Supreme Court bans Ahmednasir from appearing before it

The Supreme Court where tonight, judges have slapped advocate Ahmednasir Abdillahi and associates of his law firm with a permanent ban from ever making appearances at the supreme court. In a statement, the full seven judge bench of the Supreme Court said Lawyer Ahmednassir has relentlessly ridiculed the Supreme Court and its judges accusing them of corruption and undermining the Supreme Court. But lawyer Ahmed Nassir has dismissed the ban and instead termed it a badge of honor

Rights come with responsibilities. Secondly everyone's freedoms end where other people's rights begin. Supreme Court, too has rights. Ahmednassir had already been cautioned against throwing endless accusations of corruption and incompetence of Supreme court judges. He was politely reminded to take such evidence to JSC, for his claims to be processed.

As a person who has even been a member of JSC, doesn't he know the role of JSC? Anyone with any kind of evidence of incompetence or corruption against any judge is expected to take that evidence to JSC. But Ahmednassir prefers a platform from where he can make all sorts of unsubstantiated claims against some judges and from where his claims are not tested. Supreme court has done the right thing.

You have missed the gist of the discussion. Ahmednassir is not just about "people who are not happy with the IG". This is a Senior Counsel. He is a former member of JSC.He can't conduct his case against his perceived "incompetent and corrupt" judges in the streets or social media. Officers of the court gave a code of conduct. But leave alone Ahmednassir's status in society, no one ought to do that. He ought to put together his evidence against the judge he has in mind and present it to JSC. If you have been keeping yourself updated, you would have known that Sonko did just that when he was unhappy about Justice Chitembwe's conduct. It led to Chitembwe's sacking. And it wasn't even a long time ago! How many judges have been sacked because of Ahmednassir's endless social media rants? The fellow is just being an irritant and Supreme court is right to show him the door.

I can recall this Ahmenassir called even former Chief Justice Maraga and his judges some really bad unprintable names. His holier-than though attitude to the Judiciary is sure some scandalising behaviour. He has severally attacked his learned friends in a manner that can only be compared to attacking the delivery of the Judges which reflects poorly on him. It borders on personal. Like somebody who only attacks your talent and your star. Ahmenassir is not forgivable in this at all!

This is nothing out of ordinary in this. Ahmednassir had been cautioned earlier against insulting individual judges and supreme court. He was reminded by Supreme Court that the right channel is to take his issues to JSC from where they would be processed in a structured and factual manner. Everyone in any society bears some responsibility to that society. And Ahmednassir is not just another "everyone". He is an SC and has even been a member of JSC. This action by supreme court is therefore justified in that Ahmednassir is a "serial offender". If Sonko could use the same channel to have Justice Chitembwe sacked, why can't Ahmednassir trust the process?

Very interesting, I am not a lawyer, does it mean that he cannot challenge that ruling, if so does it mean the high court being the highest court in the land it cannot err? what of the human element in making a ruling or does it mean the number of lawyers making a unanimous decision in one direction it eliminate that possibility of error? Does it mean that the judges cannot act out of anger and revenge in punishing the senior counsel? so how will he challenge the decision, should he want to represent himself in that court? Ranting in social media is only aimed at tainting the character of judges. If Sonko, with no legal training, could follow the JSC route and get Justice Chitembwe sacked, why can't Ahmednassir do it even better? Sonko has something to show for his fight against corruption in the Judiciary. He floored Justice Chitembwe. What has Ahmednassir got to show for his endless, ineffective but irritating rants? Zero! That court ruling does not discharge him of such a burden. Secondly, and more importantly, courts are not created by individuals. They are created by the people of Kenya through their constitution.

It has been taken after he had been cautioned to avoid taking his issues on individual judges and the court as a whole to social media.
