You get to do alot of things others don’t under the guise of a “charity” that sells to people like us where they get to receive sales tax again on used items that has already been taxed. I’m sure if they pay any it’s not a lot of taxes but money is going into the government’s (probably local government officials) so that they can do whatever they want include lying that most of the money goes to charity which I know for a fact it doesn’t.

@@sethsmith4905 Goodwill as much as I dislike the hierarchy is a 501C3 Not For Profit who trains folks for the workforce, that is what they do. They are not in the business of supplying resellers products, that is not their charter. Goodwill like say like the Alzheimer's Association has regional subsidiaries, so Goodwill has many CEO's and the top twelve CEO's salaries range from $500,000-$900,000 thereabouts and they deal with much more than just the stores. That's not necessarily outrageous but they've lot of middle management. We've teachers were I live who have $250,000 salaries, outstanding benefits and work less than nine months a year with cost of living for the average family is $45,000. We can ask why does Goodwill not get slammed for selling items that are counterfeits. They are no more trained than you or I in spotting them and items are donated, they are not buying counterfeit product with intent of resale for profit. By being a 501C3 Goodwill's charter is not about profit in sense of term as resellers think, its about generating revenue assets to service the corporations charter, that's why its called a "Not For Profit." Doesn't mean they dont make money, it means they service the charter. They can make 10 million this year, 20 million the next but its not PROFIT, its operational revenues servicing the charter.

This is extremely important for all resellers and thank you Kevin for bringing it up. This Bill is funded heavily by manufacturers, retail advocacy groups and authorized dealer groups. The intent of the bill is to kill the secondhand online market. eBay is fighting this Bill tooth and nail.

Funded? Who's getting paid? Understand where this all began and it was in 2017 under Trump and Senate towards regulating the Internet. Internet regulatory measures were to be his signature work, covid popped that. He'd his wife and her entourage travelling the land speaking to groups of people about social media safety, identity theft safety, online commerce safety whilst he used Twitter masterfully to divide and prove the need for regulatory measure. This is a fact. He was elected as a businessman as so many Americans voted based on, "Run America like a business." Clean the swamp, all that stuff, banter. He doesn't speak in the board room I can assure you with other business leaders in their chairs. Business lives within bounds of regulatory control laws. This is why all this stuff, social media talk, commerce talk, consumer fraud talk all bi-partisan so citizens cant point fingers at either party but it took on new meaning with a businessman as the most powerful man on the planet in the most powerful economy on the planet. Everything has cause reaction my friend you'll find many of the names dealing with Shop Safe are also on other committee's about Internet regulatory measures. Mr. Coons sat lambasting social media CEO's just week back... Nobody seem take notice no sign of Elon Musk being there. Why? Starlink and Space X that's why not to mention if Mr. Musk go off on Twitter. But all these other CEO's, his competitors. There is far more under the hood of Shop Safe than counterfeits and frankly I'm ever so surprised none of the more intelligent resellers see it as its just glaring and has been. I sent Kevin an email on it and its the "Worms" under the lawn.

You bring up a lot of good points on this. It makes no sense to punish people in the US for selling products that the government is allowing to be shipped into our country. They know where these items are coming from. I would never knowingly sell a fake item. Definitely a law we need to be writing our representatives and senators about. Counterfeit products come from a variety of areas around the globe, China, Russia, former Russian Nation States, Mexico, some areas of S. America, some areas of Africa, Asian sphere even Germany and Poland. It's global issue not one simply of China even though Chinese knock offs are more than the rest. How is Customs to check every single item in every single sea based incoming shipping container to make sure the manifest, chain of custody is correct and not having counterfeits? Are they to know how to spot every possible counterfeit shoe, handbag, toy, perfume, cologne, watch, thermal cup, its an enormous list. Import prices would go up to the point the five dollar T-Shirt at Walmart or Screwdriver cost more than US Made by quite some measure. Now that might sound grand to some Americans. "Yes! Buy American!" until they actually have to do so and pay $25 for a $5 T-Shirt or $60 for a five piece set of Fruit of Loom underwear. There are Americans who purposefully sell counterfeit items, LOTS of money in it. Most get caught or they travel, make the big money, disappear only to rear up a year or two later and do it all over again. The alternative is tariff against said nations products until they deal with counterfeits. That action comes full circle hurt them and hurt you quite directly when you buy anything and can lead to escalation, war. All kinds of war, price wars, tariff upon US products whereby now folks loosing jobs here, economics here, physical war even.

I was thinking while watching today and the reselling community is huge into recycling and reusable items and that's how to fight the big guys. We as resellers can sell the idea that we reduce landfill waste. I wonder what the data is for this?

There are resellers and then there is simply grandma who bought Barbie's Car for little Jane only to find little Jane doesn't want it and grandma tossed receipt. Now she can't sell it at Facebook? This legislation is vague and ill thought out on purpose IMHO just to get something in place amending trademark law. Trademark is euchre trump card per se that now they can amend and craft catering to manufacturer and retailer protections.

I heard around Christmas time Walmart was selling PS4 controllers that were counterfeit. They had purchased them at an lower price and were selling them at a lower price…. Apparently they looked correct until you used them and they were delayed, button were off and available in strange Colour’s. I’m in Canada not sure if this happened in the 🇺🇸.

The dangers of these legislation also changes are real but counter response might be better not just to approach it as counterfeit concerns, which companies can have real concern but instead pay attention that it is minimizing 2nd hand used online markets only. If they keep raising the bar of entry for online sellers, by redefining what a 'credible' online seller is, pretty soon everyone must meet the standard of being a Walmart or target to sell online. If we really want to shift the focus it should be argued we need to protect the ability of used goods to be sold. The textile, fast fashion industry has a 70% waste stream, meaning for every 3 Lululemon leggings bought 7 are entering the waste stream. Buying used goods, slows the waste stream. It doesn't create rampant over production. For the good of the environment and for the good of people's pocket book we need to have second use streams as they do not create additional waste. Because of that, laws need to be made not to protect this business model but to actually promote it. Oh and Temu purchasing and to a mirrored effect what Amazon has become, that business model is the most wasteful.

Working for a shipping company and customs agents directly. This came straight from a customs agent in regard to a large shipment of clearly counterfeit Nikes. “ Nike told them they would rather put the money into advertising the real item vs trying to sue every counterfeit shippers and this was back in 2003-2004.” Unlike companies like Tiffany, LV,MCM and Gucci who gladly do what they need to do to protect their business hence the reason for the cost of said items.

In terms of quality, I don't see the difference between the real and fake Nikes. They're built pretty much the same way. They just come with a much softer price tag. I would rather buy the fakes than the real ones. The price tags for the reals just don't make sense, at least to me. After all, I just want nice shoes to wear, not to flex or to flip.

Gamestop which sells online and brick and mortar has been selling some counterfeit video games. Some of their employees can't identify which games are counterfeit when accepting game trade-ins. Also, some stores Home Depot and other brick and mortar stores have been accepting store returns which scammers switching out knock-off products. Before walking out of the stores it is good practice to open the box before walking out of the store. I recently bought and had delivered groceries which included eyedrops. I noticed immediately the seal on the box was taped, the box had expired on 2023 date, and when I opened it, the safety seal on the cap was missing. I was able to get a full refund.

Gamestop is an interesting case many ways. They've big problems even staying in business due to online resale of video games, consoles and network download games. Yet they are an authorized reseller online and offline. So say the Game Publishers association goes after trademark with third party sellers, now the customer cant sell their games online yet Gamestop can but the consumer can trade in or get cash for the games they bought at Gamestop from Gamestop. Thats CRAZY.

A kids toy company came after me for selling a used item. Said I was bootlegging their toys. Sought council and the company agreed that I was caught in a wide net of counterfeiters. However, I had to settle out of court for $1000 to be done with it even though I was in the right. Could not afford to fight it. I was out a total of $2800 after the settlement and attorney’s fees. The item BTW sold for $7.99. This seems to be a common practice these days. It was a money grab and they won. These companies sue 1000 businesses and settle for $1000 each. Be careful out there.

There are two things at eBay ought to do: one, a due process for sellers if there is a suspected violation of policy, and two, a method to really educate sellers to help them avoid any future occurrence that could lead to big trouble. For example, if counterfeit sneakers and purses are a big thing, then eBay could create modules to show sellers how to differentiate authentic from fakes.

I’m glad your sales have picked up. Mine have been pretty good since Thanksgiving. I try to add new items almost daily and when those are priced right they seem to sell fast. I’ve also, surprisingly, selling a nice amount of items that were posted some time ago. I really think it’s all about listing items with demand at the right price more so than some algorithm that hides listings.

I got a policy violation on cheap figurines I got from a family that collected from superstores like target. Violation seemed to point towards me selling counterfeit: I deleted the item pics from my phone after the sale, the figures were in the mail en route the new owner, and eBay hit me with a policy violation on counterfeit sold figures so I can no longer prove they were real as eBay has the photos but the sale listing was removed from me being able to see it. The Purchaser did not report them. They didn’t even have them yet. I got big red violation banner and slower sales. Buyer got refunded from me automatically then the sold figures in the mail, I chose to not stress until I just got a second completely unrelated violation. Now how do I go back and fight something sold that I cannot prove without the photos eBay took down of the sale?

When Amazon pulls stock that is counterfeit, WHY are they not required to destroy it, rather than add it into the the Returns stock that gets sold on wholesale, that ends up in the bins stores, only for us to buy it and try to resell it? Kevin, you would be a good spokesman for the reseller community. You are well-informed and a good communicator. We need to reach out to our representatives and senators and make our voice heard against government squelching free enterprise in this tight economy they created.

I received a nasty email from Columbia telling me resellers aren't allowed to resell their goods. I pushed back and they responded with a lawsuit threat. Never will I ever purchase Columbia for myself again,what a joke of a company that is threatened by resellers. They are not on the VERO list. There are tens of thousands sold so I'm not sure why I was targeted.

I applaud Ebay on fighting this, but I still have my issues with them. Like how they still expected me to accept an return on a camera that was clearly marked in the title AS-iS for Parts / Untested in the title, description and also in the item condition category.... it was sold camera only untested, for parts, as-is....no functionality tested and the person complained about a few dead pixels...despite all the caps etc they still said for me to accept return....

Be careful on the Thomas the Tank items were recalled back in 2007 due to some red and yellow trains had lead paint being used.

And importers get around this by not putting a company name on the item. I purchased 40 radio rechargeable batteries in the past and not one would accept a charge. I also have purchased several battery chargers and not one would charge. Found out they were drop shipped in the US and the seller from China wanted me to ship them back to China. Um NO, I purchased from the US. eBay gave me my money back.

I've purchased knock-off items, one time back in 1989. Had a co-worker from the Phillipines and she had a connection (family) still there who would send her counterfeit LV. They were still pretty pricey but nowhere near retail and you would never have known they weren't real by just looking at them. That said, I never would have thought about selling them to anyone...ever. I knew they weren't real and they were for personal use. I understand brands wanting to protect themselves but when it comes to reselling legit items they should have no say in any of it. Once they've made their money through a legitimate sale that should be the end of their interest in that item. Period.

My suggestion for a way to voice our concerns would be an email campaign sent to iour Senators and Congressmen. Focusing on Tom Tillis and Chris Koontz might be better. A prepared letter people could send to their Senators and Congressman would give people a voice and volume counts. Senators don't like to be seen badly by large numbers of their constituents You got me fired up too.

Would this law be also looked at from a consumer's protection perspective, which means that, the consumer's do not get duplicate products from any e-commerce platform. In such a way counterfeit products do not roll-up in the market, thus the big brand's also do not get hit.

I will not buy or sell items known to be counterfeited. Shoes, purses, music, ect. When I was stationed in the Middle East during the Gulf War there were stores that sold counterfeit music tapes. I bought a few dozen, but I wasn't aware of the problem back then.

It seems Kevin, like you are asking for some volunteers to help in forming a group to help advocate for reseller issues on a federal and perhaps state by state level? I have some experience on a state level and understand what it takes to get a bill proposal endorsed by allies in a state legislature. I will note that it is extremely difficult to get volunteers to do even the most basic activities they promise to do as an activist in a timely (or any manner). I was a volunteer national assistant (the only one) for a grass roots national lobby group for a time. I helped activists (state and regional directors) get ready to hold a lobby day in their respective states, helped them at times a bit in formatting bill proposals (according to a standard format of the organization I belonged to), and hosted a national conference call for activists weekly. I've been to protests, rallies and even successfully chaired a small state political convention once that included a business meeting, 4 out of state guest speakers, a dinner and cocktail party. I thought I had long moved away from doing anything political. Yet as a part-time reseller who sees the threats of big government intervention (by the stroke of a pen) I might be persuaded to put my activist hat back on and try lending a hand if you're thinking of kickstarting any kind of organization. Btw, love your videos. I watch regularly.

I always thought if these companies would put as much effort into making affordable lines of their popular products instead of wasting time trying to legislate fakes, a large part of the problem would go away. If there is no market for fakes, people won’t seek them out. This is especially true of handbags. More resources to inspect imports would also do more than threatening to sue resellers.

We need the environmental lobbyists on reselling side. Why make more when we can reuse? Reselling is better for the environment then most recycling programs.

Another threat: I ordered something, bathroom rugs, on eBoo this week. The jerk seller bought it on Amazon after being paid and used Amazon Prime free shipping. Gift receipt included in the package with the order date on it - caught red-handed. 1. THIS IS NOT ALLOWED by ebay; it's right in the rules - you can only drop-ship from inventory you yourself own. 2. Some blindingly stupid buyers on eBay's message boards thought this was OK. What do they think is going to happen to their Amazon Prime membership fees if jerks keep abusing it. Seriously. It's like shoplifting. The kicker is there's no way to report it to Amazon, I tried, and the only way on eBay is to file a return with pictures. SNAD, since Amazon scammers don't take returns. It's a less direct threat, but one guess what's going to happen when Amazon really gets sick of it.

They don't care if it's a fake or not- They want you to buy the expensive new stuff rather then getting it used n cheap- I can see a "buy back" down the road- They will give you 10% or less and you mail it in. Then they trash it. And folks will do it out of fear- Another reason i like selling old stuff (20yrs plus) that i hope they don't care about anymore? 🤔 I notice my local thrift don't sell Nikes,Addidas etc anymore? Wonder if they got a notice- idk I can see a day when alot of products won't be on online markets- It will look like a large antique mall😢 and lots of $ tree junk

I do wish that it was more obvious to the buyers that they are buying from people like us. (Faceless) I have my face on my store for that reason. Lot's of sellers don't have a personal photo.

I have been having trouble listing. When I put the amount in and go to package dimesions and go back up the amount disappears or stays red and it says The buy it now price must be greater than or equal to us which it is. and when I finish it won't go through. What is up?

Can they really sue us for selling something with their Company name on it? I've been dinged by the VeRO policy once on a legitimate item. Looks like we can be suspended 1 to 3 days, 7 to 15 days or completely kicked off if we get so many of these warnings. This is my 1st in 24 yrs of selling. I'm done. All these trademark names will eventually not let us sell legitimate products when using their name. I'll sadly be closing my store in the next few Months. Ebay and the other platforms will be a thing of the past if all the companies on the VeRO list, which is extensive, stops allowing us to put their company name in our descriptions. I was told by an Ebay rep to look at the VeRO list before I list anything....really? This is my livelihood not the game they are trying to have it be. Scared to list anything now. Sad, very sad. Firstly, we pay tax on a product when we buy it. So the state & Gov. make their money. If you as a reseller buy that item at Goodwill or a thrift store, you pay tax again. Secondly we are paying fees & tax when we resell an item. So, from my perspective as a reseller the taxes are paid 4X's over usually. The manufacturer has already made there money the first time. I do not believe it is fair to allow them to go after someone again for a small amount that a reseller may make. This has to be stopped.....People are getting fed up, what's next taxing your yard /garage sale. This is not right.

What do you bet the insurance companies are also in on it. If this continues even the most basic of resellers should get insurance against this junk. Kind of like having malpractice coverage just in case.

If these manufacturers start being able to (words I can't and don't use in public) consumers willy nilly, the only small sellers who are safe from them will be those selling vintage and antique merch whose manufacturers are out of business. For now anyway. Kind of. One hint of who to talk to - @the Auction Professor. Don's a vintage merch seller, mostly paper, who's been hit by unjustified takedowns. THe new laws don't go after him directly, but eBay already has.

I put 25 years in at a public school. So you know as well as I do that all you have to say is it's "unsafe." ie: The batting cage net has a hole in it. Therefore, it's not safe. I need a new one. Bingo! The school springs for a new one. Could it have been patched? Sure, it could, but "Safety" is the magic word. Of course SAFETY should be everyones concern. Sadly, the word is being over used and taken advantage of. Us little guys are the ones who are being hurt by this. And oh, BTW, CAUTION, THE COFFEE IS HOT.😵💫
