One of the worst aspects of it is that it's in the receiving parent's financial interest to withhold access to the child because the fewer nights the child spends with the paying parent the more he/she pays. So they end up paying money they can't afford to a child they're not allowed to see and they now have no money to pay a solicitor to help them. That's the next 18 years of their life. It's a miracle the suicide figures aren't higher.

My son was 18 in March this year and I had a mutual agreement with my ex payable up until then so that’s what I did now she has gone to cms for a claim for up until he’s 20 but my son has been at college since 2023 one day a week for 4hours an also has a job I have phone DWP fraud and HMRC fraud how long does it take for them to intervene? I’m have had a letter from cms an going to ring them to tell of all I have just said how long does it take for them to find out what iv said to then go no further with the claim many thanks

If your on benefits you still got to pay child maintenance at £30.50 a month.. you get £393.45 per month on Universal credit. 😢

I am currently having this problem. My child has been working full time for the past 2 years doing 2 jobs. She is 18 yet im still having to pay £170 a week. I contacted cms and gave them the info yet all they said was child benefit is still being claimed therefore i have to carry on paying. Im at my wits end and dont know what to do

With all this rigid technology they use now the human aspect of the past where you could speak to someone and if they agree could actually change things, nowadays they can only change something if the computer system lets them, so you get bizzare situations like you said in the video of both parents saying they are out of education and yet they cant stop it, things like this seem to happen all the time in all aspects of life, the one downside of technology replacing everything

I’m going through a nightmare time with the CMS at the moment. My daughter is now living with me and the CMS rejected my change of circumstances because I’m not claiming child benefit for my daughter so I’ve now put in a claim for child support. The process can take up to 3 months apparently. They will make contact with the mother and stop her payment and only when I receive payment of child benefit. Will the CMS update the status. Meanwhile I have to continue paying maintenance to the mother while my daughter lives with me. Currently seeking further advice on whether I would get away with suspending payment until this is sorted out.

You have to apply for child benefit from HMRC. They will ask th eother person. If the other person demies it, a rival claim will be processed where both parties provide evidence of the greatest care. If you win, it can be backdated. Once you win, CMS direct feed to HMRC will show the other person is not getting child benefit and the case is closed. You can open a case, from the moment, child benefit is not being paid.

Its an area where CMS is slow. You end up paying whilst child is with you. Ive been through this twice, and then the child changes their mind!

My Daughter end of term date is Friday July 5th 2024 . So would that make my final payment go past 31st August 2024? I thought my daughter finished in June

Yes. Her age is only signigicant for CMS purposes if she is under 16 or 20 years old. Under 16, your going to be paying CMS, even if frarely at school. Above 16, 12 hrs per week educaton needed. Age 20, absolute end of CMS even if in education... although arrears may apply.

My daughter was in work for two years and they hit me with a bill for 4k !! When I went to court … the CMS representative told me that this wasn’t right but as the case was shut I’d hit to pay it !!! 😮😮😮

Hi Keith, Whenever I google "Child benefit 2023 what is classed as education" or "When does CSA stop" I keep stumbling across the same old text, I'm sure that google just uses the same text for every answer, so my child is has just turned 17 beginning of December 2023, apparently she is attending College. So as she is attending college is this classed as secondary Education ? I believe child benefit is only payable IF a child is in Secondary education, is this correct? So do I need to get the college to tell me what type of course my child is on? All I seem to get is this repeated over and over Your Child Benefit stops on 31 August on or after your child’s 16th birthday if they leave education or training. It continues if they stay in approved education or training, but you must tell HM Revenue and Customs (HMRC). What is Approved education? Education must be full-time (more than an average of 12 hours a week supervised study or course-related work experience) and can include:- A levels or similar, for example Pre-U, International Baccalaureate T levels Scottish Highers NVQs and other vocational qualifications up to level 3 home education - if it started before your child turned 16 or after 16 if they have special needs traineeships in England You cannot get Child Benefit if your child is studying an ‘advanced’ course, such as a university degree or BTEC Higher National Certificate, or if a course is paid for by an employer.

You are not entitled to Child Benefit for young people aged 16, 17, 18 and 19 who are in advanced education. Examples of advanced education are: • any course in preparation for a degree • NVQ level 4 or above • teacher training This is not a complete list.

Good question. Attendance at colllege does not automatically qualify for child benefit. Education must be approved to Level 3. I personally know of at least one child, who was compelled to do a different college course, to the one they wanted, in order for Mum to retain child benefit. You may need to ask the college what level it is. If it is A levels, that is Level 3. Child benefit cuts off 4 times per year, not just August. So its possible that it may bbe before 31 Aug. Note, if taking exams in June, it continues to 31st August, but if they leave at easter, it stops on 31 May. See: kzbin.info/www/bejne/ml7bd4ptdp18etU

Furthermore, if child benefit ceases before the 19th birthday it cannot be resetarted once the "child" reasches 19. So you need to speak to child benefit and pursue a fraud case, meaning that the child benefit should cease from before the 19th birthday, which then invalidates the claim post 19th birthday. You might also like to speak to CMS, on the basis that i the claim is invalid you are due a refund. Some have deliveberatly swopped to collect and pay in the past to delay payments, and to make it easier to obtain refunds.

If a child no longer qualifies for child benefit, ie left education. Then it’s a fraud report. If child still qualifies, but is primarily in your care, it’s a rival claim.

Im near the end of child support payments journey I have been paying for my 18 and 20 year old adult children since the oldest was 6 and can’t wait to be free,I may not support my 18 year daughter through university because I will be settling the £10,000 debt as child support made mistakes in their calculations,refused to correct their mistakes pushing me into £10,000 debt in order to punish my 2 new young children. For 1 year they have ignored considering my new child into the calculation despite supplying them with his DWP child benefit certificate. I’m still paying child support for a 20 year old daughter with learning disability,she has been on her life skills training at college for 3 years,she just started her fourth year this year. It seems this will never end and may be paying child support for another adult for life.When does child support payments cease for adult with learning disability?

It won't be in the CMS interest in annual review to confirm if the child is still in FT education as it generates income by not asking for any change in children still in education and in receipt of child benefit

The child education status does not come into it. The annual review is all about the change of income, no tif shared care is changed. or a cuhild is no longer entitled. They are covered as seperate events at the time. For example a large number of children stop being eligable on the 31st August each year. The reveiew before that, does not consider that. It just calculates the weekly amount based on the income. CMS dont know if you r child is continuing in education, they dont even know where your child is studying.

I have to take my ex to small claims court to recover my CMS overpayment. Its was me who caught ex still claiming CB so I told HMRC that our child had left education (online form) and completed a fraud report (another online form). Forms are quick and easy. Good luck!

In my opinion child maintenance shouldn't exist. It's no business of the government or wider society what private citizens financial arrangements are. Married parents aren't coerced into handing money to each other, why should separated parents be forced to? The children still need paying for when at the paying parents home, why aren't they given money as well?
