The Fourteenth Amendment was added to the Constitution in 1868 to empower the federal government -- including particularly federal courts -- to stamp out a culture of lawless tyranny and oppression in the South by enforcing basic civil rights of newly freed blacks and their white supporters. This culture of oppression took many forms, including widespread censorship, the systematic disarmament of freedmen and white unionists, and the wholesale denial of economic liberty. At the heart of the Fourteenth Amendment was the Privileges or Immunities Clause, which the Supreme Court effectively deleted from the Constitution in the 1873 Slaughterhouse Cases. Today, that judicial error continues to take its toll on important freedoms like private property and the right to earn an honest living, which receive virtually no protection from courts despite their obvious importance to ensuring the economic autonomy of the freedmen following the Civil War and all Americans today.

A "privilege" is not a "right"! I have 'God given rights,' not 'God given privileges.' All the 14th Amendment did was create a new "Status" (Statute) for anyone living in North America. So anyone choosing to align themselves with a new slave based monetary system could now call themselves a U.S. Citizen and be 'granted' "privileges" by their government who gave them their new status, thus superseding the very concept of a 'God given right.' A "Right" is inherent; a "Privilege" is granted.

After dozens of readings of the 14th Amendment, this is the first time I've paid any attention to the blurb about "privileges and immunities". Until now, I've always just gone straight to the "due process" and the "equal protection" parts. Hey-hey.

Great video! I know it's not quite in your mission, but any chance we could get more videos like this on some of the other amendments / important Supreme Court cases? I'd love to see a video like this on prohibition, turn of the 20th century censorship, or the Federalist / Anti-Federalist debates!

The constitution had a full section addressed to the abolishment of slavery, but because the only way to win against England was to present a united front. Thus compromises were made, although our founding fathers knew this problem would have to be resolved eventually.

Lol, yeah.. slavery is still a thing🤡👌 yeah, racism is still certainly present.. but I can almost guarantee you that there are more black racists than there are white racists/supremacist.. the media(leftwing media) has breathed life back into racism but its racism towards white people, people who had nothing to do with slavery.. there aren't any black on white hate crimes these days.. Theres ONLY black on white racist attacks.. most recently, a man nicknamed Peanut was fixing his mailbox and was shot and killed by two blacks dudes who specifically went out to find and KILL a white person.. little did they know that the LOVE OF HIS LIFE was an African American women.. its such a shame, our media has done absolutely nothing but divide us Americans over race.. again

One of the primary things about it, is it was "ratified" at the muzzle of guns. As were a couple of other amendments "ratified" during Reconstruction.

Privileges granted, may be removed at any time by the Grantor, a right is not granted therefore may not be removed by any human!

It seems with the advent of legal entities recognized as "persons", who often engage in parallel interests, i.e. lobbyist ....without accountability checks and balances are void while individual justice becomes vulnerable. Corporate person = collective resources, limited scope/goal, limited factors vs Individual person = single resource, broad scope of responsibility, many factors.

"VOLUNTARY SERVITUDE" Is one way of saying "hired to do a job", what normal people call 'employment'. You are hired to perform a service, like changing the oil in a car, or mowing a lawn.

So what does the original document say when it was created. Do you know or is there a link that shows any evidence? If not then the closest document to 1776 is The Bill of Rights?

Section 3 of the 14th Amendment highlights "Officer of the United States." During the US Supreme Court Case: 561 U.S. 477 (2010), Chief Justice John Roberts said that since presidents are elected, not appointed, and therefore are not considered officers of the United States. His actual quote is, "'People do not vote for 'Officers of the United States.'" Officers are appointed and are not accountable to the People. Furthermore, no one can be labeled as an "insurrectionist" without Due Process and ultimately being found guilty. In the United States, Due Process means that you are innocent until proven guilty especially if you were never charged with a crime to begin with.

Did these people read the McDonald decision? It was the due process clause that overturned the Chicago gun ban and the slaughterhouse decision remains. I heard the oral arguments and the lawyer was interrupted a few minutes into his speech about the privileges and immunities clause and I also listened to the conclusion in which Justice Scallia said they weren't overturning or reconsidering the slaughterhouse cases.

There were two decisions, the Justice Thomas voted to overturn the law, but wrote his own concurring decision.

Interesting. So what you are saying is that the constitution does allow for Voluntary (tax) Servitude? If we give it the presumption that 'voluntary' slavery is legal, there'd have to be wording in the constitution that links/labels a citizen as a 'voluntary' slave. Does this wording exist? because w/o it, 'voluntary servitude' can be disregarded.

I'm an optimist. I believe the full potential of the 14th Amendment to protect individual rights will be realize, and not just abused to rationalize illegality.

I have to fundamentally agree with that. Remember, it is cheeper to pay someone a wage then pay for their food, shelter, and heat in durring those very cold northern winters. While warm in the south, the use of the cotton-gin allowed the south to export textile products to europe cheeper then northern factory owners could export their products to europe. Southern business owners could turn a profit 3x greater then his northern equivalent as long as the status quo remained in tact...

I have to agree about "just stop..." it really dosn't matter who did what then. What matters is who is doing what today. 'When' is a tool to learn from our mistakes so we don't foolishly make the same ones repeatedly....

+Turkish Delight Unfortunately, the first responder to your question is not an educated nor a reasonable person. The history of the passing of the 14th amendment is rife with unresolved and illegal behavior. It was not legally passed. And when it came to the states ratifying the 14th, there was more of the same unresolved and illegal behavior. So you see, if they wanted to do it right today, I believe they would have no trouble in doing so because the 14th amendment *as intended* there would be no problem. But it was a different time and a highly emotional time at that. The use of deadly force was everywhere. It was a time when meaningful legislation was impossible to pass. We shouldn't confuse wanting proper law adoption with a desire to reverse the rights and freedoms of all the people of the US. Bad law and improperly passed/ratified laws are problems which require proper resolution so that subsequent law remains true and stable for all time to come.

Quite good, however it really should have elaborated on the modern violations of the PorI clause, as particularly egregiously violated by New York, Massachusetts, and New Jersey, both on 2nd Amendment issues as well as egregious economic freedom violations.

All I know is that Corporations are people too. We call 'em Money People. Be nice to them please. They mean no harm. They wouldn't hurt a fly. That's why The 14th Amendment is so special. It gave those poor custodians of these precious business institutions life. Mrs. Mary Shelley herself couldn't have dreamed that one up.

@nicademus1974 Because there are those among us that will deny our fellow man his rights, for any reason he can whatsoever, simply because he can; especially if it benefits themselves, because they don't care about anyone else. It is because of corrupt individuals like these that we need things "set in stone", so-to-speak, to clarify the things they cannot do - like deprive their peers of their rights.

no document or statute applies to anyone. we are already free. the burden of proof in any case against you falls on the plaintiff to provide applicability to any such person and when you ask for it instead of pleading guilty you will see what im talking about. there is no such thing as states or nations just individuals. peace brothers and sisters

Didn't Thomas Vote against Ex Convicts or Felons in the Heller V DC 2008 or McDonald V Chicago 2010 decisions ?? Just asking cuz a ex convicted Felon in 2004 and 2006, having MY RIGHTS RESTORED in 2014, except my 2nd Amendment. Any Felon who bears arms in America is sent back to prison for having their 2nd Amendment Right Infringed upon. Not only a 2nd Amendment Right, but also a Violation of the 14th Amendment Right to Equality. My rights are still violated in Employment, Fair Housing, and other areas of my life. Due Process is violated, the moment they call us a Felon or Ex Felon, cuz at that point, we get rules against by those that have a Bias Mentality or think a ex convicted person is unequal. AZ calls it a Rule 609 Hearing or a Creditability, due to a past conviction.. A ex con doesn't get a Fair and Impartial Jury or a actual Fair Trial in America today.. Therefore the Due Process clause is Violated and Jurors make decisions and give verdict, that is actually Unconstitutional and UnFair, since they are judged and looked at UNEQUALLY.... That is facts and I've lived through this Modern Day Injustice.. This is the reason I am asking if Clarence Thomas Ruled, that us Americans with a Felony history are Equal with the rest of you Americans reading this, or are we still 2nd Class Citizens, no different than Negroes were treated during the Segregation era. ???? My debt to Arizona for breaking the state statue in 2004 and 2006 was finished or maximum expiration of sentence was in 2009 and I was given a Absolute Discharge of Imprisonment in 2011.. Not only was it certified that my debt had been Paid In Full to the state, a judge Ordered it in 2014, yet I lost my kids in 2017, due to my past history in Kangaroo Maricopa Juvenile Court and was Hired to be Fired a week later by some employers, due to my background report ?? Didn't President Trump sign the Second Chance Act and the First Step Act in Dec 2019 making us a Equal AMERICAN or not??? I would like to know and if so, How do I file complaints or grievences for Violating my civil rights and who enforces these Federal laws???? I would just like to know how much longer do I have to still keep paying a debt for breaking the law many years ago that has already been paid, so my Rights will No longer be violated ??? @nicademus1974 I never said rights were given by words on a piece of paper. A constitution is important to protect our natural liberty. The only purpose of even forming a government is to preserve individual liberty from threats foreign and domestic. The best kind of government is the one that governs least. The best way to assure that is a strict constitution of expressly limited powers and fundamental liberties that cannot be legislated over. That is why words on a piece of paper matters.

Actually, the States can set it to whatever age they want. However, if they lower it to less than 21, they will lose their federal highway funding. Many States, have fought to lower it, past and presently, but usually lose by vote or veto due to that fact.

Why would either say anything about voluntary servitude? The 14th and 'subject to it's jurisdiction' is there to exclude diplomats and such from aquiring Citizenship from it. Subject: "person or thing that may be acted upon"

I find it phenomenal that changing the Constitution of the United States of America is exceptionally hard. Manipulation is the only way it will be changed. Time-tested freedom should be left alone. Politics need to change not freedom and rights of all mankind.

14th, Section 4, states basically: "The validity of the public debt of the United States...shall not be questioned." Ok...no one can question validity...but what about avenues of SATISFYING that Valid Debt held?

I'm going to have to make a damn video talking about this...I really do. I'm kinda futzing around, because I don't REALLY want to get my face on there and somehow look stupid. That's why I put my bear, or my thumb on the lens, as it's better for me...or, I just write it! Besides, I think my stuffed bear is more photogenic than I am. Wrong, the number of States required is from the actual date the last State passed. They don't back-date Amendments and never have. The Bill of Rights was passed in 1789 and ratified in 1791.

2 National governments? Bidwell, 182 U.S. 244 The never ratified 14th article(notice how careful they are to say "ADDED" in the statement under the video) creates a new federal citizen, this new federal citizen has civil rights(government privileges) and NOT God given rights(no government necessary) per our founding document: "the laws of nature and of natures God entitle them" July 1776. For a precise definition on this new federal citizen, use Black's Law 6th edition under "Fourteenth Amendment" page 657. (creates or recognizes for the first time a "citizenship of the United States'', as distinct from that of the States) Exact. This is a new legal citizen that is the EXACT opposite of our founding and NEVER approved, which begins a new unlimited government. This federal aka national citizen was discussed in the constitutional convention of 1787 and turned down due to the central government having supremacy over these citizens. This is exactly what we are seeing today. And the $20.5 Trillion debt shoves it right in our face. The never ratified 14th article aka a "bill of attainder" is a 100% scam. The statement that all men are equal and endowed by their Creator with certain inalienable rights, life, liberty and the pursuit of happiness, was the result of a change from the John Lock's, life, liberty and private property. It was changed because the writers knew it would be used to justify owning slaves

@sophiethegypsyqueen Part2: You can argue this, but it simply dose not make any other distinction between people except to citizenship. So if you want to define who the 14th amendment pertains to you would have to look at the legal definition of an American Citizen. I'm pretty sure it includes women and homosexuals, etc, and therefore equal under the law.

Both definitions apply, but before you had to be a Citizen of a State to be a citizen of the U.S., now it is reversed, you have to be a U.S. Citizen to be a citizen of any of the several States.

In what language is a privilege the same thing as a right? A privilege is something that can be taken away.. And why does he think he knows the intentions of the creators of the 14th amendment better than the supreme court in the Slaughterhouse case? Sounds like revisionist history to me..

The income tax for example is a tax upon a federal privelege (excise)... so if your make money directly because of the existence of uncle sam it is a privelege and therefore can be taxed. If your job does not exist because of uncle sam, you shouldn't be paying income tax. Kansas V Coppage 1915 held that we have a right to work. Rights can't be taxed, priveleges can be.

There is no one alive today that could possibly be a 'pre-14th Amendment citizen'. Everyone born within any of the States or U.S. territories (excepting diplomats and such) are "We the People" and U.S. Citizens. The U.S. is not limited to Washington D.C..

The flagrant violation of Article 4 of the 14th Amendment to the United States Constitution is an inexcusable affront which must be addressed without delay. The unchecked desecration of one of the fundamental legal tenets of our country must be roundly condemned and remedied to ensure the preservation of our constitutional democracy.

You are quite correct. This falls into the same category as section 2 of the 13th amendment. Their; "Neither slavery nor involuntary servitude except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction." did NOT put an end to slavery. Simply put the sheeple into debt, implement new "laws" and trick words that use coercive language to work around the "involuntary" issue and throw in the "punishment for crime" exception and POOF, slavery is back in business. All brand new and improved and "legal" !!

The problem was not with the Constitution. It was with the Supreme Court, and it still is the problem. There is nothing in the Constitution that would suggest that it only applied to the Federal Government.
