@@dreamsoffury8369 well if they claimed so then it's ok. By the way, I love Nintendo games and used to have a Switch, not anymore cuz I got steam deck Oled and a gaming desktop. The consoles from Nintendo has been so weak and limited the games potential. All Nintendo games really shine on a powerful PC and steam deck. Sub 20fps on Nintendo consoles just doesn't work anymore.

After i heard about this i went and got yuzu, then put a copy on my hard drive. Then i got the last 3 firmwares and keys. I also got 2 builds of cemu and dolphin and put backups on my hard drive

Also by the logic Nintendo uses here any third party game's publisher from a previous generation can sue Sony, Microsoft, and Nintendo for using in-house emulators on current gen consoles. The old game was never made with the intention of being played on current day consoles because they too are pieces of hardware that the game software was designed for.

Maybe I can provide some clarity as someone who’s spent years working with emulation. Emulation in general is very much legal and protected for archival and homebrew purposes and generally speaking, running backups of your own games is legal. The problem here is that the steps you have to take in order to even run your own Switch games requires you to break copy-protections to copy over the system files from your Switch and game files. The problem for Nintendo is, Yuzu does most* everything by the books. They aren’t running Nintendo code in their emulator and they don’t provide keys to even use the emulator. Where Yuzu messed up was on their website where they provide instructions for using a program called LockPick to break into your console and copy over the necessary prod/title keys.

I don't know, I feel like using LockPick to crack open the protection and obtaining the keys from a device you physically own should be fine. Like, the data is stored on a chip I physically own that Nintendo sold to me... I would like to think that makes it fine to copy for personal use, just like how it's fine to transcribe a book for personal use.

@@trunguss It’s one of the many reasons that makes Nintendo anti-consumer. There are many benefits to rooting your Switch that have nothing to do with piracy. Running game mods and making manual backups of your games. Years ago I had a BoTW save file with a ton of hours into it and my wife accidentally overwrote it with her new game b/c she didn’t know you could only have one save file per account lol. I personally think Nintendo is wasting their time going after piracy anyway. The % of people that buy their games vs. pirate is probably 1,000 to 1. I supported the Yuzu project early on and the first few years of the emulator, you needed a very strong PC to run games and many still today don’t even work.

My biggest gripe is nintendo going after games they haven't sold for 20+ years. Like yeah, maybe someone pirated the original mario, but it's not like nintendo would have made any money from someone buying it off ebay for $100+.

If nintendo didn't release bad hardware, release pc versions of their games, and locked older games to older platforms the demand for emulation would go down. If I want to play a game like wind waker, I can't play it on switch so I would either have to emulate it on dolphin/cemu or try to find a gamecube/wii/wii u that are not being sold anymore to play the game.

Nintendo's lawsuit doesn't go directly for the emulator they have discord messages of the devs explaining how to dump ROMs which is Nintendo's angle. It's probably still not a great argument but they are taking a side swipe at them instead of directly suing for the emulator.

Ironic that Nintendo is so against emulation when they themselves use emulation for older games on their plastic box. Also trying to kill emulation is like trying to stop piracy, they can "plug" one hole but as one sensible person put it "Its like trying to stop Niagra falls with a tea cup".

Sorry, one last post: Dear Harmon: I can lean ever so slightly to my right and grab my Switch, which has, in the slot, New Horizons, which is the only game I play on Yuzu. And I only play it on Yuzu to cheat. Yuzu doesn't have an online component, I can't affect the wider environment of Animal Crossing Islands. And I haven't paid a single thin penny to Yuzu to do any of this. Yuzu is free!

As a Nintendo fan, I love emulation, Nintendo makes some of the best games ever in every generation especially in the switch generation, but eventually Nintendo will shutdown the switch eshop in the future, and the switch cartridges are not indestructible, they will stop working eventually, with emulation none of these problems will matter and these games can exist forever.

Once again, Harman being completely *wrong* about everything per usual. I just really want to know is.. is it an act at this point? Because being this factually wrong and off base has to be a bit, right? Jesus christ. Emulation is one of the few tried and true methods of game preservation. When it comes to emulation, a lot of the time it boils down to: 1) Said game being out of 'print' 2) Insanely priced 3) Region/Console locked 4) Outright banned in your country 5) Beyond obscure; circle back to problem 1 and 2 6) Any combination of the above. And Nintendo is no better, with yet another lawsuit that doesn't hold much weight legally. The only thing that they have is money-- that's it. For a company that crafts some pretty fun games, they really are bitter old bastards that don't want anyone else having fun. Well, unless it's on one of their own consoles.

Just remember that Dragon Quest IV only got one release in English on the DS and never again. If i want to play it in English, I either have to find a used copy or emulate it. One of these is a lot easier than the other

In this particular case, I can see why Nintendo went after Yuzu over just any emulator. It was actually doing things like paywalling and promoting being able to play games before release, which is definitely 100% a piracy thing since, unless you're a time traveler, you're not ripping your legally acquired copy there. If they go after Ryujinx, THAT'LL be screwed up.

My only point with this is that, if you're a kid or a student that doesn't have the luxury to spend money on video games, pirate all you want. But it looks incredibly pathetic when people that have proper income wants to pirate games but has 6 different pair of shoes as a man. No man needs more than 3 pairs, and 2 pairs DEFINITELY do if you're not the suit and tie kind of guy. You still go out of your way to buy shoes you like, or watches that don't even serve any purpose because you now can know the time just by looking at your phone at any given time. And you wouldn't steal a pair of shoes or a watch. But you'd steal games? Piracy is for people that can't afford it. It's for people who aren't living in the privileged world of Central/Western Europe or USA. Yeah it's not literally stealing something from someone physically. But just because that's not the case, it doesn't mean you're not stealing anything. If you can easily afford it but choose not to, it's 100% stealing. There's nothing wrong with retro console emulation though, because some of those games, people that made them don't even exist in the industry anymore. And the games themselves go for ridiculous prices so you're being ripped off for a game very few people want to play but because it's rare. And no developer or publisher is even making money off of those cartridges being sold by scummy people that sell for 10 times more than they got the game. And Nintendo realized that way too late and is trying to charge people money for games that they've already been playing for ages again. I personally only hacked my PS Vita because Sony stopped supporting it, not only that, they just pulled several ps plus games from it due to not bothering to renew licenses for a dead console. In that case I feel no shame in hacking it. If Sony isn't gonna be providing me what I paid for, I'll just take it.

I used to have a bicycle when I was a kid and we'd ride around the block all the time, play ball, play actually physical games. Kids don't need investment to play games. Of course I did have an 8 bit console too, but those games were usually hard and short. So you just had to go play something else too.

I think a big part of the strategy will be cross-gen games with switch and switch 2 for at least a few a couple years. Meaning people will be able to play with our essentially switched to games and possibly get better performance on their PCs

@@TheUnknownDoc In the US there are valid reasons to own pew pews such as for hunting and self defense. It is silly to blame a tool for improper use of the tool, though that doesn't stop some from arguing for a state monopoly on the use of pew pews. And then some of them dare to complain about how certain state officials abuse their authority in ways that may or may not involve pew pews. Room temperature IQ in Celsius.

If they are allowing pirated content on their emulator that could present a problem, because they'd essentially be supporting an illegal activity. If they are taking "donations" for their emulator, voluntary or not, that's illegal because they're making a profit off copyrighted material.

Let's entertain for a minute that emulators/Yuzu actually was "illegal" it's like ok and...? Why exactly should I care? Is the FBI going to break down my door for playing a 25 year old Pokemon game in an "unauthorized" way?

The irony of Harman to praise old Nintendo games as being “some of the best games ever made” but then immediately celebrate when the only preservation of the past might be taken down is so backwards and alien… he’s seriously not even human. This dude who praises N64 and Gamecube games probably never owned either system and grew up during basic baby Wii era

If Nintendo sold a program to emulate their old consoles, and sold ROMs (without stupid DRM or monthly subscriptions) for those emulators, I would buy them. They do not.

So the thing nintendo might win on is cus Yuzu gets around their security to play the emulation. So its not illegal to emulate the game but they might get it under it being illegal to circumvent their security. I believe its something similar to what dkoldies did; they put those void warranty stickers on which is not illegal to put on a product but is illegal to enforce the voiding of the warranty. Personally i side with Yuzu because i dont think you should be able to make an action to do something legally(emulate) unable to be done without breaking the law (circumventing their security)

They want legal precedent that emulation is illegal so they have a monopoly over their old software so you can either go through third party resellers or them. They want to make their games scarce. Piracy is a service problem. Most people want to buy older games legally but companies like Nintendo don’t want to release older software. There are obscure Nintendo games like wario world that are around $100 a copy and Nintendo doesn’t want to release it.

Honestly I've heard good arguments on both sides of this one. There is a clause in the DMCA that prevents DRM circumvention that might be the thing that brings down Yuzu. It's not as open and shut as people think. One thing i can say for certain though is that even in the worst case scenario where emulation becomes "illegal", nothing is really going to change. People will just start making and working on these projects anonymously/underground. Or, development will just move over to countries that don't care about western IP laws. Not to mention, all these emulators are all already out in the wild.

i Don't get why is piracy is bad thing at all especially with game that they don't sell anymore. Here the deal. Let say i have legit nintendo game i have. And i give it to my friend because he don't have that. Is that count as piracy? No? Then what is make different if i share my game with others on the internet?

Ocarina of time is my favorite game of all time. I have such a strong nostalgic connection to that game, and it's what got me into video games in the first place. One of the best things about the dungeons in that game is the atmosphere. My n64 died years ago, so if I wasn't able to play it on pc then my only way to experience that game would either be through nintendos dogshit emulation that makes the game look worse and completely ruins scenes like the dark link fight, or play the 3ds version that makes everything way too bright and removes blood textures from places like the bottom of the well and the shadow temple, completely ruining the atmosphere of basically every dungeon. The suits at nintendo do not care about their games or their history. The fans who work on emulators and decompolation projects do. Reject corporate greed, and support these passionate fans who do what nintendon't.

From my understanding, installing and running a ROM through an emulator in itself is not illegal, but uploading it to various sites and distributing copyrighted content is where you can get into some real trouble. I could be wrong, but that’s how I think it works.

UltraHLE was doing what yuzu is doing but 25 years ago. It was emulating at the time the current Zelda game

It appears that Harmon Smith's fondness for his own voice outweighs his grasp of legal matters. He blindly defends a corporation that couldn't care less about him, as evidenced by Sony's failed attempts to eradicate emulation. Emulation doesn't yield profits, so what's the fuss? Sure, downloading ROMs may raise eyebrows, but with sites dwindling and the need to own the game for ripping, the landscape has changed. As for Harmon Smith, his grating voice and lack of understanding are hard to endure. Frankly, I'm perplexed as to why anyone would subject themselves to his diatribes. Nevertheless, I find solace in watching you systematically dismantle his arguments, even if it means repeating yourself. Your diligence in debunking his flawed logic keeps me engaged, and for that, I continue to tune in. Keep up the good work!

If Nintendo was Smart they would sell The rights of Emulation to certian Emulators it would preserve games better and everyone wins sure it would then make it more expensive but it could help skirt a lot of piracy

Nintendo doesn't like the idea that you can bypass their hardware entirely and play on PC with better specs. PC gamers genuinely buy Switch games when they don't own a Switch and Nintendo can't wrap their head around that. They make most of their profit on hardware sales. Seems like they just want to lock in customers.

If think it couldn't be said better. Nintendo puts money on lawsuits and not on making these games available. Emulators are the key to preserving the knowledge and work of all the industry across its lifespan
