What if someone lied and give untrue information of the death certificate, like written the ex divorce wife to the person death certificate as a spouse or a widow instead the legal wife. My father died way back 1986, my mother had not received any VA benifits since my father died. My brother made an appeal with the VA, and the VA recognized him as our mother's representative. The appeal had possitive results & mother's checks started coming in july. My mother was with me in the province & the checks were addressed to my brother who lives in Manila. Because of covid (no flights, delayed mail) in short, my mother was not able to get hold of those checks because she passed away last Agust 8. Could we ( her children) claimed the benifits she would have been receiving before she died? What about the checks issued to our mother? We need advice please, your help will be much appreciated. Did your mother apply for benefits? Doesn't sound like it. VA home loan is for the Veteran and spouse, not children.

VA gives you one year after date of death to file a claim (you would get retroactive pay up to that date). Beyond one year, your pay date would start the month following when your application was received (assuming you qualify).

I am 100% T&P for ischemic heart disease (Vietnam veteran). 100% rating as of 12/2017. Turned down on unemployability because they said i did not need it since I already had 100%. I also have had high blood pressure (treated for past 50 years), sleep apnea, and tinnitis (I think 10% rating for this). Never applied for these other things. My question re: my wife...DIC has income asset requirements. If you count life insurance and savings she will have assets of about $140,000, I know this is close to the "limit". Is DIC reduced as you reach this asset limit or is it 100% so longer as you are under it by a little. Our income per 1040 is less than 10K per year. thank you

My father passed in 1997 after 2 tours in Vietnam. Was stationed at camp Lejeune in North Carolina ..After Discharge he went on to be a Chicago policeman for 30 years then passed in 1997 at age of 50 yrs old. Of heart attack brought on by liver failure from alcoholism. He married his nurse and left her his benefits.she might have passed for all I know do I have any claims or rights to benefits,??

My husband was a Navy Vietnam Veteran he died from his PTSD and it caused his death he had alcholic and he cerrosis hepatitis C Cirrhosis he got hepatitis carcinoma liver cancer from the drinking self medicated he only had it 5 year's cause they kept dening him since 1975 when he got out of the service kept dening him he was frustrated from them dening he got his 100% in 2014 he said they gave to him when he was dieing he had even faut for his 100% even in the 90's and 2000's we've been married 17 years and together 35 years and I still haven't got my funeral reimbursement and he died May 26 , 2019 of this year now I have to prove he died from PTSD he had severe PTSD but that wasn't put on his death certificate and the person that did the optosy said they couldn't put PTSD on the death certificate 😥😥😥😥😥

Jeanette Avila how about his regular doctor who treated him and knew that his PSTD was a contributing factor maybe you could have that doctor to write the medical examiner to influence him to change it . Call the va things might have changed 13 years ago when my husband died the doctor who singers it had to do the amendment . Did he give a reason why ? Is he lying. Look up or google secondary service connection. Al did he go to any Therapist for treatment? Have the doctor to explain and put in writing that you are a widow and explain the circumstances along with your husband diagnosis. Call representative at the VA hospital . They are va offices that could help you or an va attorney at no charge unless they win might be best!

My father was boiler tech and served on multiple ships. He was diagnosed with pulmonary fibrosis, as well as cancer somewhere around the bladder that had metatastized. The local va clinic classified it as idiopathic so he couldn't receive benefits. I think his pulmonary issues came from the asbestos in the ship's boiler rooms. Is there any way to get a second opinion?

I would Navy is notorious for having asbestos on ships. Keeps searching online for specific information about his unit ship etc. Also pulmonary fibrosis is on the pact act list of presumed service connected injuries. But I think it is also based on when your dad served. I am trying to service connect my father who died in 86 and I think on my next go around I should be approved based on proof that was right online.

I just put in a claim for survivors benefit in NC I am a unmarried adult. The paper sent said I meet the basic eligibility for substitution and there were no other eligible survivors. I was my dad main care giver for 13 years of his being a disabled Vitenam Veteran. The second letter said we are working on your claim for left above knee amputation. Will I recieve the benefits he was approved for before he died. I am told to wait for the notifications letter.

Question I'll try to make this short and to the point US Air Force divorced wife of 20 years I never remarried he did I get half of his military retirement right now it's like $550 a month that's in our divorce papers he is very ill at this time when he passes away what then happens to the money I get per month I always thought it would be gone I do know that at a certain age I can get his Social Security but I am just wondering how it works for the retirement money right now thank you for your time

Divorced so no eligibility for Survivor Pension. You would have to check with the military about retirement pay, not the VA.

I’m an adult only child I’m 47 and my dad passed away June 14,2021 he had a heart attack and his kidneys shut down. He was 73 he was in the army and was honorable discharged am I entitled to any benefits?? Also he was disabled he was hurt on the job. I have his death certificate. Thank you in advance. Does all veteran’s have insurance policy’s??

Age cut off is generally 23 unless you were diagnosed as a helpless child before 18.

They sent my form back saying i had to get the death certificate and resend but they told me i did not have to and they could find it when I 1st talked to them. After waiting for 6 months get back nothing and they were on the phone when I filled out the form and said it was fine and I did not need a death certificate but now they say its wrong. With COVID this might take forever. They will not tell me what veterans hospital he died at but they want the info but they have it because he died there. It's nuts! It at this time is not easy to do and you get slow results if any these days. I cant even get SS because they say I was devoiced and I was not. At the time of his death he did not remember being married at all. (ALS). And San Francisco sent a email saying they found nothing in the form of a divorce but will not send paperwork i can use to get SS. I sent to them 2 times and have to send again and its not cheap. I can get these funds but I cant get them. What do I do? I had the phone of a lawyer but cant find it now.

Nope. You are divorced so you are not eligible for Survivors benefits.

Hi hello ma'am and sir.if you dont mind i have a really question that i want you guys to explain it to me details.me and my husband got talking about his military benefits which is he is retired since 2014 and we are married about almost 10yrs.but my husband mentioned into me that he said once he will died i dont get any moneys from his military retirement.i was shocked and i don't know why he say that to me.he told me too that before he retired military asking him to join for paying insurance $1,450 every month for incase he died who will his survivor can get money of his retirement once he died.which is he didn't join and decided to much of insurance just his SURVIVORS incase something bad happens to him since he didn't join on it that offered thats the reason his SURVIVORS can't recieve any retirement Money's...can you guys explain this to me if is true? Military retirement and VA Survivors Pension are two completely different things. Sounds like he didn't elect SBP so when he died the military retirement ends with him.

Why do va say no service connected. If a veteran served he or she should always be considered a veteran.

service-connected means injury or illness incurred while in service and is being paid compensation by the VA.

Maybe because you are not getting DIC benefits? Survivors pension is considerably less per month.

So my father passed away due to agent orange exposure in Vietnam he was a 100% disabled and agent orange was the main contributor of his passing. I was told by the VA that I was able to receive his benefits due to effects of agent orange in children mainly boys. But I've tried calling the VA and haven't heard anything back and its really hard trying to talk to anyone that knows anything about agent orange with the VA. I guess I need help trying to figure this out

@Pappy Pappy, your spouse may be eligible for survivors benefits if you pass away due to a non-service connected condition if you received TDIU benefits for at least 10 years prior to death. hello.. my husband is a u.s navy and he died on may 2018.. he died on his girlfriend and they have a son.. and i claim for the benefits cuz im the legal wife even we dont have a child.. but it was denied.. why i am denied? we are married january 14, 2011.. we didnt have a fight though when he hide and live with her woman on 2013-2014..its too late the live in partner of my husband contacted me on may 2018 saying that my husband already die.. where is my right on that since i was denied? so our marriage is just nothing? please i need come info's on that..

and also they denied my claim because he did not die in my hands and he did not support me also.. please help me what should i do.. he did support me for a short time before he meet his live in partner..and ofcourse he did not die on my hands because they are hiding in pampanga because we are legally married on judge..

Hello. My Father was a Veteran and passed away in 2004. Unfortunately my Mother left him because he was an alcoholic, and decide to live that life over his family. As a dependant would I be able to receive any benefits? As far as I know he was not active, he wasnt discharged for anything bad, also not sure if he wad receiving any benefits while he was alive. There are some other circumstances which allow for that...you would have to apply to see if you fall under that.

My dad wasn’t never married or had a spouse and I’m his only daughter, he was bed ridden for 3 months I cared for him , he was housebound and had a disability for 10 yrs he was a Vietnam veteran and my dad come back a nervous person that caused heart problems.

The most you could claim would be burial benefits if the Veteran met certain criteria. Other than that, no.

Nope. You are an adult so any benefits would have been terminated no later than age 23.

My husband and I are both vets. VA told us to get divorced for me to get my benefits. We did Dec 16, 2019. We planned to remarry officially 14 Feb 2020, but he died 10 Feb 2020. Now what?

You were divorced so you are not considered an eligible claimant. You could file for Veterans pension based on your own service. Seriously, the VA told you to get divorced....

@@evilload yes, they did tell me to get divorced right in front of my husband. We were just one couple of several that day. October 25, 2017 I believe was the year. I had brain surgery so I have to look things up to be sure of dates but I know it was my birthday.

@@bannlaughlin3544 The only thing you would be eligible is Veterans Pension (based on your service). This does pay a higher rate (if you do qualify) than Survivors Pension.
