Teen Accused of Dumping Baby in Trash Faces Major Issue Ahead of Trial

Alexee Trevizo allegedly dumped her newborn in the trash after giving birth in the bathroom of a New Mexico hospital in January 2023. Trevizo is charged with first-degree murder, or alternatively abusing a child resulting in death and tampering with evidence. Her defense won a legal battle to prevent some of the evidence from being presented to a jury in her trial. Prosecutors are now fighting back, claiming the evidence is key and should not be suppressed based on patient-physician privilege. Law&Crime’s Jesse Weber breaks down what this means for Trevizo.

I used to work as a CPS worker and I in fact had cases where women delivered their babies at the hospital and they told the staff they didn’t want their baby and we were called. They don’t even have to sign the birth certificate. In one case the mother accidentally signed it because the hospital staff didn’t know what they were doing and the court sealed that birth certificate. Also what does Trump have to do with this? You guys stay deflecting, yeah you’re going to be in for a rude awakening when this man is elected because the way Joe is out here getting names confused and don’t know what year it is, it is becoming incredibly likely 🤷🏾‍♀️

Actually if it's past tense...they are not required to disclose confessions. They are morally obligated to report if you are threatening/planning to kill someone. Someone else's right to life trumps your right to privacy. If it's a confession of past deeds, it's too late to intercede so privacy holds.

This is about if you tell your therapist you committed a crime (like murder) in the past- they report it only if they have reason to believe the person will commit a crime/ be a danger to others now/ in the future. Sounds like there is more to the story if they reported you to CPS- "arguing in a separate room" doesn't sound like a legit sole reason for a therapist to get CPS involved, especially for the crime of child endangerment.

Based on what I’ve read, the child was not stillborn. He had air in his lungs proven by the autopsy. He was wrapped in a SEPARATE trash bag, which was twisted shut, with other bags on top. As for her Miranda, she was not being questioned by the police, she was responding to her mother. The doctor stopped the mother’s interaction to refocus on health care. It’s my belief all that footage should be used.

A breach would be if she told them, tried to get help and they called the cops on her. That's not what happened. It's a case to find a un-live baby alone. That baby was left to be thrown away and she went on with her plan to pretend it never happened. She full on committed a crime of murder and lied about it all.

He states it in the video. It’s because discussing what happened to the baby with her was mixed in with talking about her personal medical treatment from her doctor. It’s also an issue that the authority of the doctor was blurred with the police, both being present and communicating with her instead of separately. I’ve worked in healthcare for years, and I’ve never seen police and doctors communicating with a patient at the same time, ever. Honestly I do blame the cop on that because when I watched it the first time I knew it could potentially be an issue for evidence.

I think the primary issue is that she was never read her rights prior to her discussing what happened. The doctor had every right to contact the authorities, but the issue is she was incriminating herself while being videoed prior to being mirandized. Had she been read her rights, specifically the right to remain silent and the right to an attorney, she may have exercised her rights. I absolutely do not agree with her actions, but at the same token, she wasn’t disclosed her rights either.

The problem is she felt extra pressure or forced to make a statement because her doctor was in the room also asking. Her doctor should have or could have asked her what happened before cops there, then when cops arrived Lexi could then evoke her fifth amendment right to not incriminate yourself. Now I’m not sure but possibly because the crime of murder was committed the doctor would be able to make a statement of what Lexi told her.

Doctors are mandated reporters so the concerning death of a newborn would be a reason to call the PD and they did, but the issue is what is said to the doctor is privileged by HIPAA. The doctor calls the PD and the evidence and the investigation done by the PD needs to lead to solving the case and prosecuting it and NOT the discussion had between the doctor and patient.

As a juror, the big question I’d want answered…if u didn’t know you were pregnant, when u started to give birth in the bathroom, why didn’t u yell for help? Why not let the nurse come in when they were knocking? She could’ve told the nurse she didn’t want the baby, & didn’t want her mom to know. As a legal adult, it’s up to her who knows her medical decisions. Instead of even leaving the infant in the floor of the bathroom, she instead wrapped plastic around his face and stuffed him in the garbage…even if she hadn’t heard him breathing or thought him dead she gave him no chance to survive. Second, this "teen" is NOT a minor! Therefore, she should have been treated as such. If the Dr knew she was bleeding and still needed to birth the placenta, why allow mom and the police in for a discussion or questioning. Her job should have come first. Then, the police and mom... Why did both the cop and the mother ask how old the baby was. She didn’t have a miscarriage, and no woman on earth has ever “forcefully ejected” a baby early. It just doesn’t work that way. Of course it was full term.

I have been following this case since day one and she knew exactly what she was doing! I hope and pray they convict her and I think it’s prosperous That all of the evidence is not allowed in court for the jury to see!! All evidence should be allowed in any case!
