They clearly didn't think they'd win with that, but it was also clear that there is immunity of some kind, specifically for official acts. The position of the prosecution is that there is ample evidence to bring this case because he was indicted. This court actually said the correct questions have not been answered. I'm sorry if this delays a more convenient timeline for your political cause, but the courts are pedantic and refer this back for those questions to get answered. The prosecution can tell from the ruling that they will not have a case to bring as a result. They need a better case.

Not the same. Official is defined by the origin and methodology of the order. Illegal is per the constitution. There are plenty of unofficial illegal acts, and unofficial legal acts. There are also official legal acts, and official illegal acts. The legality is in the basis of the purview of the office and the violation of the constitution and code. I think unofficial acts compelling or limiting speech are illegal. I think official acts that violate the constitution are illegal. We have the impeachment mechanism to prosecute illegal acts. This is an important decision for both the separation and authority of our branches of governement.
