One of my brothers bought a car from a large new car dealer's used lot. It broke the timing belt and trashed the engine about 200 miles later. He had it towed into their shop when it stopped running. It turns out the timing belt was due at 60K. He bought it about 50 miles short of that so it broke barely out of warranty. Once he found out he called his salesman who basically gave him the sucks being you line. He called me not having any idea what to do. I told him just go in to the service department. Make sure you are calm and make sure you talk to the service manager. Tell him the situation and that you would never have bought a vehicle that was due for a major service without that being part of the deal. He called me later and said that the service manager told him to just give him a couple of days and he would try to come up with a solution. They don't do business like that there. A couple days later the service manager called him back and told him that he spoke with the owner and manufacturer's rep. They had come up with a solution that they thought would make him happy. His guys should've caught the belt was due in the pre-sale inspection. It also shouldn't have broken that early. The manufacturer would supply an engine, dealership would put it in and he would provide his own transportation and agree to not miss any payments in the meantime. He was really happy with the way it turned out and being a bouncer and weightlifter he first inclination wasn't to take the calm discussion approach. It took about three weeks and he drove it for a few years.

I’ve worked directly in or around the car business for over 38 years as of now. I’ve seen several salespeople, ex managers from dealers and other self proclaimed “experts” of the auto business put up content on KZbin proclaiming to spill all of the so called secrets. This is the first of your videos I’ve seen and I’m very impressed with your honesty and accuracy about legal matters concerning dealers and customers. I’m someone who has been an expert in that part of the industry and you are correct here. Bravo!

I had to file a lawsuit against an extended warranty company. My car needed an engine replacement. After making me jump through a ton of hoops they denied me after making the dealership tear down the engine. So I paid $14K ( at the Mercedes dealer) for a rebuilt engine 20 years ago. Then there were attorneys fees. It ended up being $20K that they had to pay me

I want to talk to an owner of a extended warranty company and it’s actually their policy. They just want to see a publicly that building 990% of the claims and added at 90% only 10% of those people will actually go through and sue them and it’s cheaper to pay the attorneys fees and that 10% than fixing all 90% of the people to complain.

Hi Lucky Lopez! Help! I'm in California & the used dealer where I bought the car, they did not ALLOW me to test drive it. They said that if I would test drive then they would not give me the good price I had offered, and salesman also said that if there is ANYTHING wrong with it, they would fix it... and there was a lot of things wrong with it and now they refuse to fix it and. I paid $8000 CASH. I paid it on the September 23th 2024 and did not receive it my car until until October 5th 2024. Oh and I did not sign a test drive form or they tricked me into signing that form, but I was never told or advised that I was signing a TEST DRIVE FORM.

It’s false advertising and illegal in Georgia to add a bunch of BS fees to the back end of the deal and to not include them in the advertised price. Specifically transport fees, dealer prep, electronic paperwork filing for $900, etc. It’s hilarious because every single dealer I’ve encountered in the past 3 months charges all of these unadvertised fees and refuses to remove them “because it’s how we make money.” Dealers have continuously told me they don’t make money selling cars, they make money with fees.

Very important! Have a Carfax dated the day you buy the car. I was presented an older carfax without an accident with a 2000 mile car. A carfax done on the day of purchase had shown an accident. The dealer knew it, as they fixed the car after trading it. Get copies of everything & don't sign blank papers.

Not exactly true. I live in Tennessee, and purchased a 2013 Mustang in 2015 with about 18K miles, which made me the second owner. It developed a vibration 60 days after purchase, and after spending another 60 days in the shop waiting on an engineer to diagnose it, they identified it as the manual transmission output. The transmissions were backordered with an ETA of six months. Ford bought it back from me. In fairness, the dealership did not think the buyback would happen, either. But because it was still under the 5 year/60,000 power train warranty, it was eligible. I suspect the laws have a lot of variables from state to state.

As clearly stated in this video, used cars do not qualify for the Lemon law. Your car was used with 18k miles on it. Your car was still under the 60k mile warranty and they were nice enough to buy it back instead of having you wait six months for the part. That didn't have anything to do with the Lemon law and everything to do with the fact that your car was still under warranty.

Unfortunately, not being informed and thorough can cost you-sometimes dearly. In my case, it cost me $10,000 of hard-earned money as a down payment. On December 31st, I went to buy a 2019 Duramax 3500 HD with 50,000 miles, priced at $65,000. I was planning to put $10,000 down and finance the remaining $55,000. However, the finance department pulled a fast one on me. They made it seem like I wanted a warranty when I explicitly said I didn’t. As a result, they pocketed my $10,000 down payment. Later, I discovered I was locked into a 13% interest rate, a $1,500 monthly payment for 72 months, and a loan for the full $65,000. When I called them to confront the issue, they brushed it off as if it was nothing. It makes me sick to my stomach to realize how some people are just out to take advantage of others. This is the price you pay when you’re inexperienced and don’t do your homework. I was naive and young, and it’s painful to see how some people are willing to exploit that.

Hi, Lucky Love your channel, but as an attorney and arbitrator for the BBB's 'Auto Line' program, I felt like certain statements made should be clarified. The first item is that if you are looking for a repair/buyback/lease cancelation, you may not be able to do so. The reason being that all the major companies have mandatory arbitration clauses in them. This is the Auto Line program run by the BBB that I work for. Consumers shouldn't be afraid of this; it moves fast, and many consumers prevail. Best of all is that it is a partially binding result. If I find for the consumer, and the consumer accepts my decision, then that's it; the car company has agreed to be bound. Regardless, Lemon law remedies are still available, as well as any other legal recourse. Auto Line is basically a free bite at the apple. You just have to stop here first. The other point is the new cars only thing. Essentially, for the most part, that's true. Still, many CPO, Demo, used but under warranty cars are still covered. Even some cars that are under manufacturer extended warranty, or 'secret warranty' cars may be covered. I've even had a case involving a used rental car. Check before you assume you are out of luck. Again, love your videos. Arbitration is a level playing field. Finally, yes people CAN sometimes get free cars. As a private attorney, I've had at least two. One was an 'instant delivery'; the other an accidentally returned title. Both were followed by illegal attempted repos. Rather than go to court, both dealers gifted the consumer with the cars. Finallly, never hesitate to call a lawyer, preferably one that deals in automotive cases. For not much money, there's a wealth of hard won information available to you. And one final piece of advice to dealers, car companies and consumers alike. Don't lie. I'm hearing a case, often on limited doccumentation, and the testimony of the parties. If you destroy your own credibility, it will be tough for you to come up with a favorable outcome.

Excellent video and commentary on lemon law so many people don't understand. A couple of points: 1.) FTC window stickers are required on all used cars and 2.) the retail installment contract is between the dealer and the customer with assignment to the lender that agrees to buy the deal according to the terms of the contract. The dealer assigns the contract to the lender (holder in due course) and the DEALER owns that car until that happens.

Lemon laws vary by state and some states have lemon laws that cover used vehicles. I live in GA and the lemon law process is very straight forward. Dealer had my car in the dealership trying to fix an issue for over 30 days and by law the manufacturer had to replace my car or buy it back. I had all my paperwork and 30 days later they bought my car back, whole process took 60 days.

This is a great video, and I think everyone in high school should show that they comprehend this or something like it. I have a few questions/comments, however: 1) Since you mention Carfax, how does the consumer catch a Carfax that is not current and may be missing something major? Is it wise to buy a Carfax directly, and what other recourse does a consumer have? 2) The potential litigation angle is part of the risk of buying out of state. If something goes wrong it means filing litigation in that state and potentially travelling there. 3) What you say is why it is so important to get a pre-purchase inspection! 4) Check to make sure that the paperwork (amount financed, interest rate, payment amounts, etc.) that the finance company receives matches what the dealer gave you.

I think the only viable circumstance to see what dealer is when you can prove that they misrepresented the car which I was able to do recently because they sold me a car that was listed in three places is having no accidents and come to find out. I had bits of glass all through the trunk with more falling out of the body panels because the car in fact had been hit. I took it back and show them where the car had obviously been re-sprayed but you had to look close and where the glass is coming out and they offered to buy the car back because they knew they were in the wrong.

Great informative video. Most people do not understand how costly it is to file a lawsuit, they mistaking believe the lawyer will take their case under contingency, where they pay nothing and the lawyer takes a cut of the settlement. Lawyers are not dummies, they only take contingency cases where they believe they have a good chance of winning AND there the settlement/award amount enough to justify there costs. A used car lawsuit, even if it's clearly winnable case, doesn't come close to covering the expenses a lawyer would incur representing a client in a lawsuit, so these cases are strictly bill by the client by hour cases.

Unfortunately the trust between the general public and dealerships has been completely eroded, it's going to take a change in the rules for how consumers get cars to mend it. The level of dishonesty evident in the old way of selling cars (dealerships) is going to have to give way to something else. There's a reason car manufacturers and dealerships are not getting along at the moment, the manufacturer's reputation is being dragged down by the dishonesty. Personally I think selling direct to customers online is the way to go.

Thanks for your informative videos. I purchased a 2022 used Audi SLine...Beautiful car. When I first looked at the car, I didn't see any damage. After I signed the paperwork, the dealership detailed the car, I Ieft the store, and on the way home, I noticed numerous scratches covering the front end to end of the car hood. Also, there are numerous tiny nics and a dent that look as though a rock hit the hood.. It seems as though the last owner drove behind a MAC truck hauling tiny rocks, and they fell onto the front end of the car. It also looks like the owner could've driven underneath something and scrached the front end of the hood. I reported it to the store manager, and he told me to bring the car in, and he will buff the scratches and fix the rock dent. I looked at one of the scratches, and I saw a little rust. I really don't want the car now. We are talking about an Audi. A whole lot more happened. The day started off by me telling them I was on my way to look at a car (another Audi). We set up an appointment days before.. .About 1 hour and 15 minutes into my drive, they told me the car was being moved to another dealership to be serviced, due to the engine light coming on, but they had other cars I could look at. When I got there, I was introduced to the Audi 5 S Line and a lot of unprofessionalism. I wish I would've walked away. How would you handle this. It's a bit much to put all into writing. They did critical things that I now have second thoughts about going into any dealership.

I had an AS IS problem a few years ago. Not a car. Bought a high end electric bicycle. After purchasing it and as I went to pick up receipt the dealer grabbed it out of my hands and stamped it AS iS and told me he forgot about that. I was super mad. I mean he did not mention it and stamped it after I had paid with a big grin on his face. The battery caught fire and burned out my garage a week later. Major retailer local to me is like this and I did not have the resources or money to fight it. How can you avoid these types of behaviors? I mean he altered the paperwork after I had paid. I went back with a few buddies and picked a fight with him. Got away. Maybe a few months recovering will teach him a lesson. Jumped him as he was leaving work on Friday night.

When did carfax reports become mandatory, or is that just in your said state…. Because here in New York it’s just courtesy to supply your customer with the history report. Now if the bank requires that as a stipulation for financing than that’s a different story but I can’t see any state “requiring” a Carfax disclosure

I purchased a used car for my daughter from a mass dealer and the engine gave out after 80 miles of driving it. I found out the 30 days doesn't start until the date of registration. I had the car almost 2 months but it was less than 30 days it was registered so I was still covered legally. COVID BS you need an appointment to register a vehicle now it took a month to get plates on the thing.

@@garysgarage.2841 That was a big problem in DC, where there are no tag and tie companies licensed by the city. You have to use the DC DMV to get DC plates. They straight up told people to just drive on the temporary tags they got until their appointment. One of my coworkers during 2020 was a DC resident who bought a used Chevy Malibu from a dealership in Maryland. He had to use those temp tags for almost 3 months. That's how long it took for him to get an appointment.

I got burned on a CarFax as well. I bought a car for my wife in the rain; which is a big no no, worked for my dad and learned that early in life. The car in question was a used rental fleet car @ an incredible deal. The CarFax came back clean so I signed up for it. What I didn’t know was the rental fleet company fixed the car and apparently didn’t report it. I got it home and realized a couple of days after we’d had the car that it had been hit HARD in the front end. I did not know that Car Fax would help us correct this situation until about a year afterward.

Carfax can be wildly inaccurate, if the car was never reported damaged to the insurance company, then there no paper trail to report on the Carfax. There is no legal requirement to report damage or repairs to Carfax, even if a Automotive collision shot does the repair. If it's not an insurance repair, it's not getting reported to anyone.

Hi @Lucky Lopez so I bought a single owner no accident certified BMW, and later found out it had been in a pretty major accident. I put a good bit of money down to make sure I was never upside down. I’ve been in contact with the dealership and they are offering a little more over the depreciated value. Or trade into a EV to eat up some of the negative equity. I’ve had the car maybe 6 months and now am almost 17k upside down due to the accident newly showing up on the carfax. They are telling me it’s not their fault the market has turned and it’s the best they can do. Do I have a case?

My wife and I recently got a car from carmax and they gave our registration to the wrong person and gave us someone else's. When we opened our packet when we got home we had another person's personal info with their ssn, address, everything. They assured us ours wasn't given out but at the same time said this person's info wasn't even supposed to leave their office. It's been nothing short of a headache and we were going back and forth with one of their customer care agents or whatever I forget the position but they investigated and again assured us our info wasn't give n to anyone but they can't prove it. We had mentioned compensation before and this person asked what we wanted and we said we didn't know yet and then when we mentioned we wanted a settlement dude straight up left orbit and we haven't heard anything from anyone in almost 3 weeks now I think. We've filed with the dmv ect and looking to take this to court or arbitrate.

Lucky, my understanding is CARFAX is a private company that offers a service. No DMV says that a dealer has to show a carfax, autocheck etc to sell a car, so I don't know how that stands in court. Correct me if I'm wrong.

A couple of more things I’ve gotten in to us we have a group of car dealerships that belong to one parent company that their policy for selling cars is to get the keys to the trade as quickly as possible and hold the customer hostage until they sign the paper work. I as well of several of my friends and coworkers have been burned by this and refuse to do business with any dealer connected to this parent company. Another dealership I did business with was in the business of forcing highly over priced car warranties. I told them I didn’t want or need it because my credit union offered a much better deal. They forced their warranty into the deal and then went into “we’ll just hold you hostage until you sign the paperwork” mode. I eventually got out of the warranty about year later but it took about a half a dozen trips to that dealership which was about 100 miles away from where I live.

Im surprised you had to buy back over a CarFax. In Missouri, my understanding is that it falls under the As Is agreement. Customer has the VIN available to do due diligence if they choose and an inspection by a mechanic should turn up anything that never made the report. Its not the responsibility of a dealer to have to know whats on a history report, its on the consumer.

I"m just guessing here, but I think the issue is that if the dealer (or anyone selling) know's something about the car that fundementally changes the value they have to disclose it to the customer. So if an engine craps out because of 60K miles between oil changes it's reasonalbe to assume the dealer didn't know that, but an accident or two on the CarFax it's reasonable to assume they would. He just couldn't prove he told the customer about the CarFax. Steve from Lehto's Law did a video on it not too long ago.,

Unfortunately, the Nevada DMV loves to just put the screws to dealers and find a way to fine us it was cheaper to buy a bag and then risk getting a five to $10,000 fine from the DMV

Definitely read all the paperwork or take someone who can better understand it. In preparation to buy a new truck, I decided to look at the agreement paperwork for my first car, which my dad had signed under his name so I could get at a low interest rate, just to get familiar with it what the paperwork looks like. I noticed that he had signed to buy a “Wheel Rim Warranty” for a $1600 markup. I asked him about it and he never bought any add ons, but I showed him the paperwork and he didn’t even know he had signed for it. He’s doesn’t read well in English and the paperwork the provided was all in English. He said they just gave him the stack of paperwork and he signed away, not knowing he accidentally purchased an add on he didn’t want. Fast forward to now, car has been paid off for a couple of years now, no issues there. Obviously there’s no way to complain about it because of the time that has passed, fact he signed a legal agreement, as well as just being a responsible adult, but I think it’s still pretty scummy that the dealership had snuck that it and taken advantage of the situation. I hear horror stories of people going to the dealership and I dread having to go through the same process myself.

I have seen dealers sued for selling a trade in before the deal was finalized (payment from bank didn’t go through). It was awesome to watch the dealer make it right.

Too late, but NEVER hand over money, yours or the Banks, UNTILL EITHER YOU OR YOUR BANK HAS THE TITLE and it has been verified with DMV. If you check with DMV now, you'll likely find that there is an outstanding lien on the car.

Decide to buy it back? That's not how it works. You get an attorney and you sue the manufacturer under the lemon law. It's varies by state but typically the statute includes payment of attorneys fees. Do not go to the manufacturer and just ask nicely

I bought a RAV4 2 days ago. I was co-signing for someone who has bad credit. The dealer switched my name to the buyer and the person I was co-signing for as the co-signer. The salesman told me and the person I was co-signing for that the price included a 2 year warranty. I found out the next day when i went to pick up the paperwork that I was the buyer and that included warranty was charged 2,225.00 extra. The salesman gave us and took back from us the paperwork we were signing so fast we did not have time to read them. No Carfax report was even offered to us to look at. The dealership is in Florida. The salesman also put me and the person i co-signed for down as the same address. And we do not live together and are just friends. The salesman said he would email both of us the paperwork. I never received an email so that is why i went back to the dealership the next day to pick it up.

Why is the dealership involved at all? The leasing contract is between you and the Leasing company, NOT the dealership. The dealership may have brokered the deal, but they have not say after the sale.

I'd love to see a video talking about how different segments of the car dealers are the same or different. Like how an upscale (Mercedes, BMW etc.), Mid-Tier (Toyota, Honda, Subaru etc.), and Low-Tier (Used cars) sell and operate in the same or different ways.

I could be wrong but last time I checked here in NJ you can take Lemon Law action on a used car but it has to be within a certain number of miles/years. I could be wrong, I'll have to check.

@@mph5896 Last time I read through the NJ Lemon Law was like 2005. I found it though... My memory is really bad... _Under the Used Car Lemon Law, used car dealers are required to provide warranties on every used car that is sold for more than $3,000, that is seven [7] years old or less, has not been declared a total loss by an insurance company and has an odometer reading of 100,000 miles or less._ On top of that the NEW car lemon law is for vehicles 2 years old or newer with 24k miles or less. There's even a *Motorized Wheelchair Lemon Law* 😆 I had no idea... _The law requires manufacturers to provide customers with warranties that last at least one year and cover defects which impair the use, value or safety of the motorized wheelchair and scooter._ _If your wheelchair or scooter has the same problem after three repair attempts or is out of service for a total of 20 days, you may be entitled to a replacement, refund or early lease termination, minus a reasonable allowance for use. A reasonable allowance for use is based on the number of days that the wheelchair was used before you first reported the problem._

So I bought a car in 2013 . It was a 2012 . I paid it off in less then 2 yrs ,April of 2015 . I asked about the title at the bank when I asked for the pay off amount which I paid rite then . They said it would be sent . Here it is an I still have no title to this car . I called the dealer asked about the title an they said they had nothing to do with it. Just go to the bank . Called the bank . They went out of business. But I gave them my loan number. They said they had no record of the loan I asked if they could email me a letter saying just that so I could take it to DMV so I could get my title . She said call my bank . Ugh so I did . They found my check for the pay off amount. I called DMV they said there's a lean on the car . I said oh no it's been paid for yrs . Ive had this car for 10 yrs . I need the title . What do I do??

Frank sure its possible. Yet you will have to pay for the attorneys time to go and read, plus they likely will have a minimum, plus overage rate. I wouldn't disclose to the dealership that you are having an attorney review / read the contract. While you are at it might as well bring along a CPA and a E.A. for accounting/finance/tax advice. YMMV :)

Not covered but curious. I assume I have no ground here because I bought the car as is but I purchased a vehicle the other month after reading all the features like remote start. I run in and get the car from the dealership and it has none of that when I bring it home and they claimed the descriptions are usually a template and it was likely copy pasted over from another vehicle and I can go pay to get that stuff added if I want. Take it I’m screwed?

Bought a car from a individual dealer who said the only thing that said the only issue was the mass airflow. The Transmission was bad and the engine was screwed up ran hot in less than a week. He specifically said nothing was wrong with it but the RPMs revved and specifically said it was not the Transmission. I have the texts and Facebook messages. He is a licensed dealer.

If you stuck in vehicle with loads of payments & cant get out add gap insurance & crash vehicle & you be done as they will pay off vehicle difference if your insurance wont give you enough. Carfax can take up to 4 months for items to be listed on it same for AutoCheck & I know dealers selling clean Carfax vehicles & after they purchased it accidents repossessions etc. goes on Carfax when they try to sell it or trade it in.

We went to small used dealer to buy a car cash when we checked the paperwork it had payments. When we asked they said that by mistake they wrote that the cash was for a down payment and they financed the exact double with a crazy 21%. I don’t think it was a mistake. I had a Nissan dealership sell me a car, my car insurance was under my business name but the auto loan was under my personal name, the dmv wouldn't accept the business insurance so the dealership photoshopped my insurance card and sent it in to the dmv and registered my car, which Is fraud because the docs were altered, My insurance lapsed and I tried to reinstate it but dmv won't accept the original docs because my business name is on it. do I have a case against the dealership?

One thing that always scares dealers in NY NJ area are brokers. There are a lot of brokers and dealers now that are bringing cars to people’s homes and having them sign paperwork at their house. I’ve heard, not seen it firsthand, but I’ve heard that this can be used to say that the customer was pressured or under duress when it was signed.

My last 3 cars i’ve used a broker in NJ. Numbers sent clear and understandable. No shennighans with fees. Deal done all from home. With the last car my broker found, finished paper work and scheduled a pickup time in less then 2 hours at home.

So my truck had an engine tick so took to a ram dealer. they did diagnostics and told me its a cam/lifter job and it would be 8k. When i picked truck up after being fixed the tick was still there at noise level of 4 instead of the 10 like it was. they told me all hemi have that tick. I have a ram truck same year and challenger with no tick. This was two weeks ago. Well now the tick noise is at a 9 if not the same as before but they insist its something else not the cam and lifter issue. they said the noise is in the lower end and was hidden by the noise from the cam and lifter job. its the same noise just not at a noise level of 10. I'm fighting and cant afford to pay 8k for a diagnostic and have it be wrong and now pay more money. when the diagnostic was done they didn't say it could be this or that they told me the issue was cam and lifter and 8k fix. what can i do?

Hey Lopez I just found this video, thank you for posting this interesting information, if you could kindly answer this question it be amazing, I am currently thinking about suing in small claims this dealer who sold me a used car, but didn’t disclosed that it had a bad engine issue and that they patched the engine with silicone instead of actually fixing it. I spoke to a lawyer and he told me that this was a case of fraud because the dealer never disclosed this issue on the contract, and said that I should take them to small claims. I also read a law I can’t remember now, but says that dealerships have the responsibility to inspect the cars thoroughly and sell the product in the best shape possible. Something along those lines. I think it’s product liability. What are your thoughts?

I am happy with my dealer. I don’t want to sue anyone. But I have a Ford maverick hybrid on order. Everything is good if I could have it delivered. There was a battery cable that need replacing. It was replaced, no recalls, but it’s been at the rail yard since April. 135-150 days out. I just want the vehicle delivered. What can I do?

Fascinating insight of Gypsies ripping off car dealers I had no idea. I'd rather just find an honest dealer than go through the gauntlet of shady practices and have to be on high alert at every agonizing second. Buying a car in San Diego County California simply sucks, the dealers are all greedy shysters. If you buy here you are forced to pay mark ups, forced bogus fees and if you refuse then they will not sell you the car, period. They all are in collusion with each other to keep the prices exorbitant. I wish it was just a fixed retail price instead of an MSRP, a manufacturers "suggested" retail price. The last two cars I bought were out of this County and out of this State.

So I bought a car from a dealership and they didnt give me a title till almost 3 months later the car didn't pass emissions and when the called us to pick up the title it was in the previous owners name from a different state . We asked for our money back and they agreed to give it back in 7 days we went to pick it up and they weren't there and wouldn't answer our calls . When I say getting back home they called me and told me they had a misunderstanding that they would have a check the upcoming thur morning they called me Wednesday saying they weren't returning our money

SUBSCRIBER: Need help please advice, im dealing with a lithia dealership and for over a year now they have not fixed my infotainment screen blacking out on my c7 corvette. I have come in a to get the screen fixed before and they swore they fixed it but then it continued to have issues, I have waited over a year can I sue them for not fixing it? I also have an extended warranty that I used last time. They keep saying the part doesnt exist any more but that shouldnt be a valid excuse because they refuse to get a lightly used part. How can I get them to either fix it or provide me some kind of partial refund?
