You can't do ethics with just description. Choosing consequentialism and virtue ethics is as prescriptive as you can get. In particular, neither of these theories usually includes within it substantial notions of rights (to privacy, to freedom, autonomy, to fair treatment, to any particular distribution of goods, etc.). I'm a bit supporter of virtue ethics, but AI changes the system, not just the individual choices we can make, and so virtue (even with consequentialism) can't address core issues with justice at the system level (e.g. capitalism).
