That poor man looked incredibly relieved and grateful when the judge said his child support will stay the same. He is the respondent here of course, not the petitioner, so he didn't know what the heck he was going to be dealing with that day. I honestly feel compassion for him and his obvious anxiety. Just a quick editing error. It says John is the petitioner. He's actually the respondent. I'm only mentioning this because when I first saw it I was confused as to what he was petitioning the court for.

Technically speaking he is the petitioner. This was a modification and since he was the original petitioner he remains so on the case. She was petitioning the court but he was the partitioner originally on the case.

He can't. A judge can only rule on the motion that is filed. He cant show up to court and ask for something that was not being considered. The other party has to have time to prepare to defend themselves against the suit.

@@tt-wy1xr Yes and No. It depends on the State. In criminal Court? If the plaintiff doesn't show. The Defense can ask to have charges Dismissed. Which is a Motion To Dismiss. And in some Circumstances? The Court will comply. However, In some States? If the Plaintiff doesn't show on more than one occasion? The Defense can ask to have all Child Support Reduced or Dismissed During Court. In New Jersey? Most Judges will honor the request. Texas May Be A Little Different. Now in this case? If he had Motioned the Court for an Increase? The Court would have (More likely than not.) Set a New Court Date. And, if She Didn't Show? The Court would have (More Likely Than Not) Granted Him The Increase. As I Stated Earlier. It all depends on the State ...

commonman80 In this case, he couldn’t get any relief because he didn’t file anything. If he had filed something, her relief would’ve been denied and the court could proceed with what he filed. That’s family court in Texas in particular.

IE: The Original Case Being Heard In Child Support Court? Interesting... But Good To Know.. I'm Guessing The Exigency Laws Are Applied Differently In The State Of Texas.. But Then Again? commonman80 You’re welcome!! They don’t necessarily have to open a separate case. Once the case is open, the Respondent can file their own motions into the pending case. They just have to set their motions for a hearing at the same time as the Petitioner does.

Not a rise, only on the awareness that there are just as many deadbeat party mothers as there are deadbeat party fathers. It goes both ways and they have to pay like the men. Deadbeat fathers have not changed any stigma, not when they are not paying child support. It was not the dead beat fathers that pointed that there are also dead beat mothers, just there is more talking about that there are dead beat mothers. Just that they are just as responsible for paying child support like the dead beat fathers. They do like the men when they keep quitting jobs and keep getting arrested for non-payment of child support order.

Hey my ex sister in law was a deadbeat right up till my brother got remarried and his new wife adopted my nephew back in the early 90.and now my nephew will be 31 in July if he wanted to he can sue his birth mother for child support but he then again he doesnt want nothing to do with his birth mother cause she picked a child molester boyfriend over him at the time my nephew was a few months old my nephew doesnt care to get anything from her at all..

I think everyone has a right to move on but...when you decide to bring more children in to the picture, you need to make sure your other children aren't impacted negatively because of it. The cost of raising kids only goes up the older they get. So make sure you can financially take care of (mother or father) all of your children in the case of getting remarried or having more children after a divorce. In the state I live in in the case of children born to different mothers, the oldest child gets the most and les on down after that. I do not agree with this. How is a child going to feel when and if they find this out when they get older? That their older siblings were more important because they were born first? I don't know, just my opinion.
