Julie wasted these IRS scammer's days today to bring more awareness to these scams. How many red flags can you spot in these conversations? Don't forget to report scams here: www.bbb.org/scamtracker

I am an IRS licensed Enrolled Agent with almost 40 years in tax practice, and I listened to this with great attention. In the beginning Julie asked us to keep track of the "red flags". As a Tax Professional, I found 19 red flags. Here they are: Amy Karen's conversation: 1: IRS does not call over a mismatch between what is on a tax return as income and what the IRS has as income for that taxpayer. IRS sends a form letter, CP-2000 is the form for this purpose. It is usually about 8 pages long and describes the mismatch in great detail. 2: The IRS does not ever audit a tax return without inviting the taxpayer to the audit, and this invitation is in writing by postal mail. 3: Amy was calling about the 2012-2017 tax returns in 2018. There is a Statute of Limitations of 3 years for the IRS to audit a tax return (6 if there is a Gross Understatement, which the amount of tax claimed due would show is not the case and no Statute for cases of Fraud, and the scammers state it was a math error later on in the phone call, so there can be no Fraud allegation). 4: IRS allegations of miscalculations and other math errors are corrected internally first, then a letter is sent describing the error. 5: Amy Karen's Badge Number of IR2012-45 is not a valid format for IRS Badge numbers. There are no letters in an IRS badge numbers. 6: No Law Enforcement Agency is permitted to "listen in" on IRS telephone calls. 7: The comment of "Innocent or Guilty" can only be made by a Special Agent, who is part of IRS Criminal Investigation. Since this is not a criminal case, Amy must be a "Revenue Officer" - IRS collections. Owing the IRS money is not in and of itself criminal, it is civil. 8: The statement that a disconnect of the phone line will be considered a confession is a blatant violation of the right to remain silent clause in the US Constitution. 9: Mis-Statements in a tax return (I have no idea what these could be, as a tax return contains only numbers and, if put there voluntarily by the tax payer, brief descriptions of what the numbers are) cannot be a criminal offense, period. 10: The amount allegedly owed ($4,295) over 5 years of tax returns, is less than $1,000 per year. There is no way that owing that little could rise to the 20% of Adjusted Gross Income understatement that would trigger the Gross Understatement penalty that would extend the Assessment Statute from 3 years to 6 years, and certainly would not rise to Fraud which would end the Assessment Statute. 11: There is no Section 67738 of the Internal Revenue Code. 12: The IRS does not send local police to arrest anyone, their Special Agents do it themselves. 13: The "Preliminary questions" asking about prior arrests, bankruptcies, traffic or parking tickets or civil judgments are ALL totally improper. Jeffrey ? (I was unable to make out his last name) conversation 14: His statement that the error is only 5% is an admission that the tax issue, even if totally true, cannot be Fraud. 15: He mentions that this was a "Random Audit" - first, they are all begun with a mailed invitation to the taxpayer. 16: IRS will not go to Court over a Math Error. 17: Payment Plan? Jeffrey forgot to mention Form 9465 and the fact that with the small amount due (being under $25,000) no financial information from the taxpayer is required, and approval of the Installment Agreement is automatic. 18: Jeffrey goes back to talking about a criminal case, with no mention of the Miranda Warnings or IRS Publication 1 or the taxpayer's right to representation in this "audit" or the Taxpayer's Bill of Rights right to Representation in all matters. 19: Your check that the badge number Jeffrey gave you was a legitimate name in the IRS. Scammers can get legitimate names. At one point I git this same phone call, and the caller used the name of "Nina Olsen". The scammer did not know that at the time Nina Olsen was the National Taxpayer Advocate at the IRS, nor did the scammer know that I know Nina Olsen personally. I asked the scammer why the IRS demoted her from Taxpayer Advocate to Collections. She had no answer. I offer my services to you as a free consultant to help you through the minutae of tax laws and IRS practice and procedure. Steven Katz EA Vail AZ

@stevekatz30322 жыл бұрын
@@faizullakhan1556 You are confusing the Statute of Limitations for Suit (meaning over debts) with the Federal Assessment Statute Expiration Date (ASED for audits).. In some States, that SOL is 10 years. Those States are IL, IN, IA, LA, MO, RI and WV (this is the SOL for written contracts - oral contracts, promissory notes and open ended (like credit card) debts may be different). Most States have a 6 year SOL.

Anyway, he was trying to tell me how much I owe on and on. I was going with the conversation he tried to threaten me. I told him for one don’t threaten me then he said that he was going to send the sheriff to my house. I said great my husband works for the sheriffs department. I told him I’m looking forward for my husband to use the handcuffs on me. I asked scammer do you know long I’ve been waiting for that to happen. The IRS wouldn't send local cops. As a federal agency they have their own officers. They don't need Homeland Security, Sheriff's nobody. And you wouldn't get arrested, the first thing they'd do is file a lien. Then you'd get a visit from a Revenue Officer. Threats of arrest would never happen.

@ButcherBird-FW190D2 жыл бұрын
Of course. And, in most cases the IRS would have you phone them. Especially as a consumer. Maybe not so much for a business in that the AIC (Auditor In Charge) would have a direct line to the Controller, who would know the AIC's voice automatically and on the spot. As an aside, I was a higher level banking examiner for the FDIC for 33 years. Retired last spring and am with a major bank for my retirement gig. What the hey, it's better than chasing a little white ball around with a club, right ? But, yassir. First time you contact a new bank (as their new federal regulator), you 1-Send a letter, 2-Likely communicate to/fro via e-mail. Noting; neither is really fool-proof. -In most cases you'll meet the shop in-person first as the shop is handed from one EIC to the next (or AIC). As to phoning out of the blue, in your letters and e-mails, you suggest they phone their contact (prior EIC) or contact the Regional Office first to verify. -And you do NOT provide them with the number; they should know better than that. As to phoning someone completely out of the blue as a bank examiner ? It happened, but you would never-ever ask for sensitive information to be sent without their (the bank) performing some form of due diligence to verify who you are. Never. And that statement held true as far back as I go, so 35 years now re: in a professional position.

The IRS or social security isn’t going to call you, ask you for money, or ask you for iTunes cards. Or either ask you for personal information. They will send you a letter in the mail.

What a great public service... thank you... And, with a glowing smile... : ) The education of how we’re supposed to be notified by the IRS seems to be key. With common sense and trusting no one on the phone, texts and emails, we will protect our identity and $. I’ve only been scammed once by a look alike credit card email.(right name, colors, etc.) Thanks for telling how to report scams also. 🐸

Little known fact: There is only one Janet Smith in the United States. That's why the (totally legitimate) IRS agent was able to find her case so quickly.

Once he found out you only had a hundred bucks in your savings and 30 bucks in your checking is why he said he'll call you back and he never does that's what the secret is you just told everybody so that's how you handle it you don't have any money good job I love that one

This happened to me a few years ago. It worked for about 5 minutes because I had just straightened out a tax issue with the IRS and was utterly baffled as to why they suddenly said I owed 5K and would be arrested if I didn't give them this money immediately because I know the IRS did not work this way. Then it suddenly dawned on me!

After saying she’s afraid this might be a scam and he tells her not to worry, she should start a conversation about how scammers are all dirtbags and lowlifes and need to be shot and see if he will agree with her. THAT would be funny!

THEY ALWAYYS HAVE AN ACCENT!!! This crosses the line, and is no longer an Innocent robo caller. because now its embezzlement, false accusation, the list of offenses is longer then a roll of toilet paper. Interpol should get involved in this.., because of course this call is from another country.

I really like how she gave the financial facts that are true to many people, elderly, disabled, single parents etc. It shows hows how callous these people really are, and that anyone can be a victim. Though it’s more entertaining when greed takes over it’s not real for many people. The first time I watched this tax scams were practically unheard of in the U.K., scams must have increased by a factor of ten here in that time. I actually got one from the IRS a few weeks ago...I’m English living in England and we don't have the IRS. We get frequent answerphone messages saying there’s a problem with our National Insurance Number, which is the unique reference number used for tax purposes. However, they don’t say which one of us has the problem and HMCR don't have our telephone numbers.
