I live in Florida. We have a law against slap suits, so if she tries to sue the content creator over a video that follows all copyright guidelines and doesn't qualify for harassment per the platform rules she'd be filing a slap suit. Which means she'd be launching a suit that she could get successfully countersued for for a large sum of money. Also, I work in law.

Countersued for a large sum of money? When has there been a case where it was more than "fees and costs" (i.e. what the statue specifies)? Winning an anti-slapp suit does not imply any rights for compensatory damages beyond court/attorney cost/fee, and I don't see anything about punitive damages unless the offender is the government.

An affidavit is just a sworn statement. It’s often used as legal evidence, but it doesn’t have to be attached to a lawsuit or court proceeding at all. If there WERE a lawsuit in the works, I’d expect a cease and desist, not an affidavit, so I highly doubt this lady has even consulted a lawyer about the situation.

I don't know where Emily lives, but Earica lives in Florida (I believe). Florida is an anti-slapp state. So, if Earica tries to file in Florida, it will be thrown out.

A court must dismiss the lawsuit if it finds the claims subject to the anti-SLAPP statute and that either: The responding party fails to establish a prima facie case as to each essential element of the cause of action; or The moving party establishes either that (1) the responding party failed to state a cause of action upon which relief can be granted, or (2) there is no genuine issue as to any material fact and the moving party is entitled to judgment as a matter of law on the cause of action or part of the cause of action. While a motion to strike is pending, all other proceedings, including discovery, are stayed. If the court grants the motion, the moving party is entitled to its attorneys' fees and costs-so long as the moving party provided the responding party 14 days' notice before filing the motion. If a court denies the motion, the responding party may recover fees and costs if the court finds the motion was "not substantially justified or filed solely with intent to delay the proceeding." In the event of a denial, the moving party also has an automatic right of appeal.

There is no privacy in public. That includes online places that are either public or open for the public to see. Same thing goes when you are outside. If you’re in public there is no privacy always assume somebody has a camera on you because in reality it’s probably about 100 or more on you at any given time.

I’m a bit confused by the percent earned. If they buy a piece, then sell it, does that mean they are on the honor system to report to the company what was sold, pay the difference to the company, and then get the commission? What if a consultant just has people pay in cash and never reports it to Paparazzi?

Pretty sure it doesn’t matter if they sell it. They are buying it for I think half price from the company and then IF they sell it, they make the commission. If they don’t, they don’t. Paparazzi doesn’t care whether they sell it because they already got their money out of it when they sold it to the consultant. That’s the selling part. Then there is the recruiting part where the consultants make money when people in their Downline buy stuff at the “discounted” price. In short, the so called business owners that buy the discounted jewelry are the customers of paparazzi. I do not know the details but I think this is usually how these MLMs work.

These people could go buy costume jewelry from a department store on sale and resell it and make more money. I have a high school friend who was higher up in Paparazzi and was getting out …she sent me one of the men’s style watches and a few other pieces that she was getting rid of …no way would 8 pay go it ….the watch hasn’t worked since the second week I owned it . I replaced the battery and it worked for a week.
