A "privilege" is not a "right"! I have 'God given rights,' not 'God given privileges.' All the 14th Amendment did was create a new "Status" (Statute) for anyone living in North America. So anyone choosing to align themselves with a new slave based monetary system could now call themselves a U.S. Citizen and be 'granted' "privileges" by their government who gave them their new status, thus superseding the very concept of a 'God given right.' A "Right" is inherent; a "Privilege" is granted.

Section 3 of the 14th Amendment highlights "Officer of the United States." During the US Supreme Court Case: 561 U.S. 477 (2010), Chief Justice John Roberts said that since presidents are elected, not appointed, and therefore are not considered officers of the United States. His actual quote is, "'People do not vote for 'Officers of the United States.'" Officers are appointed and are not accountable to the People. Furthermore, no one can be labeled as an "insurrectionist" without Due Process and ultimately being found guilty. In the United States, Due Process means that you are innocent until proven guilty especially if you were never charged with a crime to begin with.

The constitution had a full section addressed to the abolishment of slavery, but because the only way to win against England was to present a united front. Thus compromises were made, although our founding fathers knew this problem would have to be resolved eventually.

The only purpose of even forming a government is to preserve individual liberty from threats foreign and domestic. The best kind of government is the one that governs least. The best way to assure that is a strict constitution of expressly limited powers and fundamental liberties that cannot be legislated over. That is why words on a piece of paper matters.

@erroneus008 жыл бұрын
+Turkish Delight Unfortunately, the first responder to your question is not an educated nor a reasonable person. The history of the passing of the 14th amendment is rife with unresolved and illegal behavior. It was not legally passed. And when it came to the states ratifying the 14th, there was more of the same unresolved and illegal behavior. So you see, if they wanted to do it right today, I believe they would have no trouble in doing so because the 14th amendment *as intended* there would be no problem. But it was a different time and a highly emotional time at that. The use of deadly force was everywhere. It was a time when meaningful legislation was impossible to pass. We shouldn't confuse wanting proper law adoption with a desire to reverse the rights and freedoms of all the people of the US. Bad law and improperly passed/ratified laws are problems which require proper resolution so that subsequent law remains true and stable for all time to come.

The Gettysburg Address and the 13th, 14th, and 15th Amendments are interconnected through their themes of equality and freedom. The Gettysburg Address, delivered by President Abraham Lincoln during the Civil War, emphasizes the idea of equality and the preservation of democracy. It highlights the sacrifices made to ensure that "government of the people, by the people, for the people, shall not perish from the earth." Similarly, the 13th, 14th, and 15th Amendments were enacted after the Civil War to secure civil rights and equal protection under the law for all citizens, particularly for African Americans. The 13th Amendment abolished slavery, the 14th granted citizenship and equal protection under the law, and the 15th granted African American men the right to vote. These amendments reflect the principles of equality and liberty laid out in the Declaration of Independence, which asserts that "all men are created equal" and are entitled to "life, liberty, and the pursuit of happiness." Thus, both the Gettysburg Address and the constitutional amendments are connected to the Declaration of Independence through their shared goal of establishing and preserving equality and freedom for all Americans.

So if you want to define who the 14th amendment pertains to you would have to look at the legal definition of an American Citizen. I'm pretty sure it includes women and homosexuals, etc, and therefore equal under the law.

No, I don't think the liberals and democrates of 1863 were the same as today. The philosophies have changed, yet the "tag" remained the same. Liberalism and conservitivism are only two social philosophies while a political party is a political philosophy of how to govern within the confines of the social philosophies which your political group values the most. What mattered the most then to that generation seems to differ "somewhat" from what matters the most to Americans today...

So you are saying the 14th still has nothing to do with Illegal Imagration.

There are Supreme Court cases that are decided so obviously wrong that it is simply infuriating to learn about them. For me, The Slaughter House Cases and Hans v Louisiana were such cases. They are so obviously contrary to the plain reading of the text that they actually produce a feeling of anxiety in me when I consider them. I find them both intolerable opinions, but what is someone like me, an average citizen supposed to do about it?

Both definitions apply, but before you had to be a Citizen of a State to be a citizen of the U.S., now it is reversed, you have to be a U.S. Citizen to be a citizen of any of the several States.

If the second amendment guarantees a right to bear arms (and to buy them, presumably), and the fourteenth amendment says that "all persons born...in the United States are citizens of the United States and of the state wherein they reside...no state shall make or enforce any law which shall abridge the rights...of citizens of the United States...", isn't it technically unconstitutional for there to be an age requirement for purchasing a gun? If someone under 21 can't purchase a handgun and someone under 18 can't purchase a long gun, aren't their rights as citizens of the United States being abridged? Regardless of what the courts have said, I believe that the right to bear arms (just like the right to free speech) applies to all citizens, regardless of age.

Children don't have the same rights as adults and in anycase the 2nd A doesn't create an individual right. You have to be eligible to serve in the militia.

@sophiethegypsyqueen Part1: Article 14, Section 1, makes no reference to gender or race, only citizenship. Therefore, clearly, in 21st century America gender, race, lifestyle, religion, political ideology, life philosophy, or what have you has nothing to do with your rights - these rights are for all citizens equally.

On what day did the people ratify the constitution? Never…only the bill of rights. If we enforced our rights the 14th amendment was unnecessary.

2 National governments? "The idea prevails with some, indeed it has found expression in arguments at the bar, that we have in this country substantially two national governments; one to be maintained under the Constitution, with all of the restrictions; the other to be maintained by the Congress outside and independently of that instrument, by exercising such powers as other nations of the earth are accustomed to...I take leave to say that, if the principles thus announced should ever receive the sanction of a majority of this court, a radical and mischievous change in our system of government will result. We will, in that event, pass from the era of constitutional liberty, guarded and protected by a written constitution into an era legislative absolutism...It will be an evil day for American liberty if the theory of government outside the Supreme law of the land finds lodgment in our Constitutional jurisprudence. No higher duty rests upon this court than to exert its full authority to prevent all violation of the principles of the Constitution." Downes v. Bidwell, 182 U.S. 244 The never ratified 14th article(notice how careful they are to say "ADDED" in the statement under the video) creates a new federal citizen, this new federal citizen has civil rights(government privileges) and NOT God given rights(no government necessary) per our founding document: "the laws of nature and of natures God entitle them" July 1776. For a precise definition on this new federal citizen, use Black's Law 6th edition under "Fourteenth Amendment" page 657. (creates or recognizes for the first time a "citizenship of the United States'', as distinct from that of the States) Exact. This is a new legal citizen that is the EXACT opposite of our founding and NEVER approved, which begins a new unlimited government. This federal aka national citizen was discussed in the constitutional convention of 1787 and turned down due to the central government having supremacy over these citizens. This is exactly what we are seeing today. And the $20.5 Trillion debt shoves it right in our face. The never ratified 14th article aka a "bill of attainder" is a 100% scam. Understand it, denounce it's validity. Thomas Maddux Texas National (not a federal citizen aka a never ratified 14th amendment legal citizen)

We should recognize that God has given us all our rights. The legislations only lists them. Stand under God. Those who make the rules, are not greater than the Creator..... Use the organic legislations under the natural, common law, under America the Republic, not UNITED STATES THE DEMOCRACY.... Marsha.
