My ex fiancé got me a puppy for Christmas while we were engaged/living together (2.5 years after the engagement). I broke off the engagement for a variety of reasons. We hadn’t even started making wedding plans or even talking about getting married since the engagement. Now he is saying that I have to return ALL gifts to him, including the puppy, because he said all those gifts were given in contemplation of marriage. Does this have any legal basis? I understand that I need to give him the ring back, but the puppy was my Christmas gift in 2020 and I have several witnesses who could testify to that. Aren’t gifts given on holidays unconditional?

Birthday, Christmas, and other holiday gifts are unconditional gifts. Great analysis! The condition of the gift is set at the time of conveyance. "Will you marry me? Here's this ring." "Here's this house so we have something to live in when we're married." If he didn't condition the gift at the time of conveyance, then it is hard for him to argue that there was a "meeting of the minds" for any contract.

@@MatthewHarrisLawPLLC thank you for your reply 😁 Do conditional gifts always have to be expressed conditions, or could he argue that it was an “implied” condition? There were definitely no expressed conditions that he conveyed when he gave me this puppy for Christmas. It’s just so ridiculous… he would have had to say “here’s this surprise puppy for Christmas that I’ve been promising to get you for years, but if you break off the engagement you have to give him back” 🙄 He seems to think that because he got me this puppy assuming/hoping we would never break up, automatically makes the gift conditional upon the relationship continuing/marriage eventually happening.

@@browneyedgirl1542 You're well versed on the conditions of gifts! The implied condition would have to have some relation to the marriage though. "Here's $1,000 as the down payment on the fence for the house we're going to live in" would be implied because it has some relation to the condition of marriage. It doesn't seem like the gift of the dog was related to the condition of marriage. As you said, it was a Christmas gift and he'd been promising to get you that gift for years. Honestly, if it were me, I would tell him to kick rocks and sue me. I love my dogs and if an ex wanted to take one, then they'd have to take me to Court.

@@MatthewHarrisLawPLLC thank you for all your guidance 🙏🏼 I am the same - my dog is my world and he will have to sue me if he thinks my dog is his. He’s trying to say now that he actually didn’t get the dog for me alone, that he actually got him for “us, for our family”. Since we were living together at the time, I’m sure he was HOPING we would stay together to enjoy the puppy together in the future, but from what I’ve read, giving a gift in hopes that a marriage will follow isn’t the same as giving a gift conditional upon marriage. Anyway. Whether he has the guts to actually sue me… I guess time will tell! Thanks again for your help, I feel better already 😄
