A tenant in Louisiana is furious and says that it’s not fair after being evicted. The tenant withheld the rent after repairs were not made quickly enough by the landlord but she was evicted anyway.

I live in Pennsylvania and you have to have a bank account that says escrow and put all of the rent money in. You also have to have pictures, emails to landlord showing that the landlord is aware of things that need repaired and if landlord refuses to repair then you contact code enforcement and they give the landlord so many days to make repairs.

You can legally withold rent, however, you have to go to your local county courthouse and put it in escrow. You still pay rent, but will go to the escrow account. Landlord will have to go to court and verify repairs are done before they are awarded their rent. This is in every state.

I pay my rent on time every month and I'm low income I waited 4yrs to get my stove replaced and the dishwasher repaired and that only happened because a new state law went into effect at the first of the year that gives the landlord 30 days to make repairs after that the tenant can pay to have repairs done and deduct the cost from the rent I can't afford to move because my income is way below the 3 times the rent most places want before they will rent to you so low income tenants are at the mercy of the landlords

I never, ever rented a place that needed that many repairs. It seems to me that he is more or less a Slum Lord! The place should always be in good shape beforehand. Just a bit of preventative medicine.

Ongoing water leaking is a health hazard. If your comment is solely nased on the article your read, you don't state how long she amd her family have been living in these conditions. What do you consider a reasonable amount of time to live that way? If he isn't making the repairs and simply files on her, he appears to be a slumlord. Changing an air filter does not compare to multiple water leaks. Why doesn't maintenance have access to the apartment for repairs? We have no idea what type of communication attemps the repairman made. She should have put her rent in escrow. It is possible he stalled on making repairs in an attempt to get her out.

In our state, if there is a dispute over repairs, you still have to pay rent but you pay it into a court escrow account until the court resolves the dispute. This helps eliminate the scammers who are damaging the property to avoid paying rent.

My understanding.. the best course of action when a landlord is not making repairs in a reasonable amount of time is to send the landlord a certified letter informing them of the repairs needed done and inform the landlord the you will put the rents in an escrow account until rents are completed.. this way..the rent is being paid but not until repairs are made and it is legal to do this.. gives the renter peace of mind and legal leverage

99% of landlords are doing everything right. They follow the law, treat their tenants with respect, and provide safe livable housing. Your comment would be similar to telling you to hold your fellow tenants accountable because some tenants are horrible. You have no control over what other tenants do and I have no control over what other landlords do.

The tenant can put the rent in escrow through the courts, take a picture and take the landlord to court, in the state of Minnesota.

The Doctor was a slum Lord, He had enough time to make those repairs if he Attempted to evict her 3 times that was over 90 days her complaint was fair and reasonable.

The gov't collected the property tax and other taxes but no support to the landlords and property owners. The gov't indirectly allows renters to be abused and take advantage of not paying rent and can not evict the tenants and renters. This gov't system kills many landlords.

I had a tenant try to withhold rent because the pilot light in the furnace had a blue flame. I had the heating system checked out just to cover any issues that might come up. I quickly got rid of that tenant.

It is okay to withhold the rent when the landlord is not completing repairs in adequate time . However, it has to be done legally . One simply goes to the court let them know what their grievances about and they put the money in escrow until the landlord makes said repairs on the rental property. This way, you don't get evicted and wonder why.

Have you ever dealt with problem tenants who trash a house then blame the landlord? One of the tenants I had to evict had a horrible roach infestation in their unit that spread into my other units. They claimed I refused to fix things, but never told me the stuff was broken until they were being evicted. They claimed the unit was in bad shape but I had pictures of the unit which was completely rehabbed before they moved in.

This particular tent you highlighted couldn't have a decent stove or a proper refrigerator to preserve her food and to cook her food! You ignore the possibility of health issues that may have caused more problems than just the average complaint!! Roaches were not the issue, and your video is completely one-sided!! Those items should have been repaired before the house was even rented out. The landlord wanted to use her rent money to make repairs. This is wrong to take advantage of desperate people trying to find affordable housing for their families.

I am a Landlord , not a slum lord. You have taken the stance that she was not patient enough for the repairs to be done. A letter that you read was signed by both parties, if you’re an Honest Landlord your word should be your bond. Why are you making excuses for the landlord by saying oh well they needed more time, nothing is instant. That landlord gave his word and he did not honor his commitment. Listening to you , you’re no different, you will sign a contract with your tenants and not keep your word , but expect full payment of the rent. Would you be Ok with the leaks from the ceiling , she has 5 kids and can’t cook properly because only one burner works, that landlord promised her a stove , BestBuy is open every day, a cheap stove could have been delivered in 72hrs after the letter was signed if he had any honest intentions. She may be a bad tenant, but the Landlord gave his word as well. I know I am right about this, because all a man has is his word. Even if the other party does not keep theirs , he should have honored his word!

By law, if repairs are not made, the tenant has the right to get it done themselves and reduce the rent by the cost of the repairs If the repair is so costly that it isore than the rent, I would not pay the rent either.

A contract with that woman to read her an apartment that was in full working order Why should she have to be patient and wait well he's collecting Rent why should she like have to live in in in discomfort everyday so he can find like you know some guys that don't know what they're doing it pay anything to him it's notorious that landlords do that that obviously has money I mean his car you know he's a doctor and this guy like you know thinks women should just suffer and be thankful she has a place shut up and take it. @@trandyman not all landlords are rich, in fact, many of them have underwater mortgages, so renting is a way to pay for a bad investment. They dont get tax breaks, on the contrary, they pay more for not living the property. Rent doesn't cover for the full mortgage, taxes and insurance. If this was the 3rd attempt, something else was going on. Some people make up all kinds of stories or even damage the property themselves to skip payments. So there's always two sides.

Why wasn't the FIRST thing addressed IMMEDIATELY the leaking ceiling? Doesn't the landlord care about his own structure? Does the tenant have 7 children? She'll have a difficult time finding a place to live. If you want to know if you're going to get a good tenant, ask to interview them at the home they are presently living in- that evening and speak to the current landlord. Two truths: 1.Some people shouldn't own investment property because they don't know the costs or don't care. Some tenant are a nightmare. If you're going to purchase investment property be able to afford the very real costs. If you live in someone's property as a tenant, take care of it as if it were your own. Pay your rent on time.

From the looks of the apartment it looks like the damages especially water and around the ceiling vents were long term damages. How long was she suppose to wait for those repairs to occur? Betcha his home looked nothing like what he had her living in! Most times when it comes to Eviction Court, the tenant always loses.

Let me start by saying I currently am a tenant who lives in the house where the inspectors gave the owners 18 violations and had to repair all of them since October 2022. He is only taking care of two out of the 18 violations and only took care of them within the first month of the inspection. I continue to pay her monthly rent of nearly $3000 a month, even though things were falling and leaking in the house and even though he got hit with violations. I think 6 months living somewhere and still continuously paying rent, is more than enough money and time given to the landlord to handle his business of all these violations. He has still yet to fix the other 16 of them and I stopped paying him rent in April this yr. I live in a 5 bedroom duplex with a total of 7 people .... five adults two children. The reality is not all landlords or all owners horrible. But the obvious ones making it okay to live in those kinds of apartments even if it was with just one person, he seemed as if it was okay to collect the rent but not okay to fix things to make apartments livable! That why the tenant above me is moving and im moving in 2 weeks and he will not receive another $1 from me! And stop with The theatrics in trying to read like what the woman would sound like.... It is unnecessary and condescending.

I finally got to the point, where I just surrendered them all to my tenants and let them know that they have to take em with them whenever they moved out. I was so over it. That was back in 2015. Since then, it’s worked out really great for everyone.

Some jurisdictions require a working refrigerator at the time of inspection, which can lead to problems of storing a refrigerator because many tenants have a refrigerator and would prefer to use their own creating a storage problem for the landlord 😊

Your position is prejudicial units analysis and clearly biased. The order stated those repairs were to be completed by the end of March. Even if a repair person couldn't come out, communicate with the tenant the issue and then make good on it by following up. Further, coordinate the scheduling of repairs with the tenant - don't just show up and expect someone to be there to let you in and you didn't set an appointment! Rightly or wrongly, she withheld a portion of her rent - just as he provided only a portion of a list - two of the repairs that were clearly ordered to be completed by the end of March! Instead of doing right by her and getting the repairs taken care of, he filed an eviction notice. What a gem of a human being and business man.😑 Rent is expected on time - yet the landlord gets to take their sweet time with repairs or ignore them all together until they move out?! What are the tenant rights as the landlord continues to receive the rent money as they spend it on themselves and their family to live comfortably while their tenant lives in a substandard dwelling or live in inconvenience? This is not about those who are squatters or bad tenants. Some of those were obviously long-standing issues she was dealing with! No proper working stove or refrigerator, leaks etc. Are you kidding right now?! You used this story as an example?! This woman actually had legitimate complaints! Where is your compassion for her seeking redress for a decent atmosphere to have for her family to lay their head at night?! There are WAY TOO MANY slumlords and greedy folks charging exhorborent rent for sub par, substandard properties. This is the case with both real estate conglomerates and individual property owners alike. One is too many and unfortunately, there are more than that. I witnessed this recently as my friend looked for a place to stay and it was just horrible! The property management company said it had been cleaned but it was filthy and also needed things replaced. They said they wouldn't do anything to fix it for her to move in. Btw, they do this because they unfortunately can. I told her no way and she agreed. God blessed her with a BEAUTIFUL apartment several months later. Being late with rent is not a crime if she paid her arrears, with I'm so sure added on big late fees. Being poor is also not a crime - many people are struggling these days or haven't you heard? And yes, you may need repairs on your personal home because there is usually something to do when you own a home but I venture to guess your home doesn't look anything close to that apartment in it's condition or function. And that, sir, is the crux of the issue. Would you live there?! No self respecting property owner or business person in any capacity of profession, treat their clients in such a manner. Only entitled people who think owning a business makes them better than the person they are supposed to be there to serve and in kind receive monies for agreed upon services rendered. This video smells of condescension and it is repulsive. The world needs less slumlords and those who support them legislatively through unjust laws. Treat others the way you would wish to be treated in the exact same situation. Period. Check your humanity and mindset. Please.

Hi Tony! I dont agree with you at all! You assumed she didn't have the rent money. That is an assumption, not fact! Yes, she needs to know the state law, but being a renter myself, that unit was not livable condition. If anyone didn't have the money, it would be the Doctor. By law, he does have a reasonable time to get it fixed. So, if they had issues with the refrigerator, stove, and air conditioning(which looked like black mold), then it is not reasonable!! If I had to live under those conditions, I would leave! I don't know about how she complained and how he reacted, but nobody should live under that condition. You wouldn't either!! How long did she have a bad refrigerator? Being late didn't mean she didn't pay!! One working top stove... You just said he would fix it up after she moves out!! she chose to move in with those items not working. She should have said I will move in when they are repaired or moved somewhere else. Why would you move your children into an apartment when you know the stove and fridge are not working and there is mold? Where is her lack of judgment in the situation?

Everything has to work prior to moving in!! My friend works for the state-housing. So, if those items stopped working while being a tenant, she has to inform the landlord. I would love for you to walk through these impressionable apartments and gracious landlords that won't fix the problems during the lease. You would change your statement quickly. Your statement is so out of touch... No different in telling a homeless person to get a job when they don't have clothes, housing to bathe or an address to fill out a resume for a job... It may not be your problem, but it's a problem, nevertheless.

In Texas, you can't evict a tenant for withholding rent when repairs are not made in a timely manner as long as the tenant sends a certified letter listing repairs to be made.

In the State of Florida statues require the tenant to notify the Landlord when withholding the rent for repairs. The eviction process gives the tenant time to respond as to why they should stay and not vacate. The judge then hears the reasons and move towards a rent determination hearing in which they will decide on how much the tenant should place in the court registry. It’s important the tenant follow the process of not they will be given a notice to vacate. As a landlord I must advise discrimination is regulated Florida has agencies like most states ready to attack and defend. Not renting to blacks is just not that glamorous as it was before the Civil Rights Act of 1964. Discrimination is serious and so is filing and appeal. Being a landlord you must fully understand applicable laws and status. Even for judges I have seen judges corrected and fined when filing complaints with the judicial qualification commission. Tenants like landlord have rights.

In Texas, the state law is that tenants can withhold rent if the apartment or house is not liveable. Like my apartment complex, we owe rent but we have roaches and rats running the whole complex. We have called them to put in work orders but nothing is done about the roaches. We moved in here in June of 2022 the roaches get in everything we have to put most food items in the fridge but the roaches still get in the fridge and freezer. Our hot water is a problem throughout the entire complex the cold water comes out more than the hot water, it's been like that since the day we moved in it was supposed to be fixed but it wasn't

We have videos of our apartment and the roaches, they claim are apartment isn't kept clean but we clean constantly last night we use the vacuum to remove some of the roaches that were crawling on the walls in our room and our kid's room. The roaches have started biting us all they fall on us from the ceiling. Our apartment complex told us a month ago that they would move us to another unit in 2-3 weeks the deadline came and my husband asked them about moving to the other unit they finally tell us no after giving us the runaround for 2-3 weeks they tell us no because our apartment is unkept, which wasn't true then they tell us they can let us out of our lease and it's not going to be against us but we can't afford to move and I'm pregnant.

I never said we haven't paid rent in 2 years if we didn't we wouldn't still be here we just stop paying rent 2 months ago and we have been paying that off as well while we are still dealing with rats and roaches. We aren't the only tenant who have this problem everyone over here has the same problem. Sorry wrong move in date we moved in last year in June we signed a new lease in Dec after out 6 month lease

I worked as a maintenance man for several buildings for several years and some tenants made it hard for me and the other workers to go through the work order,some even changed the locks so we had to wait for them to be home,which is the against the law,if you change the locks,you are supposed to give the building manager a copy so we can do the work,also we them a 24 hour notice that we would be there to do the work,it's not like they didn't know we were coming

I mean it's not unreasonable for people to not want you in their home without them there but it is unreasonable to make a schedule without including the tenant and then expecting them to mold their life to that schedule. When people get internet or cable the guy might have a giant window where he could show up so people pick a day they have free if possible. It makes sense to feel the same way about repairs scheduled by the landlord. You could do a great job at repairs but still steal my medicine or change or what have you if you're in my home alone and without cameras I wouldn't be able to prove it

You must continue to pay rent. Period. If repairs aren't being done you go through the courts. You don't get to just do whatever you think is fair because then you'd get the people that withhold rent for a burned out lightbulb.

The Lanlord stated he would have the repairs completed by end of March, & he did not come close. Like a commenter said, he got a free or discounted refrig. Landlords are sticklers for contracts in regards to tenants, yet not a stickler with contracts regarding themselves. Furthermore, what were the other reasons he attempted to evict her? Mmmm same reason she with held the rent this time. Slum Lord.

Yes, the landlord did not complete the needed work, the problem is that there was never any agreement that the tenant wouldn’t pay April’s rent. The only month the tenant was allowed to skip rent was March.

If you check the news report on this, the news reporter said that they have been to this complex many times with many other tenets.

NJ does allow rent to be withheld for repairs, however the full rent must be deposited with the court on the court date before an inspector would be sent out to confirm the complaints. There really is no point in doing an inspection if the tenant does not have the money to pay the rent and the eviction should go through.😊

Cluster. Land lord should have never rented that unit out in that condition period. I rented a house unseen from progress residential, from Tennessee to Florida, it was a DISASTER. Completely unworking fridge, broken ac, floors covered in thick grease, rust runs all down the cabinets from the hinges, microwave didnt work, paint splatters all over the floor, trash and busted glass all over the property grounds, back porch roof black with mold and leaking everywhere, only one toilet worked and it barley flushed, it was a NIGHTMARE. IN AN EXPENSIVE HOUSE. Landlords can't be good landlord if they provide dilapidated residences. Period. Differences being that i PAID MY RENT because i didnt want an eviction. I'm responsible. They fixed the giant list of problems, and everything was at least okay until i got the heck out of there at the one year mark.

She may of withheld the rent , but I would of paid it into escrow to protect herself seeing as though he didn’t uphold his end of the bargain. That system didn’t help her at all or penalize the landlord for being a slum lord. I’m sure his home doesn’t look that ways and your supposed to give 24 hour notice when you want to enter a home and I’m sure she had no notice at all…smh…

I have 11 properties and as soon as I get a call. I do repairs within 1 day no more than 2. I have 3 top notch handyman on call. Also I make sure every place that I have, would be if I was renting it. You have to take pride in every property. In my state u can't withhold the rent. If u can't pay the rent, I would prefer that u move, cause once I file the eviction papers. It good bye. Landlord should have had keys for the repair

In AZ, you have to give landlord written 10 day notice that something is in need of repair, and they aren't fixing it, will be repaired by you and taken off the rent. Only a certain amount is allowed. If the repair amount is over the allowed amount, then there is another notice that goes to them stating you will withhold rent. That rent has to be put in a separate account and be held until later. It's always best to get legal assistance before you do anything, however you can find what your states landlord tenant rules allow. The rules walk you through things well

When these news crews interview landlords, it makes them looks like heatless SOBs. How can landlords make repairs if the tenants don't pay rent? Landlords have to pay taxes, mortgages, utilities, and maintenance. Those things cost money, and are paid through RENT. The audacity of these tenants.

🎉I was 4 minutes into your video and had to stop. When you were reading her comments in a mocking way I was done. A picture is worth a thousand words. How she was living is not ok. How patient is she supposed to be when she has one burner to cook for a family of 7? Not to mention the leaks and the dilapidated state the property seems to be in. There is already a 157000 views in 5 days of your video If you really want to make an impact and educate people on housing properties and being a landlord, you can do that with having decency and a little empathy as well I have been t a renter and my landlord was an older, cantankerous man. But he was fair and I would do whatever I had to do to make sure that he got his rent money because of the way he treated me. He wasn't kind or friendly but he treated me like a human and cared about the state of the property. Now, I am a landlord of 11 properties and I remember and try to emulate the landlord I had. You don't have to become a tenant's friend but if you treat them fairly and allow them to live in a decent property, they will care about you getting your money. You sir, would not want to pay to live the way this lady was living. You wouldn't want to stay there with your family for a week let alone an ongoing amount of time. Stove and refrigerator are botal. Landlord could have allowed tentant to rent those items and deduct that cost from tent till he teplaced those two items. Clear the Apt was not in shape to rent apr out. I believe Judge was unfair. Owner could have lowered the rent and allowed tentant to resolve those issues.. SlumLord. 7 kids, eviction? 😢😢😢😢😢😢😢 Don't rent bad apts. And expect tentants to pay high rent.

If a tenant is given so many days to get their rent in than a landlord should put also in writing how many days they need to repair a plumbing situation, electrical, frigerator or stove. The landlords should make provisions to always have face to face or phone contact with their tenant who is dealing with the issue at hand and have the monies to support their complaints....These complaints can turn into serious situations..why get even with the tenant? Be prepared to handle the situation ASAP...remember it's your responsibility to up keep your property without a grievance as if the tenant caused the problem....if so included in the contract that there will be inspection every so many months to maintain the property.

Escrow is where you put your rent until repairs are done. If after 30 days, nothing is happening, then plan on moving. Have all your evidence. Talk to a lawyer. You can find one that takes low income and see what your next step can be. As long as you keep your end of the deal and have rent money in escrow, you should be all right .

In Florida, the tenant has to give the landlord a written notice of repairs needed and they are required to pay the rent into the court. After receiving written notice, the landlord gets seven days to fix the issue. If they don't pay the rent into the court, they can be evicted for nonpayment.

I've been in same boat. I was after my landlord for 4 years to repair my steps to get into my home. 2 of these years the steps were unusable. I withheld 1 months rent to fix the steps and they tried to evict me.

When I rented, my water heater broke on a Friday. I called the landlord and promised to get me a new one installed by Sunday or Monday. His handyman had to buy a new one and get it installed. It was just me, I was able to heat water to wash up. Landlord got it installed Sunday night. As a homeowner I pay for everything. There were too many things wrong all along. We don't know how long minor things were not being fixed. He got her a new refrigerator but not a new stove? Leaky roof means MOLD. I would have moved. Today, property owners won't fix things quickly only want to raise rents. My mom rented for 30yrs. The owner would fix things for quickly for other renters except my mom. My mom was on rent control and her rent was lower. We had to go to the city to make him fix her toilet that had been leaking for years. He refused to properly fix it. My mom made all minor repairs to the stove, garbage disposal, etc. You are crazy if you do not get repairs done promptly. You need to maintain property for a tenant, if you can't don't be in the rental business. What you do as a homeowner is your business, that's not what a renter signs up for. They pay the rent, you maintain the property...PERIOD.

Your mum was on rent control? I wonder if his expenses had been capped just like her rent? Imagine if say Walmart were on price control by the government, how could they stay in business by selling goods below cost? Well they couldn't they would go out of business. Great for your mum getting cheap rent all those years but not great for all the tenants that are now competing for fewer and fewer properties because it's not viable for investors to build new ones because who knows if they will end up losing money if they can't recover any increase in their costs?

Well if she has a leaking roof and it's in that condition for months, yes she should not pay. And she has a stove with ONLY one burner working, the landlord needs to purchase her a new stove asap, repair that roof , asap And whatever else that needs repair It seems like this landlord was just collecting rent and nothing else. And I'm sure, she's been waiting for some time for him to do these repairs. ALL these things didn't happen all at once Some landlords or REALLY "Slumlords"

The problem I have is the apartment should have never gotten to that stage. We are not Talking one repair we are talking multiple things. Clearly he's a slum landlord. I'm amazed that you don't find that to be a problem leaking water from the ceiling mold a stove that doesn't work. Did all of this just magically happen at once? No it did not. And why I understand you want rent tenants have a right to a decent place to live. I wouldn't have given him a dime until every last thing was fixed. But I also would have called the government and had them come in and fine him out the ass.

You must pay your rent or if you decide to keep your money & NOT pay the rent cuz repairs are NOT done you should get evicted. And if you feel that the landlord has wronged you, you can sue him/her in Court. Your street justice of retaining the rent money cuz the repairs weren't done is just bogus. If you make your bed so must you lay in it. *AND I HONESTLY THINK SHE DIDN'T HAVE THE MONEY TO PAY HER RENT AND SHE'S USING THE REPAIRS AS AN EXCUSE. My landlord absolutely refuses to fix anything. We have put all repair requests in writing. She has threatened my family with eviction if we get it fixed and deduct from the rent. I have done my research and we have started repairing things and deducting from rent. I told her to go ahead and take us to court. There are leaks everywhere, rot everywhere.
