सर मेरा 10 साल से चेक बानस का केश चल रहा था वो केश मे हार गया हारने की वजह ये रही की बेंक ने जो चेक के सात मेमो दिया उस मै बैंक की सील तो लगी है पर उसमे बैंक कार्मचारी के सीघ्नेच नही तो Cort ने मेरा केश खारिज कर दिया इसमे मेरी तो कोई गलती नही है ना ये तो Bank की गलती हुई ना तो क्या मे एेसे मै क्या Bank के खिलाफ कानुनी करवाई कर सकता हु Bank की इस गलती की वजह से मै 10 सालो तक कोर्ट के चकर कटता रहा मानसिक अौर शारीरक रूप से पीडित हुआ पैसो की बार्बादी हुई

Sir apka pass koi judgment hai.. if chq is outdated instruments.no case will lies against accused. Chq issuse on 01.04.2018. complainant deposit said chq in month of May. Thenafter again said chq deposit in month of July.. but said chq validity expire in month of June .. is their any judgement favour accused

Sir, mere Bank me 2 creditcard he Dono pe 3-3 lakh k parsnol loan chal Rahe the. Covid19 k baad mere Bussness me lost ho gaya. Emi pay nahi kar paya, 3-3 Emi dono ki Bounce hue tab Bank se ligle notice aaya. 23000 aur 25000 ka. Se. 25 aur 138 Court case hua. Mene Lok adalat me dono ka payment kar k case close kar diya. Ab bank ne loan k Full amount jo baki he usko Bounce karva Rahe he. Kya bank is par vapas phir se case kar sakta he ? Sam customer sam card pe aur mene koi cheque bhi nahi diya Ecs hit kara rahe he. Sir Ecs me 138 lagta he kya?

ECS bounce attracts 138 of NI Act ( readwith Section 25(5) of Payment and settlement act 2007) and we cannot escape from the same.Earlier settlement seems to be qua two instalments only. Unless and until complete loan is settled, there is no escape from ECS dishonour and Bank can file case against you

Sir, Bank ka creditcard writtoff ho jane k baad kon se case kar sakte he. Civil to ho sakta he mujhe pata he. Magar Ye RC (Recovery Certificate) bank kis customer pat kat sakta he. Agar cust. Loan settle karna chahta he to bhi Rc kat sakta he? Writtoff card par bhi Rc kat sakta he? Sir Wt card me meximum kya kar sakta he bank? Bahot jyada sawal kar diye he sir is liye sorry lekin utyub pe aap ne mujhe ans. Kiya aur koi ans. Nahi deta isliye pls. Ans. Me.

Banks are write off the loan amount on which they feel that amount is not immediately recoverable so write off is an internal process of the bank for their books of account it does not affect on the defaulter of loan. Bank can proceed under the provisions of law

Dear Sir, Your word's are true, but while crossing examination of evidence for what for amount issued, when and where issued, whether within limitations factor payment transaction, every judge's will not consider the supreme court order, some times judge's may not aware supreme court orders. Lawyer brought to Honourable judge's knowledge. Otherwise keep on consider the appeal from lower to supreme court level. Thanks for your judgement reference.
