing, the hearing that appoints your sister to be in charge of the estate. If I were you, I would attend that hearing in person or remotely an object to her appointment, tell the judge what you just told me.

My dad passed away in 2018. A church stole 2.7 million dollars of his money. And they changed his will before he died. I am the benificiary of the estate who is going to end up with nothing in the end of this.. This executor that stoled all the money. Passed away. How do i sue for it? Do i sue the homeowners insurance. Because this man was also remodeling my dads home when he died. Or do i sue his wife.? Because she sold everything and moved already. A probate litigation attorney would be the person to address that question.

As we know they are “bad apples” in every segment of our society. If it were a police officer or judge it is still illegal to steal property from Estate. If you have proof that that individual stalled it especially if the proof is some kind of camera or something in writing it’s likely to stand up in court.

In the General Durable Power of Attorney under title 3.22. Power with Respect to Create Additional Trusts where my mother authorized the attorney-in-fact ( my niece) to make gifts of her property.(nieces cop husband sold my parents homestead acreage of 62 years) and In addition my mother authorized my attorney-in-fact (my niece) to create a special needs trust.The following 2 parts of trust do not mention either of these ,but I the only person on SSI and Medicaid and the only person disabled in the entire family.Its been 15 years and no special needs trust was ever set up ,but my mom signed the general durable power of attorney.

Question ❓. The fellow who claims my Dad appointed him the Executor of his Estate was first appointed Power of attorney last June by my Father. When my Dad passed away last year in October, this guy claims my Dad appointed him Executor as well in a suspicious Will . During the so called accounting..he provided bank statements dating only from September forward.. Can we get this person to produce banking account statements all the way back to June into the Probate Court? I strongly believe that this person has been helping himself to my Dad's assets and money from the start. I really think this guy wrote that Will and forged my Dad's initials to it. My Dad was mentally declining quickly before he passed. I believe that this person is manipulative and very deceitful...dis-honest is an understatement to say the least. My Father was surprisedly well off when he passed and only this person at that time knew it. My Sister and I had only met our Dad 9 years ago.

Sir I would love it if you could personally reach out to me directly due to everything you are addressing right now. My mom was charged vehicular Manslaughter Reduced from a felony to an infraction charge in California it never went on her license or record at all. And my father died and left me everything and actually filled for divorce before he died. My mom's criminal defense attorney changed his legal profession to family probate attorney at law and prior to me being released from jail custody. My mom had me placed on temporary probate conservatorship prior to being released from jail custody on March 5th 2012 she had me placed on temporary probate conservatorship on February 29th 2012. I was placed on a contingency for 13 months before speaking to the courthouse investigator and I was never allowed to speak to the judge and he never met with my doctor from the veterans hospital. And he never appointed legal counsel to represent me in the courthouse as well as when speaking to an attorney about everything he told me that everything was heard in the judges chambers not in public viewing of the courts and we'll my mom's attorney Steve Mortimer was her criminal defense attorney changed to family probate attorney at law. As well as my brother's signature is forged on a form that gives my mother consent to be my conservator. The investigator for the Madera CA courthouse suggested it go to trail because he said I never needed to be placed on temporary probate conservatorship at all. As well as the fact that my mother is not doing this to benefit me in any way at all she is doing this to benefit herself and her wrong doing when I was a kid and we'll she was selling property and stealing from my inheritance and well she has stolen from two inheritances cause my stepdad Tommy died recently from cancer left me his truck and she took it back to Toyota said he couldn't afford the payments anymore. Also to be honest with you I would have to say everything I have discovered up tell now I think my mother truly might have killed my stepdad Tommy because he died from melanoma cancer and we'll she is a registered chemotherapy nurse for Kaiser. And my father died because his sister Barbara LaMattina called my mother and told her that my dad was sending his bank statements credit card statements and divorce papers to his dad's house and we'll one hour later my father lost his life and the first CHP officer on the scene to investigate the car accident that my father died in was someone that my mother and my aunt Jana both dated in High School named Rick Nadeau. So I honest think it started a long time ago cause she had a son who died on March 15th 1985 his name was Sammy David LaMattina and we'll he was 3 years old she told everyone that he died from heart palpitations when his death certificate says he died from Sid's not heart palpitations at all and well I was born March 25th 1985 and my name is David James LaMattina and we'll my first dad died in August of 1995 and his name is Samuel Ronald LaMattina and we'll my stepdad Thomas Carmen Astone III. And we'll I think she killed him to because they weren't legally married to each other she married Tommy in Tahiti which is not recognized as US Territory. And we'll he did get her pregnant and she had a abortion he had a vesectomy cause she said having a kid would kill her and that's not it at all she didn't want to tell Tommy they weren't legally married and the kid would be able to take everything from her if he died so I think my mother is a very sick person and because she works at a hospital people seriously protect your loved ones. Because my mother moved to Bend Oregon and I found out from benverified website and we'll my mom lied to me about where my step dad Tommy was being buried she said he was being buried in Arlington National cemetery when he was actually being buried in Schofield barracks Hawaii. And my brother admitted to his name being forged on this form that gives my mother consent to be my conservator. And the law clearly states that if you cause the Death of a loved one you can't benefit from their death in which you cause! And in the state of California you can only be put on a temporary probate conservatorship for 30 days to a maximum of 90 days and the courthouse has to have something in writing from a Dr stating that he recommended you be put on temporary probate conservatorship and my Dr from the veterans hospital in Fresno California never wanted that to happen to me he wrote to the judge and he never got a response back. And we'll she'll have to explain herself and her saying I'm crazy or this and that to everyone she did this to me her son cause she is my biological mother and well she has told everyone that I am crazy since I was a kid and she said I have never loved her. And the truth is that I have loved her I just didn't like her lying to me and I especially didn't like her spending my dad's money selling his house when I was In AIT and Furthermore treating me like I'm stupid and couldn't catch on to what she was doing to everything that my father left me. If you have not already done so, visit the California Bar Association's website and research probate litigation attorneys.

My mom passed away with out a Will my stepfather was and still is in control of all assets my mom and stepfather own an Apartment which my stepfather soled while my mom was still alive the bought a second apartment which my stepfather said was my mothers share from the sale of the first apartment after my mother passed away my older sister and I put my stepfather on notice to sell the apartment and give us our share that was a year and half ago to this day he has not respond, more over he went behind my mother’s back and put the apartment under his daughter name. I am sure where you are state or country, however here in California if a person dies without a Will and have assets in their name their will have to be probated. A probate proceeding in public record. I would determine if the estate was probated or not by searching the public record. If he estate were not probated, why? Please speak with an experienced probate attorney. I hope that was helpful.

reginald mitchell 1 second ago I lost my mother on this year, February 22nd, 2022 and coming to find out that Mom had a trust in trusting things would go right in leaving things behind. Mom, on her death bed mentioned that she's leaving the building to her Children, but made my sister the power of attorney. The building amongst my sibling was given to me verbally and announced me being the oldest brother would be taking care of mom building. I addressed my sister to draw up a document with my name, wanted to know my role in living in mom's place and nothing was given, in putting a little fire under her feet, I mentioned that I would not pay the mortgage until I get something in writing, after that been said she put the building up for sell without communicating with me or my siblings. What can I do? Feeling very hurt😪🥺😭😤

I’m sorry for your loss. Unfortunately I do hear about disagreements in family matters in probate or trust administration too often. If your sister is named as the successor trustee in your mom‘s trust, your sister has a duty follow the instructions of the trust. Check with an estate planning attorney to determine if this would be a good situation for a trust contest. If you do not know any experienced Trust Attorney’s let me know and I could recommend one to you.

Thank you so much in getting back to me, it just hurt in seeing mom leave us so suddenly and to have my sister to add to the hurt, I really appreciate the video and would love some guidance in seeking answers, my family/siblings we didn't want anything in the beginning, but to see her (My sister) grudgingly take all and just don't care, hurts us all. She will not communicate with us, so in seeking to find out, what was in the trust, will just soothe everything.

I think my step mother has problems with taxes on home because of this she did not let me know anything about the home father left,, i was not raised by him but he did know I existed, when i came into his life he told me an the brother would share the inheritance, but never put on will nor did we do dna test , I don’t what to do from here on out step mother is older lady that needs assistance but brother isn’t taking care of her needs, but dispite of this she wants to tell me she will leave everything my father an her owned to her grandkids , like telling me im not leaving any thing to you. So my dad set up a wheel supposably he couldn't read or write very well So my aunt handled everything well she only had one person sign the will and had it notarized but not turned into I am the only child left and his wife died years ago she had the safe robbed while I was burying my dad stole guns but then they ended up back in the house took his life insurance money and did not buy a gravestone just being as nasty as possible but the lawyer had me leave him with the titles to the property because she had them I would not have released the paperwork if she did not give me a fake will and somehow her name got on the safety deposit box box

Must get lawyer mass immediately Scotland, United Kingdom, Canada, all over the United States not including stocks bonds along with George Washington’s properties on top of that there is literally land all the way from the state of Maine all the way across Alaska everywhere I counted over 35 properties due to my disability of epilepsy, I have not been able to handle anything I just had that surgery the doctor read all of the original documentation and said first of all you had to Mac brain injury. They should’ve done immediate surgery. Follow through regarding the family my person where I get work going to live you ended up in a foster home everything they agreed-upon with your mother completely was broken. Never mind the rest, I don’t have any properties everywhere all over the United States and all overseas and have them stolen from you trying to find a strong attorney is almost impossible. The last one I had God Despard I found out the court date was supposed to be 2016 I was told I had a period of time to fight. Massachusetts attorney generals office was discussed in coming there with the paperwork but it just may be coming tomorrow more seizures.
