Big changes are coming on January 27, 2025, with the new Telephone Consumer Protection Act (TCPA) rules. These updates will impact how real estate professionals generate leads, communicate, and market to prospects. Here’s what you need to know:
Key Changes
✅ One-to-One Consent Required
Consumers must explicitly opt-in to being contacted.
Consent forms must feature blank checkboxes for each service provider and cannot include a “select all” option.
✅ Covers Texts, Phone Calls, and Voicemail Drops
Email and mailers are exempt.
Manual dialing is still allowed, but automated systems without consent will result in penalties.
✅ Existing Databases Need Re-Consent
All contacts must provide updated consent to continue receiving automated communications.
Consent expires, generally within 6 months.
✅ Massive Penalties for Non-Compliance
Fines range from $500 to $2,000 per call or text, making violations a costly mistake.
