@@beachliving3127 Basically he pled no contest and took a plea deal. She stole the car so they probably couldn't prove he knew. The resisting was subsequent to that and passive so the judge probably gave him non-association orders and called it a day.

Yeah it sucks when the cops work so hard at looking for these thugs, chasing them down, and having to fight them to get them in cuffs the whole time the thugs are screaming and sweating all over everyone, then the judge or prosecutors dismiss most of the charges. It's ridiculous. I know it's probably because of a plea agreement but still. Our justice system is way too easy on criminals. Like these two idiots, they have long records and are still walking around taking people's property when they should be sitting in prison.

Yeah he was dumb. Situation like that you keep the suspects in the car at gunpoint until backup arrives. He was in chaos, turned his back multiple times on the driver who could've shot him, both could've overpowered him. It was a disastrous stop but the cop got lucky.

I work for the courts, the public defenders always end up getting these charges dropped and they usually plea to the lightest offense. It really drives you crazy when your processing the criminal case and you see how much these low lifes get away with compared to what they are charged with.

"Dismissed and read in" means that the cases are dismissed, but the judge may consider the conduct underlying the charge in determining the sentence in another charge which a person is being convicted of. So not as bad as it sounds.

@@southernbreeze3278 It is as bad as it sounds because they are already repeat offenders. They got ANOTHER slap in the wrist, guaranteeing that they will do this again. Reading it in and dismissing is ok for first offenders, or people genuinely making life changes, but they face no consequences for their actions, and they CLEARLY did not care about getting caught this time either. If the jails are full and they can’t take them, then at least convict them and sentence them to something else.

The reason a lot of the time judges dismiss these charges is because of overcrowded jails and prisons. It's been a growing problem for at least three decades. It all began when the Reagan administration dramatically reduced funding for mental health facilities which forced a lot of the folks who should be receiving proper mental care onto the streets. Police are then essentially forced to deal with the fallout. Something which police are neither trained nor equipped to handle. The justice system is utterly broken. The US has one of the highest incarceration rates in western industrialized countries. This is not because US citizens are generally more crime prone. Rather, an underfunded judicial system, lack of proper mental health services along with bad incentive structures within departments creates inmates at disproportionate rates while not actually helping reduce criminal behavior.

You can and likely will get hit with an intent to distribute charge if you have over a certain amount, regardless of whether or not you're actually selling it. People don't typically buy in amounts like that purely for personal use unless they're relatively rich, though. Unless you're the kind of moron who stores his entire stash in his car and winds up getting searched.

Even if you are completely INNOCENT just because the officer puts you in handcuffs doesn't mean you are being "arrested". It's a legal detainment. The fact she was acting the way she was is reason enough to be very concerned. The officer managed a very chaotic situation very professionally.

It's just a desperate bid to contend the situation. They don't actually believe that anymore than she believed the cop was actually trying to assault her when patting her down. It's just panicked bs. It's like the DUI stops where people claim the cops are just giving them tickets to make money for the city, despite being clearly intoxicated. It's something they've heard about so they're desperately throwing it out there to try and avoid what's about to happen. Its nuts they stole a car, were uncooperative, and threatened and kicked a cop just to be let off. I was caught with like 4 grams of weed and paraphernalia and had to pay like a 900 dollar fine and got put on a conditional discharge for 6 months. All they got was a slap on the wrist and walked out

I would not be surprised if Destinee was a behavior support student (BST) in high school. As a teacher, her affect suggests that she probably has had a long history of noncompliance, arguing, and fighting in the public school system. Don't know about the county this was in, but thats a huge problem here too. They get their charges dropped because they rat out their friends all the time and stay as an "informant" to police instead of getting time. My old boss had her car stolen and nearly totaled as well as missing money and items from the car, and the woman who did it got her charges dropped, and she's a well known informant.
