When the last Chinese dynasty fell, the final imperial edict (what we call treaty) stated that all areas of the dynasty including Xinjiang and Tibet was to be under the rule of the incoming Chinese government. So those areas are legally part of China. They were just illegally operating as another country this whole time before being "reoccupied"
