I have taken or defended more than 2,000 depositions in personal injury (civil) cases, and it's surprising how often deponents try to do that. I have to patiently explain that their attorney can place objections on the record, but the deponent has to answer the question. They can later bring a motion to preclude introduction of that information at trial.

It was Harvey and Louis' fault for not preparing her, even though she insisted. They didn't have to guess what case Malick was going to ask her about. Louis should have attacked her personally as he did in the CM process in order for her to be prepared to keep her composure in the stands and not give in emotionally.

It would not have made any difference. Malik through a curve ball and it wouldn't have prepared her for the shock. Dona would not have been prepared and would have broken down anyway. Even if Louis attacked her she sees him as a friend and not a threat now unlike back when he did so she would still feel relatively safe even if uncomfortable.

They knew he was going to attack Harvey and Donna's personal relationship, and that since working at the DA, Malick had accused Donna of her and Harvey having more than just a professional relationship. She had to be prepared not to lose her temper. When Harvey lost control and hit Tanner, the decision was made to have an internal trial to prepare him not to lose his temper in court.

Yeah - it's a tad dated now, but I have to say I just adore this series - all of the actors in it are fantastically believeable and mesmerising to watch. I especially love that there's no violence to offend and very few swear words. This was such a great show and I'd like to thank all the amazing actors in it that kept me so entertained and everyone involved for such a great story and series. I'm watching it for the third time (and yes, I know some of the lines) and I love it just as much as the first time - a true classic for sure!

As we learned in a few of the mock trials they ran in suits, when you plead the 5th to everything, they can set you up with questions that make you look guilty for every single answer you’re pleading the 5th for. Sure technically you’re not admitting anything, but if you’re the jury you’ll have an opinion and if you don’t say anything you can’t help your case.

Not sure which clip you are referring too, but, you can only plead the 5th if it incriminates you in a crime. Donna couldn't plead the 5th regarding loving Harvey because to do so isn't a crime.

if donna pled the fifth there, the judge would draw the adverse inference that she did in fact tamper with evidence in this case and the effect would be the same. Also, don't know that it applies here but bear in mind that you cannot use the fifth amendment selectively - answering some questions on the stand and ducking others, because opposing counsel has a right to cross-examine whatever testimony you do intend to enter into the record. If you attempt to use the fifth selectively the judge can rule you have waived your fifth amendment rights (why you often see people on the stand pleading the fifth to everything) and at a minimum will have the rest of your testimony stricken from the record.

Mike's explanation of how his photographic memory works is flawed . . . if he has to read and understand something in order to remember it, how did he instantly memorize the page of random computer code to win his bet with Benjamin when they first met? Benajmin even said, "If you get a single comma wrong, I win." And Mike responded, "There are no commas on that page."

Its still amazing how in Mikes Bar ruling, the person who put him in prison after a dogged campaign to so, after being released, is ever allowed to be at the table at his bar ruling.
