Called the off duty line later on because he said he was going to just start making fake names and numbers. I got an officer who knows me, in a positive way, if it happens again they will have to come out but after that they are just flagging my house so I won’t even be notified over it. Asking medical history is not Hippa violation It’s the unauthorized sharing of medical information
@t.r.6930Ай бұрын
Yes. It is.
@ddaa502Ай бұрын
@t.r.6930 No, it isn't. Hipaa deals with involuntary release of information by informed parties without consent, even accidental and incidental actions can be violations. (Such as Doctors talking about a patients case in an elevator with someone else unrelated to the patients care is in the elevator can be a hipaa violation if it can simply be deduced who they are talking about, even if a specific name isn't used.) A voluntary request of medical information is not a hipaa violation, what would be is if the school got the records from the kids doctor without parental consent.
@celesteramsey6663Ай бұрын
Yeah - and the answer to that would be involuntary
@ddaa502Ай бұрын
@@celesteramsey6663 Ya that's not how that works. A request for information that someone does not want to give is not an involuntary release of privileged information (or a hipaa violation), as by refusing to provide said information, no information is given to the requesting party. If it was GIVEN, then it was voluntary. The fact they don't want to give it doesn't make it involuntary either, it would only be obtained involuntary (and a hipaa violation) if they dont want to give it, but the requestor got it anyway from a hippa covered source without the relevant parties consent. This is beside the fact that schools under 99% of circumstances arent hipaa covered entities, they would follow ferpa guidelines for the storage and transmission of sensitive medical information. A school making a request would not violate hipaa, as they are rarely a hipaa covered entity and a voluntarily request for relevant information has nothing to do with hipaa. The way a school could violate hipaa would be the improper storage or transmission of data that fell outside ferpa, but within hipaa (such as a school having an on-staff medical provider that provided medical services that were billed to an insurance company) - but this is incredibly rare.
@johnwhite8777Ай бұрын

Little girl is wrong, someone asking you for your health information is not a HIPAA violation. Not that you have to answer though. It's only if your healthcare or employer gives out your health information is it a HIPAA violation. So if the teacher went out of their way and contacted the little girls healthcare provider and they gave the information out then it would be a HIPAA violation. A HIPAA violation refers to the failure to comply with HIPAA rules, which can include unauthorized access, use, or disclosure of Protected Health Information (PHI), failure to provide patients with access to their PHI, lack of safeguards to protect PHI, failure to conduct regular risk assessments, or insufficient employee training on HIPAA rules.

Still not a HIPAA violation. I never said it is any of the teachers business, and the student doesn't need to and still shouldn't answer, but it is not a HIPAA violation. Go read HIPAA laws. If the teacher called the girls Healthcare provider and they give out the info, the Healthcare provider violated HIPAA laws. If the teacher calls the Healthcare provider pretending to be the girl or her parent to get the Healthcare info, then the teacher violated HIPAA. But the teacher just asking a student is not a HIPAA violation. It's weird, and the student doesn't need to answer, but it that has nothing to do with HIPAA laws.

That’s not a HIPAA violation. A violation would be a health care worker proving protected patient information to someone who is not a part of the treatment team. A person providing their own health history, in this case their vaccination record, and being asked to do so for something like school or work, is not a violation.

When the youngest after turning 16 y.o. wanted to complete her medical intake paperwork at the clinic. When she came to the question asking if there were guns in the house, I told her to leave it blank. Having been brought up to be truthful, she was confused so I told her that information has nothing to do with the health issue for which she was being seen. The clinicians all say the information is gathered to complete a mental health wellness evaluation, but honestly, the previous question should have been enough. The prior question asked if the patient felt safe or threatened at home.

Splitting hairs over the specifics over a HIPPA violation being something other than what was addressed here is unbelievable. Asking a kid that age their medical history instead of speaking with their guardians is the improper familiarity thst opened the door to this in the first place. A hearty "f you, nosy" is more appropriae, really, but a bit harsh.
@Didleeios886 ай бұрын
HIPPA rules don't apply to patients. They are allowed to reveal anything. HIPPA applies to record keepers and medical providers. A teacher asking a child those questions does raise issues of ethics and privacy since a child doesn't understand the implications of revealing information. But schools regularly ask for vaccination history and should have every right to.
