I believe it would vary state to state but since it was actually the employee's fault for not charging him, it's not really stealing. This usually results in the employee getting fired but no legal action from anyone unless they found out you were doing it on purpose and doing it often to sell that stuff. It would be stealing if he didn't attempt to pay for it.

No, I would feel way to bad. I have been in situations like this before on smaller scales where shop assistants have not actually charged me for everything or even given me the wrong amount of change by giving me more back and I've instantly corrected them and pointed out their mistakes without hesitating. That's just how I was raised.
