The situation, as described, really sucks. There is one other alternative, expensive as it may be. You have , as I recall, 3 dealer plates. Put one on the Kia and give it to Nick, since he is probably pretty close to driving age. Just set the condition that he earns enough to keep it fueled up and cover any parts to service it. That way, while you are still out the money already spent, the car will at least be usable within your family unit rather than earning a profit for someone else.

In Calif, using a dealer plate for personal use "other" than the actual dealer is a huge fine and/or loss of dealers license. A salesperson can only use the plate on dealer vehicles for dealer related activities like a test drive, repair or smog. I'm going with he probably wouldn't jeopardize his license. Also, in Calif, there is a form to replace the original title. In my experience, best to bring that into a registration services to verify paperwork needed.

@@MPDano 100% correct, pretty sure some states do offer a "personal dealer plate", but thats a extra fee. if you don't have one, as you said if anyone got into a crash on a dealer plate while driving wherever, say goodbye to your license or pay tons of fee's.

This is why most dealer associations preach, don’t touch the car till you have title in hand…. This happens all of the time, but to be fair their is not a quick answer to these kind of things. In most cases the title is still in the original owners name, reassigned by a dealer to the auction and the auction to you. So the selling dealer now has to go back the the original owner to get paperwork signed, and the original owner has no insensitive to do so…. Happens every day.

Try to get a bill of sale from copart. Take it to your local department of motor and they might be able to get you a replacement title for the vehicle for a small fee. Or they might be able to point you to aware of getting a replacement in another way. Good luck

@@StalloneSiciliano Actually was IAA, both are Salvage auctions and they sometimes have clean title cars as well as Copart. I've had bad experiences with both, Copart being the absolute worse of the two. Either way, the invoice is also downloadable as a pdf on either websites.

The law specifically states it must be a licensed mechanic shop in order to do a lien sale. Without that any yokel in his garage can do a lien sale and get a title on any vehicle with no oversight.

According to the OK DMV, a lost title can be replaced for $11 upon filing form 701-7 and will be mailed to the original owner of record. That is likely what the auction company is doing with the original owner. The process may take a while, Randy, but you should keep on them and wait to get it as it will be worth it for you. Don't lose money. Also, (my opinion) you need to put in place some policy changes in the way you do business for your benefit: do not take possession of a vehicle without line of sight to getting a title. Do not put money into a car without actually having the title in hand.

You can still sell the car but you have to find a state that will accept a "bill of sale" document to register. Nevada is a state that will register cars with just a bill of sale and then the new owner sends paperwork in to get a title for it. I used to live in Nevada and registered motorcycles and cars with just a bill of sale and then I would send in paperwork for a Nevada title in my name. You should be able to get top dollar for the car if advertised in Vegas.

What you mean was in Nevada the registration department is separate from the title department. You cannot just go in with a bill of sale. You still have to show previous ownership to get plates unless you have a special document from a tow yard lien sale or something like that.

The DMV on east Sahara and registered the vehicle with a bill of sale only. I then sent in paperwork to get a title thru a separate entity. Randy, I have messaged you before with my lessons I have learned when I was into car sales, collector and used. I dealt with auctions from the seventies to about 10 years ago. When you buy cars from the auctions do not put any money into them until you get the title. I had more problems than you can ever think about. Take the lesson the hard way, either wait for a title or lose money getting in a hurry. It is a lesson learned. Some times it is to your advantage. When I bought cars at a auction I do not think they cashed my money until they sent the title. That means that I had time for buyers to see the car before I even paid for it, sometimes I had a car sold before I really owned it. So just remember You do not really own the car until you get the title, and just park it and do not sell it until the title shows up. They may have watched you video and decided to get it back and resell it and make more money. I would wait until hell freezes over.

On another note about bumpers getting tore up from you know who. I too bought a Mercedes E430 Sport and the pics of the front bumper was perfect. The loader brought it out and the front bumper was broke in half!! Not usable at all. $1k bumper they destroyed. Went inside and showed the auction pics and they told me OH WELL Sold as is...just like you said Randy, the pics are for representation only. They told me to kick rocks!!

Just to add my experience with Copart which I no longer do business with and aside the ridiculous raise in their fees. I had bought a Boat from them for cash, they give you the Title right away. Well, 6 months after and was ready to register it. Registration went fine and paid the fees. Well, then I was ready to move on and sell it, the HIN didn't match the HIN on the Title. Yup, those incompetant Copart desk clerks gave me the wrong title. Told Copart and they did find the right title, but Copart wouldn't reimburse me for registering a wrong vessel. My suggestion is to try and contact above the Branch Manager, I think I was able to get a district managers email when I was cc'ing everyone at Copart. The Branch Managers are also a joke and ANY auction locations. I never get satisfaction until their boss is contacted. I have more horror stories about Copart, but will refrain. Don't arbitrate that Kia, you'll lose all the money you put into it. I put my suggestion in another post.

Same thing recently happened to me with IAA Long Island NY. First they were very nasty when I called to ask for a storage fee waiver for 2 days because my wire transfer got delayed. The manager straight up said “not my problem”. Then when I went to pickup my car they didn’t even have a title and were like “ looks like someone made an error and they are requesting a duplicate …things happen” I usually would be understanding but the annoying thing was they weren’t compassionate when I was asking for assistance but now expect me to be okay with their error. I’ve since been getting a run around about the title 😡

@@TracyCorbett he has the receipt where he bought the car from the auction, and when you authorize an auction company (where I am) to sell a lot for you, you actually do sign possession of the item over to them. He can in fact put a lien on it. I actually got a title for a vehicle from a auction company receipt years ago, it's complicated but can be done.

I would think that either the auction or you, assuming you have a bill of sale, would be able to apply for a lost title. Any costs involved should be on the auction because they lost the title.

Ranndy, First off im sorry this situation has happended to you it suks I know. years ago I used to work for a small dealer in WI and I was the title clerk for him we ran into a similar situation on a vehicle he purchased from the auction. We could not get a title somehow I have no idea how the auction lost/misplaced/? the title so we ended up sitting on the vehicle for about 30days. we ended up bringing the car back to the auction and he got his money back. He was on a floor plan so really he got a "CREDIT". This was after we waited and waited and both he and I made daily calls to the auction and almost daily visits me being the title clerk I was a bit more tenacious. It was a terrible thing the dealership lost income potential and we ended up at a lost after minor maintenance, repairs, and a detail. Its your choice sir but after what yoou have said in your video I would just get my investment back and return the car its frustrating waiting a good while for something and the emails and phone calls and being ignored. And the TOS as far as damage goes is another area I had to deal with also. Good Luck.

Probably they have to get an duplicate title, which can be complicated if the previous owner did not clear the title of the lien holder and the lender went out of business or was bought out. I went through that problem when i traded a car for a ps2. I was given a bill of sale with a duplicate title form.

That is like what happened to me I bought a Ford car from a dealership in Phoenix Arizona and thay could not get me a title for the car and after 4 months the dealership gave me all the money that I spent on it and what I paid for it I had to do a windshield a alternator belts and tires I paid 900 for the car and 1500 in repairs got it all back

At this point the best take-away from this nightmare is prior to bidding on a future vehicle from said auction house would be to see what the current status of the title is for that particular vehicle. If the auction house cannot give a potential bidder/buyer the physical location and legal status (who legally possesses said title) then just move on to another car or truck. Obviously it's not worth the aggravation and frustration.

But for the next vehicle you purchase I personally wouldn’t drop a dime into repairs until title is in hand! My mom who is 67 paid $15k cash for a car from a dealership. They cashed her check and she is still waiting on a title.

Lost titles happen all the time. As a lender I see it too often. In Michigan the Secretary of State can look up the owner on record with the VIN#. The listed owner can request a copy of the title due to lost title.

Hey Randy I noticed on the Cadillac you haven't replaced the windshield wipers yet I think? There's a trick what you do is you get the size of windshield wiper 1 inch longer you have to get the metal windshield wiper blade replacement even though they're black that's okay and you take out the windshield wiper blade and you could use them on those metal windshield wipers you just have to squeeze the little clips tighter and at the end there's little holes on the end of the new windshield wipers where you can stick them into you'll see stick them into the plastic of the the little metal tabs on the windshield wiper arms or whatever they call him and you can replace him but you have to get 1 inch longer wipers than what it calls for so if they're you know 18 get 19 / whatever size they are. Then you could keep the nice silver windshield wiper arms on there not them black ones that look they always look wrong one on old classic cars you know everything's pretty stock and then they have silver arms and then black wipers it just looks dorky. And I wish you some luck on the Kia that's too bad after you did all that work to it sorry to see that that's going to happen I hope they find it there's no way to get a replacement a duplicate title or anyting from the previous owner?

If you know someone that does towing that you trust you can have the car "impounded" and they can file for a new title because it would be considered an abandoned car after 60 days. Then you will get a title in the tow yards name. So it might cost you some money and time but its possible you can get a title again.

I been through a similar thing they sold me a stolen car. I called and called even went up there they told me they see this from time to time. The title that they had given me was not even the latest title. I had the suv for 3 months before the cops said that they would take it off the stolen list. Then I had to file for abandonment title in my state to get a title. The people at IAAI had a attitude they I was calling every two days to get a update and the suv that I overpaid for.

Bonded title? It's how tow companies and other entities get titles for vehicles they legally possess and want to resale instead of part out (since you can't legally scrap the frame of a car you don't have a title for). I'd try to get the auction company to pay for it. I heard before as well, if there's an arbitration clause, forget trying to fight and just wait. Arbitration is 9 times out if 10 going to favor the big company unless you can prove they maliciously acted. At best, they'll rule that the auction company refunds you when you return the car. All else is lost. I also guarantee they'll do as little work as possible since it's not really their problem, and possibly in the back of their mind, they could potentially get higher fees if they bring the car back and have whoever listed it resell it for 2-3x what you paid (assuming they take a percentage and not a flat fee). In any case, I'd wait, but look over those terms of service... They may have a 45-90 day warranty to return the car if there are issues they caused. After that, it'll be your problem.

About the only idea I have is to perhaps export the car where titles don't matter so much, but I can't imagine there's much demand for that on a Kia. I hope you find a solution.

I would just keep the car and drive with your dealer tag on it and use it as a business vehicle. Drive it back and forth from your house to AAR headquarters and save gas and mileage on your newer vehicles . You might even be able to use it as a tax right off

for me in Alaska it within 30 days, you not the only one with this going on. 3 weeks, & iaa told me well big deal. but you right randy at the end of the day. they getting a pay check, & the person who gives them that money for there pay check is nothing much for them. for me i would wash my hands, & move on what i might do for my.

well you can take your receipts of what you paid to the courthouse or local municipality and whatever paperwork you have and apply for a title and based on that they will give you a copy of the title that every car has on file for registration purposes or what have you…..so just apply for one on your own….p.s. You’ve got a lot of youtubers that you know surely they have ran into this issue before, i’d be curious to know how they handled it 👍🏿

Uncle Tony's Garage has a video on how to get a title for any car. You should watch it, it is a legal way to get a title for the KIA.

Run the VIN with the local PD and once they confirm the car is not stolen take the paperwork and register it in Vermont. You can then apply for a title. It’s legal and Vermont advertises this My family does this all the time and it works. If you don’t want to do that, You then need to get to a C-Suite executive at coparts.If you get the COO or CEO name their email will be the same format so let’s say the COO is Rick Jones. Look at how the addresses are formatted. Then use the same format and email them and tell him what a great customer and can’t believe your being treated like this. The COO or CEO have special team for situations like this. That gets attention most times. You just need to do a little research. Be sure to stay civil and just tell them who you are On KZbin and you’d like to give them a great video for addressing this so quickly. That tells them you’re going to trash them if not. Obviously don’t say that but you really did by telling them you want to give them a positive review

I know in Georgia all they would have to do is have the seller file for a list title and normally that only takes a week or two. I would wait just because of the potential profit.

we here in nz, dont have paper titles, we do change of ownership online for $10

I would contact the Division of Motor Vehicles and ask for a new title. There might be a fee. OR have Copart contact the original owner to file for one. That might be another fee. Here in Tennessee one can file for a new title.

I dealt with the same situation a couple times I would definitely try to hold out if you can it's easy just to give it back but that doesn't make up for the profit loss especially if it was going to be a good one just my opinion I would definitely try to hold out they're probably trying to contact a customer to get you a dup title I would definitely try to hold out if you can

Keep it and run it on dealer tags. Surely there is a way the auction house can get a copy of the title from the DMV.

Okay Randy, well that sucks!! My advice is to return the car to the lot. Then give them a document of the costs you incurred purchasing the car, the replacement parts, and the labor/time you spent. I would call them and tell them they have exactly five business days to mail you overnight the title to the Kia Forte. It's already been 15 business days. If you don't receive the title by May 19th then they will have to cut you a check for the purchase of the car, the parts, and labor you put into it. If they refuse, hire a lawyer ASAP. They are taking way too long.

i feel your pain but if you have a bill of sale or a document of purchasing the vehicle you go to DMV and request a new title

They can contact the owner and the owner can go to the dmv and get a title or they the auction should be able to go to the dmv with their paperwork for the car

Take the person who consigned it to Small Claims court? They have the power to make the person give you a title, or a duplicate title. There was an issue with a red Focus or Fiesta that you sold where you would potentially have to give the money back. Can't recall the circumstances....
