You're right about being on the bottom of the pile. I got arrested because someone tore off a guy's ear and I was on the bottom of the pile. Some gal actually testified that I wasn't the guy who tore off the dudes ear because he was on the top of the pile and I was on the bottom. I got off but I still got arrested and I had to pay for a lawyer and a broken jaw. Fighting is a lose lose nobody wins.

On 12/11/21 I had a road rager brake check me, we collided. Do to the video I had he was ticketed for reckless driving and the ins found him 100% at fault. I had my firearm on my right hip, it never came out, everything was on camera including the cabin of the car. I live in a duty to notify, once the police showed up I let them know I was carrying and I had my CCW. Get a dash camera it will help you in more ways that you know.

Very good video! I try to use a very simple rule: I don't reveal a firearm unless I see a weapon or firearm. And yes, avoidance is number one. The best way to dodge a punch is to not be there when it's thrown. Anyone that feels brave or "manly" because they have a firearm, should not have one.

The one caveat I'd add to that is if the person has you pinned down and is pummeling/kicking you to death, or trying to strangle you or take your firearm. In which case.... it's so bad that you may as well have a knife to your neck, I'd say.

My concealed carry instructor, years ago, warned a shooter will likely be convicted in a road rage incident. If you are the instigator, you have no case for defense. My driving behaviors changed a lot after strapping on a gun.

It is amazing how far an immediate apology goes towards de-escalation if you agree with someone and say they are absolutely right and that you didn't mean any offense and you are extremely sorry and even horrified that you might have caused any offense -and that none is taken on your part. Pride is your worse enemy sometimes. Wish them a good day and a good life and leave them at it. Disengage and GTFO of there.

A while back I had a rager following my daughter and I, she was 12, as we were driving along. He verbally threatened to kill us both. I was armed but it wasn't time to go there just yet. I knew a police station was a few miles down the road so I lead him to it, drove to the back where the cops parked. He hightailed it out of there with police giving chase. He was caught soon after. He was wanted in NJ for several violent offenses and was a gang member in Trenton. This guy deserved to be shot but thankfully it wasn't me who had to do it. I was fortunate enough when I began carrying to study laws, both statutes and case law. I was amazed at how these things can turn bad real fast for someone just trying to get where they're going. So many of these things apply to armed response.....you better be really sure a gun is necessary. Anyone who carries and isn't learning how is walking on thin ice. Videos such as this are great resources for that education as are forums that are gun/defense orientated.

@@AshGreen359 - If you attempt to drive away and they pursue you, you are building a case. Follow up with calling 911 and continuing attempts to evade. Do not reveal your firearm unless they employ deadly force - keeping in mind that juries won’t consider a car deadly force unless they ram you first. In most cases attacker will break off in boredom. If not it’s likely cops will be there quickly, if you’ve done your job right it will be obvious you are the victim. If there is violence, let the cops mete it out on the other guy.

The three most important steps to take if there's a possible incident: 1. Identify the situation ahead of time. Can you 'see it coming'? 2. Avoid the situation if you can. Take another path, pull over, take the exit..... 3. Deescalate if the first two steps do not bear fruit.

Fortunately he didn’t start anything inside the bar and eventually calmed down (after his girlfriend left him for being an asshole). In retrospect I should have asked bouncer for assistance first or second time he “asked me out.”

The day I got my conceal and carry license in the state of texas, I became the most peaceful driver on the face of the earth. I realized in the moment, when I put on that holster, that I did not it wanted ever to go there. It has been quite a few years now since that day and I have not had any altercations. If someone becomes angry with me on the road I stay calm and let them have the road. If someone starts to cut me off in traffic, I back off and let them have it because I realized they're only trying to get where they need to go. I don't play those games anymore and it has changed my life for the better. I view carrying a handgun as carrying a tool of last resort. I set my mind each day to the fact that the only way that gun will be pulled is if it needs to be used immediately because my life is in a minute danger. I hardly suggest that everyone adopt this attitude to help keep themselves out of trouble.

May I make a comment and ask a question-- First off, as a former city police Detective I agree that it is always an extremely bad idea to display a firearm in a road rage incident, even if you're the 'good guy'. The one who sees your gun inevitably will, as you said, lie his behind off and claim you pointed it at him. And, since they saw your gun, they will be able to describe it perfectly. This is why I would say there is NEVER a reason to just 'display' a firearm-- you should only be unholstering it if you plan on following through with it. If you feel a use of force is imminent, you can certainly place your hand on it but DO NOT pull it out so anyone can see it. I can say I have thwarted a couple of attempts by erstwhile 'complainants' who claimed someone pulled a gun on them, by asking them what the gun looked like-- it was "big and black and scary"... when in fact the guy had a chrone Derringer. I will add though that in my state at least, judges aren't generally going to sign off on a Felony arrest warrant off the word of only one witness, no matter how convincing. More is needed-- Forensic evidence, video, another witness, etc. But bottom line-- don't let the other guy SEE your firearm. That way he won't be able to describe it if he decides to lie and say you brandished it. A question-- have you considered doing a video on going w a bench trial rather than a jury trial, or vice versa? In my state you can choose, and most detectives and Comonwealth attorneys (as prosecutors are called in VA) would agree that often, a defendant is worse off going w a jury for guilt or penalty phase because the results are often worse-- whether you're guilty or inocent. Why? Because judges are extremely experienced and can tell easily whether they're being lied to (while most jury members/ordinary people can be naive)-- there's nothing a judge hasn't seen before. But also, juries often don't have any pity at all, and recommend much heavier sentences than judges, who are often more proportional. I have several times heard Commonwealths say "he shoulda gone w a judge trial..." Anyway, I think a video from you guys on this topic would be interesting.

In Minnesota you are only allowed to have a BAC of.04 when carrying a firearm which is a very small amount. Most instructors recomend not drinking at all.

@@ArmedAttorneys I don't carry concealed or carry off private property at all but in my state it is a crime to "be in possession of a firearm while under the influence of alcohol" (paraphrasing). Without telling you what state this is in can you say anything about how they would define that? Discretion of cops/DA/judge/then jury? I'm pretty sure I've seen people visibly a few beers deep shoot on private property in front of off duty cops for whatever that is worth. Just wondering if you have any insight into how that works in states that prohibit but don't define shooting intoxicated (in the code of statutes at least).

The .04 is because they 'technically' needed a number, to be a specific line. So they just slapped half the usual legal limit on there. Rest assured, even if you are under 0.04 you will still not be having a fun time if an officer stops you.

I tell people to avoid road rage and third party encounters all the time. The Rules of Stupid handle the bars problem. Neighbors can be a problem. OC Spray for dogs, as a first issue and default.

Road rage being #1 doesn't surprise me. I've noticed a huge difference in road rage incidents now compared to 40+ years back. Back then someone might swear at you, beep their horn and for the most part that was the end of it. Now, it seems people use their car to brake check, run you off the road, pull over and come at you with a weapon from their car, a few swear words and such don't seem to cut it anymore. Escalation of road rage encounters is off the charts. One area I wonder about is if a nutcase brakes and stops sharply in front of you on a highway. What are you options if the driver exits his car and comes for you? Specifically, I have a major concern about him forcing you to stop on the highway. Stopping on a highway is extremely dangerous, how many times do we see on KZbin videos of another motorist just plow into the back of a stopped car on a highway. Is trying to get away due to the huge risk of an accident a reason to forcibly (if given no choice) using your car to drive around said stopped car in front of you but in your escape you hit the nutcase motorist in your endeavor to get away. If they get hurt or die, can your car be a self-defense weapon? How pertinent is your reasoning of imminent danger of having a distracted motorist drive up from behind and crush your car when they crash into you?

Excellent break down. When I took my first Texas Concealed Carry class our instructor brought in an ADA to explain our responsibilities and liabilities relative to carrying a gun. This video served as a reminder that it’s unlikely I would be attacked by a gang of 10 armed bad guys but a road rage incident might be a different story.

#2 varies from state to state. I lived in the PNW for a while and I looked up the laws, asked an officer and he said, “if an animal attacks your pet, do what you have to do”. I was told the same thing by an officer in a very red part of Commiefornia when a pit dug a hole under his fence to get to my dogs.

Great video. Almost all of the training we see is based on responding to a criminal attack. Yet that doesn't break the Top 5. I have a "Winning the self-defense encounter" class that covers many of these elements. The "badguy" is most likely not a "bad guy."

As a former NY Police Officer and retired Federal Agent, I have a rule I NEVER EVER violate. If I'm carrying concealed, alcohol never passes my lips. One of the very first thing the police will do in a shooting incident is take a sample of the shooters blood to see if the shooter had consumed drugs and/or alcohol. Don't drink and carry.

As a martial arts instructor, I always promote the acronym: ADAC - Avoid Diffuse Accept Confront Always AVOID the potential fight, if avoiding cannot be achieved, then DIFFUSE by being the one who states let's not fight, let me buy you a drink, I don't want to fight, let's get over this, etc., if diffusing the situation does not or has not worked or simmered the conflict down....then you ACCEPT that you will be in a fight and CONFRONT by engaging and ending with the least force that will subdue the aggressor. I really appreciate both of your videos and commentary, much appreciated.

For a neighbor disputes I recommend getting cameras , I have my neighbor making a threat on camera and I just keep that on file so if anything does happen and goes to court I have footage for the Jury . Stay safe you all . Stay safe you all 🤙🙏

Jeff Holt: At 1st thought, I would not have believed that RoadRage was that high either. But having moved from a metro area of 2 1/4 million to a county with barely 40,000, I look back on my daily drive in the city and 2nd thought is that they are totally believable.... Out here in the sticks with little traffic, it's more likely to be Bar Fights, Neighbors, or Dogs. I don't drink, have plenty of room to avoid nasty neighbors, and since my two dogs died last year I feed and pet my neighbor's roaming dogs. Love dogs. Have also noticed that dogs are like DemonRats in that the are ALWAYS on the lookout for a handout. But also unlike the DemonRats in that they are friendly and loyal to anyone who feeds and pets them. And they don't care what you think or look like......

Dash cams can really be helpful to document what has happened. It may even deescalate a an already tenuous situation. A few months ago, I actually had someone try to bait me into a road-rage incident with their aggressive/dangerous driving. After several minutes of this, we came to a stop light. They got out of their car and started walking back towards me, but I think they noticed the dash cam because they just suddenly stopped, stood there for a second, turned and hurried back to their car and took off. I had video proof they were the aggressor, so it ended right there.

I have one, too. Gives great peace of mind. I'm not sure how the audio aspect of things would work, but I'm thinking there might be an advantage to narrating what is going on where the camera isn't pointed or if it may not be clear to lawyers what is happening. I'm not a lawyer, but I'm thinking it might be beneficial to give a verbal record of what you are encountering in a way that paints you as the victim, e.g., "I'm trying to get away, this person won't leave me alone" etc. But I'll leave that supposition to the lawyers.

A long time ago, I flipped a guy off because he cut me off in traffic. He started aggressively flipping me off repeatedly, brake checking, basically throwing a tantrum in his car with gyrating arms, bouncing in his seat, etc. I said, "Holy shit, this is bad." and took the next available turn to get away from him. I even avoided driving on that street for the next few months, just in case he was looking for me. That was my lesson on the meaning of, "Discretion is the better part of valor." I never again felt a need to flip anyone off.

I think everyone who owns a gun should be subscribed here. Firstly, there is a huge amount of misunderstanding by many folks as to the legal ramifications of owning a firearm, much less having to utilize one. Second, even those who have a good - or better than average - understanding rarely have the broad base of experience that is being shared here. Richard and Emily present things so concisely, in language we can all understand, there is simply no excuse for not taking the opportunity to absorb the wisdom. I thank them both every time i view one of their presentations.

You (R) made a comment right there at the end (@13:19): juries ARE going to think about it...they just can't help themselves. This is the reality behind the oft-touted "I'd rather be judged by 12, than carried by 6." Yes, if you have to defend yourself, you have to defend yourself. The one CCW'ing is the one responsible for their safety and the safety of those in their care. Having said that, I can't tell you how many times I've heard the 'Judged by 12..." as almost a rallying cry to never back down, never budge one inch, EVER. It's as if the fellow's world will somehow dissolve and their lady will leave if they back down (if she does, let her go). As one who has had my share of hearing airborne lead whizzing past my ears in another life--and seen the damage that lead can do when it reaches its intended target (aka lead poisoning), when it comes to these situations, such as road rage or neighbour wars, where I can take a step back and ensure that nothing will happen to me or mine at that time...I"ll do it. I'll do it every time. I really think our bravado and our sense of masculinity being damaged has caused way more damage than it should. I'll just bet as abogados, you guys have to deal with this 'He challenged me!' mentality all the time. I'd really like to see some discussion about Bravado vs. De-escalation in a future vid. Twenty years ago I lost a close relative to unnecessary lead poisoning because 'he was THE MAN, and he HAD TO prove it to everyone.' What a useless encounter that was! Everyone: listen to these lawyers. They aren't sitting there talking just to feel their lips flap. They know what they're talking about. Good vid, thanks. You two are 💯 times more informative than the wasted 2 hours I spent listening to the "Law of self-defense webinar." Mid way thru I I commented this feels like an old school high-pressure timeshare pitch. It was just 2 hours of, this is why I'm great, my book is great, this is why my consultation is the best ever, I won't consult on any case unless you're a platinum level member, do you really want to go to jail for the rest of your life!? There was supposed to be a q&a, at the end, there wasn't, just one quote about how much some anonymous person liked him. Then he gave away a few books and before anyone who asked a question could say what about... he ended the Zoom. He might be a good lawyer, but you two actually give out helpful information in short, and to the point segments. Thanks so much! 👍👍

I had what you might call a "near miss" road rage incident. In a nutshell, when the young man(mid 20's) stepped out of his car with what looked like a sawed off pool stick...my hand went to my holstered pistol.( I am 66 years old) At that point his wife/girlfriend said, "Harold, if you get locked up again, I AM NOT GOING TO BAIL YOU OUT!" Luckily for everyone, he just yelled more obscenities at me but got back in his car. I have absolutely no desire to hurt or kill anyone. But since I am my wife's caretaker, I cannot allow myself to be killed or beaten to the point that I cannot take care of her. Sorry Harold.

I have found that most problems today have been solved centuries ago. Another reason to read the classics. Marcus Aurelius stated in book 1 “Meditations,” “My First Teacher: 'Not to support this side or that in chariot-racing, this fighter or that in the games. To put up with discomfort and not make demands. To do my own work, mind my own business and have no time for slanderers.'" Marcus Aurelius figured this out in about 170 AD. If everyone followed this simple rule, there would be fewer problems in this world. Shakespeare figured it out too! In Shakespeare’s play, Henry IV Part 1, Act V Scene 4. It’s spoken by Shakespeare’s popular knight, Sir John Falstaff said: ‘To die is to be a counterfeit, for he is but the counterfeit of a man who hath not the life of a man; but to counterfeit dying when a man thereby liveth is to be no counterfeit, but the true and perfect image of life indeed. The better part of valor is discretion, in the which better part I have saved my life.’ Use some "discretion" in everything you do, it might save your life. If you don’t like old solutions, here is a simple, but not as eloquent: The “Four S” rules: 1. Don’t go Stupid Places. 2. With Stupid People. 3. And do Stupid things. 4. At Stupid times. Avoidance is the best policy. Look for trouble on the horizon, and steer clear of it. If you see trouble coming, leave.

This happened to my father. He was 65 years old and he was threatened by a young man in a parking lot. My father brandished a weapon and drove away. The police came to his house almost arrested him.

I know someone who pulled into a gas station. Saw a Large man rip a woman out of her truck and throw her on the ground. He intervened, pulled his handgun and told the guy to back off and get on the ground. The woman got up and said thank you and got in her truck and drove off. The guy held the man at gun point till the police arrived. Turned out it was his truck and the woman was stealing it.

Thank you so much for all this information,I think the majority of us armed or not don’t consider the possible outcomes when talking to police. I was raised to believe police are the good guys & you can trust them to do what’s right for you but the simple fact they can legally outright lie to you says otherwise! It is hard to go against what you were taught to believe from a young age! Thank you.👍

In road rage incidents most often one party is not paying attention to their driving and the other party is. This causes conflict because the party not paying attention to their driving thinks they haven't done anything wrong when the other party passes or tries to pass them. All of a sudden the party that was not paying attention is now focused solely on the party that was paying attention to their driving. Now the one party who was not paying attention before is all about "why are you passing me? I can drive" or they are now offended because you passed them. I have had this happen to me many times. People driving 35 in a 55 and when you go to pass they all of a sudden remember they are on a road with a speed limit of 55. Now you couldn't pass them at 75. But, when you allow them to remain in front they know they are pissing you off when they don't do the speed limit so they slow back down until you try to pass them again. I have had this happen so many times that I am sure it must be some kind of macho thing. After you try to pass them for NOT driving all of a sudden they are completely awake and hostile. Really annoying and now they are deliberately messing with you. I will still pass them when they slow down again which they always do. It's kind of like you can only go as fast as I will allow you to go. A control issue. So I pass them anyway. Now you can't shake them at 100 mph. Yes, people are that stupid. It does make you want to hurt them. I understand road rage very well. I just never draw a weapon to deal with it.

Road rage #1; makes sense. Within days of getting my license had an incident. Driver was offended that my reflexes were faster and chased me down and blocked my vehicle from moving. Thankfully I had MANY MANY hours of watching the Active Self Protection channel so I had my firearm out, safety off and hidden out of sight. I silently begged the other guy to stay within his vehicle and thankfully he was content with yelling from his SUV. I had no idea what he was yelling as my stereo was pretty cranked. He was also on dashcam.
