Only because of qualified immunity are these people allowed to continuously get away with this kind of behavior. And unfortunately the only ones to blame are the American people because when there was a time to stand up none of them did.the tree of Liberty must be trenched in the blood of patriotism. And there will never be Justice on stolen land. Give me control of our country's money and I care not to governs it. People still live in a thought concept illusion. The only way to stop tyranny is to enact equal or greater force against the tyrant. That's what the 2nd Amendment is for it's the people's last defense against the tyrannical government do you think the people in the colonial days would have laid down their arms and willfully submitted to these people of authoritarian mentality. It is not a war on race it is not a war on drugs it is not a war on land nor is it a war of politics it is a war on KNOWLEDGE.

@Audit the Audit Can you do a video on the Plano Police arresting the guy walking in the snow this past month? I live in Plano and it concerned me greatly that they used walking across the street as "pedestrian in the street," to justify detaining him. His is Rodney Reese and he was simply walking home from work during the recent snow storms we had here in Texas. The police dropped the charges eventually after we here in our community pushed back, but the Police Chief still contends the detention of Reese was legal. I personally disagree. Care to give your opinion on this one?

Well, I would be nervous if cops keep showing up and boxing me in with their hands resting on their weapons. It's clear that cowboy-hat cop and the others ASSUME that the black man has done something wrong, they just need to browbeat it out of him. I think that police officers need to obtain an Associate's degree in law enforcement plus pass their state academy and achieve firearm competency at the Marksman level - before they get a badge. Too many officers appear to be under-trained in case law, human deescalation methodology, and firearm competency under stress.

I know. He seemed like such a a friendly, easygoing guy. His truck is F'd up and he's still smiling and telling them about what's wrong even though he has no obligation to tell them a damn thing . These little piggies are way out line and abusing the authority that they don't actually have since that poor man wasn't caught involved in criminal activity

It should be illegal to perform a frisk in the way that officer did. No warning at all, just sneaking up behind the guy, absolutely disgusting, it's almost an instictive uncontrollable and healthy reaction to resist at this point.

Go back and watch the video. Prior to backup arriving the first officer told Frazier that he was going to frisk him for weapons and the suspect freaked out and asked what for. The officer awaited backup because he thought there would be an issue. He was right. The suspect got crazy.

@@ropedb... I’m ignorant for using proper terminology? That’s funny. Regardless of ATAs analysis, the guy could not explain why he or the woman was trespassing on someone else’s property. His car happen to break down while in someone’s driveway? Yeah, right. No one pulls into a driveway when they’re having car issues. They pull off to the side of the road. He was clearly up to no good but I can see that because I’m not biased towards the cops or blacks. Look at how the SUSPECT reacted at the beginning of the video when the cop asked why he pulled into the driveway of someone he does not know. He stumbled... then stumbled again. Those of us who made it to college and took a psychology class and/or have children knows the delay was because he was mentally formulating a lie. Plain and simple.

Compared to most Texas cops, these guys were pretty good. In Texas we have a lot of gang activity including MS13 and drug cartels, but the biggest is the _Criminal Police Gangs_ that can be found roaming the state.

And if it’s public intoxication, you can’t even prove your innocence with a breathalyzer or blood test. It’s not “economically feasible” says the judge.

In Lower Paxton Twp PA I was charged with Public Drunkenness for dropping my cell phone in front of an officer. I had not been drinking. The officer exclaimed he could "Smell it all over me!" 6 other officers showed up. I pushed for a field sobriety test or breathalyzer - which they explained they did not have to administer. Eventually the superior yelled at me "You want to play this game!!" (my reply "What game I just want to demonstrate I haven't been drinking.") He then administered the breathalyzer which came back 0.0 The lead cop then yelled at me "We don't know if you're going up or going down! You could have just chugged a bottle of vodka before we got here!" yelling that in my face. They repeatedly threatened that I was going to jail. I eventually talked them into letting me call a cab to get home and leave my car there - despite being 100% sober. They allowed that - then I rode my bike right back and got my car. This charge was highly disruptive to my position as a postal worker. The charge was of course later dismissed in court, but not before causing me to be transferred to the downtown low income area post office for "problem" carriers. Also I never got any of their names. The cop who's name was on the citation and who showed up in court was a new guy in training and was seated in a patrol car throughout most the abuse and never had any interaction with nor ever spoke to me.

Usually it is best to say nothing. If the police are talking to you about a serious crime then absolutely say nothing beyond name, DOB and address even if you are innocent. If the police are talking to you about a minor crime it is usually best to say nothing however you may make your life easier by talking to police provided you are innocent. For example they may allow you to continue about your business rather than detaining you for further questioning.

I get that it is technically resisting, but surprising him with a pat down from behind it was likely just an automatic reaction. Honestly I feel that resisting needs to have a higher standard.

Right... And ATA stated multiple times that the man resisted the officers but doesn't even show it. All he did was try to question them touching him for no reason. He wasn't resisting and the officer pepper sprayed him for no reason.

that's a detail that a lot of people seem to miss that the human body has reflexive actions when you do certain things to it and they always want to call that resisting. if you're choking me or causing my body pain it's going to squirm it's not a mental decision that I made. They have these pressure holds they use that are extremely painful that make you feel like they're going to break your wrist but if you squirm they call that resisting

@@MessOfThings I agree. A friend of mine works security at a nuclear plant in his state. The level of training is to the point where the state police in their area regularly try to recruit people after they have a year at the facility (Apparently it is a fast track to being LE there) . Anyways he and some buddies demonstrated some of the holds on me and on each other. ‘It doesn’t really hurt it only immobilizes.’ I politely disagreed.

I got an idea. How bout public servants actually serve the public instead of bullying and stroking their own ego. I'm a supporter of law enforcement. As long as they're not being tyrants trying to boss people around and not try to compensate for their own weakness. It only goes to show how truly weak their mind is and the absolute lack of confidence a lot of officers display. I'm more than glad to give every one the benefit of the doubt and give every bit of respect they earn....as long as I'm not asked to forfeit any rights or lick their boots. They aren't n charge, they aren't the boss, they don't have authority of u....they only have authority to enforce the laws. Officers acting like a parent to a child bullshit is tiresome and gets a lot of people hurt. We pay their goddamn salary and hire them to do a job. It's voluntary. If they don't want to do that job by serving the public, then they're only doing a disservice to those they have a moral, ethical, and mostly legal duty to treat like American citizens.

“Arrested for resisting arrest.” That doesn’t make any sense. Wouldn’t they need a whole different reason to initiate an arrest to begin with and THEN if he resists, they can add on “resisting arrest” to the charge(s)???

​@@marlettohemmingsen2828 Technically, no. Resisting is a secondary offense that requires a legally valid arrest to add the charge of resisting. An arrest for resisting without a primary charge creates a false arrest.

@@marlettohemmingsen2828 It is true that that the police often ignore a primary charge, make one up and then arrest for resisting. It is worthy of note that they forget about the phony law. Often they tack on disorderly conduct in an attempt to make the resisting valid. They disregard the rules of the law when they make the resisting arrest. Thank you for your comment.

I don’t know why people respond without simply reading the statute, it took all of 30 seconds: Texas Penal Code - PENAL § 38.03. Resisting Arrest, Search, or Transportation (a) A person commits an offense if he intentionally prevents or obstructs a person he knows is a peace officer or a person acting in a peace officer's presence and at his direction from effecting an arrest, search, or transportation of the actor or another by using force against the peace officer or another. (b) It is no defense to prosecution under this section that the arrest or search was unlawful. By simply reading the text we can see that even if the original arrest is unlawful, it is still illegal in Texas to resist the arrest.

Furthermore, depending on the type of assault, suspension without pay for three months. One more violation will cause dismissal. There is no excuse for this type behavior and neither should they be allowed to investigate their own behavior.

So tell me, if a police officer snuck up from behind you, and without any warning started patting you down, you're telling me you wouldn't have any reaction? You'd just sit there and let it happen, without knowing why it was happening, or what exactly was happening. You're a lot more trustworthy than I am. He didn't resist that frisk, he was surprised at what was happening and the bad cops escalated the situation.

They didn't even really explain what they were doing before they started putting hands on him and then it wasn't even a second they were arresting him when there wasn't even a crime to be arrested for. It was supposedly a pat down.That was pretty fucked up to me. They got their way though. They found out who he was.

He knew he was going to jail for the warrants and like most didn't want to go to jail. He really screwed up by resisting the pat down. All because he got traffic tickets and simply never dealt with them.

One of my favorite things about how easily "resisting arrest" is applied is a case where a guy with an open carry permit was openly carrying in a secure (AKA latched shut, need to actually work to open it) holster on his hip. He was patted down, the cop doing it popping open the holster in the process, and then cuffed behind his back (for a legitimate reason). When he was made to lie facedown on the ground, he bent forwards and his gun fell out of the still unlatched holster and onto the ground. The basis for him resisting arrest was him pulling out a weapon. He was charged with resisting arrest because a cop assisted gravity in moving a gun from a position the cuffed guy could theoretically have drawn it from to one where the cop was in far more control of it than the cuffed guy.

It seems to be the general rule that a 911 call/complaint provides the police with "reasonable suspicion". So a 911 complaint gives an anonymous caller the right to have an individual investigated, but overrides the rights of the individual that was reported.

Yeah there's no justifying the cops' actions on this one. In traditional police fashion, they escalated the situation until they finally had a reason to go hands on. They went there with the intention to flex their authority, and they weren't gonna leave until they accomplished that.

Yeah, my father would have reacted with an instinctive kick or jab, we kids learned early on that we made our presence and intention to touch him very clear. I don't see that as a lawful Terry frisk. A Terry stop and a Terry frisk are two SEPERATE transactions. The courts have ruled the ability to do a Terry stop (i.e. detain someone under Reasonable Articulable Suspicion) does not grant an AUTOMATIC right to frisk someone. In fact TWO criteria must BOTH be met to conduct a frisk. First the officer must believe the person has a weapon based on clearly articulable reasons, not just "I saw a random budge" which could be anything including a cell phone but "I saw what based on my 10 years of experience looked like the butt of a pistol in his small of the back". Next the officer MUST ALSO feel there is an immediate threat to his life. So in Oklahoma here we are almost all always carrying a gun, that in and of itself even during a Terry stop does not allow for a frisk/pat down. The officer must also feel the person intends to use it. We have to get away from this blanket "I'm going to pat you down for officer safety" mentality. Go read the actual Terry v. Ohio ruling, the pat down is not automatically part of the initial stop and requires BOTH additional criteria to be lawful.

Normal people don't like being manhandled, just because police do it at the drop of a hat doesn't mean your natural reaction still won't be to object. And I challenge whether he "resisted" cuz you sure didnt show any. You showed him turning around to object, which meets the police definition of resistance which is anything less than eager agreement, it seems. I've noticed you don't seem to think being handcuffed means much nowadays, too.

I believe it's somewhat standard to always be careful in that line of job. I've seen some videos where cops were killed or harmed because they weren't expecting a bad outcome, sometimes even on a simple traffic stop. I am all for the innocents too, but I wouldn't hold a standard approach against every cop because of some bad cops that follow the same standards.

@Quartinium Quite the opposite, actually. They are so poorly trained that they are excessively afraid in these situations. Most times, police violence is out of paranoia rather than malice. They need *more* funding, for better training (and better technology/systems/etc. for screening people to keep the corrupt from joining in the first place.)

@@ArissXAS More often it's the citizen that is in danger. Being a police officer doesn't even make it into the top 10 most dangerous jobs. Working in a factory, being a fisherman, a teacher, or a firemen are all considerably more dangerous than being a cop.

@@nunyabizness4382 I don't believe race has anything to do with it. The problem is that Conservatives have a tendency to support Police too much. It's a good thing to support the Police as a general rule, but individual cops should be treated like any other citizen. And Conservatives often tend to ignore the little details and focus only on the big picture. Liberals, however tend to focus a great deal on every little detail when it comes to stop and search. Conservatives are also much more likely than liberals to grant qualified immunity for overlooking those little details. One appeals court (I think it was the 5th circuit) granted immunity to an officer's use of violent force against an individual because he "didn't witness the patdown" and thus "could have reasonably believed he was armed." This is unnerving. In the 1803 case of _Marbury v. Madison_ the Supreme Court said a man ought to be able to turn to the laws of his country for a remedy when his rights are violated. A recent ruling said it was the founders' intention for people to seek a remedy at law when law enforcement violate their rights. So the problem isn't about race. It's about the traditional Conservative expectation that police are right and citizens should help the Police to show their support. And they'll overlook those "subtle facts" to rule in favour of Police. I don't depart from Conservative values much, but this rule and that of "qualified immunity" violate the basic values of liberty.

9:35 traffic warrants are one of the most grating aspect of public policing, and seem to be a pretext for many searches and elevation of charges based on those searches that would not otherwise have been based on probable cause. Traffic enforcement through jailing is and extreme, profit-oriented abuse of the public trust.

I have never understood how identification would help in determining whether a crime is being or about to be committed. It's almost always about finding a reason to get you in a cage so they can work you for money and get a file going on you so they can continue to harass and exploit you.

@@markshaw309 Because preventing them from creating the list in the most efficient way means obstructing their work. They try to be efficient, and you don't cooperate. Not that I ever heard about such a list used anywhere, or mentioned in the codes of criminal procedure.

No, he picked his cousin up from the front of the trailer park. The driveway he was in was probably who called the police on him. He sat too long and they got scared. I would have too. He should ha e let a licensed driver drive and they would have checked the license and then informed the homeowner the vehicle was broke down and no one would have gone to jail.

@@glorioskiola They were probably scared to come out and say anything. Could have been a little old lady. So, if you have warrants, a kilo of coke, five guns and you're a convicted felon, maybe don't park in someone's drive you never met. Or, knock on the door explain you are broke down and assure the person someone is coming to tow you away. Don't just sit there for thirty minutes. But, I would probably approach them and ask what they were doing to.

I have great respect for your work. My father was a law enforcement officer for 30 years. He was always the one to say that "a few of us give the rest a bad name". Here in Canada it is now becoming a more public issue because of our ability to view everything in real time. If you could offer your expertise to the Canadian laws and rights landscape. The audit community here would be very grateful and it may help with our current tribulations with police. We have made great strives but the balance has shifted to the point of law enforcement being confined in the news and community. Your unbiased stance i feel would do wonders for our entire justice system.

Yeah. The cop whispered it to the other cop. He didn't announce it to the guy. If he had announced it to the dude and actually gave him a chance to submit then things would have gone differently.

Yup - it is ridiculous officers aren't required to: 1. Announce the beginning of the stop/detention. 2. Articulate their reasonable suspicion, and any new suspicions derived from the investigation. 3. Announce each action like a frisk or intent to use cuffs (unless the person is already resisting). 4. Document every detention, use of cuffs, pulling weapon, etc. 5. Respect the person's rights once declared (4th Amendment, 5th Amendment). 6. Perform the investigation in a timely manner and not engage in action which unnecessarily delay the investigation (such as repeatedly asking the same question after the person legally refuses to answer). 7. Promptly end the detention when the investigation is no longer being progressed. 8. Promptly return all personal items. 9 Promptly announced the end of the detention. 10. Provide some means of identifying the officer on request for a complaint (doesn't have to be officer's name for his protection, just department and badge number), and provide name after court case is progressed.

This is so frustrating. He started out smiling and laughing with the cops. Probably would have went above and beyond for them but they had to assume he had weapons and shit for no reason and it immediately soured the mood on the interaction. Ego and good ole boys caused this shit.

i will never understand. Resisting Arrest is a normal human reflex, if someone tries too grab you you will instinctivly defend yourself, thats why they need too give proper warning. The cop said he was going too do a search barely even a second before he tried too do it. Thats no time to understand , and whats worse he came form behind all of a sudden . That would cause most people with an average-strong survival instinct too fight back.

I repeatedly remind my Afro-Brazilian stepson to always do the following: Do not talk to the police. Do not consent to a search. Obey police orders even if they are not lawful. Save your arguments for the judge. He claims he already knows this and so it doesn’t need repeating. I keep repeating it.

They deserve an F! They violated his 4th/5th Amendment rights which should instantly give them a failure grade. They also lied later in the video that the caller said he was intoxicated which was different from what they said at the beginning.

The dude got a C-? he was just waiting for the repair man, got surrounded by cops and was rightfully cautious. Have we forgotten recent racially motivated interactions that have been in the media? I can imagine myself what a wallet could be misinterpreted as to a cop and how quickly they could escalate the encounter especially considering he was a fugitive and the cops were being very demanding and accusing him of trespassing when he knew he was stranded and not there to commit a crime. I would have expected at least a B, not sure about your grading on this one.

He had already lifted his shirt to show them he was unarmed so the sudden attempt to physically search him without warning was uncalled for and unsettling. It was a reflex responsible to someone suddenly grabbing you from behind. Kinda like when they're attempting to break your arm or choke you out or any of the many things they do to cause you pain or fear of death to which any normal person would instinctively and reactively resist. But because the law rarely considers natural human instincts and behavior. Cops often get away with things like unnecessary use of force, escalations and abuse of power

When the officer snuck up behind him and started grabbing him a normal human reaction is jump or move to she what was going on. The fact the officer immediately grabbed him and threw him against his car and getting pepper sprayed does not amount to resisting arrest. You ever been pepper sprayed? You react in anguish. That then is not resisting it is reacting to violence on one’s person. If they officer said stand there and then proceeds to knock you down, then arrests you for failure to comply, it is bogus.

I tested civilian grade Capsicums Oleoresin by spraying it in my face then attempting to operate a coin-operated pay-phone finding that though it is not safe-relaxed I was able to dial a specific number repeatedly ~Similarly those consumer-grade "Tasers" have nearly no-effect on me demonstrating to my brother that as his supervisor had instructed him they also only upset an actual core-criminal by demonstrating in the retail display area by rubbing in on my inside inner forearm that it is useless or aggravating ○ I have not been able to arrange a test of LE Tasers though have been hit 2 or 3 times by 277 which is far more deadly ◘ I side with LEO here as it appears to my by incomplete viewing of the video that SOI was lingering for some reason rather than normal vehicle recovery

@@ChiDraconis I personally avoid pepper spray and tasers. As far as what I saw the gentleman was a victim of an inoperable vehicle. Since that was clear obvious the officers escalated the encounter way passed what should be acceptable. Not withstanding he admitted he may have a warrant outstanding. To which arrest was warranted. That was his fault. However the stopping and speaking with him was about the 911 call. Clearly not intoxicated. Explained why his vehicle was disabled and help was on the way to correct the problem so he could repair his vehicle

@@billmcconnell1837 I followed your response-the details explain to me further facts-in my situation I am tole by "Torac" ( his prison alias ) that there have been 935 theft by burglary @ 1 location alone in the area where the 2 traffic intercepts resulted in shining bright LED into the lens of my iris with LED Light bar also causing "adverse" opinion • There was a supervisor present at one whom stepped in to inform me there would be an arrest had I not complied yet the "935" is ~500-x what I can comprehend and keep as concept yet in my 2 instances I ran clean on NCIS so what is the concept that drives the "Billy Bully, A school-yard counting tale by Alvaro & Ana Galan - Kids Books | Storytime with Elena" → This is so far beyond my nature that I am at a loss and seek ideas as to how to position & conduct my affairs ◘ Avoid civilian "avoid pepper spray and tasers" as they are ineffective as constraint of those whom live a hard-life and make for difficulties-in the situation presented if used they will knock a person to the ground despite my bravado claims yet I have been hit by "instantly deadly voltage" and just shook it off missing 3 blundered steps while acceleration to the field mobile office trailer had 3 supervisors blowing hot-air whom immediately responded to my report correctly ○ I have remediation of several physical stuff and am contemplating a jaunt to Anderson County TN where my online honey is targeting me as replacement husband for the moron she unloaded ~ I am trying to scam here for the $138,000 proceeds of recent house-sale to finance my journey-she is fast on the mind enough to make joke of it & can whup me if I attempt blurrable bubble blowing but where do we get-one of them still had his cadet bars-"The only one you can catch" being the honest Joe & Josie Normal????? ◘ As a matter of course without a need we are back to the PI type invest to explain badged officer's in my case ~ this does not cut it for serve & protect; I am at a loss for what to think

I would have given them a D or F. A cop shouldn't just sneak up behind someone and start feeling them up. Especially after they've been arguing with the man (are more especially since they were dead wrong in that argument). If someone's pissed off, especially if you're the one who pissed him off, let them calm down before you put your hands on them. He already showed them he had no weapons, so what's the big rush?

Regardless of the fact that this new had any warrants, the tactics and mindset of these officers display exactly what is the problem today. A person standing next to a vehicle that says their car is broken down and immediately the police want to turn it into something much more. I've had police want me to identify myself for having McDonald's food in my lap and eating it in my car while in the McDonald's parking lot, claiming that they believe that I'm only sitting in my car and eating the food at Mcdonalds to case The Joint to Rob McDonalds. Never in my life have I heard that it's suspicion of a crime to order food at a drive-thru and to still eat it on the property. There is no such signage on the property either that said anything about if you get your food in the drive-through get the f*** out of here

Because american police are completely untrained. They take social rejects and give them power. Here in germany there is no quota or whatever to be filled like in the USA, so police dont go around causing problems with people who just need some help starting their car. The police here are actually here to protect and serve.

I think I would like the cops to investigate if that vehicle belongs to the person, especially if it has locked up on them. A number of vehicles have anti-theft devices that lock up when they don't have the microchip keyfob in the legitimate key. Asking for a identification so they can verify the vehicle belongs to them should be reasonable, they might also have a suspended license from something like DUI etc, that you wouldn't want them on the road.

Etc. etc. It's important to check just some standard things and you might save a life, or recover stolen property. Heck you might even discover that he's got some 8 year old girl tied up in the back. Imagine if no one asked any questions of Tim McVeigh, who was captured because the State Trooper noticed he didn't have a license plate.

@@Grabthar191 the average person doesn't believe that every person should be investigated so thoroughly over things that do not create a reasonable articulable suspicion that a crime has taken place therefore it is safe for me to assume that you yourself are an officer of the law and I don't even want to say an officer of the law simply because cops that think the way you do typically think that way because they look at the more people to investigate the more likelihood I am upholstering my reports to make me look better to line my pockets with more money, it's not in the pursuit of justice and we both know this just by your predatory speech

These kind of situations will END when it's illegal for police to lie to the public. Handle it the same way as illegal search and seizures. Anything handled charged afterwards is dropped along with any impound charges for taken property and lost pay.
